Martin Heideggers Abendgespräch in einem russischen Kriegsgefangenenlager zwischen einem Jüngeren und einem Älteren ist datiert auf den 8. Mai 1945, den Tag, an dem der Nationalsozialismus besiegt wurde. Der Schlüssel zum Verständnis des Textes ist ein Zitat aus dem klassischen daoistischen Buch Zhuangzi. Warum wendet sich Heidegger an diesem Tag der chinesischen Philosophie zu? Für den Philosophen und Sinologen Fabian Heubel birgt das Abendgespräch die einzigartige Gelegenheit, Heideggers Öffnung für östliches Denken kritisch zu erörtern. Zugleich zeigt sich die Kommunikationsverweigerung zwischen (...) Heidegger und Adorno in neuem Licht, indem das Buch beide mit Hilfe daoistischen paradoxen Denkens ins Gespräch kommen lässt. Kantian deontology is one of three classic moral theories, among virtue ethics and consequentialism. Issues in medical ethics are frequently addressed within a Kantian paradigm, at least – although not exclusively – in European medical ethics. At the same time, critical voices have pointed to deficits of Kantian moral philosophy which must be examined and discussed. It is argued that taking concrete situations and complex relationships into account is of paramount importance in medical ethics. Encounters between medical or nursing staff (...) and patients are rarely symmetrical relationships between autonomous and rational agents. Kantian ethics, the criticism reads, builds on the lofty ideal of such a relationship. In addition to the charge of an individualist and rationalist focus on autonomy, Kantian ethics has been accused of excluding those not actually in possession of these properties or of its rigorism. It is said to be focussed on laws and imperatives to an extent that it cannot appreciate the complex nuances of real conflicts. As a more detailed analysis will show, these charges are inadequate in at least some regards. This will be demonstrated by drawing on the Kantian notion of autonomy, the role of maxims and judgment and the conception of duties, as well as the role of emotions. Nevertheless the objections brought forward against Kantian moral theory can help determine, with greater precision, its strengths and shortcomings as an approach to current problems in medical ethics. Wir möchten der Charter on Medical Professionalism, die wir für vorbildlich halten, eine durchdachte Anreicherung hinzufügen. Wir beginnen mit einer skeptischen Note gegen das verbreitete theoretische Vorurteil, die wichtigsten Probleme im Gesundheitssystem seien Gerechtigkeitsprobleme und diese seien theoretisch gut beherrschbar. Unter Bezug auf Norman Daniels, der John Rawls’ Theorie der politischen Gerechtigkeit auf die Bewertung und Gestaltung von Gesundheitssystemen anwendet, sowie auf die biomedizinische Ethik, die von Beauchamp und Childress vertreten wird, analysieren wir das komplexe Verhältnis zwischen moralischer Integrität von (...) Strukturen und Organisationen einerseits und natürlichen Personen, die in ihnen arbeiten, andererseits. Anschließend interpretieren wir die Charta als eine Spezifizierung der ärztlichen professionsmoralischen Verantwortung auf mehreren Ebenen, die Tugend- und Organisationsethik verklammern. (shrink)

There is a move away from a market economy in health care in the United States and a move towards such a market in Germany.1 This article tries to make explicit what underlies the moral intuition that there is a tension between a market economy and health care. First, health care is analyzed in terms of the economic theory of the market and incompatibilities are described. The moral problem is identified as the danger of liquefying the distinction between persons and (...) things . The basic moral intuition seems to be the classical social contract: as a functioning market is governed by the principle of commutative justice , free riders have to be kept away, which is achieved by coercion that is not provided by the market; coercion can be justified by a social contract. The special moral problems of a social contract for health care are discussed. It is argued that public coercion in order to collect contributions for essential health care is justified. (shrink)

This article views the Hippocratic Oath from a new perspective and draws consequences for modern health care. The Oath consists of two parts, a family-like alliance where the teacher of the “art” is equal to a father and a set of maxims how the “art” is to be practiced. Self-commitments stated before the gods tie the parts together and give the alliance trustworthiness. One might call this a proto-profession. Modern physicians form a similar alliance. Specific knowledge and skills and specific (...) action guiding rules are elements of a profession but its trustworthiness rests on a combination of professional autonomy and public control. In order to be granted autonomy the profession must show some effort in enforcing its specific rules and in order to do so its members need to be convinced of the intrinsic value of their profession. Whereas in antiquity physicians acted as single individuals the modern alliance is shaped by division of labour. Physicians use each other and other professions by mutual consent and the health care system as means in the diagnostic-therapeutic process. As any actor is reponsible for the means he uses physicians are co-responsible accordingly. Thus, professional conduct now entails care for the organisation of the alliance as detailed in the “Charter on Medical Professionalism”. The effort the profession gives to this task will confirm its trustworthiness. (shrink)

