Cultural heritage as an intrinsic element of human activity has undergone notable changes in its perception depending on the historical context in which it is generated. That is why, approaching the role it has played over time, is essential to understand its situation and determine the challenges it faces. Although same-sex couples and their offspring have been legitimised in many European countries, heteronormativity is still embedded in institutions and practices, thereby continuing to affect the daily lives of LGBT individuals. Italy represents a clear example of the hegemonic power of heteronormativity because of the fierce opposition to recognising lesbian and gay parenthood among many parts of society. This paper focuses on the peculiarities of the Italian scenario with the aim of highlighting how heteronormativity works in contemporary neoliberal contexts. By (...) drawing on queer and feminist perspectives, the article also analyses how LGBT equal rights demands can contribute, to some extent, to reinforcing heteronormativity. Implications concerning strategies for challenging the regime of normality and queering kinship are discussed. (shrink)

El presente artículo recoge un texto inédito hasta la fecha del filósofo español Manuel Sacristán Sacristán (1925-1985) en torno al libro El futuro del Partido Comunista Francés, un ensayo de Waldeck Rochet (1969), entonces secretario general del PCF. En el mismo pueden observarse motivaciones políticas de Sacristán características de su tiempo que parecen prefigurar parte de la caracterización que más adelante realizará en torno al eurocomunismo, donde la firme defensa de los valores democráticos en el marxismo no es incompatible (...) con críticas a determinadas involuciones político-institucionales en el campo de los partidos comunistas europeos de la época. Si su autor es conocido sobre todo por su compromiso político y social, como filosofo político por sus interesante y peculiar reflexión en la tradición e Marx, o como profesor y traductor de excepcional categoría, en estos PAPELES surge otra imagen destacadísima suya: la del filosofo del rigor y de la maestra metodológica puestos al servicio de un pensamiento (...) vivo que explora los problemas fundamentales de nuestro tiempo. One of the most important contributions of Einstein to the philosophy of science is the distinction between two types of scientific theories: ‘principle’ and ‘constructive’ theories. More recently, Flores proposed a more general distinction, classifying scientific theories by their functional role into ‘framework’ and ‘interaction’ theories, attempting to solve some inadequacies in Einstein’s proposal. Here, based on an epistemic criterion, we present a generalised distinction which is an improvement over Flores approach. In this work (i) we evaluate the shortcomings related (...) to Flores’s proposal, (ii) we present an epistemological criterion that opens the door for a more general classification of any scientific theory in all of the natural science into two distinct groups, which we call ‘mechanistic theories’ and ‘structural theories’, and (iii) we show that such a criterion is connected to Flores’ proposal while overcoming issues of all previous approaches. The variety \ of semi-Heyting algebras was introduced by H. P. Sankappanavar [13] as an abstraction of the variety of Heyting algebras. Semi-Heyting algebras are the algebraic models for a logic HsH, known as semi-intuitionistic logic, which is equivalent to the one defined by a Hilbert style calculus in Cornejo :9–25, 2011) [6]. In this article we introduce a Gentzen style sequent calculus GsH for the semi-intuitionistic logic whose associated logic GsH is the same as HsH. The advantage of this (...) presentation of the logic is that we can prove a cut-elimination theorem for GsH that allows us to prove the decidability of the logic. As a direct consequence, we also obtain the decidability of the equational theory of semi-Heyting algebras. (shrink)

