Die Beiträge des Bandes untersuchen die Genese der Rechtsphilosophie Kants und zeigen auf, dass deren grundlegende Thesen lange vor der „Metaphysik der Sitten“ existierten. Das erfordert die Analyse der kantischen Vorlesungen zum Naturrecht in den handschriftlichen Quellen, die die Interpretation der veröffentlichten Werke entscheidend ergänzen können: Kant hielt in Königsberg von 1767 bis 1788 Vorlesungen zum Naturrecht, von denen nur eine einzige handschriftliche Abschrift aus dem Sommersemester 1784 erhalten ist – „Naturrecht Feyerabend“. Mit der philosophischen Analyse der Vorlesungsnachschrift, die bislang (...) von Forschern unter rechts-, moral- und kulturphilosophischen Aspekten nur in Ansätzen untersucht wurde, soll durch die Bestimmung des Verhältnisses von Recht und Moral eine grundlegende theoretische Vorarbeit für einen internationalen Dialog über die normativen Grundlagen des modernen Rechtsstaates geleistet werden. Nach der Wiederentdeckung der normativen Ethik Kants sowie seines politischen Denkens in der internationalen Kantforschung und den „Humanities“ vervollständigt die Neubewertung der Rechtslehre die Renaissance der praktischen Philosophie Kants – sicherlich eines der wichtigsten Phänomene der moralischen und der Rechts-Kultur unserer Zeit. In recent decades, Kant's philosophy of law has increasingly moved into the focus of moral-philosophical discussions. In this context, the "Naturrecht Feyerabend" is of particular importance. On the one hand, it is the only surviving transcription of the lectures on natural law that Kant gave twelve times between 1767 and 1788; on the other hand, it is based on his lectures in the summer semester of 1784 and thus provides important evidence of Kant's reflections during an important phase in the (...) development of his moral philosophy. Despite this special significance, the text has received little attention in previous research. Dieter Hüning, Stefan Klingner and Gianluca Sadun Bordoni present here a volume that emphasizes this special significance. The ten contributions in the volume ask about the relationship of "Naturrecht Feyerabend" to the tradition of natural law as well as its relationship to critical moral philosophy and the late "Doctrine of Right". Contributors are: Manfred Baum, Franz Hespe, Philipp-Alexander Hirsch, Dieter Hüning, Stefan Klingner, Markus Kohl, Gabriel Rivero, Gianluca Sadun Bordoni, Michael Städtler, and Gideon Stiening. Este artículo presenta por primera vez en castellano la “Introducción” de las lecciones kantianas conocidas como Naturrecht Feyerabend, a partir de la nueva edición del manuscrito preparada por Heinrich P. Delfosse, Norbert Hinske y Gianluca Sadun Bordoni. La traducción está antecedida por un estudio crítico en el que sostenemos la tesis de que la obra en cuestión constituye una fuente jurídico-política crucial para entender la formación del pensamiento práctico de Kant. Intentamos mostrar que si bien el texto (...) puede ser leído como complemento de la Fundamentación de la metafísica de las costumbres, la preocupación central de la “Introducción” de Naturrecht Feyerabend gira en torno a tres ejes conceptuales que recaen, por entero, dentro del reino de la filosofía jurídica y política. En primer lugar, encontramos en el curso una preocupación por definir el concepto de la obligación jurídica desde la idea de coacción, distinguiéndolo así del de la obligación ética y asociándolo a la definición de derecho subjetivo como potestad o título para ejercer coacción de manera legítima. En segundo lugar, es central la tesis propiamente kantiana de que el derecho debe fundarse en la libertad externa y en la posibilidad de su compatibilidad universal, y no en la felicidad entendida como fin natural que todos los individuos deberían perseguir y como propósito del Estado. En tercer lugar, aparecen in nuce los fundamentos conceptuales por los cuales Kant delimita la obligación jurídica desde la realidad práctica del derecho político, esto es, de un Estado, y no desde una supuesta confluencia pre-jurídica de intereses privados. Daily rhythms are a ubiquitous feature of living systems. Generally, these rhythms are not just passive consequences of cyclic fluctuations in the environment, but instead originate within the organism. In mammals, including humans, the master pacemaker controlling 24‐hour rhythms is localized in the suprachiasmatic nuclei of the hypothalamus. This circadian clock is responsible for the temporal organization of a wide variety of functions, ranging from sleep and food intake, to physiological measures such as body temperature, heart rate and hormone release. The retinal circadian clock was the first extra‐SCN circadian oscillator to be discovered in mammals and several studies have now demonstrated that many of the physiological, cellular and molecular rhythms that are present within the retina are under the control of a retinal circadian clock, or more likely a network of hierarchically organized circadian clocks that are present within this tissue. Melatonin, the neuro‐hormone synthesized during the night, has recently seen an unexpected extension of its functional implications toward type 2 diabetes development, visual functions, sleep disturbances, and depression. Transgenic mouse models were instrumental for the establishment of the link between melatonin and these major human diseases. Most of the actions of melatonin are mediated by two types of G protein‐coupled receptors, named MT1 and MT2, which are expressed in many different organs and tissues. Understanding the pharmacology and function of mouse (...) MT1 and MT2 receptors, including MT1/MT2 heteromers, will be of crucial importance to evaluate the relevance of these mouse models for future therapeutic developments. The case of Merleau-Ponty’s phenomenology is based on the weaving between experience and expression of experience. From this point of view, the article examines Merleau-Ponty’s reflections on children’s drawing and on modern art. Bot try to get back the raw perception of the world - beyond the idealisations of perspective art and of geometry - and rediscover the expressive and symbolic dynamics in our body experience.

