In this paper we explore the connections between ethics and decision theory. In particular, we consider the question of whether decision theory carries with it a bias towards consequentialist ethical theories. We argue that there are plausible versions of the other ethical theories that can be accommodated by “standard” decision theory, but there are also variations of these ethical theories that are less easily accommodated. So while “standard” decision theory is not exclusively consequentialist, it is not necessarily ethically neutral. Moreover, (...) even if our decision-theoretic models get the right answers vis-`a-vis morally correct action, the question remains as to whether the motivation for the non-consequentialist theories and the psychological processes of the agents who subscribe to those ethical theories are lost or poorly represented in the resulting models. Clinical delusions are difficult to investigate in the laboratory because they co-occur with other symptoms and with intellectual impairment. Partly for these reasons, researchers have recently begun to use hypnosis with neurologically intact people in order to model clinical delusions. In this paper we describe striking analogies between the behavior of patients with a clinical delusion of mirrored self misidentification, and the behavior of highly hypnotizable subjects who receive a hypnotic suggestion to see a stranger when they look in (...) the mirror. Based on these analogies, we argue that the use of hypnosis is a reliable method to investigate the surface features of clinical delusions. But to what extent can hypnosis successfully recreate delusions? Can it also contribute to a better understanding of delusion formation? Although clinical delusions and hypnotically induced beliefs are different in etiology, some analogies can be identified in the underlying processes that characterise them, based on the two-factor theory of delusion formation. This article presents a computational model of the learning of diagnostic knowledge, based on observations of human operators engaged in real-world troubleshooting tasks. We present a model of problem solving and learning in which the reasoner introspects about its own performance on the problem-solving task, identifies what it needs to learn to improve its performance, formulates learning goals to acquire the required knowledge, and pursues its learning goals using multiple learning strategies. The model is implemented in a (...) computer system which provides a case study based on observations of troubleshooting operators and protocol analysis of the data gathered in the test area of an operational electronics manufacturing plant. The model not only addresses issues in human learning, but, in addition, is computationally justified as a uniform, extensible framework for multistrategy learning. (shrink)

This study investigates the pattern of institutional shareholding in the U.K. and its relationship with socially responsible behavior by companies within a sample of over 500 UK companies. We estimate a set of ownership models that distinguish between long- and short-term investors and their largest components and which incorporate both aggregated and disaggregated measures of corporate social performance (CSP). The results suggest that long-term institutional investment is positively related to CSP providing further support for earlier studies by Johnson and Greening (...) (1999, Academy of Management Journal 42, 564–576) and Graves and Waddock (1994, Academy of Management Journal 37, 1034–1046). Disaggregation of CSP into its constituent components suggests that the pattern of institutional investment is also related to the form which CSP takes. Investigation of the impact of investment screens on the selection of stocks suggests that long-term institutional investors select primarily through exclusion, rejecting those firms which have the worst CSP. Folie à deux is the transference of delusional ideas from one 'primary' individual to one or more 'secondary' individuals (Lasègue & Falret, 1877). However, it is difficult to investigate experimentally because often only one patient is identified as delusional. We investigated whether hypnosis could model the experiences of the secondary in this delusion. Our primary was a confederate, who displayed two delusional beliefs and attempted to transmit them to hypnotised subjects. We manipulated the status of the confederate so that (...) they were portrayed as either "credible" or merely "interesting". Many high hypnotisable individuals adopted the confederate's beliefs and confabulated evidence in support of them. Also, subjects who interacted with a credible confederate extended their delusions beyond those displayed by the confederate. We discuss the strengths and limitations of this approach and suggest ways to improve the validity of this model. (shrink)

