The article examines the effects of non-financial disclosure on corporate social responsibility. We conceptualise trade-offs between two ideal types in relation to CSR. Whereas self-regulation is associated with greater flexibility for businesses to develop best practices, it can also lead to complacency if firms feel no external pressure to engage with CSR. In contrast, government regulation is associated with greater stringency around minimum standards, but can also result in rigidity owing to a ‘one-size-fits-all’ approach. Given these potential trade-offs, we ask (...) how mandatory non-financial disclosure has been shaping CSR practices and examine its potential effectiveness as a regulatory instrument. Our analysis of 24 OECD countries using the Asset4 database shows that firms in countries that require non-financial disclosure adopt significantly more CSR activities. However, we also find that NFD regulation does not lead to lower levels of corporate irresponsibility. Furthermore, our analysis demonstrates that, over time, the variation in CSR activities declines as firms adopt increasingly similar practices. Our study thereby contributes to understanding the impact of government regulation on CSR at firm level. We also discuss the limits of mandatory NFD in addressing regulatory trade-offs between stringency and flexibility in the field of corporate social responsibility. (shrink)

For more than fifteen years, Melissa Ann Pinney has been making photographs of girls and women, from infancy to old age, to portray how feminine identity is constructed, taught, and communicated. Can you draw a clear line through American history from the Puritans to the "Nones" of today? On the surface, there is not much connective tissue between the former, who often serve as shorthand for a persistent religious fanaticism in the United States, and the almost one quarter of the population who now regularly check the "None" or "None of the above" box when responding to surveys of religious preference. A number of late Stoic sources describe either ethical concepts or a supposed universal belief in gods as being innate in the human animal. Though Chrysippus himself is known to have spoken of "implanted preconceptions" (ἔμφυτοι προλήψεις) of good and bad, scholars have typically argued that the notion of innate concepts of any kind would have been entirely incompatible with his theory of knowledge. Both Epictetus' notion of innate concepts of good and bad and the references to an innate belief (...) in gods by other philosophers of the Roman era are thus generally held to be later developments, probably owing to a Platonist-Stoic syncretism. Review of the evidence, however, shows that Chrysippus, like Epictetus, held ethical concepts to represent a special category of conception in that their formation was guaranteed by oikeiôsis. Unlike other concepts, that is, these represent a formal conceptualization of an innate tendency to distinguish between things fitting for one's constitution and things not fitting that all animals, according to the Stoics, bring to their empirical experiences. While the notion that human belief in gods is similarly innate does seem to have been a later development, it too was explained with reference to oikeiôsis rather than resulting from a simple "syncretism.". Are doctors and nurses bound by just the same constraints as everyone else in regard to honesty? What, anyway, does honesty require? Telling no lies? Avoiding intentional deception by whatever means? From a utilitarian standpoint lying would seem to be on the same footing as other forms of intentional deception: yielding the same consequences. But utilitarianism fails to explain the wrongness of lying. Doctors and nurses, like everyone else, have a prima facie duty not to lie--but again like everyone else, (...) they are not duty-bound to avoid intentional deception, lying apart; except where it would involve a breach of trust. This article examines the excitement that Adam Smith's Theory of Moral Sentiments generated in France during the French Revolution, focusing particularly on the writings of political theorists, participants and commentators such as the abbé Sieyès, Pierre-Louis Rœderer, the Marquis de Condorcet and Sophie de Grouchy Condorcet, who were dismayed at their political opponents’ use of Rousseau, and looked to Smith for an understanding of the passions that was compatible with democratic sovereignty and representative government. If Savulescu's (2001, 2009) controversial principle of Procreative Beneficence (PB) is correct, then an important implication is that couples should employ genetic tests for non‐disease traits in selecting which child to bring into existence. Both defenders as well as some critics of this normative entailment of PB have typically accepted the comparatively less controversial claim about non‐disease traits: that there are non‐disease traits such that testing and selecting for them would in fact contribute to bringing about the child who is (...) expected to have the best life. We challenge this less controversial claim, not by arguing deductively for its falsity, but by showing that Savulescu's central argument for this presumably less controversial claim fails. Savulescu offers intelligence as the paradigm example of a testable non‐disease trait such that testing and selecting for it would increase the likelihood that the child selected would be the one who is expected to have the best life (or at least as good a life as the others). We provide a series of arguments aimed at demonstrating that Savulescu's argument from intelligence fails. If our arguments are successful, the upshot is not that PB is false, but more modestly, that the burden of proof remains squarely with Savulescu. (shrink)