En este artículo llevamos a cabo una extensa revisión de la literatura científica en lo relativo a los vínculos entre materialismo y felicidad, desde un enfoque multidisciplinar que incluye la psicología, la comunicación, la economía y la ética. La línea dominante en la bibliografía insiste en vincular un mayor materialismo con una menor auto-percepción de felicidad y de bienestar, y con una mayor propensión a la depresión. En esta revisión atendemos a los aspectos que así lo evidencian, al rumbo actual (...) de las investigaciones y a los retos aún pendientes de clarificación por parte de la comunidad investigadora. Positive Youth Development (PYD) is an approach that promotes resilience and focuses on youth strengths rather than their weaknesses as done by the traditional deficit-based perspective. Research in Europe and North America show that developmental assets are associated with school success, psychological well-being, and lower health risks among youth and young adults. However, not much research has been done on these associations in Latin American contexts. The purpose of this research study is to assess the association between substance use behaviors, (...) such as drunkenness and the use of illicit drugs, and mental health, together with the mediating role of developmental assets representing youth strengths (e.g., social competence) and contextual resources (e.g., social support at home or school). Cross-national data was collected from Colombian (n= 210; 70.4% females) and Peruvian(n= 349; 66.5% females) 1st year university students. Results shed light on the protective role of developmental assets regarding substance use behaviors and mental well-being. Specifically, the results showed direct negative associations between developmental assets and substance use behaviors and positive associations of developmental assets with mental health indicators. Internal assets appear to be a stronger predictor of social, emotional, and psychological well-being compared to external assets. We did not find any statistical significance in the association of substance use behavior and mental health. We discuss implications regarding research, policy, and practice. (shrink)

Este trabajo analiza las dos tesis principales del reciente libro de Manuel Pérez Otero, Vericuetos de la filosofía de Wittgenstein: la revisión de la simetría general entre acciones y omisiones como comportamientos intencionales, y la propuesta de respuesta disposicional “teleológica” al desafío escéptico sobre el significado del Wittgenstein de Kripke. Sobre la primera tesis, ponemos de manifiesto la neutralidad la gramática de la atribución de comportamientos intencionales respecto al determinismo causal, destacando el carácter retrospectivo implicado por el concepto de (...) “justificación post hoc”. Sobre la segunda, indicamos el rechazo del internismo no alcanza para hacer de las disposiciones teleológicas una explicación satisfactoria del comportamiento. Intentamos clarificar la clase de problema planteado por el escepticismo semántico wittgensteiniano: el abandono de la concepción que ve al seguimiento de reglas como la “praxis de un sujeto” por otra que ve a los seguidores de reglas como los “sujetos de una práctica”. El presente artículo trata de presentar la edición que el Prof. Manuel Barrios Casares ha llevado a cabo del texto de Hugo Ball sobre Nietzsche, redactado en un principio en el marco de un proyecto de tesis doctoral entre 1909 y 1910. A la traducción y anotación del texto antecede un extenso prólogo sumamente interesante para su comprensión y contextualización. Hugo Ball, promotor del dadaísmo y amigo de Kandinsky, plasma en el texto el clima intelectual de la recepción del (...) pensamiento de Nietzsche entre las vanguardias artísticas europeas de principios del siglo XX. Este ensayo busca comprender la estructura simbólica que sostiene las dos fases que constituyen la fiesta de mak , veintena relacionada con el inicio del ciclo agrícola en el calendario maya yucateco. El punto de partida es el testimonio de Fray Diego de Landa, obispo de Yucatán en el siglo XVI, quien describe la fiesta que se celebraba al momento del contacto europeo; sin embargo, buscando establecer la fenomenología del hecho religioso estudiado, también se recurre a testimonios prehispánicos así (...) como a la literatura maya colonial y a algunos reportes etnográficos del siglo XX. Los paralelismos entre el ritual y las prácticas agrícolas permiten reflexionar en torno a las creencias mayas sobre la fecundidad y a las formas concretas en que el ritual cumple el papel normativo y práctico de la religión maya. Sobre dialéctica recoge las principales aportaciones –inéditas en su mayor parte– de Manuel Sacristán Luzón (1925-1985) en torno a esta debatida noción, entre las que se incluye el importante prólogo que escribió en 1964 para su traducción castellana del Anti-Dühring, prólogo que Javier Muguerza ha caracterizado como “el texto filosófico más significativo de Sacristán –el que más me impactó cuando lo leí y prolongó más duraderamente dicho impacto” y del que Gregorio Morán escribió que “otro tanto ocurrió con (...) su soberbio prólogo al Anti-Dühring…; fue un texto capital en la formación marxista de una generación”. Como señaló Sacristán, y tal como reflejan los distintos textos que configuran este volumen, la dialéctica es una visión global del mundo, no un método, y una hipótesis de estas características no se aplica: se realiza, se concreta, y para ello hay que trabajar de verdad y verazmente. Miguel Candel Sanmartín, Manuel Monleón Pradas y Félix Ovejero Lucas son los autores del prólogo, nota final y epílogo del volumen. Antoni Domènech ha traducido para esta edición la “Loa a la dialéctica” de Brecht. Manuel Sacristán Luzón (Madrid, 1925-Barcelona, 1985) estudió Derecho y Filosofía y Letras en la Universidad de Barcelona y cursó estudios de lógica y epistemología en el Instituto de Lógica Matemática e Investigación de Fundamentos de la Universidad de Münster (Westfalia, Alemania) entre 1954 y 1956. Sacristán se doctoró en Filosofía en 1959 con una tesis sobre Las ideas gnoseológicas de Heidegger y en 1964, dos años después de que le fuera negada la cátedra de lógica de la Universidad de Valencia, publicó Introducción a la lógica y al análisis formal, uno de los textos que más contribuyeron a la presencia y consolidación de la lógica formal en la cultura científica y filosófica española. Profesor de “Fundamentos de Filosofía” y de “Metodología de las ciencias sociales” en la Universidad de Barcelona, impartió durante el curso 1982-1983 dos seminarios de postgrado en la UNAM de México. Miembro del comité central del PCE y del PSUC, entre 1965 y 1970 formó parte del comité ejecutivo del PSUC. En su faceta de filósofo marxista, destaca la sensatez y originalidad con que siempre trató el complejo, y en ocasiones oscuro, tema de la dialéctica y su concepción del marxismo como una tradición de política revolucionaria. De uno de los escritos aquí recogidos, Félix Ovejero Lucas señaló en 1985: “Apenas veinte páginas tenía la introducción de Manuel Sacristán a la edición castellana del Anti-Dühring, de Engels; veinte páginas que enseñaron a varias generaciones de marxistas mucho más acerca de lo que significaba ser marxista que la marabunta editorial de unos años más tarde”. La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. Esa temporalidad es la de las formas de un poder destituyente articulado en distintas organizaciones e iniciativas, como el movimiento piquetero, las asambleas, las formas de justicia de los escraches, las ollas populares, etc. Las preguntas que recorren el texto son, entre otras, qué pasó con las figuras comunitarias en los años de los gobiernos kirchneristas, cuáles (...) fueron las memorias del 2001, y cómo se activa la política “por abajo” ante el escenario de una nueva crisis y la reaparición del “que se vayan todos”, pero esta vez como marco del ascenso de la derecha. Through the explorations of excellent scholars, this book provides a new understanding of Plato's _Theaetetus_, an absolute masterpiece which contains fundamental insights – about the nature of human cognition, perception, rationality – which are still at the centre of the contemporary debate.