Currently no classification approaches exist in order to identify and evaluate this type of manipulation. Therefore, this article will discuss this type of manipulative communication and align each category into an assessment model. Forty-two varieties of manipulative arguments will be identified as well as classified along three-dimensions. In a recent response to our paper on developing a philosophical framework to guide the design and delivery of a just health service, Sarela raises several objections. We feel that although Sarela makes points which are worthy of discussion, his critique does not undermine either the need for, or the worth of, our proposed model. First, the law does not negate the need for ethics in determining just healthcare policy. Reliance on legal processes can drive inappropriate focus on ensuring (...) policies avoid judicial review, as opposed to ensuring they are truly just; the law affords protection against unjust policies but does not put a commitment to avoiding them at the heart of policy-making. We defend the need for Scanlonian supplementation by emphasising the practical value of adding a step based on reasonable rejection, particularly in ensuring that the views of vulnerable stakeholders are robustly considered. We discuss the similarities and differences between the work of Daniels and Sen in considering the relationship between health and opportunity, concluding that Sen’s capability approach is both valuable and compatible with our proposed model. Finally, the practical use of our model requires consideration of what constitutes a reasonable person. Our model is explicitly intended to help develop a healthcare system which is just to all its users. With this in mind, we suggest that those involved in decision-making should meet Scanlon’s definition of reasonable: they should be motivated to justify their actions to, and seek agreement with, others. We consider models of forcing axioms $MA(\Gamma)$ which also have a normal ideal $I$ with completeness $\omega_{2}$ such that $\mathbb{P}_{I}\in \Gamma$ . Using a bit more than a superhuge cardinal, we produce a model of PFA (proper forcing axiom) which has many ideals on $\omega_{2}$ whose associated forcings are proper; a similar phenomenon is also observed in the standard model of $MA^{+\omega_{1}}(\sigma\mbox{-closed})$ obtained from a (...) supercompact cardinal. Our model of PFA also exhibits weaker versions of ideal properties, which were shown by Foreman and Magidor to be inconsistent with PFA. Along the way, we also show (1) the diagonal reflection principle for internally club sets ( $\mathit{DRP}(IC_{\omega_{1}})$ ) introduced by the author in earlier work is equivalent to a natural weakening of “there is an ideal $I$ such that $\mathbb{P}_{I}$ is proper”; and (2) for many natural classes $\Gamma$ of posets, $MA^{+\omega_{1}}(\Gamma)$ is equivalent to an apparently stronger version which we call $MA^{+\operatorname{Diag}}(\Gamma)$. The author has collaborated in research teams to visualize supercomputer simulations and real-time data. She describes these collaborative projects that employ advanced-technology graphics and novel digital displays that include large-format IMAX film, high-definition television productions, and a museum digital dome at the American Museum of Natural History. The popularity of these images and the function that they provide in popular culture are discussed. She also describes two key technologies that she was part of designing: IntelliBadge(tm), a real-time visualization and ‘smart’ (...) tracking system; and Virtual Director(tm), a virtual camera choreography and remote collaboration system. The process of data-visualization involves the mapping of data from numerical form into an iconic representational form in the attempt to provide humans with insight and understanding of a phenomenon. This is discussed in the context of metaphor, cognition, and postcolonial theory. Because data-visualizations carry the ‘weight of scientific accuracy and advanced technology’, most general audiences confuse these visualizations as ‘real’; however, it is argued that data-visualizations are models and metaphors, not reality. In metaphor theory, the mapping of attributes from one domain of information into another is how humans understand, create, and engender new meaning. Data mapping is correlated with this theory. The author explores how the use of mapping information is culturally contingent. In the spirit of scientific inquiry, she deconstructs the very professional activity for which she is most famous. The relationship between the structural identity of narrative and the truth claim of the historical narrative work is one of importance to Ricœur. He considers the attempts of two interwoven models of history emerging from analytic philosophy—explanatory and narrative—to articulate this relationship. This paper explores the trajectories of these models as well as the epistemological and ontological crises culminating from the “simple” theses of each model. The solution to these crises requires a more complex method to account for the (...) nature of the connections underlying historical understanding. Georg Henrik von Wright’s provisional or “hybrid” model of explanation and understanding revises the simple explanatory model and is foundational for Ricœur’s own complex revision of narrativist models through his notion of questioning back. The present paper argues that the structure of this hybrid model was unsatisfactory for von Wright, and leads in the direction of Ricœur’s own narrative method. A theory of two-sided containers, denoted ZF2, is introduced. This theory is then shown to be synonymous to ZF in the sense of Visser (2006), via an interpretation involving Quine pairs. Several subtheories of ZF2, and their relationships with ZF, are also examined. We include a short discussion of permutation models (in the sense of Rieger–Bernays) over ZF2. We close with highlighting some areas for future research, mostly motivated by the need to understand non-wellfounded games.

