Nicholas of Cusa (1401-1464) was active during the Renaissance, developing adventurous ideas even while serving as a churchman. The religious issues with which he engaged - spiritual, apocalyptic and institutional - were to play out in the Reformation. These essays reflect the interests of Cusanus but also those of Gerald Christianson, who has studied church history, the Renaissance and the Reformation. The book places Nicholas into his times but also looks at his later reception. The first part addresses institutional (...) issues, including Schism, conciliarism, indulgences and the possibility of dialogue with Muslims. This article discusses the disability insurance industry in order to provide context regarding the potential impact of genetic testing on disability insurance. It describes disability income insurance, exploring both the protection it offers and its main contract provisions. It goes on to describe the private insurance market and the differences between group and individual insurance, and concludes with implications of genetic testing with respect to the private disability insurance market. The individual disability income insurance market is theoretically of great interest (...) as a matter of public policy since there is potential for unfair discrimination through genetic testing although this remains very unlikely as a matter of practice, however.It is more likely that a person will become disabled than die before age 65. The loss of income during a disability can be quite devastating. In contrast to the high risk and high impact of disability are the realities of the disability market. (shrink)

Bringsjord and Licato provide a general meta-argument that cyberwarfare is so different from traditional kinetic warfare that no argument from analogy can allow the just war theory of Augustine and Aquinas to be pulled over from traditional warfare to cyberwarfare. I believe that this meta-argument is sound and that it applies not just to cyberwarfare: in particular, on my reading of the meta-argument, argument from analogy has never been adequate to allow JWT to be applied to the kind of warfare (...) that we are familiar with now. The paper by Susan M. Wolf and Jeffrey P. Kahn published in this issue of the Journal of Law, Medicine & Ethics notes that we are members of the Working Group on Genetic Testing in Disability Insurance and that the members of the Working Group do not necessarily subscribe to its recommendations. Although we agree with some of Wolf and Kahn's recommendations, we do not agree with recommendations 1, 3, 4, and 5 for individual disability insurance and recommendations 1, 2, (...) and 3 for group disability insurance. We use this paper to delineate our areas of disagreement, but we do not discuss areas such as employment law as they are not our areas of expertise.First, understanding our roles on the Working Group is important. As members, we provided technical expertise on disability insurance. Our input to the Working Group represents our individual opinions. (shrink)

This article explores thematic parallels between the book of Ecclesiastes and the reflections and memories of Holocaust survivors. The three themes touched on find expression in the post‐World War II existentialist literature which sought to respond to the incomprehensibility of the Holocaust : the role of extreme circumstances, absurdity, and the individual struggle with, or against, death and fate. It is existentialist philosophy, then, that provides the categories for the comparison.Although one cannot presume an experiential likeness between Qoheleth’s narrative and (...) the real suffering of Holocaust victims, Qoheleth’s observations and lamentation about the absurdity of his own experience resonate a great deal with the experience of the Holocaust ’s survivors. In Testo Junkie, Preciado briefly introduces the figure of the ‘techno-Barbie’. Contrasted with his own Testogel-fuelled pornographic experiments, the possibilities of oestrogen or progesterone seem somewhat uncharitably foreclosed upon. Though Preciado draws our attention to the gendered politics of chemical enhancement and hormonal justice, it begs the question: where do we draw the line between experimentation and chemical domination? We engage with the figure of the techno-Barbie to explore our own experiments with hormones and gendered agency in the boundaries of (...) advanced biocapitalism. Drawing on a range of allied texts, we explore the ambivalences of our own hormonal experimentation. What kinds of hormonal experiments are allowed to be cast as such? In response to this all-encompassing theory of domination, we ask: how might the techno-Barbie speak back? (shrink)

An adequate theory of rights ought to forbid the harming of animals to promote trivial interests of humans, as is often done in the animal-user industries. But what should the rights view say about situations in which harming some animals is necessary to prevent intolerable injustices to other animals? I develop an account of respectful treatment on which, under certain conditions, it’s justified to intentionally harm some individuals to prevent serious harm to others. This can be compatible with recognizing the (...) inherent value of the ones who are harmed. My theory has important implications for contemporary moral issues in nonhuman animal ethics, such as the development of cultured meat and animal research. (shrink)

Value capture occurs when an agent’s values are rich and subtle; they enter a social environment that presents simplified — typically quantified — versions of those values; and those simplified articulations come to dominate their practical reasoning. Examples include becoming motivated by FitBit’s step counts, Twitter Likes and Re-tweets, citation rates, ranked lists of best schools, and Grade Point Averages. We are vulnerable to value capture because of the competitive advantage that such crisp and clear expressions of value have in (...) our private reasoning and our public justification. There is, however, a price. In value capture, we take a central component of our autonomy — our ongoing deliberation over the exact articulation of our values — and we outsource it. And the metrics to which we outsource usually engineered for the interests of some external force, like a large-scale institution’s interest in cross-contextual comprehensibility and quick aggregability. That outsourcing cuts off one of the key benefits to personal deliberation. In value capture, we no longer adjust our values and their articulations in light of own rich experience of the world. Our values should often be carefully tailored to our particular selves or our small-scale communities, but in value capture, we buy our values off the rack. In some cases – like decreasing CO2 emissions – the costs of non-tailored values are outweighed by the benefit of precise collective coordination. In other cases, like in our aesthetic lives, they are not. This suggests that we should want different values suited to different scales. We should want value federalism. Some values are perhaps best pursued at the largest-scale level, others at smaller scales. The problem occurs when we exhibit an excess preference for the largest-scale values – when we consistently let the universal metrics swamp our quieter interests. (shrink)

In The Case for Animal Rights, Tom Regan argues that although all subjects-of-a-life have equal inherent value, there are often differences in the value of lives. According to Regan, lives that have the highest value are lives which have more possible sources of satisfaction. Regan claims that the highest source of satisfaction, which is available to only rational beings, is the satisfaction associated with thinking impartially about moral choices. Since rational beings can bring impartial reasons to bear on decision making, (...) Regan maintains that they have an additional possible source of satisfaction that nonrational beings do not have and, consequently, the lives of rational beings turn out to have greater value..
