Much recent philosophical attention has been devoted to variants on the Best System Analysis of laws and chance. In particular, philosophers have been interested in the prospects of such Best System Analyses for yielding *high-level* laws and chances. Nevertheless, a foundational worry about BSAs lurks: there do not appear to be uniquely appropriate measures of the degree to which a system exhibits theoretical virtues, such as simplicity and strength. Nor does there appear to be a uniquely correct (...) exchange rate at which the theoretical virtues of simplicity, strength, and likelihood trade off against one another in the determination of a best system. Moreover, it may be that there is no *robustly* best system: no system that comes out best under *any* reasonable measures of the theoretical virtues and exchange rate between them. This worry has been noted by several philosophers, with some arguing that there is indeed plausibly a set of tied-for-best systems for our world. Some have even argued that this entails that there are no Best System laws or chances in our world. I argue that, while it *is* plausible that there is a set of tied-for-best systems for our world, it doesn't follow from this that there are no Best System chances. Rather, it follows that the Best System chances for our world are *unsharp*. (shrink)

The better best system account, short BBSA, is a variation on Lewis’s theory of laws. The difference to the latter is that the BBSA suggests that best system analyses can be executed for any fixed set of properties. This affords the possibility to launch system analyses separately for the set of biological properties yielding the set of biological laws, chemical properties yielding chemical laws, and so on for the other special sciences. As such, the BBSA remains (...) silent about possible interrelations between these freestanding sets of laws. In this paper, I explicate an emergence relation between them which preserves the autonomy or novelty of each special science’s laws but also shows their dependence: the autonomy of each level’s generalisations is given because nomicity is conferred to them system intrinsic, their dependence is established via their supervenience on lower level laws. As will be shown, the autonomy of special science laws is further strengthened by their ceteris paribus character. (shrink)

Here we consider two ways that nanomedicine might be disruptive. First, low-end disruptions that are intrinsically unpredictable but limited in scope, and second, high end disruptions that involve broader societal issues but can be anticipated, allowing opportunity for ethical reflection.

Many believe that nanotechnology will be disruptive to our society. Presumably, this means that some people and even whole industries will be undermined by technological developments that nanoscience makes possible. This, in turn, implies that we should anticipate potential workforce disruptions, mitigate in advance social problems likely to arise, and work to fairly distribute the future benefits of nanotechnology. This general, somewhat vague sense of disruption, is very difficult to specify – what will it entail? And how can we responsibly (...) anticipate and mitigate any problems? We can't even clearly state what the problems are anticipated to be. In fact, when we move from sweeping policy statements to more concrete accounts, nanotechnology seems to bifurcate into two divergent streams: one is fairly continuous with current developments, extending extant science in a quantitative way; the other is radically new, and includes science fiction-like dreams of molecular manufacturing and assemblers, with their utopian scenarios of absolute plenty. This seminal paper, which marks a turning point of the chemical revolution, is presented for the first time in a complete English translation. In this first half Lavoisier undermines phlogiston chemistry by arguing that his French contemporaries had replaced Stahl’s original theory with radically different systems that conceptualised the phlogiston principle in completely incompatible ways. He refutes their claims by showing that these later models were riddled with inconsistencies as to phlogiston’s weight, its ability to penetrate glass and its (...) role as a source of colour and odour in chemical compounds. A significant part of hip hop culture, [1] rap articulates the experiences and conditions of African-Americans living in a spectrum of marginalized situations ranging from racial stereotyping and stigmatizing to struggle for survival in violent ghetto conditions. Rap is thus not only music to dance and party to, but a potent form of cultural identity. It has become a powerful vehicle for cultural political expression, serving as the "CNN of black people", or upping the high-tech ante, as their "satellite communication system". It is an informational medium to tune into, one that describes the rage of African-Americans facing growing oppression, declining opportunities for advancement, changing moods on the streets, and everyday life as a matter of sheer survival. Drawing on a century of data, Common Enemies reveals why disease campaigns are the battles Americans come together to fight, why certain diseases rose to prominence, and how fighting one disease at a time changes the way we distribute resources, conceptualize problems, and promote health. Combining quantitative and qualitative analyses, Rachel Kahn Best persuasively demonstrates how disease campaigns have created unintended consequences for health policy.