Models of recognition memory have traditionally struggled with the puzzle of criterion setting, a problem that is particularly acute in cases in which items for study and test are of widely varying types, with differing degrees of baseline familiarity and experience (e.g., words vs. random dot patterns). We present a dynamic model of the recognition process that addresses the criterion setting problem and produces joint predictions for choice and reaction time. In this model, recognition decisions are based not (...) on the absolute value of familiarity, but on how familiarity changes over time as features are sampled from the test item. Decisions are the outcome of a race between two parallel accumulators: one that accumulates positive changes in familiarity (leading to an ‘‘old’’ decision) and another that accumulates negative changes (leading to a ‘‘new’’ decision). Simulations with this model make realistic predictions for recognition performance and latency regardless of the baseline familiarity of study and test items. (shrink)

While it is widely held that normative reflection is an effective means of controlling our emotions, it has proven to be notoriously difficult to provide a plausible model of such control. How could reflection on the normative status of our emotions be a means of controlling them? Higher-order models of reflective control give a special role to higher-order beliefs and judgments about the normative status of our emotions in controlling our emotions, but in doing so claim that higher-order beliefs (...) and judgments have more control over our emotional lives than they in fact have, and fail to explain some of the central features of reflective control. First-order models of reflective control give a special role to first-order evaluative beliefs and perceptions about the objects of our emotions in controlling our emotions, but in doing so fail to explain how normative reflection could be a distinctive means of controlling our emotions at all. In this essay, I defend a model of reflective control which avoids the twin pitfalls of the higher-order and first-order models of reflective control, while learning from them both. I defend a model according to which normative reflection is a means of bringing our emotions under the control of reflective reason, where an emotion’s being under the control of reflective reason is to be understood in terms of its being under the control of one’s first-order evaluative beliefs and perceptions in accordance with one’s reflective commitments. Hilary Putnam's famous model-theoretic arguments have the virtue of presenting metaphysical realists with a clear challenge. On pain of embracing either an implausible antifallibilism or the radical indeterminacy of reference, metaphysical realists must appeal to metalinguistic levels of interpretation richer than our own in order to fix meaning. And sense must be made of this appeal. In this paper I begin the task of developing a version of metaphysical realism that takes up this challenge.

No fruitful discussion of the logic of religious belief can afford to ignore George Mavrodes' classification of propositional concepts, i.e. concepts predicable of propositions singly or in sets , as an analytical tool for pinning down the ‘person-oriented’ and ‘content-oriented’ factors in such ‘epistemic activities’ as religious proving, experiencing, and verifying. Mavrodes shows in particular that the formal model of logical soundness, i.e. valid form and true premises, has but limited application to proving, experiencing, and verifying as ways of (...) giving good reasons for religious belief. In this essay, I will show how Mavrodes' analysis of the logic of religious belief can be extended by substituting a procedural model of logical soundness for the truth-functionally formal model that he adopts. I will show further why it is desirable and, in certain instances, vital to extend his analysis in this manner. Along the way, I will explain why the extension that I am advocating augments Mavrodes' original analysis without substantially altering it or sacrificing any of its original analytical virtues. The multiple activities of the RecA protein in DNA metabolism have inspired over a decade of research in dozens of laboratories around the world. This effort has nevertheless failed to yield an understanding of the mechanism of several RecA protein‐mediated processes, the DNA strand exchange reactions prominent among them. The major factors impeding progress are the invalid constraints placed upon the problem by attempting to understand RecA protein‐mediated DNA strand exchange within the context of an inappropriate biological paradigm – namely, (...) homologous genetic recombination as a mechanism for generating genetic diversity. In this essay I summarize genetic and biochemical data demonstrating that RecA protein evolved as the central component of a recombinational DNA repair system, with the generation of genetic diversity being a sometimes useful byproduct, and review the major in vitro activities of RecA protein from a repair perspective. While models proposed for both recombination and recombinational repair often make use of DNA strand cleavage and transfer steps that appear to be quite similar, the molecular and thermodynamic requirements of the two processes are very different. The recombinational repair function provides a much more logical and informative framework for thinking about the biochemical properties of RecA and the