Individuals differ in their ability to feel their own and others’ internal states, with those that have more autistic and less empathic traits clustering at the clinical end of the spectrum. However, when we consider semantic competence, this group could compensate with a higher capacity to imagine the meaning of words referring to emotions. This is indeed what we found when we asked people with different levels of autistic and empathic traits to rate the degree of imageability of various kinds (...) of words. But this was not the whole story. Individuals with marked autistic traits demonstrated outstanding ability to imagine theoretical concepts, i.e., concepts that are commonly grasped linguistically through their definitions. This distinctive characteristic was so pronounced that, using tree-based predictive models, it was possible to accurately predict participants’ inclination to manifest autistic traits, as well as their adherence to autistic profiles – including whether they fell above or below the diagnostic threshold – from their imageability ratings. We speculate that this quasi-perceptual ability to imagine theoretical concepts represents a specific cognitive pattern that, while hindering social interaction, may favor problem solving in abstract, non-socially related tasks. This would allow people with marked autistic traits to make use of perceptual, possibly visuo-spatial, information for “higher” cognitive processing. (shrink)

We continue the work on the relations between independence logic and the model-theoretic analysis of independence, generalizing the results of [15] and [16] to the framework of abstract independence relations for an arbitrary AEC. We give a model-theoretic interpretation of the independence atom and characterize under which conditions we can prove a completeness result with respect to the deductive system that axiomatizes independence in team semantics and statistics.

Asomatognosia designates the experience that one’s body has faded from awareness. It is typically a somaesthetic experience but may target the visual modality. Frequently associated symptoms are the loss of ownership or agency over a limb. Here, we elaborate on the rigorous nosographic classification of asomatognosia and introduce a structured interview to capture both its core symptoms and associated signs of bodily estrangement. We additionally report the case of a pure left-sided hemiasomatognosia occurring after surgical removal of a meningioma in (...) the right atrium. Despite the wide lesions of the right angular gyrus and of the temporo-parietal junction, the patient did not present visuospatial deficits or bodily awareness disorders other than hemiasomatognosia. The patient and 10 matched controls’ motor imagery was formally assessed with a limb laterality task in which they had to decide whether hands and feet presented under different angles of rotation depicted a left or a right limb. Bayesian statistics showed that patient’s reaction times were significantly impaired exclusively for the left foot and especially for mental rotations requiring somatomotor rather than visual limb representations. This was in accordance with a more enduring left-sided hemiasomatognosia for the lower limbs confined to the somesthetic modality. Our findings shed new light on motor imagery in asomatognosia and encourage the future use of the structured interview introduced here. In addition, the limb laterality task may capture phenomenological elements of a case by chronometric means. This allows a more standardized reporting of phenomenological detail and improves communication across different clinical facilities. (shrink)

