Although Belgian diplomats analysed the nazi-regime from the very first moment as intrinsically crimina!, inhuman, dictatorial and revenge seeking, they showed the nazis in 1934-1935 that dialogue was possible. The nazi-diplomacy, with secrecy as a keystone, permitted some of the most important Belgian politicians and businessmen to meet the.nazi-leaders without being disapproved by public opinion or even parliament. This resulted in a «practical» way to improve political and above all economical relations between Belgium and nazi-Germany. It can be seen as (...) a Belgian answer to the inability of France and Great Britain to force the Third Reich to respect the international security treaties which were to guarantee the sovereignty of Belgium. The axiomatic bases of Special Relativity Theory (SRT) are thoroughly re-examined from an operational point of view, with particular emphasis on the status of Einstein synchronization in the light of the possibility of arbitrary synchronization procedures in inertial reference frames. Once correctly and explicitly phrased, the principles of SRT allow for a wide range of “theories” that differ from the standard SRT only for the difference in the chosen synchronization procedures, but are wholly equivalent to SRT in predicting empirical facts. (...) This results in the introduction, in the full background of SRT, of a suitable synchronization gauge. A complete hierarchy of synchronization gauges is introduced and elucidated, ranging from the useful Selleri synchronization gauge (which should lead, according to Selleri, to a multiplicity of theories alternative to SRT) to the more general Mansouri–Sexl synchronization gauge and, finally, to the even more general Anderson–Vetharaniam–Stedman’s synchronization gauge. It is showed that all these gauges do not challenge the SRT, as claimed by Selleri, but simply lead to a number of formalisms which leave the geometrical structure of Minkowski spacetime unchanged. Several aspects of fundamental and applied interest related to the conventional aspect of the synchronization choice are discussed, encompassing the issue of the one-way velocity of light in inertial and rotating reference frames, the global positioning system (GPS)’s working, and the recasting of Maxwell equations in generic synchronizations. Finally, it is showed how the gauge freedom introduced in SRT can be exploited in order to give a clear explanation of the Sagnac effect for counter-propagating matter beams. (shrink)

