This paper focuses on the 1986 Amendments to the False Claims Act of 1863, which offers whistle-blowers financial rewards for disclosing fraud committed against the U.S. government. This law provides an opportunity to examine underlying assumptions about the morality of whistle-blowing and to consider the merits of increased reliance on whistle-blowing to protect the public interest. The law seems open to a number of moral objections, most notably that it exerts a morally corrupting influence on whistle-blowers. We answer these objections (...) and argue that the law is not objectionable on these grounds. Since there are no compelling moral objections to the law, it is appropriate and acceptable to judge the law in terms of its economic costs and benefits. We assess the most salient of these and conclude that the benefits outweigh the costs. We suggest that a mechanism similar to the Act should be considered for protecting stockholders’ interests in the private sector. This paper presents an analysis of bluffing in labor negotiations from legal, economic, and ethical perspectives. It is argued that many forms of bluffing in labor negotiations are legal and economically advantageous, but that they typically constitute lying. Nevertheless it is argued that it is generally morally acceptable to bluff given a typical labor-management relationship where one's negotiating partner is familiar with and most likely employing bluffing tactics him/herself. We also consider whether it is an indictment of our present negotiating (...) practices and our economic system as a whole that, given the harsh realities of the marketplace, bluffing is usually morally acceptable. This paper examines several issues regarding deception in advertising. Some generally accepted definitions are considered and found to be inadequate. An alternative definition is proposed for legal/regulatory purposes and is related to a suggested definition of the term deception as it is used in everyday language. Based upon these definitions, suggestions are offered for detecting and regulating deception in advertising. This paper additionally considers the grounds for the generally held but largely unquestioned assumption that deceptive advertising is unethical. It is (...) argued that deceptive advertising can be shown to be morally objectionable, on the weak assumption that it is prima facie wrong to harm others. Finally, the implications of this analysis with respect to current regulation of deceptive advertising by the FTC are considered. (shrink)

Background Informed consent is an integral component of good medical practice. Many researchers have investigated measures to improve the quality of informed consent, but it is not clear which techniques work best and why. To address this problem, we propose developing a core outcome set to evaluate interventions designed to improve the consent process for surgery in adult patients with capacity. Part of this process involves reviewing existing research that has reported what is important to patients and doctors in the (...) informed consent process. Methods This qualitative synthesis comprises four phases: identification of published papers and determining their relevance; appraisal of the quality of the papers; identification and summary of the key findings from each paper while determining the definitiveness of each finding against the primary data; comparison of key themes between papers such that findings are linked across studies. Results Searches of bibliographic databases returned 11,073 titles. Of these, 16 studies met the inclusion criteria. Studies were published between 1996 and 2016 and included a total of 367 patients and 74 health care providers. Thirteen studies collected data using in-depth interviews and constant comparison was the most common means of qualitative analysis. A total of 94 findings were extracted from the primary papers and divided into 17 categories and ultimately 6 synthesised findings related to: patient characteristics, knowledge, communication, the model patient, trust and decision making. Conclusions This qualitative meta-aggregation is the first to examine the issue of informed consent for surgery. It has revealed several outcomes deemed important to capture by patients and clinicians when evaluating the quality of a consent process. Some of these outcomes have not been examined previously in research comparing methods for informed consent. This review is an important step in the development of a COS to evaluate interventions designed to improve the consent process for surgery. In a recent paper that appeared in this journal Fritz Allhoff addresses the morality of bluffing in negotiations1. He focuses on cases in which people misstate their reservation price in negotiations, e.g., suppose that I am selling a house and tell a prospective buyer that $300,000 is absolutely the lowest price that I will accept, when I know that I would be willing to accept as little as $270,000 for the house rather than continue to try to sell it. Allhoff (...) criticizes my (qualified) defense of bluffing in my paper Second Thoughts on Bluffing,2 and offers what he takes to be a more plausible defense of bluffing. Allhoffs criticisms rest on several serious misinterpretations of my views. He ascribes to me several arguments that I dont make. He also attributes to me an unqualified defense of bluffing that I explicitly reject. I briefly document this in Section 1. In Sections 2 and 3 I explain and criticize Allhoffs positive views about bluffing and the morality of bluffing. (shrink)

First, he argues that the two principles of justice provide a better match with our 'considered judgments in reflective equilibrium.' Second, he argues that his two principles would be chosen in preference to the principle of utility in 'the original position.' I shall be concerned only with the second of these two (...) arguments in this paper. According to Rawls, people in the original position choose principles on the assumption that whatever principles are chosen will be strictly complied with, i.e., they choose on the assumption that the basic institutions of their society and all of the actions of its members will be in compliance with whatever principles are chosen. Jean E. Chambers and Timothy F. Murphy responded to my article “Cloning and Infertility” and extended the debate over human cloning in interesting ways. I had argued that none of the objections to cloning by somatic cell nuclear transfer are successful in the context of infertile couples who use cloning to have genetically related children, assuming the issue of safety is overcome by scientific advances.