Relatively little is known about those who consistently produce the valid response to Modus Tollens (MT) problems. In two studies, people who responded correctly to MT problems indicated how “convinced” they were by proofs of conditional reasoning conclusions. The first experiment showed that MT competent reasoners found accurate proofs of MT reasoning more convincing than similar “proofs” of invalid reasoning. Similarly, there was a tendency for MT competent reasoners to find an initial counterfactual supposition more convincing than did people who (...) were less competent in MT. The second experiment showed that when individuals produced the correct MT response, and found correct MT proofs to be more convincing than “bogus” proofs, they were also less likely to find the conclusions to Denying the Antecedent, or Affirming the Consequent problems valid, compared to individuals who could not discriminate between valid and bogus MT proofs. These findings are discussed in terms of both their implications for the mental logic and mental models positions, and individual differences in System 1 and System 2 reasoning. (shrink)

Sustainability reporting and assurance of sustainability reports have been used by organizations in an attempt to provide accountability to their stakeholders. A better understanding of current practices is important to provide a base for comparative and trend analyses. This paper aims to consolidate and provide information on sustainability reporting, assurance of sustainability reports and types of assurance providers. Another aim of this paper is to provide a descriptive analysis of these practices for a global sample, comparing results with previous (...) studies, and suggesting opportunities for future research. To accomplish these objectives, a literature review was performed, an analysis of the organizations included in the Fortune Global 500 2010 was completed, and results were presented and consolidated by country. These results demonstrate that all organizations analysed provided some type of information in relation to their social or environmental performance in their official website. The percentage of organizations issuing a sustainability report has been increasing in the last few years. However, the percentage of organizations assuring their sustainability report has stagnated. Types of assurance engagements include those performed by accountants and non-accountants, and new practices have emerged, namely the “mixed approach” and the “stakeholder or specialist review”. The analysis also shows that the practices of issuing sustainability reports and having them assured have become a world-wide phenomenon, occurring in developed, and emerging economies around the world. Convivo is a VoIP system designed to provide reliable voice communication for poor quality networks, especially those found in rural areas of the developing world. Convivo introduces an original approach to maintain voice communication interaction in the presence of poor network performance: an Interface‐ Adaptation mechanism that adjusts the user interface to reduce the impact of high latency and low bandwidth networks. Interface modes facilitate turn taking for high latency connections, and help to sustain voice communication even with extremely low (...) bandwidth or high error rates. An evaluation of the system, conducted in a rural community in the Dominican Republic, found that Interface‐Adaptation helped users to maintain voice communication interaction as network performance degrades. Transitions from full duplex to voice messaging were found particularly valuable. Initial results suggest that as users get more experience with the application they would like to manually control transitions based on feedback provided by the application and their own perceived voice quality. In the context of critically ill children, Baines contended that the best interests test was neither objective nor coherent, and thus of little applicability in making end-of-life decisions. In reply, Bridgeman attempted to refute these claims through legal analysis and contended that the doctrine allowed for responsive, fact-specific, context-sensitive and prudential reasoning. This paper is a response to Bridgeman, and argues that an examination of case law reveals the subjective and value-laden nature of the test. Courts must make decisions (...) in contested cases, but there is no reason to hold that a judge can divine the best interests of a critically ill child better than either parents or medical staff. This paper analyses a number of cases where judicial decisions appear at odds with the child's best interests, and argues that as the outcome depends upon the value system of the decision-maker the test is unhelpful in contested end-of-life cases. In this paper, we analyse the most important documents establishing the criteria for the treatment and exclusion of COVID-19 patients, especially in regard to the giving of respiratory support, in Italy and Spain. These documents reflect a tension that stems from limited healthcare resources which are insufficient to save lives that, under normal conditions, could have been saved, or at least could have received the best possible treatment. First, we analyse the healthcare systems of these two countries before (...) the spread of the virus, both of which have seen decreases in the number of intensive care beds and have been marked by financial cuts during the last ten years. It is a fact that a greater number of people, especially those over 70 years of age, have been left without respiratory support treatment, and therefore, there have been a greater number of deaths. It is also a fact that there has been a higher infection rate among healthcare professionals due to the delay in the management of protective measures and the inability to provide adequate care for those in nursing homes, as recognised by WHO. In the context of this health emergency, healthcare professionals have suffered a real ‘moral distress’ because, knowing first-hand the causes of the limitation of resources, they have had to put triage protocols into practice. Finally, we set forth a series of concrete ethical proposals with which to face the successive waves of COVID-19 infection, as well as other future pandemics. (shrink)