This article proposes an innovative methodology for enhancing the technical validation, legal alignment and interdisciplinarity of attempts to encode legislation. In the context of an experiment that examines how different legally trained participants convert select provisions of the Australian Copyright Act 1968 (Cth) into machine-executable code, we find that a combination of manual and automated methods for coding validation, which focus on formal adherence to programming languages and conventions, can significantly increase the similarity of encoded rules between coders. Participants nonetheless (...) encountered various interpretive difficulties, including syntactic ambiguity, and intra- and intertextuality, which necessitated legal evaluation, as distinct from and in addition to coding validation. Many of these difficulties can be resolved through what we call a process of ‘legal alignment’ that aims to enhance the congruence between encoded provisions and the true meaning of a statute as determined by the courts. However, some difficulties cannot be overcome in advance, such as factual indeterminacy. Given the inherently interdisciplinary nature of encoding legislation, we argue that it is desirable for ‘rules as code’ (‘RaC’) initiatives to have, at a minimum, legal subject matter, statutory interpretation and technical programming expertise. Overall, we contend that technical validation, legal alignment and interdisciplinary teamwork are integral to the success of attempts to encode legislation. While legal alignment processes will vary depending on jurisdictionally-specific principles and practices of statutory interpretation, the technical and interdisciplinary components of our methodology are transferable across regulatory contexts, bodies of law and Commonwealth and other jurisdictions. The papers in this collection break down roughly into two sorts. There are those which take a historical approach and attempt to explicate various aspects of the content of the OD article. The other sort might be labelled “application” papers in which Russell’s analysis in OD is seen as a tool or a model for subsequent philosophical work, in the spirit of Ramsey’s much quoted “paradigm of philosophy” remark. The volume opens with a reprint of the OD text with pagination indicated for the original Mind printing, for the text in Collected Papers 4 and for the widely referenced Logic and Knowledge Russell collection edited by R. C. Marsh. The Mind and Papers texts use the American convention of single quotation marks within double quotation marks. The Marsh edition (and the text given here) uses the inverse British convention. Readers need to be aware that paper authors here, and elsewhere, vary in which text they cite. The end of the volume has a comprehensive 21-page bibliography of the secondary literature. In between there are thirteen papers. I will be rather brief with the “application” papers, since I believe that Russell readers will tend to favour the more historically oriented papers. Some of the application papers wander quite far afield from Russell’s treatment of definite descriptions. For instance the paper by Thomas Mormann on “Description, Construction and Representation from Russell and Carnap to Stone” takes off from Russell’s assertion that his theory of descriptions was an early version of his subsequent interest in substituting “constructions” for “inferred entities” such as space-time points. The paper by Guido Imaguire, “Theory of Descriptions and Inferential Semantics”, explicitly eschews an “exegetical” approach and allies itself with a “systematical approach, in which one analyses possible new features and extensions of the proposed theory” (p. 397). The extension considered here is to “inferential semantics”, especially that of Robert Brandom. The spirit of this approach is to take the semantics of a language to be determined by the set of allowed inferences within that language. Imaguire takes as an essential lesson of Russell’s theory of descriptions that definite descriptions and proper names cannot be treated as singular terms of a language in the same manner. He goes on to argue for a criterion for distinguishing proper names from definite descriptions based on inferences allowed between sentences containing them, and he takes this distinction to argue for a modification of Brandom’s treatment of singular terms in his inferential semantics. Elena Tatievskaya’s paper on “Russell’s Theory of Descriptions and Wittgenstein on Internal Properties of Propositions” is another paper that is mainly about something other than Russell and his theory of descriptions. According to virtue epistemology, the main aim of education is the development of the cognitive character of students (Pritchard, 2014, 2016). Given the proliferation of technological tools such as ChatGPT and other LLMs for solving cognitive tasks, how should educational practices incorporate the use of such tools without undermining the cognitive character of students? Pritchard (2014, 2016) argues that it is possible to properly solve this ‘technology-education tension’ (TET) by combining the virtue epistemology framework with the theory of extended cognition (...) (EXT) (Clark and Chalmers, 1998). He argues that EXT enables us to consider tools as constitutive parts of the students’ cognitive system, thus preserving their cognitive character from technologically induced cognitive diminishment. The first aim of this paper is to show that this solution is not sufficient to solve the TET. Second, I aim to offer a complementary and more encompassing framework of tool-use to address the TET. Then, I apply it to the educational uses of ChatGPT as the most notable example of LLM, although my arguments can be extended to other generative AI systems. To do so, in Sect. 1.1, I present Pritchard’s framework of cognitive character and virtue epistemology applied in education, to which I am committed in this treatment. In Sects. 2 and 3, I respectively illustrate Pritchard’s (2014) solution to the TET, and I highlight the general limitations of his proposal. Thus, in Sect. 4.1 I characterize ChatGPT as a computational cognitive artifact using Fasoli’s (2017, 2018) taxonomy of cognitive artifacts. In Sect. 4.2, I introduce my proposal, which combines Pritchard’s account of virtue epistemology with Fasoli’s (2017, 2018) taxonomy of cognitive artifacts to address the TET. Finally, in Sect. 5.1, I present some epistemically virtuous uses of ChatGPT in educational contexts. Given the metaphysical and explanatory stalemate between Embedded and Extended cognition, different authors proposed moral arguments to overcome such a deadlock in favor of EXT. Farina and Lavazza attribute to EXT and EMB a substantive moral content, arguing in favor of the former by virtue of its progressiveness and inclusiveness. In this treatment, I criticize four of their moral arguments. In Sect. 2, I focus on the argument from legitimate interventions and on the argument from extended agency. Section 3 concerns (...) the argument from better protection and the argument from better treatment. Sections 4 and 5 are dedicated to counterarguments against each respectively. By distinguishing between EXT and the extended view, I argue that it is sufficient to use this second version for directly addressing and evaluating moral problems on normative grounds, independently of the causal or constitutive cognitive influence of the external resource on the agents’ minds. Moreover, I argue that the arguments and assumptions used by EXT theorists do not foster values of progressiveness and inclusiveness. To conclude, in Sect. 6, I show that the analysis of each argument converges on the conclusion that EXT does not have substantive moral content and implications per se, since they always depend on further assumptions. In this paper we investigate how to represent and reason about legal abrogations and annulments in Defeasible Logic. We examine some options that embed in this setting, and in similar rule-based systems, ideas from belief and base revision. In both cases, our conclusion is negative, which suggests to adopt a different logical model. This model expresses temporal aspects of legal rules, and distinguishes between two main timelines, one internal to a given temporal version of the legal system, and another relative (...) to how the legal system evolves over time. Accordingly, we propose a temporal extension of Defeasible Logic suitable to express this model and to capture abrogation and annulment. We show that the proposed framework overcomes the difficulties discussed in regard to belief and base revision, and is sufficiently flexible to represent many of the subtleties characterizing legal abrogations and annulments. This paper provides an analysis of how concepts pertinent to legal contracts can influence certain aspects of their digital implementation through smart contracts, as inspired by recent developments in distributed ledger technology. We discuss how properties of imperative and declarative languages including the underlying architectures to support contract management and lifecycle apply to various aspects of legal contracts. We then address these properties in the context of several blockchain architectures. While imperative languages are commonly used to implement smart contracts, we (...) find that declarative languages provide more natural ways to deal with certain aspects of legal contracts and their automated management. In this paper we show that the Hilbert system of agency and ability presented by Dag Elgesem is incomplete with respect to the intended semantics. We argue that completeness result may be easily regained. Finally, we shortly discuss some issues related to the philosophical intuition behind his approach. This is done by examining Elgesem's modal logic of agency and ability using semantics with different flavours.