The term ‘sustainability’ is vague and open to interpretation. In this paper we analyze how firms use the term in an effort to make the concept their own, and how it becomes a premise for further decisions, by applying a bottom-up approach focusing on the interpretation of ‘sustainability’ in the Norwegian salmon-farming industry. The study is based on a strategic selection of informants from the industry and the study design rests on: 1) identification of the main drivers of sustainability, and (...) 2) the application of five different discursive strategies to analyze how the firms maneuver to legitimize ‘sustainability’ in their conduct. We employ the Critical Discourse Analysis framework, which emphasizes how discourses provide different concepts of meaning. The sustainability concept is assessed based on how sustainability is brought into action by social actors in a legitimate way, and how this action results in sustainable practices. The empirical case of the study is the verbal justification of sustainability practices among representatives of the Norwegian salmon-farming industry. We aim to find out how these representatives translate the rather vague directives of the sustainability concept into legitimate choices that resonate with the firms’ contextual environment, hence, how the salmon farmers perceive, explore, interpret, explain, enact, and defend the diverse landscape of sustainability when implementing professional decisions. We found a trend of passive adaptation to external requirements, such as public regulations and regulative requirements from certification bodies. At the same time, there are progressive forces that attempt to improve the sustainability of the farming practices by involvement in research and innovation projects or cooperation with other firms, e.g. the contribution from offshore engineers in developing high seas farms. The strategies outlined and discussed cannot be seen as a typology to categorize the firms. More than one discursive strategy may be involved in one firm’s choice, and the strategies may work on different levels. (shrink)

In this essay I criticize recent attempts to prove that the concept of lying does not include the intent to deceive. I argue that examples by Isenberg and Carson fail to prove that one can lie without intending to deceive and, furthermore, that untoward consequences would follow if these authors were correct. I conclude that since intending to deceive is indeed a necessary condition of lying, the class of statements that constitute lies is smaller than what Isenberg et al. (...) would suggest. Hence the class of deceptive advertisements is also correspondingly smaller. (shrink)

How does one measure whether a “Speculum” is of sufficiently broad interest to be worthy of an article in Speculum? I refer to Marguerite Porete's Mirror of Simple Souls, which I believe amply meets the test. Since the publication of the Middle French text of the Mirror in 1965, two translations have appeared in modern French, two in Italian, one in German, one in Spanish, and one in Catalan. Two translations are also available in English. Both have remained in print (...) since their initial appearance in the 1990s; one is owned by 576 libraries worldwide, and the other by 160, to which might be added 279 copies of an earlier English translation made from the Middle English version of the Mirror. A rough count of secondary works on Marguerite published in the last twenty-five years adds up to some one hundred books and articles. Quite intriguing is the diverse use made of Marguerite and her work outside of the academy. In 2001 an “installation opera” about Marguerite based on a libretto by the noted poet Anne Carson was performed in New York City; the following year a “Requiem für Marguerite Porete” with “dance and musical interpretation” was performed in Karlsruhe. A Web site promoting Eastern wisdom explains that Marguerite's “works illumine the nature of the soul in language which is remarkably reminiscent of Vedic teaching on the Atma, the individual soul.” And yes, she has been unofficially canonized, for another Web site informs readers about the “martyrdom” of “Saint Marguerite of Hainaut called la Porète.”. O presente trabalho tem como objetivo apresentar a rearticulação do problema do amor na obra da classicista e poeta Anne Carson. Em seu livro Eros, the bittersweet, Carson realiza uma reconstrução do problema do amor na tradição helênica. A operação, porém, não se restringe a uma mera reconstrução histórica, visto que as elaborações conceituais da autora acabam pondo o problema do amor como um tipo de situação que tem sua força justamente na transcendência das condições particulares. Analisaremos, portanto, (...) como Carson concebe os contornos da dinâmica do amor como uma relação entre amante, amado e a distância entre eles, a partir das obras de Safo de Lesbos. Em seguida, discutiremos no artigo como, a partir dessa concepção da relação amorosa, a autora elabora, por meio de uma leitura do diálogo Fedro de Platão, os desdobramentos do problema do amor na questão da composição dos sujeitos e nas experiências do tempo e do espaço. No fim, procuramos demonstrar como a obra de Carson nos fornece uma visão renovada do problema do amor. (shrink)

