Law being a derivative feature of reality, it exists in virtue of more fundamental things, upon which it depends. This raises the question of what is the relation of dependence that holds between law and its more basic determinants. The primary aim of this paper is to argue that grounding is that relation. We first make a positive case for this claim, and then we defend it from the potential objection that the relevant relation is rather rational determination (Greenberg 2004, (...) 2006). Against this challenge, we argue that the apparent objection is really no objection, for on its best understanding, rational determination turns out to actually be grounding. Finally, we clarify the framework for theories on law-determination that results from embracing our view; by way of illustration, we offer a ground-theoretic interpretation of Hartian positivism, and show how it can defuse an influential challenge to simple positivist accounts of law. A new strategy in philosophy of law appeals to explanatory gap arguments to attack legal positivism. We argue that the strategy faces a dilemma, which derives from there being two available readings of the constraint it places on legal grounding. To this end, we elaborate the most promising ways of spelling out the epistemic constraints governing law-determination, and show that each of the arguments based on them has problems. We revisit the flight-to-quality and flight-from-quality occurrences vis-à-vis the stock-bond nexus across differing investment time scales in the COVID-19 era, using a novel technique hinged on a denoised frequency-domain transfer entropy. Our findings divulge that flights, both FTQ and FFQ, could be attained during stress periods. Generally, in the intermediate term of the COVID-19 pandemic, both Islamic and conventional bonds could act as safe havens, diversifiers, and hedges for international equities, and the same could be observed for international equities. We (...) reiterate empirically that flights may improve the financial system’s stability and robustness by allowing diversity to be effective when it is most required. The findings have financial and portfolio implications for investors considering how to deploy their investments in the COVID-19 era. Our findings may impact policymakers’ responses to changes in various asset classes, allowing them to better monitor financial markets and adjust macroeconomic policies. (shrink)

This paper summarizes a theory of cognitive development and elaborates on its educational implications. The theory postulates that development occurs in cycles along multiple fronts. Cognitive competence in each cycle comprises a different profile of executive, inferential, and awareness processes, reflecting changes in developmental priorities in each cycle. Changes reflect varying needs in representing, understanding, and interacting with the world. Interaction control dominates episodic representation in infancy; attention control and perceptual awareness dominate in realistic representations in preschool; inferential control and (...) awareness dominate rule-based representation in primary school; truth and validity control and precise self-evaluation dominate in principle-based thought in adolescence. We demonstrate that the best predictors of school learning in each cycle are the cycle’s cognitive priorities. Also learning in different domains, e.g., language and mathematics, depends on an interaction between the general cognitive processes dominating in each cycle and the state of the representational systems associated with each domain. When a representational system is deficient, specific learning difficulties may emerge, e.g., dyslexia and dyscalculia. Nanomedicine applications incorporate materials and components with nanoscale dimensions where novel physiochemical properties emerge as a result of size-dependent phenomena and high surface-to-mass ratio. Nanotherapeutics and in vivo nanodiagnostics are a subset of nanomedicine products that enter the human body. These include drugs, biological products, implantable medical devices, and combination products that are designed to function in the body in ways unachievable at larger scales. (...) Nanotherapeutics andin vivonanodiagnostics incorporate materials that are engineered at the nanoscale to express novel properties that are medicinally useful. These nanomedicine applications can also contain nanomaterials that are biologically active, producing interactions that depend on biological triggers. Examples include nanoscale formulations of insoluble drugs to improve bioavailability and pharmacokinetics, drugs encapsulated in hollow nanoparticles with the ability to target and cross cellular and tissue membranes and to release their payload at a specific time or location, imaging agents that demonstrate novel optical properties to aid in locating micrometastases, and antimicrobial and drug-eluting components or coatings of implantable medical devices such as stents. This paper, unlike other work on the topic, investigates archival sources and early texts, up to and including the publication of theEssay on Some Problems Concerning the Normal and the Pathologicalin 1943, in order to reveal Canguilhem’s early thoughts on error and to formulate the basic philosophical problem therein, as he understood it. It proceeds by sketching an important part of the intellectual history informing Foucault’s genealogy of this assumption’s emergence in a disciplinary society. This history involves Georges Canguilhem, Foucault’s elective master. And in the relation between the writings of master and student, we find a different exemplification of education, namely, as a thoroughly dialogical and philosophical activity undertaken for the sake of freedom. Examining this (...) historical relation also: 1) establishes Canguilhem’s international importance as a philosopher because of his role in the 1953 UNESCO report on The Teaching of Philosophy; 2) helps clarify Foucault’s understanding of philosophical activity as problematization and his understanding of normativity; 3) helps think about education and the history of philosophy without looking for master theorists, but rather philosophical schools. In what way does the construction of three-dimensional spherical models in the early modern period reflect the search for an appropriate representation of subtle, slow changes perceived in the firmament of the fixed stars? The present paper analyses some of the preserved models and assesses the potential they held to stimulate contemporary thinking on this question, termed the “motion of the eighth sphere.” The spheres discussed here reveal different ways of conceiving and visualizing stellar precession, which