Business students appear predisposed to select disciplines consistent with pre-existing worldviews. These disciplines then further reinforce the worldviews which may not always be adaptive. For example, high levels of Social Dominance Orientation is a trait often found in business school students :691–721, 1991). SDO is a competitive and hierarchical worldview and belief-system that ascribes people to higher or lower social rankings. While research suggests that high levels of SDO may be linked to lower levels of empathy, research has not established (...) the potential relationship between another related adaptive trait in the workplace, compassion. Compassion facilitates workplace performance by lowering levels of litigation, easing stress, and facilitating cooperation. Accordingly, the following study aimed to examine the relationship between SDO and compassion while hypothesizing Economic Systems Justification would mediate this relationship. Because of the importance of compassion in the workplace, the prevalence of SDO in the business academic community and the topicality of ESJ, we conducted our study with business school students. “Black box argument” is a metaphor for modular components of argumentative discussion that are, within a particular discussion, not open to expansion. In public policy debate such as the controversy over abstinence-only sex education, scientific conclusions enter the discourse as black boxes consisting of a result returned from an external and largely impenetrable process. In one way of looking at black box arguments, there is nothing fundamentally new for the argumentation theorist: A black box argument is very like any other (...) appeal to authority, and what might be said about any particular form of black box will turn out to be a particularized version of what might be said about evaluating arguments based on authority. But in another way of looking at black box arguments, they are a constantly evolving technology for coming to conclusions and making these conclusions broadly acceptable. Black boxes are to argumentation what material inventions are to engineering and related sciences. They are anchored in and constrained by fundamental natural processes, but they are also new things that require theoretical explication and practical assessment. (shrink)

Betrayal is both a “people” problem and a philosopher’s problem. Philosophers should be able to clarify the concept of betrayal, compare and contrast it with other moral concepts, and critically assess betrayal situations. At the practical level people should be able to make honest sense of betrayal and also to temper its consequences: to handle it, not be assaulted by it. What we need is a conceptually clear account of betrayal that differentiates between genuine and merely perceived betrayal, and which (...) also provides systematic guidance for the assessment of alleged betrayal in real life. In what follows I offer an account of betrayal that attempts to meet the two requirements of conceptual clarity and contextual adequacy. There is a great temptation to use the events in Washington of the past few years as the case study for such an analysis, but I believe that, for a variety of reasons, including the difficulty of viewing events from “within,” this would only complicate matters rather than clarify them. Rather, I believe that betrayal in literature is fruitful ground for analysis. I have chosen Jane Austen’s Sense and Sensibility for examples of trust and betrayal, because Austen displays the needed complexity and subtlety of human relationships and because she recognizes that violations of trust come in a variety of shades and colors. This particular novel, moreover, not only supplies multiple instances of trusting relationships gone awry, but also a common, detailed, and intelligible landscape within which these relationships exist. Again, however, in order to illuminate betrayal and appropriately assess a purported betrayal, rich examples are not enough. We need a clear concept of betrayal. I will develop this concept by beginning with the related concept of trust. By starting with an explicit definition of trust and using this definition to analyze the various examples Austen provides, betrayal will emerge as but one of two types of violation of trust. This in turn will allow us to distinguish actual from merely “felt” betrayals. I will finally argue that understanding and being sensitive to the other form of violation of trust, which I call abandonment, may be even more significant to our moral life. (shrink)