strand exchange reactions it facilitates. The central problem of this dissertation arises from reflecting on Euthyphro’s often neglected final attempt to define piety and the discussion (elenchos) that follows. He claims that piety is knowledge of how to give to the gods what is pleasing in prayer and sacrifice. Socrates, without much argument, reduces Euthyphro’s answer to his earlier, already refuted one – that piety is what is dear to the gods – inviting the question of whether this is all the elenchos is meant to (...) accomplish. If it is not, we should expect to find its purpose in the brief discussion that falls between Euthyphro’s definition and the final reduction of this definition to its predecessor. At the center of this discussion Socrates compares Euthyphronic piety to commerce. This comparison has classically been interpreted as showing Euthyphro’s definition to imply that humans can benefit gods, and since Euthyphro has elsewhere rejected this idea, his definition is refuted by contradiction. But this strands the reduction withoutpurpose, and scrutiny of the text suggests this is not the correct way to interpret the inference structure of this intervening discussion. In this dissertation I argue for two main theses: (i) the disambiguation thesis, which claims that the comparison to commerce is not the philosophical point of the elenchos, and does not result in the refutation of Euthyphro’s definition. It is instead intended to elicit which of two possible models of piety Euthyphro means to describe, the language of his definition being equivocal in at least one important respect, namely whether or not a met need necessarily confers a benefit upon the recipient; (ii) the translation thesis, which claims that there are some important observations to be made about the Greek of Euthyphro’s definition, observations that will make the dis- ambiguation thesis more plausible, and which are obscured by traditional translations of the passage under discussion. These observations concern kecharismena, a word often translated as ‘pleasing’, but is better understood as denoting a broad set of social and religious norms, and for which there is no simple English equivalent. Together, these two theses allow us to see that the main philosophical lesson of the last elenchos is that Euthyphro’s account of piety as ritual is an application of his more famous third attempt to define piety voluntaristically, and that any philosophical concerns over the last definition are consequences of it being an extension of the third one. This is why Plato puts the two side-by-side to close the dialogue, and we are kept from seeing this clearly when we take the comparison to commerce to be accomplishing the main work of the elenchos, rather than as clarifying Euthyphro’s answer so that its conceptual similarities to the previous answer are plainly visible. I conclude the project by defending the venerable view that Socratic piety is service to the gods instantiated by rational inquiry, and show how this model of piety is the antithesis to, and moral remedy for, Euthyphronic piety. We initially describe a feature-rich discriminative Conditional Random Field (CRF) model for Information Extraction in the workshop announcements domain, which offers good baseline performance in the PASCAL shared task. We then propose a method for leveraging domain knowledge in Information Extraction tasks, scoring candidate document labellings as one-value-per-field templates according to domain feasibility after generating sample labellings from a trained sequence classifier. Our relational models evaluate these templates according to our intuitions about agreement in the domain: workshop acronyms should (...) resemble their names, workshop dates occur after paper submission dates. These methods see a 5% f-score improvement in fields retrieved when sampling labellings from a Maximum-Entropy Markov Model, however we do not observe improvement over a CRF model. We discuss reasons for this, including the problem of recovering all field instances from a best template, and propose future work in adapting such a model to the CRF, a better standalone system. We can conceive of peace in many different ways, and these differences are related to a variety of assumptions and practices we can adopt in our culture. This book is about those differences. Part I describes the ways in which we usually talk about peace. It argues that our conception is fundamentally obscure. We do not know what peace is and we do not know how to promote it. Part II develops an explanation of how peace has been obscured. It (...) has been obscured by a network of beliefs and institutions in our culture. Part III critically evaluates some key parts of this cultural web and argues that there is an alternative cluster of assumptions and practices which we ought to adopt. It is a cluster which is intrinsically better—regardless of whatever it may imply about peace. Part IV argues that it happens to imply that we should think of peace as an activity—a practice we can cultivate at high levels of excellent performance. It draws on Gandhian satyagraha, Quaker process and practices of "principled negotiation" using the Harvard model to illustrate. (shrink)