Zusammenfassung Patientinnen und Patienten steht das Recht auf Behandlung nach ihren eigenen Vorstellungen auch dann zu, wenn sie aktuell keinen eigenen Willen bilden können. Advance Care Planning (ACP), als ein spezielles Verfahren der gesundheitlichen Vorsorgeplanung, zielt darauf ab, dieses Dilemma durch eine Willensbestimmung im Voraus aufzulösen. Besonders ausgebildete Gesprächsbegleiter*innen bieten an, bei der Ermittlung, Formulierung und Dokumentation eines solchen, die individuelle gesundheitliche Situation berücksichtigenden Willens zu helfen. Das Umfeld der Betroffenen soll in den Gesprächsprozess einbezogen und es soll organisatorisch gesichert (...) werden, dass deren Willensbestimmung den aktuell Behandelnden im Bedarfsfall faktisch zugänglich ist. Das Verfahren kombiniert also ein kommunikatives mit einem institutionellen Element. Aus ethischer Sicht stellen sich dabei zwei wesentliche Herausforderungen. Erstens erfordert Gesprächsbegleitung mit einem so komplexen Ziel Kompetenzen und setzt bestimmte Haltungen voraus, wie sie für Professionen im strengen Sinne typisch sind. Daher wäre es wichtig, entsprechende professionelle Normen explizit zu machen, beispielsweise in Form eines Berufs-Kodex. Zweitens muss das Verfahren trotz seiner institutionellen Form für die Betroffenen freiwillig sein. Dies ist entscheidend für die Validität des Prozesses, aber auch für dessen Ergebnis. Denn wenn Letzteres rechtlich bindend sein soll, müssen die Betroffenen freiverantwortlich, d. h. ohne sog. Willensmängel handeln können. Es ist deshalb ethische Pflicht, beim Eintritt in und im Verlauf der Beratung auf die Freiwilligkeit zu achten. (shrink)

In order to reflect on the morality of the health care market this paper critiques some of H. T. Engelhardt's presuppositions. Engelhardt has created the vivid term ‘moral stranger’ and suggested that there can be a ‘morality of moral strangers’. However his position relies either on certain necessary presuppositions which he leaves unmentioned or on presuppositions that are—in a strict sense—not moral ones. Engelhardt advocates the market economy as the guiding principle of health care, and claims that the market needs (...) no moral presuppositions. But when the preconditions of a functioning market are examined it turns out that a functioning market requires property and ownership, and that property and ownership are moral institutions. Therefore the application of the idea of the market to health care undoubtedly has morally serious consequences: most important, the difference between commodities and human beings is obscured. Foucault’s understanding of the history and contemporary significance of ascetic practices or exercises of cultivation (ascesis) differs significantly from attempts which consider the renewal of asceticism in spiritual or even religious terms. This paper tries to show that he thought about related problems from the perspective of aesthetic cultivation. The first part will discuss his analysis of sexuality within the broader context of his theory-formation and elaborate on the theoretical structure of his concept of self-cultivation. In the second part I (...) will situate the idea of creative ascesis in a broader historical context. The principle that everybody should have access to essential health care goods is in conflict with the notion that property rights should be respected. The Kantian doctrine of rights is explored in order to solve this conflict. Kant's notion of a legislative will is explained and used to show the inherent limits of the legal terms property and ownership (it can refer only to things external to subjects and to possible objects of choice). What is internal to the subject is (...) outside of the realm of the legislative will. A law excluding those unable to pay from access to essential health care would not be just. Der Beitrag diskutiert das Verhältnis zwischen dem Organisationszweck eines Krankenhauses und dem je individuellen Handlungszweck der ärztlichen Professionellen. Es wird unterschieden zwischen Zwecken, zu deren Erreichung ein Organisator Akteure extrinsisch, d. h. durch Anknüpfen an ihre natürlichen Eigeninteressen motivieren und sie so zu Mitteln für einen Organisationszweck machen kann, und solchen, bei denen das nicht möglich ist. Die therapeutische Interaktion wird als ein Handeln zu einem moralisch hochrangigen Zweck – das gesundheitliche Wohl von einzelnen Kranken – identifiziert, in deren Kern (...) ein Interesse am fremden, nicht am eigenen Wohl steht. Daraus wird geschlossen, dass, wer ein Krankenhaus (oder das Gesundheitssystem) organisiert, auf intrinsische Motivation der therapeutisch Tätigen angewiesen ist. Diese lässt sich durch organisatorische Mittel nicht erzeugen, sondern nur vor Verfälschung schützen oder durch günstige Bedingungen bewahren. Für diese Aufgabe werden die Professionen – die Professionellen