Researchers of advanced technologies are constantly seeking new ways of measuring and adapting to user performance. Appropriately adapting system feedback requires accurate assessments of user performance. Unfortunately, many assessment algorithms must be trained on and use pre‐prepared data sets or corpora to provide a sufficiently accurate portrayal of user knowledge and behavior. However, if the targeted content of the tutoring system changes depending on the situation, the assessment algorithms must be sufficiently independent to apply to untrained content. Such is the (...) case for Interactive Strategy Training for Active Reading and Thinking (iSTART), an intelligent tutoring system that assesses the cognitive complexity of strategy use while a reader self‐explains a text. iSTART is designed so that teachers and researchers may add their own (new) texts into the system. The current paper explores student self‐explanations from newly added texts (which iSTART had not been trained on) and focuses on evaluating the iSTART assessment algorithm by comparing it to human ratings of the students’ self‐explanations. As a die-hard supernaturalist, someone "at two with nature" who would be at one with God, the author has mixed feelings about Theodore Nunez's defense of "naturalism." Unlike neopragmatists, the author is not troubled by Nunez's general realism about value; he takes exception not to Nunez's theoretical account of truth, but to his specific axiology. He does not share Nunez's confidence that "projective nature" can provide reliable moral inspiration, suggesting instead that such inspiration can arise only from trust in the (...) holiness of God. The fact that a number of printed editions of Greek physicians appeared during the sixteenth century is clear evidence that publishing houses of the time believed that a substantial interest in such texts existed. What is most surprising is that, until the last decade of the fifteenth century, a prevailing shortage of Greek medical manuscripts had not at all troubled the scholarly and medical communities. This essay shows how minor a niche Galen and other Greek medical writers occupied in the (...) West for a long period of time, until some significant occurrences brought them to the forefront in the 1490s. (shrink)

This article explores some of the challenges and benefits of doing a dissertation with participants from a population to which I belong and on a topic some consider controversial, that of gay and lesbian educators. I describe the homophobia I experienced and how that homophobia affected my choice of topic, the research process, and my job prospects. Each step of this research journey presented me with a variety of delicate decisions. I discuss my thought processes in resolving these dilemmas and (...) some of the practical solutions I used to address a variety of difficulties. Although written specifically about doing research with gay and lesbian teachers, many of the lessons I learned throughout this process can be applied to a range of research situations. For example, many researchers share cultural backgrounds with their participants. This presents both the opportunity to establish rapport with participants quickly but also the danger of the researcher reading his or her own experiences into the data. I describe some of the ways I addressed this issue as well as others commonly faced by those doing dissertations. I conclude that doing a dissertation on a topic I feel passionately about sustained me throughout the dissertation process. (shrink)

This article reviews the opportunities for legal semiotics to contribute to legal philosophy, legal sociology, the reading of legal texts and the analysis of legal language (with bibliography) and surveys the institutional development of legal semiotics.

Though lobbying for federal money may seem like business as usual today–with billions of dollars spent annually by companies, labor unions, and other organizations in an effort to win a piece of what has become an enormous federal pie–this was not always the case in the United States. An all-but-forgotten event, the Harrisburg Convention of 1827, may have been one of the key historical turning points in this regard, an opening of a floodgate that would transform the role of the (...) U.S. federal government forever. It was in the modest Pennsylvania capital that a hundred of the North’s most influential manufacturers and public servants–backed by legislators like Henry Clay and Daniel Webster–assembled to draft a “memorial” to Congress, imploring that body to pass a protectionist bill to save their industries from what they viewed as eventual ruin. As Jonathan J. Pincus observed and Thornton and Ekelund echoed, “it is not small cohesive individual groups but larger diverse ones that are necessary in order to effectively lobby representatives and senators to obtain majority coalitions” in comprehensive legislation. The convention would bring together this “larger diverse” group—with just such a legislative goal. Meanwhile, mostly in the South, anti-protectionist opinion continued to surge. The Harrisburg Convention of 1827 would lead to the passage of that most hated piece of protectionist legislation—the “Tariff of Abominations” of 1828–and it would do so by framing the protectionist agenda into a nationalist “cause” borne of “patriotic duty.”. How should doctors respond to requests from parents of terminally ill children for unproven treatments to be tried? Here it is argued that doctors faced with difficult cases where (1) it is not obviously against a child's interests to undergo an unproven treatment and (2) provided the treatment does not draw extravagantly on NHS funds, it may be appropriate, though not necessarily obligatory, for doctors to comply. It is important to recognise that often there may not be 'the right response'--only (...) alternative appropriate responses. (shrink)