In this paper we present a Gentzen system for reasoning with contrary-to-duty obligations. The intuition behind the system is that a contrary-to-duty is a special kind of normative exception. The logical machinery to formalise this idea is taken from substructural logics and it is based on the definition of a new non-classical connective capturing the notion of reparational obligation. Then the system is tested against well-known contrary-to-duty paradoxes.

Recent years have yielded many discussions on how to endow autonomous agents with the ability to make ethical decisions, and the need for explicit ethical reasoning and transparency is a persistent theme in this literature. We present a modular and transparent approach to equip autonomous agents with the ability to comply with ethical prescriptions, while still enacting pre-learned optimal behaviour. Our approach relies on a normative supervisor module, that integrates a theorem prover for defeasible deontic logic within the control loop (...) of a reinforcement learning agent. The supervisor operates as both an event recorder and an on-the-fly compliance checker w.r.t. an external norm base. We successfully evaluated our approach with several tests using variations of the game Pac-Man, subject to a variety of “ethical” constraints. (shrink)

This article aims to explore the debate on human enhancement from the perspective of the evolutions of responsibility paradigms, and in particular from the perspective of the so-called Responsible Research and Innovation approach. The aim is not to explore the arguments pro or contra the ethical legitimacy and/or technical feasibility of human enhancement, but rather exploring if, and how, the RRI perspective can shape the debate on human enhancement.In particular, the human enhancement debate will be read through the lenses of (...) four main responsibility paradigms that we sketch by examining both, the historical and conceptual evolution of the responsibility idea and the dynamics of its ascription. In order to provide a useful scheme for interpreting human enhancement, RRI will be characterised as a distinctive responsibility model that can subsequently be used to frame the debate on HE with a particular emphasis on its normative implications, as well as on its social and political significance. This paper provides a computational framework, based on defeasible logic, to capture some aspects of institutional agency. Our background is Kanger-Lindahl-Pörn account of organised interaction, which describes this interaction within a multi-modal logical setting. This work focuses in particular on the notions of counts-as link and on those of attempt and of personal and direct action to realise states of affairs. We show how standard defeasible logic (DL) can be extended to represent these concepts: the resulting system preserves some basic (...) properties commonly attributed to them. In addition, the framework enjoys nice computational properties, as it turns out that the extension of any theory can be computed in time linear to the size of the theory itself. (shrink)