This paper argues that functionalist metasemantic views, such as Conceptual Role Semantics and Interpretivism, face a Euthyphro challenge. The challenge, put roughly, is this: functionalist metasemantic views reverse the order of explanation. According to such views, representational mental states have the contents that they do partly because they play certain roles in our mental lives. According to an intuitive picture of the roles that representational mental states play in our mental lives, however, these states play the roles they do partly (...) because they have the contents that they do. Since explanations—even partial ones—are asymmetric (call this principle ‘the Euthyphro Principle’), we can’t accept both this intuitive picture and a functionalist metasemantics. Hence, we should reject all versions of the latter. This paper can be seen as an attempt to better articulate an intuition that has been suggested in various forms in the literature. The paper proceeds as follows. First, it shows that functionalist metasemantic views imply certain ‘partly because’ claims. Second, it argues for the Euthyphro Principle. Third, it defends the intuitive picture of representational mental states and shows that it implies ‘partly because’ claims that conflict with those made by functionalist metasemantic views. Finally, it considers ways of relaxing the intuitive picture and finds them all wanting. (shrink)

Naive realism in philosophy of perception is the view that (successful) perception involves a direct relation between perceiving subjects and the world. The naive realist says that your perception of a cat on the mat is a worldly relation which is partially constituted by the cat and the mat; a spatio-temporal chunk of the world is presenting itself to you. Recently, Elijah Chudnoff and John Bengson have independently developed an extension of this view to intellectual experiences, or intuitions, for traditionally (...) a priori domains. We argue that this view, which we call ‘Intuitional Naive Realism’ (INR), will not have the epistemic advantages that Chudnoff and Bengson claim that it does. In perception, but not intuition, there is a deeper explanation of what makes it the case that one experience is constituted by the world while another is not. Whether or not INR is true, then, it does no interesting epistemological work for traditionally a priori domains. (shrink)