This study examines the extent to which corporate responsibility influences the demand for shares by institutions. The study follows Bushee (Account Rev 73(3):305–333, 1998 ) in categorising institutions as dedicated or transient. The demand for shares is organised according to three factors: a long-term factor, corporate responsibility; a short-term factor, market liquidity; and a time-independent factor, portfolio theory. The rank and importance of the factors for the different types of institutional investor are analysed. For one of two types of dedicated (...) institution, corporate responsibility is as important as portfolio theory in influencing the demand for shares. For all dedicated institutions, corporate responsibility influences the demand for shares more than market liquidity. For two of the three types of transient institution, market liquidity is the most important factor in share selection. For all transient institutions, the least important factor is corporate responsibility. Findings suggest that corporate responsibility positively and significantly influences the demand for shares by dedicated institutions. The discussion considers the extent to which these trends are constitutive of significant shifts in ethicality within the context of institutional investment. Looking at this from within a highly institutionalised Anglo market model, dedicated institutions’ commitment to broader and longer-term concerns could be interpreted as a small but significant step towards a more axiologically informed ethical business practice. Such a form of engagement calls for sensitive attention to a fuller range of features deemed to be relevant to investment decisions, as opposed to more narrow reliance on legislation, codes of practice and fiduciary principles. Research highlights several risk and resilience factors at multiple ecological levels that influence individuals’ mental health and wellbeing in their everyday lives and, more specifically, in disaster or outbreak situations. However, there is limited research on the role of these factors in the early days of the COVID-19 crisis. The present study examined if and how potential risk factors and resilience factors are associated with mental health and well-being outcomes, and whether these resilience factors buffer the associations between risk factors (...) and said outcomes. One to two weeks after the government recommended preventative measures, 1,122 Canadian workers completed an online questionnaire, including multiple wellbeing outcome scales in addition to measures of potential risk and resilience factors. Structural equation models were tested, highlighting that overall, the considered risk factors were associated with poorer wellbeing outcomes, except social distancing which was associated with lower levels of stress. Each of the potential resilience factors was found to have a main effect on one or more of the wellbeing outcomes. Moderation analysis indicated that in general these resilience factors did not, however, buffer the risk factors. The findings confirm that the COVID-19 crisis encompasses several stressors related to the virus as well as to its impact on one’s social, occupational, and financial situation, which put people at risk for lower wellbeing as early as one to two weeks after the crisis began. While several resilience factors emerged as positively related to wellbeing, such factors may not be enough, or sufficiently activated at that time, to buffer the effects of the numerous life changes required by COVID-19. From an ecological perspective, while mental health professionals and public health decision-makers should offer/design services directly focused on mental health and wellbeing, it is important they go beyond celebrating individuals’ inner potential for resilience, and also support individuals in activating their environmental resources during a pandemic. The overall goal of the approach developed in this paper is to estimate the likelihood of a given kinetic kill scenario between hostile spacebased adversaries using the mathematical framework of Complex Conceptual Spaces Single Observation. Conceptual spaces are a cognitive model that provide a method for systematically and automatically mimicking human decision making. For accurate decisions to be made, the fusion of both hard and soft data into a single decision framework is required. This presents several challenges to this (...) data fusion framework. The first is the challenge involved in handling multiple complex terminologies, which is addressed by drawing on a set of Space Domain Ontologies. Another challenge is the complex combinatorics involved when considering all possible feature combinations. This can be mitigated by using integer linear programming optimization that is outlined by the Complex Conceptual Spaces Single Observation mathematical model framework. A third challenge is the complicated physics that is involved in a spacecraft collision that must be addressed to obtain a better understanding of threat assessment. Overcoming these various challenges allows for a quantitative ranking for the potential of a kinetic kill collision across multiple spacecraft pairs. In addition to overcoming these challenges this paper will break down threat assessment into four domains and identify a ranking of threat both for each individual domain and for the four domains combined. PURPOSE: To evaluate the effects of social support on comprehension and recall of consent form information in a study of Parkinson disease patients and their caregivers.DESIGN and METHODS: Comparison of comprehension and recall outcomes among participants who read and signed the consent form accompanied by a family member/friend versus those of participants who read