Rodolfo Sacco developed the idea of “mute behaviours” during his studies on mute law. The notion of “mute behaviours” denotes an action that is able to mould a legal relationship without any use of language. Certainly, this concept may give rise to some doubts in relation to the attribution—to a behaviour qualified as mute—of the capability to affect dynamics involving a plurality of people. Aiming to clarify the idea of “mute behaviours” by this point of view, the authors analysed the (...) semiotic terminology used by Sacco himself to explain this notion and the issue of its silent nature. Therefore, the terms “signifying signs” and “symptoms”, deemed by Sacco—respectively—incompatible and compatible with the theory of mute behaviours were considered. The former term was traced back to the notion of conventional and arbitrary sign, the notion of the latter was reconstructed linking it to the concept of signs based on signification and suggesting a possible framework in view of the idea of “presentative meanings” developed by the philosopher Guido Morpurgo-Tagliabue. Clarified this dichotomy by a terminological analysis, the authors noticed—as affirmed by Rodolfo Sacco himself—the impossibility to ascribe the notion of gesture to the mute behaviour’s category, as some exegetes proposed. Consequently to this last remark, the authors tried to analyse the relationship between gestures and “mute behaviours”, identifying the category of “sema-pragmatic acts”, that includes gestures and may be seen as an intermediate phase between “mute behaviours” and legally relevant behaviours operated by speaking. While the legal concept of a subject of rights is eminently an abstraction, Ricoeur’s philosophical challenge seeks to rethink its identity within the philosophy of action, in correlation with the ideas of capacity, attestation, and recognition. The terminology Ricoeur employs presents some significant marks of this theoretical stance, as he speaks of a “veritable” or a “real” subject of rights as distinguished from the purely formal one. I argue that Ricoeur’s approach to the legal subject attains its highest meaning in (...) connection with the renewal of the semantics of responsibility in a prospective sense. In particular, I contend that Ricoeur’s idea of a “veritable” subject of rights deploys its full theoretical potential in relation to a prospective idea of responsibility in contrast to the “static” perspective of the ascription of rights and duties. Reciprocally, a prospective idea of responsibility deploys its full meaning in relation to a subject of rights not reduced to a legal abstraction since, as far as narrative identity is implied, this subject is and has to be an embodied one. I shall show that the thesis advocating a projection of responsibility towards the future may have some significant theoretical implications, in particular in relation to the effect of techno-scientific development in areas such as Artificial Intelligence. Most of the theories on formalising intention interpret it as a unary modal operator in Kripkean semantics, which gives it a monotonic look. We argue that policy-based intentions exhibit non-monotonic behaviour which could be captured through a non-monotonic system like defeasible logic. To this end we outline a defeasible logic of intention. The proposed technique alleviates most of the problems related to logical omniscience. The proof theory given shows how our approach helps in the maintenance of intention-consistency in agent systems (...) like BDI. (shrink)

The question of the moral acceptability of infertility treatment to HIV positive persons raises a number of interesting ethical points regarding the responsibility of the infertility specialist for the outcome of his or her actions. The analysis of the physician’s responsibility is conducted within the framework of accomplice liability. The physician is a collaborator in the parental project of the principals—that is, the intentional parents. Both causal contribution and intention are considered as elements of complicity. It is concluded that a (...) two per cent risk of vertical transmission when the woman is HIV positive is insufficient to blame the infertility specialist who helps her to conceive. Helping an infertile HIV positive infertile couple to have a child does not constitute reckless behaviour. When the couple is fertile, infertility treatment is directed at risk reduction and falls under the physician’s obligation to act in the best interests of his patients. (shrink)

The communication process between the political elites and the general public, crucial as it is in a democratie system, is suffering increasingly from an information overlaad. The best way to tackle this problem seems to be the improvement of the communication medium, i.e. ofthe political language. Ideology is the most «rational» political language available : it can carry more information about elite decision-making to a relatively modest cost.This problem-definition suggest a sequence of three critical questions. Do the decisionmakers have a (...) political ideology? If so, is it instrumental in the actual decision-making process? If so, why does this ideological factor rarely reach the general public? The article deals with the two last questions from a format point of view. It can be shown, after the necessary conceptual clarifications and contrary to current opinion, that ideology can hold its own in the private forum of political decision-making and fades away when the elites address the public in the public forum.The private forum is dominated by the need for policy output and by the necessity of coalition-formation. The adaptation of ideology to this situation depends on its degree of articulation and on the type of coalition-formation. In general the «salience» aspect of ideology is likelyto suffer less than its «position» aspect.The public forum is dominated by the needs of recruiting support and legitimizing proposals. Generally ideology is too costly a device to be used for these purposes. (shrink)