Theoretical biology and economics are remarkably similar in their reliance on mathematical models, which attempt to represent real world systems using many idealized assumptions. They are also similar in placing a great emphasis on derivational robustness of modeling results. Recently philosophers of biology and economics have argued that robustness analysis can be a method for confirmation of claims about causal mechanisms, despite the significant reliance of these models on patently false assumptions. Alternative Learning System (ALS) has been adopted in Philippine basic education, yet there is no academic institution in the region prepares ALS teachers in teaching life skills. ALS teachers graduated from different programs of teacher education for formal education. In response, an extension project was conceptualized and implemented to enhance the teaching capacity and effectiveness of ALS teachers. Case study was conducted to evaluate the effectiveness of the project. It explored the transfer of life skills among ALS teachers. Data were (...) collected from multiple sources. Interview and written responses, and feedbacks were analyzed using thematic narrative analysis. Other data were analyzed using document and descriptive analyses. The project had achieved its objectives and rated best by participants. These indicate that the project was implemented effectively and successfully. ALS teachers have acquired life skills and transferred them to others. Thus, the project has made a difference in the lives of these teachers. (shrink)

Humean reductionism about laws of nature appears to leave a central aspect of scientific practice unmotivated: If the world’s fundamental structure is exhausted by the actual distribution of non-modal properties and the laws of nature are merely efficient summaries of this distribution, then why does science posit laws that cover a wide range of non-actual circumstances? In this paper, we develop a new version of the Humean best systems account of laws based on the idea that laws need (...) to organize information in a way that maximizes their cognitive usefulness for creature like us. The focus of this essay is on substitute materials, particularly the research on substitute metals. The two periods of autarky in Germany were of primary influence on this field. Engineers and construction engineers proved most important in this context despite inter-institutional cooperation between the disciplines of metals research, materials testing, and technical mechanics. Engineers had to solve construction problems respecting the materials used and to analyse components in terms of economic efficiency. However, the research on substitute metals not only meant (...) the substitution of one substance for another. It also implied economizing and recycling scarce materials. These activities required tacit knowledge. Engineers succeeded to some degree but the German war economy paid a high price for it. Each technical system demanded a case-specific approach. Typically a loss of effectiveness, reliability and durability of the products containing substitutes had to be taken into account. (shrink)

Craig Callender, Jonathan Cohen and Markus Schrenk have recently argued for an amended version of the best system account of laws – the better best system account (BBSA). This account of lawhood is supposed to account for laws in the special sciences, among other desiderata. Unlike David Lewis's original best system account of laws, the BBSA does not rely on a privileged class of natural predicates, in terms of which the best system is formulated. According to (...) the BBSA, a contingently true generalization is a law of a special science S iff the generalization is an axiom (or a theorem) of the best system relative to the set of predicates used by special science S. We argue that the BBSA is, at best, an incomplete theory of special science laws, as it does not account for typical features of special science laws, such as attached ceteris paribus conditions and the idealized character of law statements in these disciplines. In recent years, an active research program has emerged that aims to develop a Humean best-system account (BSA) of laws of nature that improves on Lewis’s canonical articulation of the view. Its guiding idea is that the laws are cognitive tools tailored to the specific needs and limitations of creatures like us. While current versions of this “pragmatic Humean” research program fare much better than Lewis’s account along many dimensions, I will argue that they have trouble making sense of (...) certain key features of the practice of fundamental physics. Indeed, these features seem to go against the very idea that laws are useful for agents like us. In my view, Humeans can address these issues by paying more attention to the explanatory role of laws. Following this idea, I will propose an account on which what makes a systematization the best is a kind of explanatory power, understood along the lines of the unificationist theory of explanation. The resulting view, I will argue, can make sense of those features of laws that other pragmatic accounts of laws have trouble explaining. (shrink)