In the sixth century BC, Pherekydes of Syros, the reputed teacher of Pythagoras and contemporary of Thales and Anaximander, wrote a book about the birth of the gods and the origin of the cosmos. Considered one of the first prose works of Greek literature, Pherekydes' book survives only in fragments. On the basis of these as well as the ancient testimonies, the author attempts to reconstruct the theo-cosmological schema of Pherekydes. An introductory chapter on the life of Pherekydes is followed (...) by four chapters on the contents of his book. From Pherekydes' mythopoeic creation account, his colourful narratives of a divine marriage and a battle of the gods, and finally from his remarks on the soul, Professor Schibli is careful to unfold the philosophical implications. Pherekydes emerges as a figure who moved in that fascinating frontier between myth and philosophy. The theogonies of Hesiod and the Orphics, the cosmological speculations of certain Presocratics, and the Pythagorean tenets on the soul are all profitably compared with the remnants of Pherekydes' book. Pherekydes is thus shown to be an important witness to early Greek thought in its various manifestations. This is the first book-length study in English dedicated to Pherekydes. It includes a comprehensive appendix of the fragments and ancient testimonies, along with limited critical apparatus and English translations. (shrink)

Les stratégies de Bayle et de Hume devant la question de l’athéisme sont bien plus proches qu'on ne le croit généralement. Cet accord découle de l’influence constante que Bayle exerça sur Hume. Pour Bayle et pour Hume, l’athéisme et le scepticisme sont très étroitement liés – celui-là n’est qu’une forme du celui-ci. La force des Dialogues sur la religion naturelle de Hume ressort précisément de cette alliance entre athéisme et scepticisme qui, puisant la plupart de ses arguments chez Bayle, aboutit (...) à une critique de la théologie fondée sur une analyse sans concession des fondements épistémologiques de la croyance, tout en se gardant, comme le Straton de Bayle, de réduire l’athéisme à un dogmatisme métaphysique abstrait. The author proposes that the anonymous letter dated May 19, 1641, which Mersenne delivered to Descartes, should be attributed to Thomas Hobbes. Although the text is known, it is usually considered not so much in itself as for Descartes’s two replies, which contain important clarifications on the proof of God’s existence. Hobbes’ hand is revealed by various thematic, conceptual, and lexical analogies and, above all, by the presence of two doctrines characteristic of his thought: 1) the denial of the existence (...) of intellectual ideas; 2) the assertion that the nature of God can only be described by the proposition “God exists”. Attribution to Hobbes of the May 19 th 1641 letter throws new light on the debate that followed Descartes’s Meditations as well as on Mersenne’s role. (shrink)

Analyzing and evaluating legal case reports are labor-intensive tasks for judges and lawyers, who usually base their decisions on report abstracts, legal principles, and commonsense reasoning. Thus, summarizing legal documents is time-consuming and requires excellent human expertise. Moreover, public legal corpora of specific languages are almost unavailable. This paper proposes a transfer learning approach with extractive and abstractive techniques to cope with the lack of labeled legal summarization datasets, namely a low-resource scenario. In particular, we conducted extensive multi- and cross-language (...) experiments. The proposed work outperforms the state-of-the-art results of extractive summarization on the Australian Legal Case Reports dataset and sets a new baseline for abstractive summarization. Finally, syntactic and semantic metrics assessments have been carried out to evaluate the accuracy and the factual consistency of the machine-generated legal summaries. (shrink)

Beginning with a brief presentation of the historical data and conceptual issues that have led to the emergence of the doctrine of the notion of Transitional Justice, I will describe the orientation adopted in two paradigmatic historical contexts, the Nuremberg trial at the end of the Second World War and the post-apartheid reconciliation process in South Africa. Supported by documents from International Human Rights Law and other international legal sources (Rome Statute) I will then offer a provisional definition of what (...) I call a Critical Transitional Justice. The conclusion highlights how the relationship between retrospective and prospective responsibility today is not exclusionary: as central principles of Critical Transitional Justice, they contribute in conferring normative legitimacy to transformative processes of adapting the international system to compliance to general principles of human rights.
