Die ethischen Aspekte der Verwendung von Placebos in klinischen Versuchsreihen wurden im letzten Jahrzehnt ausführlich und kontrovers diskutiert. Es fehlt dennoch eine gründliche vergleichende Analyse der verschiedenen internationalen Richtlinien, ihrer Terminologien und ihrer auf Placebo bezogenen Prinzipien. Das zentrale Problem ist die Rechtfertigung von Placebo bei einer nachgewiesen wirksamen Therapie. Alle aktuellen Versionen der untersuchten Richtlinien schlagen solche Rechtfertigungen vor, unterscheiden sich hierbei jedoch beträchtlich. Zunächst werden wir ein formales allgemeines Prinzip herausarbeiten. Dann werden wir drei verschiedene Kategorien von Kriterien (...) darstellen: das Schadensrisiko oder die Belastung, zwingende wissenschaftliche Gründe und die Erhältlichkeit einer nachgewiesen wirksamen Therapie. Die Analyse zeigt bedeutende normative Abweichungen und Widersprüche innerhalb und zwischen den einzelnen Richtlinien. Besonders frappierend ist es, dassmancheRichtlinien es erlauben, Versuchsteilnehmer dem Risiko eines schweren Schadens auszusetzen, während andere gerade dies untersagen. Abschließend versuchen wir zu zeigen, wie sich die normativen Unterschiede bei der Entscheidungsfindung von Forschern und Ethikkommissionen auswirken können. (shrink)

ZusammenfassungDas juristische Konzept der Einwilligung nach Aufklärung ist im Respekt vor dem Selbstbestimmungsrecht begründet. Es entwickelte sich seit Ende des 19. Jahrhunderts, gewann mit der rapiden Ausweitung der klinischen Forschung seit Mitte des 20. Jahrhunderts mittels der Deklaration von Helsinki und seit 1972 in den USA als Konzept des informed consent erhebliche Bedeutung in der klinischen Forschung, nachfolgend auch in der klinischen Praxis. Die psychiatrische Forschung stieß bald auf das grundlegende ethische Problem, dass psychische Krankheiten die Einwilligungsfähigkeit und (...) damit die Voraussetzung jeder Forschungsteilnahme beeinträchtigen oder gar zerstören können. Versuche der Lösung dieses ethischen und juristischen Problems in den letzten 30 Jahren – von frühen, durch das Konzept angestoßenen Fragen über die Entwicklung von Verfahren zur Feststellung der Einwilligungsfähigkeit bis zu aktuellen Vorschlägen für Forschungs- bzw. Probandenverfügungen und Forschungsvollmachten – werden im Kontext ihrer gesellschaftlichen Resonanz wie auch der eigenen Erfahrung skizziert. Die Übersicht soll die zunehmende Differenzierung des Konzepts verdeutlichen; sie folgt der Auseinandersetzung mit Problemen, die sich aus der Umsetzung und Wirksamkeit des Konzepts in der Forschungspraxis ergaben, um das Selbstbestimmungsrecht der Probanden zu bewahren. Als Schlussfolgerung ergibt sich 1. Das juristische Konzept der Einwilligung nach Aufklärung wurde erst durch die Entwicklung klinischer Kriterien zur Erfassung der Einwilligungsfähigkeit praktikabel; im Forschungskontext ist die Feststellung der Einwilligungsfähigkeit unverzichtbar, da von ihr die Gültigkeit der Einwilligung abhängt. 