In this paper we apply the popular Best System Account of laws to typical eternal worlds – both classical eternal worlds and eternal worlds of the kind posited by popular contemporary cosmological theories. We show that, according to the Best System Account, such worlds will have no laws that meaningfully constrain boundary conditions. It’s generally thought that lawful constraints on boundary conditions are required to avoid skeptical arguments. Thus the lack of such laws given the Best System (...) Account may seem like a severe problem for the view. We show, however, that at eternal worlds, lawful constraints on boundary conditions do little to help fend off skeptical worries. So with respect to handling these skeptical worries, the proponent of the Best System Account is no worse off than their competitors. (shrink)

In the current article and contrary to a widespread assumption, I argue that Humeanism and ontological emergence can peacefully coexist. Such a coexistence can be established by reviving elements of John Stuart Mill’s philosophy of science, in which an idiosyncratic account of diachronic emergence is associated with extensions of the Humean mosaic and the correlative coming into being of new best system laws, which have the peculiarity of being temporally indexed. Incidentally, this reconciliation of Humeanism and emergence allows for (...) conceiving the autonomy of the special sciences in an interesting way, consistently with the reductionist ideal of a unified science. Professor Wilhelm Blasius, physiologist at Giessen in West Germany, has written a book "Probleme der Lebensforschung" (Verlag Rombach, Freiburg 1973) which - I understand - is to be published in an English version. To me it has been of interest as an orientation in a world of traditional German thinking, best known from Goethe's natural philosophy of perceptible "Ur­ bilder", which perhaps in English could be rendered descriptively by calling it an inner vision of further irre­ ducible totalities. It (...) is in contemporary language a kind of intuitive 'holistic' insight which represents understanding different from that of natural science. The latter is devoted to the study of causal chains, is largely experimental and in its aim ultimately 'reduc­ tionist' -to use another modern term. Goethe's approach is reincarnated in the "Wesenslehre" of the late Ludwig Klages (1872-1956) and in the thinking of Carl Gustav Caruso To Klages the perceived image alone is the meaning of everything in this world and in this sense he is the advocate of a psychological phenom­ enology that is an end in itself. Originally trained as a chemist Klages soon turned to philosophy and de­ veloped a system of concepts supposed to give a deeper insight into the essence of life than did the endless causal chains of natural science. Blasius makes much use of the concepts of this philosopher, in particular his ideas on 'polarities'. (shrink)

Vocational Education and Training policies are paying increasing attention towards the need to develop quality career guidance processes. Career guidance plays an essential role in this challenge by enabling people to develop the career management skills that allow them to become aware of their full potential and to construct life projects that facilitate the emotional management of uncertainty and complexity, participating as responsible agents in their environment. After conducting a literature review on each of these key elements, we set out (...) to identify best practices in VET as “building blocks” for the construction of an integrated career guidance plan in VET. This study adopts an approach based on qualitative methodology, specifically a documentary type of research has been carried out. The documents analysed correspond to 88 best practices identified in Andalusia. The analysis strategy used was a content analysis. For this purpose, a system of categories has been designed, from a deductive perspective, which has contributed to a systematic analysis of them. One of the first conclusions of the study is the uneven development o best practices in the different VET professional pathways. The practices carried out in the centres begin to incorporate different elements and thus facilitate the creation of a suitable context for the development of comprehensive career guidance plans in VET. The article closes by offering implications for the development of guidance in the education system and discusses lines of future research. (shrink)

The pandemic caused by the SARS-CoV2 novel coronavirus is creating a global crisis. There is a global ambience of uncertainty and anxiety. In addition, nations have imposed strict and restrictive public health measures including lockdowns. In this heightened time of vulnerability, public cooperation to preventive measures depends on trust and confidence in the health system. Trust is the optimistic acceptance of the vulnerability in the belief that the health system has best intentions. On the other hand, confidence is assessed (...) based on previous experiences with the health system. Trust and confidence in the health system motivate people to accept the public health interventions and cooperate with them. Building trust and confidence therefore becomes an ethical imperative. This article analyses the COVID-19 pandemic in the south Indian state of Tamil Nadu and the state’s response to this pandemic. Further, it applies the Trust-Confidence-Cooperation framework of risk management to analyse the influence of public trust and confidence on the Tamil Nadu health system in the context of the preventive strategies adopted by the state. Finally, the article proposes a six-pronged strategy to build trust and confidence in health system functions to improve cooperation to pandemic containment measures. (shrink)