and signed the consent form unaccompanied. Comprehension and recall of consent form information were measured at one week and one month respectively, using Part A of the (...) Quality of Informed Consent Questionnaire .RESULTS: The mean age of the sample of 143 participants was 71 years . Analysis of covariance was used to compare QuIC scores between the intervention group and control group . In the 1-week model, no statistically significant intervention effect was found . However, the intervention status by patient status interaction was statistically significant . In the 1-month model, no statistically significant intervention effect was found . Again, however, the intervention status by patient status interaction was statistically significant . At both time periods, intervention group patients scored higher on the QuIC than did intervention group caregivers, and control group patients scored lower on the QuIC than did control group caregivers.IMPLICATIONS: Social support played a significant role in enhancing comprehension and recall of consent form information among patients. This paper describes an AFOSR-supported basic research program that focuses on developing a new framework for combining hard with soft data in order to improve space situational awareness. The goal is to provide, in an automatic and near real-time fashion, a ranking of possible threats to blue assets (assets trying to be protected) from red assets (assets with hostile intentions). The approach is based on Conceptual Spaces models, which combine features from traditional associative and symbolic cognitive models. While Conceptual Spaces (...) are revolutionary, they lack an underlying mathematical framework. Several such frameworks have attempted to represent Conceptual Spaces, but by far the most robust is the model developed by Holender. His model utilizes integer linear programming in order to obtain an overall similarity value between observations and concepts that support the formation of hypotheses. This paper will describe a method for building Conceptual Spaces models for threats that utilizes ontologies as a means to provide a clear semantic foundation for this inferencing process; in particular threat ontologies and space domain ontologies are developed and employed in this approach. A space situational awareness use-case is presented involving a kinetic kill scenario and results are shown to assess the performance of this fusion-based inferencing framework. (shrink)

Gender Dysphoria in Children and Controversies about its Treatment: Two Different Conceptions of Gender Identity Disforia de gênero em crianças e controvérsias em seu tratamento: duas concepções diferentes sobre a identidade de gênero Gender dysphoria is a marked mismatch between the sex felt or expressed by an individual and that assigned to them at birth. It is associated with clinically significant discomfort or social impairment and can occur in children, adolescents, and adults. The literature mainly describes three approaches for preadolescents: (...) therapeutic model, watchful waiting, and gender affirmative model. However, there is currently no consensus on its treatment nor any evidence that favors one approach over another. This paper provides a brief review of the existing literature on gender dysphoria, explains various approaches for children, and discusses the anthropological views behind them. We argue that at least two ways of understanding gender identity have given rise to disagreements over the proposed treatments. It is quite important to comprehend the anthropological assumptions on which these models are based since they underlie different conceptions of the person’s sex-gender relationship and, therefore, the role of corporality and self-awareness in gender identity. Mirrored-self misidentification is the delusional belief that one's own reflection in the mirror is a stranger. In two experiments, we tested the ability of hypnotic suggestion to model this condition. In Experiment 1, we compared two suggestions based on either the delusion's surface features (seeing a stranger in the mirror) or underlying processes (impaired face processing). Fifty-two high hypnotisable participants received one of these suggestions either with hypnosis or without in a wake control. In Experiment 2, we examined the (...) extent to which social cues and role-playing could account for participants' behaviour by comparing the responses of 14 hypnotised participants to the suggestion for impaired face processing (reals) with those of 14 nonhypnotised participants instructed to fake their responses (simulators). Overall, results from both experiments confirm that we can use hypnotic suggestion to produce a compelling analogue of mirrored-self misidentification that cannot simply be attributed to social cues or role-playing. Strengths, Opportunities, Aspirations, and Results is a strengths-based framework for strategic thinking, planning, conversations, and leading that focuses on strengths, opportunities, aspirations, and results. The SOAR framework leverages and integrates Appreciative Inquiry to create a transformation process through generative questions and positive framing. While SOAR has been used by practitioners since 2000 as a framework for generating positive organizational change, its use in empirical research has been limited by the absence of reliable and valid measures. We report on the reliability, (...) construct validity, and measurement invariance of the SOAR Scale, a 12-item self-report survey organized into four first-order factors. Data from a sample of 285 U.S. professionals were analyzed in Mplus using confirmatory factor analysis and exploratory structural equation modeling. The Four-Factor first-order exploratory structure equation modeling had the best model fit. Measurement invariance tests found the scalar invariance of the SOAR Scale across gender and education groups. Implications are discussed for using the SOAR Scale to build resilience at the individual, the team, and the organizational levels. (shrink)

