This article provides an ethical analysis of the U.S. practice guideline update on disorders of consciousness. Our analysis focuses on the guideline’s recommendations regarding the use of investigational neuroimaging methods to assess brain‐injured patients. Complex and multifaceted ethical issues have emerged because these methods alter the clinical understanding of consciousness. We address issues of false hope, patient suffering, and cost. We argue that, in spite of these concerns, there is significant benefit to using neuroimaging to assess brain‐injured patients in most (...) cases. (shrink)

This commentary critically examines a recent qualitative study, published in this issue of Neuroethics, on the attitudes of family caregivers toward evidence of covert consciousness in brain-injured patients.

:In this paper, the author argues that Joseph Fins’ mosaic decisionmaking model for brain-injured patients is untenable. He supports this claim by identifying three problems with mosaic decisionmaking. First, that it is unclear whether a mosaic is a conceptually adequate metaphor for a decisionmaking process that is intended to promote patient autonomy. Second, that the proposed legal framework for mosaic decisionmaking is inappropriate. Third, that it is unclear how we ought to select patients for participation in mosaic decisionmaking.

This paper develops a novel defense of the non-sensory phenomenology of desires, and more broadly, of attitudes. I argue that the way to defend this type of phenomenology is to: offer a defense of the view that attitudes are states that realize the causal role of attitude types and argue that what realizes the causal role of attitudes are, in certain cases, states that possess non-sensory phenomenology. I carry out this approach with respect to desires by developing the view that (...) desires play the causal role of motivating action, and in some cases, the states that play this role are states that possess the non-sensory phenomenology of attraction. I proceed to argue that if this way of defending the non-sensory phenomenology of desires, and more broadly, of attitudes, is unsuccessful, we should be eliminativists about this type of phenomenology. Severe brain injury is a leading cause of death and disability. Following severe brain injury diagnosis is difficult and errors frequently occur. Recent findings in clinical neuroscience may offer a solution. Neuroimaging has been used to detect preserved cognitive function and awareness in some patients clinically diagnosed as being in a vegetative state. Remarkably, neuroimaging has also been used to communicate with some vegetative patients through a series of yes/no questions. Some have speculated that, one day, this method may allow (...) severely brain-injured patients to make medical decisions. Yet, skepticism is rife, due in part to the inherent difficulty of assessing decision-making capacity through neuroimaging communication. In this thesis, I provide the first systematic analysis of this problem. I present and defend a strategy for assessing decision-making capacity in brain-injured patients who can only communicate through neuroimaging. (shrink)

In his account of epistēmē, the highest level of understanding attainable in philosophical inquiry, Aristotle articulates standards for the ideal explanations that confer this level of understanding. I argue that Aristotle's key standard for epistēmē is of central importance for the biological homology concept. The explanatory shortcoming that results from violating this standard has been vaguely articulated in recent literature on homology; Aristotle's account offers a more neutral and precise formulation of the shortcoming and its antidote. Further, the risk for (...) this shortcoming has heightened with recent accounts of homology grounded in genetics, increasing the contemporary relevance of Aristotelian epistēmē. (shrink)

The balance (...) between benefits and detriments of the independence requirements, and standards that are difficult to articulate and enforce. The implications for the continued value of independent assurance emerging from the evolution in Big Data tools and analytics, including the structural constraints of regulation. Construing all efficient causes as beginning and ceasing with their effects invites the dilemma that a given effect or event either always occurs or neveroccurs. One escapes the dilemma by distinguishing basic and subsidiary efficient causes, according temporal priority of causes to their effects in the case of theformer. In the case of human making and doing, where the two efficient causes belong to the same subject, the two are supplemented by a final cause whichserves to link or to mediate (...) them. This it does by drawing out or actuating the subsidiary cause which exists potentially in the basic cause. Arguing from analogy,can it be argued that, just when basic and subsidiary efficient causes belong to the same non-human subject in nature, they must likewise be supplemented byfinal causes if the potentiality of subsidiary causes in basic causes is to be drawn out and made actual? Surprising though it might seem to some, the answer tothis question is yes. To show this, I first place efficient causes in a dilemma. Next I show how one escapes the dilemma by distinguishing basic and subsidiary efficient causes, making the former temporally precede the latter. These two causes in some cases need to be linked, and this, I argue, requires a cause of another type, a final cause. (shrink)