The article aims to present issues arising out of differences in the way that the terms chimera and hybrid are defined in legal systems and by natural sciences in the context of mixing human and animal DNA. The author analyses the different approaches to defining these terms used in various legal systems, dividing them into groups in light of conclusions reached from examining definitions used in natural sciences. The distinction is used to answer the question of which (...) approach to definitions applied by legislators is the best way to handle the subject of human-animal organisms, given the need to balance their impact on medicine and the ethical concerns that arise. As the assumptions of perpetual economic and population growth no longer stand, the welfare systems built on such promises are in peril. Policymakers must reallocate the responsibility for providing care between generations. Democratic theories can help establish procedures for finding solutions, particularly in ageing democratic countries. By analysing existing representative and deliberative democratic theories, this paper explores how the interests of future generations could be included in such procedures. A hypothetical social health insurance scheme with the pay-as-you-go financial arrangement (...) is selected as an illustrative case. This paper argues that due to the intrinsic bias towards the current generation, both representative and deliberative democratic health policymaking are limited in making decisions that account for future generations. Many philosophers sympathetic with a Humean understanding of laws of nature have thought that, in the final analysis, the fundamental laws will include not only the traditional dynamical equations, but also two additional principles: the Past Hypothesis and the Statistical Postulate. The former says that the universe began in a particular very-low-entropy macrostate M(0), and the latter posits a uniform probability distribution over the microstates compatible with M(0). Such a view is arguably vindicated by the orthodox Humean Best System (...) Account (BSA). However, I argue here that recent developments of the BSA render the Past Hypothesis otiose. In particular, the trend among Humeans toward a more pragmatic view of laws — according to which the best system is the one that is maximally effective at helping creatures like us amplify our information about the world — does not support the idea that the Past Hypothesis is a law of nature. Perhaps the most significant contemporary theory of lawhood is the Best System (/MRL) view on which laws are true generalizations that best systematize knowledge. Our question in this paper will be how best to formulate a theory of this kind. We’ll argue that an acceptable MRL should (i) avoid inter-system comparisons of simplicity, strength, and balance, (ii) make lawhood epistemically accessible, and (iii) allow for laws in the special sciences. Attention to these problems will bring into focus (...) a useful menu of novel MRL theories, some of which solve problems the original MRL theory could not. Privacy remains an intractable ethical issue for the information society, and one that is exacerbated by modern applications of artificial intelligence. Given its complicity, there is a moral obligation to redress privacy issues in systems engineering practice itself. This paper investigates the role the concept of privacy plays in contemporary systems engineering practice. Ontologically a nominalist human concept, privacy is considered from an appropriate engineering perspective: human-centred design. Two human-centred design standards are selected as exemplars of best (...) practice, and are analysed using an existing multi-dimensional privacy model. The findings indicate that the human-centred standards are currently inadequate in dealing with privacy issues. Some implications for future practice are subsequently highlighted. (shrink)

With the deployment of information and communication technologies and the needs of data and information sharing within cities, smart city aims to provide value-added services to improve citizens’ quality of life. But, currently city planners/developers are faced with inadequate contextual information on the dimensions of smart city required to achieve a sustainable society. Therefore, in achieving sustainable society, there is need for stakeholders to make strategic decisions on how to implement smart city initiatives. Besides, it is required to specify the (...) smart city dimensions to be adopted in making cities smarter for sustainability attainment. But, only a few methods such as big data, internet of things, cloud computing, etc. have been employed to support smart city attainment. Thus, this study integrates case-based reasoning as an artificial intelligence technique to develop a recommender system towards promoting smart city planning. CBR provides suggestions on smart city dimensions to be adopted by city planners/decision-makers in making cities smarter and sustainable. Accordingly, survey data were collected from 115 respondents to evaluate the applicability of the implemented CBR recommender system in relation to how the system provides best practice recommendations and retaining of smart city initiatives. Results from descriptive and exploratory factor analyses suggest that the developed system is applicable in supporting smart city adoption. Besides, findings from this study are expected to provide valuable insights for practitioners to develop more practical strategies and for researchers to better understand smart city dimensions. According to best systems accounts, laws of nature are generalizations in the best systematization of particular matters of fact. Metrics such as simplicity and strength determine which systematization is best, but these are notoriously language relative. For this reason, David Lewis proposed a constraint on languages of inquiry: all predicates must be natural. This constraint is sometimes interpreted as requiring us to know which natural properties are instantiated in our world prior to scientific theorizing. I argue (...) that this interpretation is incorrect. I provide a better interpretation and show how it undercuts an influential epistemological objection to Lewis's best systems account of laws due to Bas van Fraassen. (shrink)