2. Zu erkennen ist ein langsamer Wandel von der Erfüllung einer juristisch begründeten Pflicht des forschenden Psychiaters, den potentiellen Forschungsteilnehmer nach Aufklärung um seine Einwilligung zu bitten, hin zu einer stärkeren Patientenorientierung; sie anerkennt das Selbstbestimmungsrecht und bemüht sich, im Prozess der Aufklärung die Fähigkeit des Patienten zu optimieren, sich zu einer Forschungsteilnahme selbstbestimmt entscheiden zu können. Ethische Grundprinzipien in der europäischen Bioethik und im Biorecht” ist der Titel eines Forschungsprojekts, das von 1995 bis 1998 von der EU-Kommission unterstützt wurde. Das Projekt gründete sich auf die Zusammenarbeit von 22 Partnerorganisationen aus der Mehrzahl der EU-Staaten. Es sollten ethische Grundprinzipien ermittelt werden, die sich ableiten aus Autonomie, Würde, Integrität und Verwundbarkeit als den vier Ausschlag gebenden Ideen bzw. Werten, die in der Bioethik und im Biorecht in Europa zum Tragen kommen sollen. Aus dem Resümee des EU-BIOMED-Projektes wurde (...) ein Rahmenprogramm der EU-Kommission abgeleitet und 1998 in der Deklaration von Barcelona festgehalten . Bei dieser Deklaration handelt es sich um einen einzigartigen Text, der die philosophische und politische Übereinstimmung von Experten aus dem Bereich der Bioethik und des Biorechts aus vielen Staaten dokumentiert. Im vorliegenden Artikel soll die Barcelona-Deklaration mit einigen internationalen Dokumenten zu Bioethik und Biorecht jüngeren Datums verglichen werden. Die Autoren stellen die Deklaration in Zusammenhang mit den Richtlinien, die in verschiedenen anderen internationalen Dokumenten und Rechtsvorschriften zum Vorgehen im Bereich der Bioethik und des Biorechts vorgegeben sind. Besondere Aufmerksamkeit gilt dem Vergleich mit der Konvention zum Schutz der Menschenrechte und der Würde der Menschen im Hinblick auf die Bereiche Biologie und Medizin, die 1996 vom EU-Ministerrat verabschiedet wurde. Sodann wurde die UNESCO-Deklaration betreffend des menschlichen Genoms und der Menschenrechte aus dem Jahre 1997 näher untersucht. Die Barcelona-Deklaration präsentiert also nicht nur die in Europa angestrebten ethischen Grundsätze in Bioethik und Biorecht, sondern erläutert und artikuliert ethische Grundprinzipien, die sich weltweit im Mittelpunkt des Interesses für universale Bioethik und Biorecht befinden. The National Library of Finland and the Von Wright and Wittgenstein Archives at the University of Helsinki keep the collected correspondence of Georg Henrik von Wright, Wittgenstein’s friend and successor at Cambridge and one of the three literary executors of Wittgenstein’s Nachlass. Among von Wright’s correspondence partners, Elizabeth Anscombe and Rush Rhees are of special interest to Wittgenstein scholars as the two other trustees of the Wittgenstein papers. Thus, von Wright’s collections held in Finland promise to shed light on (...) the context of decades of editorial work that made Wittgenstein’s later philosophy available to all interested readers. In this text, we present the letters which von Wright received from Anscombe and Rhees during the first nine months after Wittgenstein’s death. This correspondence provides a vivid picture of the literary executors as persons and of their developing relationships. The presented letters are beautiful examples of what the correspondence as a whole has to offer; it depicts – besides facts of editing – the story of three philosophers, whose conversing voices unfold the human aspects of inheriting Wittgenstein’s Nachlass. The article draws a connection between three items preserved at the von Wright and Wittgenstein Archives at the University of Helsinki (WWA), namely a book by Wilhelm Busch and two copies of the photos of von Wright and Wittgenstein in Cambridge taken by Knut Erik Tranøy in 1950, by suggesting that the photos contain an allusion by Wittgenstein.