Tench Coxe, a member of the second rank of this nation's Founders and a leading proponent of the Constitution and the Bill of Rights, wrote prolifically about the right to keep and bear arms. In this Article, the authors trace Coxe's story, from his early writings in support of the Constitution, through his years of public service, to his political writings in opposition to the presidential campaigns of John Adams and John Quincy Adams. The authors note that Coxe described the (...) Second Amendment as guaranteeing an individual right, and believed that an individual right to bear arms was necessary for self-defense and hunting, as well as for militia purposes and protection against oppression by large standing armies. The views of this important Founding Era political commentator and public servant inform the ongoing Second Amendment debate. The authors argue that Coxe's depiction of an individual right to bear arms encompassing hunting, self-defense, and the public militia power supports the "Standard Model" of the Second Amendment prevalent in the legal literature. This Article also discusses Coxe's important role as an economic scholar in early America, and in the creation of the protectionist system of the early Republic, as both an journalistic advocate and as an executive branch official. One of his executive branch positions involved heading the federal government program to give guns to militiamen who could not afford their own. (shrink)

Case-cohort design is a biased sampling method. Due to its cost-effective and theoretical significance, this design has extensive application value in many large cohort studies. The case-cohort data includes a subcohort sampled randomly from the entire cohort and all the failed subjects outside the subcohort. In this paper, the adjustment for the distorted covariates is considered to case-cohort data in Cox’s model. According to the existing adjustable methods of distorted covariates for linear and nonlinear models, we propose estimating the (...) distorting functions by nonparametrically regressing the distorted covariates on the distorting factors; then, the estimators for the parameters are obtained using the estimated covariates. The proof of consistency and being asymptotically normal is completed. For calculating the maximum likelihood estimates of the regression coefficients subject in Cox’s model, a minorization-maximization algorithm is developed. Simulation studies are performed to compare the estimations with the covariates undistorted, distorted, and adjusted to illustrate the proposed methods. (shrink)

Cox and Fritz state the central problem as the absence of a framework for healthcare policy decisions; but, they overlook the theoretical underpinnings of public law. In response, they propose a two-step procedure to guide fair decision-making. The first step relies on Thomas Scanlon’s ‘contractualism’ for stakeholders to consider whether, or not, they could reasonably reject policy proposals made by others; then in the second step, John Rawls’s principles of justice are applied to these proposals; a fair policy requires to (...) pass both steps. I argue that Cox and Fritz misinterpret Rawls. His theory has two stages: first, public reason is used to generate principles of justice; second, public reason is used to interpret and apply these principles. The second stage requires that proposals are based on the principles of justice from the first stage, and these proposals have to be acceptable to reasonable persons. Thus, Rawls’s theory does not need Scanlonian supplementation. Moreover, the application of Rawls’s theory in Cox and Fritz’s model is confusing. In any case, the problems with applying Rawlsian justice to healthcare can be located elsewhere. First, Rawls’s theory would treat healthcare simply as a ‘primary good’ or resource. Social justice ought to, instead, consider healthcare as an opportunity, in the manner conceived by Amartya Sen. Second, Rawlsian justice rests, ultimately, on the conception of a reasonable person; until and unless the characteristics of reasonable stakeholders are clarified, any model of health justice will remain hostage to the unreasonable. This essay considers whether the model of conscience operative in Christian ethics, what I call the “reflexive conscience,” is adequate to meet the global moral challenges we face today, problems such as gun violence, climate change, and the Zika virus. Drawing primarily on the work of Willis Jenkins, I argue that conscience has not yet caught up to the scale and interconnectedness of our global moral challenges. A truly “engaged conscience” must be focused not primarily on the self but (...) on the other, and must be active. I conclude by turning to Elisabeth Vasko’s criticisms of the victim/perpetrator binary to suggest that conscience must call us to greater responsibility for the systemic injustices in which particular moral challenges are embedded.