본 연구는 기하학에 대한 구조-구성주의 인식론을 정당화하는 것이다. 즉 구조주의와 구성주의를 융합하는 필자의 고유한 인식론으로 기하학적 인식의 본성을 해명하는 것이다. 그러나 현재의 연구는 이러한 큰 주제에 접근하기 위한 예비적 연구로서 칸트의 기하학적 직관 개념에 대한 역사-비판적 분석을 제공하는 데 한정된다. 잘 알려져 있는 것처럼, 칸트는 수학적 인식, 특히 기하학적 인식을 위해서 직관이 핵심적으로 중요하다고 주장했다. 그런데 칸트가 말하는 기하학적 인식을 위한 직관의 역할이 무엇인지는 여전히 논쟁적이다. 이점과 관련해서 역사적으로 대립적인 두 가지 해석이 있다. 하나는 베스(E. Beth), 힌티카(J. Hintikka), 프리드만(M. Fridman) (...) 등으로 이어지는 논리적 해석이며, 다른 하나는 파슨스(Parsons)와 칼슨(E. Kant kennt verschiedene Arten von Logik und die Abgrenzung der transzendentalen Logik von anderen Logikauffassungen ist wichtig für sein philosophisches Programm. Diese verschiedenen Logikauffassungen sowie deren Änderungen im Laufe der kritischen Philosophie werden in den Beiträgen von E. Carson, T. Rosenkoetter, C. Tolley und G. Zöller untersucht. Auch mit Blick auf Hegels Philosophie ist das Verständnis und die Rolle der (...) Logik zentral und eine Auseinandersetzung über Ziel, Aufbau und Inhalt von Hegels Logik gehört zu den wichtigsten Interpretationsaufgaben. Dem gehen die Autoren S. Houlgate, L. Illetterati, R.B. Pippin und P. Redding in ihren Beiträgen nach. Bei Fichte und Schelling ist die Rolle der Logik weniger offensichtlich. Die Beiträge von C. Asmuth, A. Nuzzo und S. Schwenzfeuer widmen sich daher vor allem der Frage, welchen Platz die Logik in den jeweiligen Konzeptionen inne haben kann und soll. Rachel Carson begins her revolutionary book Silent Spring with a quote from E.B. White that reads 'we would stand a better chance of survival if we accommodated ourselves to this planet and viewed it appreciatively'. While White's advice can account for an instrumental relationship towards nature, I believe that the more important relationship offered in his recommendation is one of appreciation or gratitude. But how are we to understand gratitude as appreciating Nature non-instrumentally when it has traditionally always been (...) understood as a response to a benefit received? My motivation is to modify our traditional conception of gratitude alongside Simon Hailwood's account of the 'Otherness of Nature' to see how we can truly show gratitude for Nature rather than simply reflecting on how Nature serves human interests. The sublime evokes our awe, our terror, and our wonder. Applied first in ancient Greece to the heights of literary expression, in the 18th-century the sublime was extended to nature and to the sciences, enterprises that viewed the natural world as a manifestation of God's goodness, power, and wisdom. In The Scientific Sublime, Alan Gross reveals the modern-day sublime in popular science. According to the traditional philosophical definition, you lie if and only if you assert what you believe to be false with the intent to deceive. However, several philosophers (e.g., Carson 2006, Sorensen 2007, Fallis 2009) have pointed out that there are lies that are not intended to deceive and, thus, that the traditional definition fails. In 2009, I suggested an alternative definition: you lie if and only if you say what you believe to be false when you believe that (...) one of Paul Grice's conversational norms (“Do not say what you believe to be false”) is in effect. Faulkner (forthcoming), Stokke (forthcoming), and Pruss (2012) have subsequently argued that my 2009 definition fails as well because it counts some statements that are clearly not lies as being lies. In this paper, I identify some additional counter-examples of this sort. But I argue that my 2009 definition can easily be revised to deal with such counter-examples once we clarify that the relevant norm is really against communicating something false rather than against merely saying it. Nevertheless, I show that even this revised version of my 2009 definition fails because it counts some statements that are lies as not being lies. Lies told by young children – which uncontroversially count as lies on the traditional philosophical definition – suggest that lying (as well as asserting in general) does not require believing that such a norm is in effect. Even so, I claim that, since all liars intend to do something that would violate this norm if it were in effect, there is a successful definition of lying that is at least in the spirit of my 2009 definition. We want to keep hackers in the dark about our passwords and our credit card numbers. We want to keep potential eavesdroppers in the dark about our private communications with friends and business associates. This need for secrecy raises important questions in epistemology (how do we do it?) and in ethics (should we do it?). In order to answer these questions, it would be useful to have a good understanding of the concept of keeping someone in the dark. Several philosophers (...) (e.g., Bok, 1983; Carson, 2010; Mahon, 2009; Scheppele, 1988) have analyzed this concept (or, equivalently, the concept of keeping secrets) in terms of concealing and/or withholding information. However, their analyses incorrectly exclude clear instances of keeping someone in the dark. And more important, they incorrectly focus on possible means of keeping someone in the dark rather than on what it is to keep someone in the dark. In this paper, I argue that you keep X in the dark about a proposition P if and only if you intentionally cause X not to have a true belief that P. In addition, I show how this analysis of keeping someone in the dark can be extended from a categorical belief model of epistemic states to a credence (or degree of belief) model. (shrink)