ZusammenfassungUnter den nichtlogischen Konstanten der Wissenschaftssprache werden zwei Arten unterschieden, die Beobachtungsterme und die theoretischen Terme . Die letzteren werden nicht durch Definitionen eingeführt, sondern durch Postulate zweier Arten, nämlich theoretische Postulate, zum Beispiel Grundgesetze der Physik, und Korrespondenzpostulate, die die theoretischen Terme mit Beobachtungstermen verbinden. Wie schon Hilbert gezeigt hat, können in dieser Weise sowohl die Mathematik als auch die theoretische Physik als ungedeutete Kalküle aufgestellt werden. Es wird hier kurz erklärt, dass durch diesen Aufbau auch den mathematischen Termen (...) eine Bedeutung beigelegt wird. Die theoretischen Terme erhalten durch die Korrespondenzpostulate wenigstens eine unvollständige Deutung. The latter terms are introduced, not by definitions, but by postulates of two kinds, theoretical postulates, e.g., basic laws of physics, and correspondence postulates which connect the theoretical terms with observation terms. As Hilbert has explained, both mathematics and theoretical physics can in this way be constructed in the form of uninterpreted calculi. It is here briefly indicated that by this method of construction also the mathematical terms have meanings assigned to them. The theoretical terms obtain at least an incomplete interpretation by means of the correspondence postulates. Bernays has pointed out that, in order to prove the consistency of classical number theory, it is necessary to extend Hilbert's finitary stand‐point by admitting certain abstract concepts in addition to the combinatorial concepts referring to symbols. The abstract concepts that so far have been used for this purpose are those of the constructive theory of ordinals and those of intuitionistic logic. It is shown that the concept of a computable function of finite simple type over the integers can be used instead, where no other procedures of constructing such functions are necessary except simple recursion by an integral variable and substitution of functions in each other. Philosophers often aim to demonstrate that the things we ordinarily think and say can be reconciled with our considered beliefs about the world. To this end, many philosophers try to paraphrase ordinary language claims by finding equivalent sentences that are less misleading. For instance, though we know that there is no British family that is the average one, we want to say that the average British family has 1.8 children, and we might do that by paraphrasing this claim as: there (...) are nearly twice as many British children as British families. This article aims to introduce and distinguish different paraphrase strategies, sketch their role in metaphysical debates and highlight some crucial questions that proponents of such strategies face. Moral behaviour, based on social norms, is commonly regarded as a hallmark of humans. Hitherto, humans are perceived to be the only species possessing social norms and to engage in moral behaviour. There is anecdotal evidence suggesting their presence in chimpanzees, but systematic studies are lacking. Here, we examine the evolution of human social norms and their underlying psychological mechanisms. For this, we distinguish between conventions, cultural social norms and universal social norms. We aim at exploring whether chimpanzees possess evolutionary (...) precursors of universal social norms seen in humans. Chimpanzees exhibit important preconditions for their presence and enforcement: tolerant societies, well-developed social-cognitive skills and empathetic competence. Here, we develop a theoretical framework for recognizing different functional levels of social norms and distinguish them from mere statistical behavioural regularities. Quasi social norms are found where animals behave functionally moral without having moral emotions. In proto social norms, moral emotions might be present but cannot be collectivized due to the absence of a uniquely human psychological trait, i.e. shared intentionality. Human social norms, whether they are universal or cultural, involve moral emotions and are collectivized. We will discuss behaviours in chimpanzees that represent potential evolutionary precursors of human universal social norms, with special focus on social interactions involving infants. We argue that chimpanzee infants occupy a special status within their communities and propose that tolerance towards them might represent a proto social norm. Finally, we discuss possible ways to test this theoretical framework. (shrink)