Following the distinctions proposed by Gamson and Easton the complex phenomenon of political alienation among the young was empirically subdivided in several dimensions. Within the 'input'dimension of political alienation we distinguished between the ability to process information and the ability to participate. Within the 'output'dimension we distinguished between two referents of distrust, political actors and authorities on the one hand, and the political system on the other. We succeeded in constructing reliable scales for each of these dimensions which were then (...) used as dependent variables in regression models. When turning to the explanation of the phenomenon our attention was focused first and foremost on the cultural factors. This was amply rewarded. Some of the normative aspects of culture, namely 'presenteism' and 'dionysianism', have a significant influence on various dimensions of political alienation. The impact of cognitive aspects appears to be even more significant. This means that an effective policy to counter the rise of political alienation wilt have to cope with a phenomenon solidly embedded in contemporary culture. (shrink)

The Belgian civil servants who are involved in the working groups of the European Council of Ministers on a full-time basis are a small elite corps which is hardly typical for the Belgian civil service as a whole. Most of its members belong to the Ministry of Foreign Affairs or to other ministries as these have delegates in the Permanent Representation. Their responsibilities too are rather different from those of the normal Belgian civil servant. The latter are typically engaged in (...) the implementation of the policies designed by their political masters, the farmer are largely autonomous policy makers and negotiators, though mostly in matters of minor political importance. In one regard though, these Euro-Belgians are still recognizable as typically Belgian. Their political culture is characterized, tough to a lesser degree than that of the other senior civil servants in Belgium, by a technocratism which is very distrustful of political actors and by a remarkable level of distrust of their organisational infrastructure. Such a culture should lead to a poor performance in the working groups of the Council of Ministers. But it does not. That is the paradox this contribution intends to examine. (shrink)

The Belgian senior civil servants do have a political ideology which, with respect to coherence and constraint, is not inferior to that of the members of Parliament and, therefore, far superior to that of the common man. The first characteristic of this ideology is its centrism: senior civil servants tend to shun the extremes, especially the socio-economic extremes. A second characteristic is its bias toward the center-right. But the latter may be an effect of recruitment and promotion practices under the (...) recent Belgian governing coalitions, rather than of the bureaucratic experience under all kinds of governments.That the bureaucratie experience leaves its mark on the ideological constructs of the bureaucratie elite can also be inferred from other data. They are inclined to centralism because the recent federalisation process imposes a heavy burden on their routines. They do not have a distinctive ideological profile with respect to religious and philosophical issues because these rarely appear on the agenda of most of the civil servants.The consequences of these characteristic ideological options are not to be underestimated. There is a clear affinity between a leftist ideology and a less technocratic and less alienated political attitude. At the same time leftist civil servantsare more inclined to commit themselves to active partisan politics. Their colleagues of the right tend more to up hold the traditional distance between bureaucracy and partisan politics. The optimal prescription for administrative reform would, perhaps, consist in furthering a more political, less technocratic style of administrative policy making, and in maintaining the traditional wariness of partisan politics. The level of political alienation is high among higher civil servants in Belgium, at least when we compare them to their colleagues in Germany. Explanatory factors should, then, have a noticeable impact on both the intra- and the inter-country variance. Early academie and political socialization seems to matter little except for the socialisation in ideological and general culture : Belgian higher civil servants are less egalitarian and more "materialistic" and therefore, it seems, more politically alienated. Another promising factor appears to (...) be the opportunity to participate in actual policy making : in this respect too the Belgian officials are not well served. However, the most striking factor is the degree of technocratism which breeds an attitude of disrespect for politicians. But how to explain that the Belgian higher civil servants grew up to be such technocrats? (shrink)