Cet article se veut une critique de la thèse défendue par [Cleland 1993], laquelle soutient que la thèse de Church doit être rejetée puisque les limites du calcul dépendent de la structure physique du monde. Dans un premier temps, nous offrons un bref aperçu de la thèse de Church puis nous présentons l argument de Cleland. Par la suite, nous proposons une analyse critique de son argument, ce qui nous amènera à faire quelques distinctions conceptuelles par rapport aux notions qui (...) concernent la calculabilité. Finalement, nous montrons que les limites du calcul ne sont pas physiques mais bien logiques. En résumé, notre argument est que les limites du calcul sont déterminées en partie par le fait qu’une procédure effective doit pouvoir être décrite de manière finie.Even though Church’s thesis is widely accepted among mathematicians, it is nonetheless controversial. In this paper, we argue against the position of [Cleland 1993], which defends that Church s thesis must be rejected because the limits of computation depend upon the physical structure of the world. We first give a brief overview of Church’s thesis and then we present Cleland s argument. We then propose a critical analysis of Cleland s argu­ment, which will involve some conceptual distinctions regarding the notion of computability, and finally we will show that the limits of computation are not physical but logical. In short, we argue that computation is limited by the fact that an effective procedure must be described in a finite way. (shrink)

Holism in metaphysics can be defended because it can solve a dilemma about error: that the object of one’s wrong judgment is either inside or outside one’s mind and that neither alternative can be the case. Among holists the American philosopher Josiah Royce provides the best account of both the dilemma and its holist answer. The latter consists in steering between the hard and fast difference of being inside and outside the mind that sparks the dilemma. Royce does this by (...) identifying a unity in the difference, which then ceases to be a stark division and becomes instead a unity-in-difference. I then show how a related dilemma is susceptible to this sort of holist solution. Yet the holist answer to these dilemmas invites all the stock objections to holism. These include the obliteration of finite selves and the distinction between such selves and their experiences. Answering these objections calls for an alternative that uses Royce’s ploy of synthesizing the extremes of being inside and being outside the mind. This sort of realism gets between the horns of the dilemmas via the real and intentional modes of forms. (shrink)

Introductions and Histories: How, When, and Where of Race in Philosophy Africana Philosophy has successfully argued itself to be an important area of philosophical discourse. Fundamental to this effort is Africana Philosophy's work to bring race, race thinking, and racism to the fore of philosophical examination. In the wake of Africana Philosophy's influence, discussions of race, race thinking, and racism are becoming central to regular philosophical discourse. The production of introductory works on race and philosophy and works examining the place (...) of race and race thinking in the history of European canonical philosophy points to philosophy's growing self awareness of race as foundational to what philosophy as a body of knowledge is and its self awareness of how race and race thinking informed the development of the field. These types of texts contribute to the normalization of race as a subfield of philosophy. Specifically, this essay will analyze four contemporary texts that exemplify this trend and what they contribute to mainstream philosophy's evolution as a site that understands race and race's role as a part of human experience and a necessary part of the larger philosophical project. People are motivated by shared social values that, when held with moral conviction, can serve as compelling mandates capable of facilitating support for ideological violence. The current study examined this dark side of morality by identifying specific cognitive and neural mechanisms associated with beliefs about the appropriateness of sociopolitical violence, and determining the extent to which the engagement of these mechanisms was predicted by moral convictions. Participants reported their moral convictions about a variety of sociopolitical issues prior to undergoing functional (...) MRI scanning. During scanning, they were asked to evaluate the appropriateness of violent protests that were ostensibly congruent or incongruent with their views about sociopolitical issues. Complementary univariate and multivariate analytical strategies comparing neural responses to congruent and incongruent violence identified neural mechanisms implicated in processing salience and in the encoding of subjective value. As predicted, neuro-hemodynamic response was modulated parametrically by individuals’ beliefs about the appropriateness of congruent relative to incongruent sociopolitical violence in ventromedial prefrontal cortex, and by moral conviction in ventral striatum. Overall moral conviction was predicted by neural response to congruent relative to incongruent violence in amygdala. Together, these findings indicate that moral conviction about sociopolitical issues serves to increase their subjective value, overriding natural aversion to interpersonal harm. (shrink)
