First published in 1975, this is a book of general intellectual interest about the role of the university in contemporary society and that of university teachers in relation to their subjects, their students, and their wider political commitments. Alan Montefiore offers preliminary analyses of the family of concepts most often invoked in discussions of these problems, taking the central dispute to be between those who hold a 'liberal' view of the university and those who regard this notion as illusory, (...) dishonest or undesirable. Six academics, representing, discuss issues of substantive conflict in light of Montefiore's initial distinctions. " Rawls renoue ainsi avec la grande tradition de la philosophie politique classique, kantienne en particulier. Les principes de justice qui gouvernent nos démocraties peuvent faire l'objet d'un accord unanime, légitimé par la procédure suivie et non plus par référence à une conception du souverain bien. Mais sa démonstration suppose une société unifiée. Or cette condition n'est plus valable (...) étant donné la diversité culturelle de nos sociétés multiethniques. La nouvelle question qui se pose est donc celle " de savoir comment une société juste et libre est possible dans des conditions de conflits doctrinaux profonds sans espoir de solution. " Dans Libéralisme politique, Rawls amorce une réponse. Le consentement recherché sur des principes de justice ne doit pas être compris comme une adhésion globale : c'est un consentement uniquement " politique " qui laisse toute liberté en matière philosophique, morale ou religieuse. Mais peut-on ainsi séparer le politique et le métaphysique? Est-il possible et même utile de rester " philosophiquement superficiel " pour parvenir à un consensus politique? (shrink)

Le dispositif: un texte de Louis Marin sur la pluralité du sens , où « langage ordinaire » renvoie au discours du « peuple » qui ne saitpas discerner la « raison des effets » de sens dans son discours; Marin l'a écrit en anglais, d'ailleurs émaillé ou doublé de fiançais, Montefiore n'en posséde qu'une traduction, et c'est elle qu'il retraduit en anglais — traduction de traduction avec l' original seulement en fin de parcours. L'analyse de Montefiore, lisant (...) Marin lisant Pascal, porte sur la force du discours et les forces d'une langue, illocutoires, mais non moins politiques dans ce français-là : si l'on peut en philosophic, entre science et littérature, rendre tout d'une langue à l'autre, n'est-il pas pourtant inevitable que les choses feel different ? As a young lecturer in philosophy and the eldest son of a prominent Jewish family, Alan Montefiore faced two very different understandings of his identity: the more traditional view that an identity such as his carried with it, as a matter of given fact, certain duties and obligations, and an opposing view, emphasized by his studies in philosophy, according to which there can be no rationally compelling move from statements of fact—whatever the alleged facts may be—to "judgments of value." (...) According to this second view, individuals must in the end take responsibility for determining their own values and obligations. In this book, Montefiore looks back on his attempts to understand the nature of this conflict and the misunderstandings it may engender. In the process, he illustrates through personal experience the practical implications of a characteristically philosophical issue. Montefiore finally settles on the following: while everyone has to accept that facts, including those of their own situation, are whatever they may be, both the "traditional" assumption that individuals must recognize certain values and obligations as rooted in those very facts, and the contrary view that individuals are ultimately responsible for determining their own values, are deeply embedded in differing conceptions of society and its relation to its members. Montefiore then examines the misunderstandings between those for whom identity constitutes in effect a conceptual bridge connecting the facts of who and what a person may be to the value commitments incumbent upon them, and those for whom the very idea of such a bridge can be nothing but a confusion. Using key examples from the notoriously vexed case of Jewish identity and from his own encounters with its conflicting meanings and implications, Montefiore depicts the practical significance of the differences between these worldviews, particularly for those who hove to negotiate them. Qu'est-ce que l'utilitarisme? Philosophie du bourgeois, philosophie de l'homo oeconomicus, dénoncée, entre autres, par Marx, Nietzsche et Foucault? Ou la seule philosophie morale de taille à concurrencer le kantisme et l'une des bases de l'éthique appliquée contemporaine? L'utilitarisme a cherché à constituer une morale purement rationnelle, critique des croyances religieuses et des conventions sociales. L'exemple le plus illustre est celui de la justice pénale. Bentham, dans des textes révolutionnaires, soutient, à la suite de Beccaria, que la peine doit être proportionnée (...) au tort commis par le coupable, non au besoin de vengeance de la victime et de la société. Dans le premier volume de cette Anthologie, Bentham et ses précurseurs, la filiation entre Bentham et les philosophes des Lumières est établie. De Shaftesbury et Hume à Beccaria et William Paley, on pourra prendre la mesure des continuités, mais aussi du génie du fondateur de ce radicalisme philosophique. Surtout, le lecteur aura accès aux textes majeurs de Bentham qui n'avaient jamais été traduits, en dehors du Panoptique et des Sophismes anarchiques écrits directement en français. The eighth Congrès des Sociétés de Philosophic de Langue Française at Toulouse, which, I should perhaps explain, was the first gathering of its sort to which I have been, was just about as unlike a Joint Session as an English philosopher might well have imagined it to be. Many of the differences arose naturally from the simple facts that French philosophy is very unlike British and that philosophers in France are greeted with banquets, civic receptions, concerts and other hospitable entertainments (...) when they meet together in congress. But there are other differences too. For one thing, the contributions are not only as a rule very different in content; they are also different in form. A general theme is set with a certain number of sub–headings. Then anybody who wishes may submit a “communication,” having if possible at least some appearance of relevance to the titular theme–though if this is not possible, it doesn't seem to matter very much as it may be included all the same. Obviously enough, if some share of the available space and time is to be given to every philosopher who wants it, , nobody is going to get very much. The result of all this is to be seen for this year in the Acts of the Congress L'Homme et son prochain , where hardly any of the no less than 76 contributors has more than four pages to himself. In the circumstances it would have been wholly surprising if such Acts had turned out to be anything other than a mainly tedious assortment of mostly undistinguished fragments, which is not, I fear, likely to prove of much interest to any reader of this Survey; which is a pity, as it is not only the receptions and the outings that make this Congress worth attending. La question de la cohérence de la théorie rawlsienne de la justice et de son tournant politique a été depuis longtemps une source de débats et de malentendus. Pour certains interprètes, l’abandon par le second Rawls d’un fondement kantien des principes de justice au profit d’un libéralisme purement politique serait un prix trop élevé à payer pour obtenir un large consensus sur des principes de justice dans des sociétés démocratiques traversées par des conflits de valeurs insurmontables. « La vérité dérangeante (...) ( inconvenient truth ) que Rawls découvre est qu’il est impossible, écrit Robert Taylor (2011), de parvenir à un consensus par recoupement sur une conception kantienne de la personne ou plus largement sur la justice comme équité », mais qu’en même temps, sans un tel fondement, la force morale de la théorie de la justice serait diluée. Dans cet article, je voudrais répondre à ces critiques et montrer que, bien loin de conduire au relativisme, l’exigence d’autonomie doctrinale et d’indépendance des principes de justice à l’égard de toute conception substantielle du Bien exprimée par Rawls ( Libéralisme politique, p. 133) exprime le sens qu’a pour lui l’idéal démocratique : le respect pour l’autonomie morale des personnes et le rejet de « la pratique séculaire de l’intolérance comme condition nécessaire à l’ordre et à la stabilité de la société » ( Libéralisme politique, p. 14). Mais un tel idéal n’est-il pas irréaliste? Faire ainsi confiance à l’autonomie des citoyens, à leur capacité à distinguer entre leurs doctrines morales personnelles et des principes publics de justice ( Libéralisme politique, p. 7) ne risque-t‑il pas d’affaiblir les démocraties au lieu de garantir leur stabilité, comme l’espère Rawls ( Libéralisme politique, p. 4)? Cette ambition d’autonomie doctrinale est-elle une force ou une faiblesse de la théorie rawlsienne? (shrink)