und ihre Organisationen – in Anspruch genommen. Dass das Bewusstsein von dieser Aufgabe als einer professionellen im Selbstverständnis des ärztlichen Berufs tatsächlich vorhanden ist, wird an der Charter on Medical Professionalism gezeigt. Seit der Einführung der G‑DRGs als Instrument zur Vergütung von Krankenhausleistungen steht das Gesundheitswesen als System unter Kritik. Denn die Ausrichtung der Krankenhäuser auf wirtschaftlichen Erfolg relativiert den Anspruch aller Bürgerinnen und Bürger auf gute medizinische Versorgung. Der Artikel geht der Frage nach, von welchem Akteur im System welche Aktivität erzwungen, erwartet, oder verlangt werden kann, dem entgegenzuwirken. Die genannten alltagsmoralischen Urteile werden unter Rückgriff auf Kants Moralphilosophie validiert und auf die wichtigsten Akteure angewandt. Ergebnis: Der Kern des Ökonomisierungs‑/Kommerzialisierungs-Problems besteht (...) in der Entwertung der Professionalität der patientennahen Berufe. Die Neujustierung des Systems kann vom Gesetzgeber nur dann verlangt werden, wenn die verfasste Ärzteschaft sich dazu bekennt, mit den ihr zu Gebote stehenden Mitteln gegen professionswidrige Handlungsanreize vorzugehen. I find myself in a strange position writing a commentary to an article on ethics committees because in Germany, ethics committees in the American sense do not exist. What we call Ethikkommission are present in every German faculty of medicine and would be called institutional review boards in the United States; committees that review research projects of faculty members with respect to ethical standards. So i most consult my imagination rather than my experience about what really happens in Americal ethics (...) committees. There are only two things. I perhaps can fall back on to simultaneously inspire and bridle my imagination. I have been sitting for 5 years on the IRB of our faculty and have been giving ethics seminars and case discussions to students for more than 10 years. Ethics is an optional subject in Germany and attracts the more sensitive and thoughtful students. Perhaps the intellectual process generating itself in those groups in some ways similar to that occurring in ethics committees. As for the rest, I hope to profit from the so-called unprejudiced perspective of the foreigner. I agree with a great deal of Loewy's descriptions and even with suffering as a principle, but I have some doubt whether that occurring in ethics committees. Mrs. J. is a 76-year-old woman who had been in good health. When she was brought to the hospital 10 days after being involved in an automobile accident, she was found to have severe brain injury and, despite vigorous treatment, has neverregained consciousness. The consulting neurologist feels that she has no chance to recover completely and the “best case scenario” is that she may regain some consciousness without ever being able to take care of herself or probably without ever being (...) able to interact with her environment in a meaningful fashion. She and her husband have been very close and had just celebrated their 50th wedding anniversary when the accident occurred. After long deliberation, her husband states that his wife had often said that “she would never want to live like this” and that she had always had a fear of being a burden to anyone. He wants active treatment stopped and asks that she only be kept comfortable and allowed to die. Their daughter agrees with this decision, although their son who lives in a distant state, feels that all treatment should continue and that she “certainly wouldn’t be a burden.” Among other considerations brought up by the husband is the fact that there are no financial arrangements to take care of long-term care in a nursing home. Frage ist, ob dies mit der Kantschen Ethik vereinbar ist, und ob es sich dazu eignet, moralischen Anforderungen an Krankenhäuser besser gerecht zu werden. Eine Analyse der einschlägigen Texte zeigt, dass Kants kategorischer Imperativ mit der Goldenen Regel gleichgesetzt wird, wogegen Kant sich ausdrücklich gewehrt hat. Die (...) Goldene Regel wird außerdem entstellt. Dass der kategorische Imperativ nicht nur Achtungs-, sondern auch Fürsorgepflichten normiert, wird übersehen. In the text “The Principles of a Liberal Social Order”, Friedrich A. von Hayek quotes from Chapter 57 of the Daoist classic Lǎozǐ 老子. Appearing in a text devoted primarily to the concept of “spontaneous order”, the quote opens up questions regarding the relationship between liberalism and Daoism, which I address in this essay. The discussion comprises three parts. In the first part, I turn to the translation cited by Hayek and, by way of a commentary to the translation, I (...) attempt to gain access to the motifs of “effortless action/without doing”, “self-transformation” and “self-government” ; the second part offers a hermeneutic commentary through which I discuss interpretative approaches found in the Chinese commentarial tradition; finally, the third part outlines transcultural correspondences which explore the political meaning of the Daoist “without doing” and the idea of “spontaneous order” in the context of the discursive struggle between the “democratic West” and “authoritarian China”.