Gentzen writes in the published version of his doctoral thesis Untersuchungen über das logische Schliessen that he was able to prove the normalization theorem only for intuitionistic natural deduction, but not for classical. To cover the latter, he developed classical sequent calculus and proved a corresponding theorem, the famous cut elimination result. Its proof was organized so that a cut elimination result for an intuitionistic sequent calculus came out as a special case, namely the one in which the sequents have (...) at most one formula in the right, succedent part. Thus, there was no need for a direct proof of normalization for intuitionistic natural deduction. The only traces of such a proof in the published thesis are some convertibilities, such as when an implication introduction is followed by an implication elimination [1934–35, II.5.13]. It remained to Dag Prawitz in 1965 to work out a proof of normalization. Another, less known proof was given also in 1965 by Andres Raggio.We found in February 2005 an early handwritten version of Gentzen's thesis, with exactly the above title, but with rather different contents: Most remarkably, it contains a detailed proof of normalization for what became the standard system of natural deduction. The manuscript is located in the Paul Bernays collection at the ETH-Zurichwith the signum Hs. 974: 271. Bernays must have gotten it well before the time of his being expelled from Göttingen on the basis of the racial laws in April 1933. (shrink)

Roughly, this is the distinction between the properties that a character really possesses and the properties it fictionally possess. But despite the popularity of this distinction in realist circles, it gives rise to a number of subtle issues about which fictional realists can and do disagree. In this paper, we aim to clarify these issues and defend three related theses. One: that (...) to say that Hermione holds the property of being female is just to say that the singular proposition ⟨Hermione, being female⟩ is true according to Harry Potter. Two: that ordinary objects can hold properties insofar as propositions like ⟨Napoleon, being French⟩ can be true according to fictions like War and Peace. In the recent literature on all things metaontological, discussion of a notorious Meinongian doctrine—the thesis that some objects have no kind of being at all—has been conspicuous by its absence. And this is despite the fact that this thesis is the central element of the noneist metaphysics of Richard Routley (1980) and Graham Priest (2005). In this paper, we therefore examine the metaontological foundations of noneism, with a view to seeing exactly how the noneist's approach to ontological inquiry differs from (...) the orthodox Quinean one. We proceed by arguing that the core anti-Quinean element in noneism has routinely been misidentified: rather than concerning Quine's thesis that to be is to be the value of a variable, the real difference is that the noneist rejects what we identify as Quine's “translate-and-deflate” methodology. In rejecting this aspect of Quinean orthodoxy, the noneist is in good company: many of those who think that questions of fundamentality should be the proper focus of ontological inquiry can be read as rejecting it too. Accordingly, we then examine the differences between the noneist's conception of ontology and that offered by the fundamentalist. We argue that these two anti-Quinean approaches differ in terms of their respective conceptions of the theoretical role associated with the notion of being. And the contrast that emerges between them is, in the end, an explanatory one. (shrink)

Labeling, Recovering and Reactivating: The Role of Labels on Microscope Slides in the Finding System on the Basis of Alzheimer's Auguste D. Preparations. This study discusses the role of labels in the process of the reactivation of preparations. Labels on slides together with corresponding lists on cards or sheets build what is here called a specific finding system. In the sciences of the archive the disciplinary memory together with such a finding system are the basis to the ability of the (...) sciences today to reactivate preparations from the beginning of the last century as it occurs with the Auguste D. preparations. The case of Alzheimer's micropreparations of brain parts of Auguste D. – the case that he used to show that hers was a specific brain disease unknown before – serves to describe Alzheimer's writing on the labels. It is compared to slides and labels prepared by other medical researchers between the 1890s and 1920s and the respective finding systems. Being an epistemologicum, micropreparations, as they are data, in their hybrid status of both image and material in one, cross the boundaries between icon and index. This is proven by the reactivation of Auguste D. micropreparations in molecular biological studies over 100 years after their production. (shrink)

The author relates symbolic logic to computer science by introducing each logical principle by a truth table, flow chart, and algorithm. He emphasizes the connections between logic and the different subjects through over two hundred word (...) problems that relate to the different areas. Following a strategic plan that avoids intimidating students, the author introduces each new principle one at a time with a set of twenty exercises that require the use of that principle. He introduces the next principle with exercises that require the use of the new principle and the principles previously studied, gradually building on the knowledge of the student until he or she has a thorough understanding of symbolic logic.