Of all the risks we face in life, ranging from unemployment to old age, early death is among the most tragic and yet most neglected by modern states. Liberal egalitarians might find it easy to dismiss social insurance against early death, but I argue they should not. Early in this paper, I explain why social insurance should include the risk of premature death by replying to four common criticisms. What follows is a case for a novel form of insurance that (...) is more liberal and egalitarian across ages than the status quo. More specifically, I show that granting storable pensions in all life stages - youth, middle and old age - promotes liberty and reduces lifetime inequality. Writers on age group and longevity justice often overlook the extent to which liberal lifetime equality can supply insightful arguments against inequality across ages. These call for a policy that gives each age group the freedom to draw a storable pension. I call that policy "freetirement". (shrink)

The paper gives an overview of primate research and the economic-ethical 'lessons' we can derive from it. In particular, it examines the complex, multi-faceted and partially conflicting nature of (non-) human primates. Our closest living relatives, the chimpanzees and bonobos, apparently walk on two legs: a selfish and a groupish leg. Given evolutionary continuity and gradualism between monkeys, apes and humans, human primates seem to be bipolar apes as well. They, too, tend to display a dual structure: there seems to (...) be a pro-social and a self-interested side to our species and a bipolar tension seems to exist between competition and cooperation respectively between self-interest and the common good. We are apparently at the same time Homines oeconomici and Homines culturali. Our inner ape tries to combine self-interested and common good motives. Based on de Waal's Russian doll model, the essay investigates the evolutionary origins of morality and 'eusociality'. With the help of selected case studies stemming from behavioural sciences/economics, the paper illustrates examples of empathy, altruism, reciprocal fairness, pro-social and other-regarding preferences, inequity aversion and altruistic punishment in (non-)human primates. Beside this selfless and groupish side, the paper also reflects on the self-interest and egoistic nature of (non-)human primates and the behavioural and cognitive differences between monkeys, apes and humans. This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

Despite being increasingly available to us all, retirement pensions remain unequally distributed: between rich and poor, young and old, men and women, and possibly different generations. As this topic receives little attention in moral and political philosophy, the articles in this thesis aim to deliver an original account of justice in retirement pensions along liberal egalitarian lines. The first part defends retirement pensions as a distribution of free time. It shows that including free time in the list of goods that (...) liberal egalitarians prioritise is plausible and avoids problems that would otherwise arise with other candidates, most notably leisure. Retirement as free time is an essential feature of liberal egalitarian societies by (re)distributing the means to pursue any life project, and especially valuable for the poor who work and contribute the longest. The second part makes a case for 'libertirement', a proposal to increase the freedom to enjoy free time across life, as a matter of justice between those who live long and those who die early. Specifically, I propose adding reverse pensions and sabbaticals on top of old-age retirement. Besides showing the importance of longevity for age-group justice, I also draw implications for distributing unconditional basic income and income taxes across life, which I suggest may offer alternative paths to libertirement. Finally, the third part discusses the cases of pension inequality between genders and generations, pushing us to refine our account further. I conclude that there is often a mismatch between liberal egalitarian justice and the design of retirement schemes. The solution is often but not always to reform these systems. Sometimes, we have reasons to revise our very own principles of justice. (shrink)

Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. This article explores attempts at legalization of the practice of euthanasia and assisted suicide. Although in many countries there have been high levels of public support for euthanasia and assisted suicide, in most of them, no legislative activity has taken place concerning these practices, and there is a lack of clarity about what is permitted and what is not. I argue that accurate definition of the relevant concepts and a clear delineation of the territory of the debate would help draw (...) a coherent roadmap for legalization. To this end, I analyze five legal approaches to the legalization euthanasia: maintenance of the status quo, legal defenses, de-prioritization, de-criminalization, and legislation. I conclude with a discussion of the moral and legal implications of the foregoing analysis. (shrink)

Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)