Probability distributions play an essential role in modeling and predicting biomedical datasets. To have the best description and accurate prediction of the biomedical datasets, numerous probability distributions have been introduced and implemented. We investigate a novel family of lifetime probability distributions to represent biological datasets in this paper. The proposed family is called a new flexible logarithmic- X family. The suggested NFLog- X family is obtained by applying the T- X method together with the exponential model having the PDF (...) m t = e − t. Based on the NFLog- X approach, a three parameters probability distribution, namely, a new flexible logarithmic-Weibull distribution is introduced. The method of maximum likelihood estimation is adopted for estimating the parameters of the NFLog- X family. In the end, we examine three different biological datasets in order to give a thorough numerical research that illustrates the NFLog-Wei distribution. Comparisons are made between the analytical goodness-of-fit metrics of the suggested distribution. We made comparison with the alpha power transformed Weibull, exponentiated Weibull, Weibull, flexible reduced logarithmic-Weibull, and Marshall–Olkin Weibull distributions. After performing the analyses, we observe that the proposed method outclassed other competitive distributions. (shrink)

Lewis’ Best System Analysis of laws of nature is often criticized on the grounds that what it means to be the “best” system is too subjective for an analysis of lawhood. Recent proponents of the BSA have embraced the view’s close connection to the particulars of scientific practice despite the objection. I distinguish two compatible versions of the objection: one opposed to mind or subject dependence and the other opposed to relativity. The BSA can answer both. Answering the (...) anti-relative version of Armstrong’s objection requires that the BSA be no more or less relative than is required by scientific practice. A spectrum of relativity is introduced with extremes of minimally and maximally relative variants of the BSA, and extant variants of the BSA are located on it. Lastly, I sketch what work remains to be done with respect to Armstrong’s objection by BSA proponents depending on where in the spectrum of relativity they hope to locate their view. (shrink)

The aim of the article is to present the application of the lean management method as appropriate for the management of the organizational system of psychiatric care in the Zealand region of Denmark. The organizational solutions of the Danish psychiatric care system presented in this paper are individualized and adapted to the regional needs of the residents. In Denmark, there are five administrative regions, in which each independently organizes its own system of medical (psychiatric) care. This means that the regions (...) have considerable independence in choosing the acceptable and necessary methods of management, including – as is clear from the conducted research – the use of methods put-upon other areas of economy. Although the national laws in Denmark define certain conditions and guidelines for the functioning of psychiatric care (e.g. regarding the use of direct coercion/restrains for patients treated in the centres), there is a distinct separation of structures and methods of functioning throughout the whole country, which constitutes unique observation material – from the cognitive point of view. The authors of this paper conduct extensive research and analyse the systems of psychiatric care organizations in various countries (including Spain, Italy and Japan) and, as a result, the obtained results may lead to the selection of the best models from other systems (good organizational practices and management, the management methods in use), which can be applied in the currently reorganised system of the Polish psychiatric care. The choice of Denmark for the observational study is not accidental and is related not only to the fact that there is a large degree of systemic identity within the country and between the regions, but also because the country applies solutions addressed to patients with very different cultural conditions and needs, resulting from their descent, religion, and (world)-views. Denmark is one of those European countries that express a significant acceptance of diversity and tolerance, which is why communities with very different imponderables, denominations, and worldviews co-exist. In the area related to the organization of the psychiatric system, these conditions are of key importance. In the period from January 2015 to December 2017 the authors participated in study visits in Denmark, conducting research aimed at identifying the key success factors of the psychiatric care organization system in the country. The conducted analysis is also based on the analysis of literature and own and participant observations. The conclusions concerning this subject are also the result of interviews conducted with employees of the visited hospitals and system users, both professionals and patients. As the search for an optimal organizational model of psychiatric care is currently an ongoing concern in Poland, it seems justified to review the existing solutions in Europe and perform their critical analysis. A comparison of the adopted solutions was performed, in the context of, above all, the improvement of the quality of these services, their availability, and the satisfaction of patients and their families from the proposed organizational changes. ‘Justice’ is spoken of in two ways: the lawful and the fair. The law is a human construct that is devoted to the advantage of all, or to the advantage of the best, or to the advantage of those in power or to the advantage of those representing it – let it be the politician, the media, the TV presenter, the filmmaker. Thus, the law serves the production or the preservation of happiness within politics and business. The law commands (...) us to act according to the mean. A well-written law follows the mean well and a poorly written law does not. On the other hand, fairness is a principle sometimes materialised through the law and the given justice system. Fairness is the ultimate value pursued by both the common law and civil law traditions. However, its distribution through the law and the representation of this delivery varies. Does this mean that a different kind of justice is distributed? Through the teachings of Aristotle, this essay aims to deconstruct the notion of justice, by breaking down its two ingredients, the lawful and the fair, and by analysing the effect of their representation in modern European society. The relativity attached to the notion of justice is not a modern phenomenon, but a philosophical matter that can be analysed and indeed explained through the teachings of Aristotle and its contemporary students. The analysis will be developed in the context of convergent Europe, focusing on the role of the media and courts especially in relation to criminal justice. (shrink)