The Gamer’s Dilemma challenges us to justify the moral difference between enacting virtual murder and virtual child molestation in video games. The Dilemma relies for its argumentative force on the claim that there is an intuitive moral difference between these acts, with the former intuited as morally acceptable and the latter as morally unacceptable. However, there has been no empirical investigation of these claims. To explore these issues, we developed an experimental survey study in which participants were asked to reflect (...) on imaginary video game scenarios as part of a 2 (undertake virtual murder or molestation) X 2 (against an adult or child) X 2 (in a high or low realism virtual environment) factorial design. We found that there was a significant difference between people’s views about virtual murder and virtual molestation. Whether the virtual act was performed against an adult or child was non-significant in most conditions, whereas whether it was performed in a high or low realism virtual environment was significant in most conditions. Gender did not impact these results, whereas perceived gaming experience, hours of video game play per week, and integrity did. These results provide an empirical grounding for future discussions of the Gamer's Dilemma. (shrink)

Faced with the present migrant crisis and the dismal record of Europe in protecting vulnerable refugees’ and migrants’ rights, what could be the view of the moral philosopher? The contrast between the principles enshrined in the European Charter of Fundamental Rights and the reality of present policies is shocking, but more scrutiny will show that it is the result of a larger trend towards an understanding of freedom mostly in economic terms, at a time when economists such as Amartya Sen (...) have revised their approach to economic growth and prosperity, noting the central role played by a much richer conception of freedom. The paper will scrutinize these inconsistencies and the conception of the person from which they derive and will provide an alternative and more coherent moral vision that could strengthen the legitimacy of the European Charter, at a time of growing dissatisfaction and so‐called democratic deficit. Such a vision could help reconnect the Charter with a conception of the human person as in need not solely of passive legal protection, but also of active promotion of her self‐respect and capabilities, and of her aspiration to a valuable life.