Growing concern has been expressed that we have entered a “post-truth” era in which each of us willfully believes whatever we choose, aided and abetted by alternative and social media that spin alternative realities for boutique consumption. A prime example of the belief in alternative realities is said to be acceptance of “conspiracy theories”—a term that is often used as a pejorative to indict claims of conspiracy that are so obviously absurd that only the unhinged could believe them. The epistemological (...) standard often involved in this indictment, however—the standard of “obvious” falsity—invites subjectivity in its application, because what is obviously false to one person can be common sense to another. This is not just a truism; considerable research suggests that people’s political beliefs, in general, and their acceptance or rejection of conspiracy theories in particular, tends in large part to be determined by partisan, ideological, and other priors. Trata-se de um estudo que apresenta uma interpretação sobre o livro de Carson McCullers, intitulado O coração é um caçador solitário, com base no argumento de que a referida obra traz consigo elementos literários e filosóficos. Com isto em mente, objetivou-se compreender a solidão para além de um dilema que a encerra em si mesma, mas, sobretudo, compreendê-la inserida no contexto dos tempos sombrios, fenômeno epocal em que se manifesta o ódio e a intolerância (a exemplo de manifestações machistas, (...) racistas, xenófobas e homofóbicas) incentivados por uma espécie de obscurantismo anti-intelectual. O problema investigado se referiu às condições de possibilidade de enfrentar-se educacionalmente a solidão, fenômeno que afeta cada vez mais indivíduos. Em linhas gerais, percorre-se o campo dos conceitos filosóficos amparados pela materialidade da narrativa literária para a apresentação de proposições pedagógico-educacionais. Loneliness in somber times: pedagogical-educational propositions for a world out of axes Abstract: This is a study that presents an interpretation of Carson McCullers' book, The Heart is a Lonely Hunter, based on the argument that the aforesaid work carries both literary and philosophical elements. That said, the objective was to understand the loneliness beyond a dilemma which encloses in itself, yet, especially, to comprehend it when inserted in dark times context, epochal phenomenon that manifests hatred and intolerance (sexism, racism, homophobic manifestations, for instance), encouraged by some sort of anti-intellectual obscurantism. The problem investigated in this article referred to the conditions of possibility of facing loneliness educationally, a phenomenon that has increasingly affected individuals. In general terms, the philosophical concepts field supported by the materiality of literary narrative for the presentation of pedagogical-educational propositions. Con esto en mente, se ha objetivado comprender la solitud más allá de un dilema en si misma, pero, estudiarla introducida en el contexto de los tiempos de oscuridad, fenómeno de una época en que se manifiesta el odio y la intolerancia (a ejemplo de manifestaciones machistas, racistas, xenofóbicas y homofóbicas) incentivadas por una especie de oscurantismo anti-intelectual. El problema investigado se ha referido a las condiciones de posibilidad de enfrentarse, en la educación, la soledad, fenómeno que afecta cada vez más individuos.