This contribution should be seen as an attempt to retrieve information from restcategories, such as «does not know» and «no answer». From these, and from other data as well, we constructed 10, mostly summating, indexes of political ignorance. Among them is an index of objective ignorance, that is about political events, persons and situations. The others aim at more subjective dimensions. Does the respondent feel informed about the political process : about government and party performance, partisan congeniality, modalities of voting, (...) local politics social problems, political issues?There seems to be some evidence in favor of the following hypotheses.1. The indexes tend to compensate each other: respondents who score low on one index, do not necessarily score low on the next one.2. I t is difficult to ascertain the validity of an index of objective ignorance. Moreover it does by no means express all the dimensions of political information.3. A mong indexes of subjective ignorance one should distinguish between «policy» and «political» information ; the latter seems to refer to a situation where strictly political rules of the game, a.o. those of political conflict, prevail.4. Of all indexes the «political issues» index showed the most discriminating power, as well as the most expected associations. (shrink)

The management of conflicts in society is perhaps the main function of parliamentary systems. lts success, as estimated by the extent of problem-solving and by the limitation of conflict costs, has to be explainedby the mildness of the challenge to the system and/or by the strength of its response. Among the resources available to the system too little credit is given to the factional elements in political culture, especially to the ideology of the decision-makers. The most promising feature appears to (...) be the differentiation of the ideological space in which political conflict-managers have to operate.The ideological space of the membership of parliament is «differentiated» when it is pluridimensional, when none of these ideological dimensions attains dominating salience, and when the most sensitive political issues are located on different dimensions. The data from a comparative research project show that the Italian parliament with its notoriously weak conflict-management record, fails the first and crucial test: its ideological space is strongly unidimensional. The Swiss parliamentary system with its excellent record passes all the tests. Belgium features a pluridimensional space which is impaired by the dominating salience of one of its dimensions. Other aspects of this space can only partially compensate this weakness. This might contribute to explain the mixed record of political conflict-management in our country. (shrink)

Most attempts at parliamentary reform in Belgium are prompted by the desire to support a Parliament which is being marginalized by political actors such as the government and the parties. These efforts are inspired by traditional constitutional thinking. Initially parliaments were designed as democratie bodies which should challenge the aristocratie government. Nowadays, parliament has quite another function. It has to facilitate the political information and to counteract the incompetence of citizens who are willing but unable to participate in an increasingly (...) complex political system.Reform should aim at restoring the significance ofpublic debates in parliament.In order to be informative these debates should focus on important issues of the political agenda and catch the attention of the general public. Within the constraints of our political system it should be possible to upgrade the early debates on budget allocations and the late debates on the evaluation of public policy effectiveness. The hypothesis to explain the often puzzling variability of political language in Parliament is that phenotypical elements of political speech such as emotionality, hostility, and oratorical style can be explained by structuralelements, that is by various aspects of the issues under debate.The data led us to criticize the more common cultural hypothesis, which would explain the variations of political language by linking it to the political culture of the members of parliament. As a result the evolutionof political language would be (...) a global one, appearing in all policy domains. This was by no means the case. The evolution of political language between 1950 and 1970 is on the contrary a strongly differentiated one.The structural hypothesis performs much better both for the short- and for the medium-term variations. The expression of hostility during parliamentary debates can be explained satisfactorily by the stakes of the game. The expression of emotion seems to stem both from these stakes and from the level of aggregation of the issue. Finally, various aspects of oratorical style, such as the invocation of values, the principled motivation of proposals and the deductive logic used to legitimize the position taken, all seem to be derived from the level of aggregation and, most of the time, from the ideological contents of the issue as well. As a result we get a profile of political language which is rather tightly controlled by the opportunities and the necessities of the political agenda and much less by all kinds of extraneous factors. A political science program at the licenciate level is currently offered by the Department of the Political and the Social Sciences at the Universitaire Instelling Antwerpen. It was able to do so with the cooperation of staff-members of other departments and other institutes of the University of Antwerp. The prÓgram is mainly focused on international polities and more specifically on European integration, North-South and East-West relations, as seen from the perspective of Belgian and West-European policy-makers. lts methodology is multidisciplinary and (...) encompasses politological and juridical as well as historical and economical perspectives. In the wake of the first encouraging from the student population, the Department has decided to strenghten further this Political Science branch of its program. It intends to invest more in full-time academie personnel and to add some more theoretical background courses to the present courses which emphasize mainly practical knowledge. Last but not least, it has initiated what it hopes shall be a new tradition of empirical research into the political culture and behaviour of international and supranational policy makers. (shrink)