was more commonly expressed (...) in tabular form, such as the Alfonsine tables, or by means of theoretical texts, such as Peurbach’s Theoricae novae planetarum. One of the spheres unexpectedly turns out to be the only known material representation of Johannes Werner’s alternative theory of trepidation. Although our knowledge of the context in which these spheres were produced is limited, their material characteristics point to their distinct origins. A focus on the rare and understudied species of “trepidation spheres” leads to questions not addressed in studies drawing only on written sources. It brings additional actors into the spotlight, in particular instrument-makers. Moreover, the variety of constructions found in the group of surviving spheres indicates that the available traditional sources allowed for variant interpretations. Besides texts and diagrams, the trepidation spheres are historical tools of thought that can literally be touched. While further investigation is needed, this paper looks at the spheres’ potential role for practitioners in exploring the geometric implications of trepidation in Alfonsine astronomy from the second half of the 15th century onwards. Autobiography is a distinctive and valuable kind of reasoning towards ethical knowledge. But how can autobiography be ethical reasoning? I distinguish four ways in which autobiography can be merely involved in reasoning: as clue to authorial intentions; as container for conventional reasoning; as historical data; and as thought experiment. I then show how autobiography can itself be reasoning by investigating its generic form. Autobiographies are particular, enabling vivid display of and education in value-suffused perception. They are diachronic, enabling critique by (...) ironic contrast. And they are compositional, enabling sense-making by placing in a temporal structure. But these features don’t distinguish autobiographies from novels. Should we therefore accept a deflationary account of a fourth generic feature of autobiographies, that they are self-reflective? I instead pursue a more ambitious account of self-reflection and the distinctively autobiographical reasoning it enables, involving a realism constraint, a reflexive explanation constraint, and unique address to first-person problems of the self. I conclude with an interpretation of an example work of autobiographical reasoning, Siegfried Sassoon’s Memoirs of George Sherston, against the idea that self-owning is necessary to the good human life. George Berkeley maintains both anti-abstractionism (that abstract ideas are impossible) and idealism (that physical objects and their qualities are mind-dependent). Some scholars (including Atherton, Bolton, and Pappas) have argued, in different ways, that Berkeley uses anti-abstractionism as a premise in a simple argument for idealism. In this paper, I argue that the relation between anti-abstractionism and idealism in Berkeley's metaphysics is more complex than these scholars acknowledge. Berkeley distinguishes between two kinds of abstraction, singling abstraction and generalizing abstraction. He (...) then rests his case for idealism, not on the denial of the possibility of generalizing abstraction, but rather on the denial of the possibility of singling abstraction. Moreover, Berkeley's argument does not rest on a blanket rejection of all forms of singling abstraction. Rather, the fundamental anti-abstractionist assumption, for his purposes, is the claim that primary qualities cannot be mentally singled out from secondary qualities. Crucially, the claim that the existence of physical objects cannot be mentally singled out from their being perceived is not a premise in, but rather a consequence of, Berkeley's argument for idealism. Berkeley's argument therefore avoids circularity inasmuch as it appeals to the impossibility of singly abstracting one idea in order to establish the impossibility of singly abstracting another. Many people believe that our thoughts can be morally wrong. For example, many regard rape and murder fantasies as morally wrong. In a provocative recent essay, George Sher disagrees with this and argues that “the realm of the purely mental is best regarded as a morality-free zone,” wherein “no thoughts or attitudes are either forbidden or required”. Ultimately, Sher argues that “each person’s subjectivity is a limitless, lawless wild west in which absolutely everything is permitted”. Sher calls this view (...) the Wild West of the Mind. I argue against Sher’s position. In section I, I summarize Sher’s view. In section II, I criticize Sher’s argument for the Wild West of the Mind. This review of the long-awaited English translation and edition of Pierre Klossowski’s Living Currency starts with a comparison of its historical context and our own in order to consider why this book remains important today. I support this comparison by examining its account of the “moral power” of industrial society to elicit the participation of the very people it exploits in their own exploitation. In short, Klossowski understands that this regime is based upon an affective arrangement that makes us, even (...) those of us who protest against it, into its ever-renewed source. Despite the apparent inescapability of this regime that is us, I suggest that Klossowski’s parodic utopia, in which the body becomes living currency, follows Georges Bataille to offer an ethics of the general economy that might, perhaps, enable us to subvert it and develop new ways of relating to ourselves and others. Careful consideration of the difficulties this translation encounters in a letter Michel Foucault sent to Klossowski, allows me to conclude by questioning how we are to interpret his book and this new edition. This paper addresses questions of friendship and political community by investigating a particular complex case, comradeship in the life of the soldier. Close attention to soldiers’ accounts of their own lives, successes and failures shows that the relationship of friendship to comradeship, and of both to the success of the soldier’s individual and communal life, is complex and tense. I focus on autobiographical accounts of basic training in order to describe, and to explore the tensions between, two positions: (1) Becoming (...) a soldier is a corrupting loss of individuality and moral sensitivity, and friendship is resistance to it. (2) Becoming a soldier is one form of flourishing, and comradeship—the soldier’s distinctive form of friendship—is one of its constitutive virtues. I draw particularly on George Orwell’s account of basic training and fighting in the Spanish Civil War, and on Tim O’Brien’s account of basic training and fighting in Vietnam. (shrink)