This article discusses the role of simplicity and the notion of a best balance of simplicity and strength within the best systems account (BSA) of laws of nature. The article explores whether there is anything in scientific practice that corresponds to the notion of simplicity or to the trade-off between simplicity and strength to which the BSA appeals. Various theoretical rationales for simplicity preferences and their bearing on the identification of laws are also explored. The microbiota-gut-brain field holds huge potential for understanding behavioral development and informing effective early interventions for psychological health. To realize this potential, factors that shape the MGB axis in infancy must be integrated into a systemic framework that considers salient behavioral outcomes. This is best accomplished applying network analyses in large prospective, longitudinal investigations in humans.

_In _Challenging the One Best System_, a team of leading education scholars offers a rich comparative analysis of the set of urban education governance reforms collectively known as the “portfolio management model.”_ They investigate the degree to which this model—a system of schools operating under different types of governance and with different degrees of autonomy—challenges the standard structure of district governance famously characterized by David Tyack as “the one best system.” The authors examine the design and enactment of (...) the portfolio management model in three major cities: New Orleans, Los Angeles, and Denver. They identify the five interlocking mechanisms at the core of the model—planning and oversight, choice, autonomy, human capital, and school supports—and show how these are implemented differently in each city. Using rich qualitative data from extensive interviews, the authors trace the internal tensions and tradeoffs that characterize these systems and highlight the influence of historical and contextual factors as well. Most importantly, they question whether the portfolio management model represents a fundamental restructuring of education governance or more incremental change, and whether it points in the direction of meaningful improvement in school practices. Drawing on a rigorous, multimethod study, _Challenging the One Best System_ represents a significant contribution to our understanding of system-level change in education. (shrink)

Increasingly sophisticated and expensive medical technologies, chronic illness and aging, and a population that insists upon the best health care and coverage, together demand that priorities be set in the public funding of health care. This article describes Spanish initiatives in dealing with such problems and analyses the ethical implications of health care legislation and rationing.

In this paper, I aim to explore Lewis’s best system analysis and how it can accommodate laws with exceptions. The Best System Account has been introduced to provide an alternative view for both minimalist and counterfactual theories of regularities. Simple regularity theory faces problems in which there is some generalization that seems to be a law or some regularities that are established accidentally. It tries to exclude the accidental generalization from the account. However, the best system analysis (...) can solve the problem of how to distinguish between laws and accidents. (shrink)

Contemporary Humeans treat laws of nature as statements of exceptionless regularities that function as the axioms of the best deductive system. Such ‘Best System Accounts’ marry realism about laws with a denial of necessary connections among events. I argue that Hume’s predecessor, George Berkeley, offers a more sophisticated conception of laws, equally consistent with the absence of powers or necessary connections among events in the natural world. On this view, laws are not statements of regularities but the most (...) general rules God follows in producing the world. Pace most commentators, I argue that Berkeley’s view is neither instrumentalist nor reductionist. More important, the Berkeleyan Best System can solve some of the problems afflicting its Humean rivals, including the problems of theory choice and Nancy Cartwright’s ‘facticity’ dilemma. Some of these solutions are available in the contemporary context, without any appeal to God. Berkeley’s account deserves to be taken seriously in its own right. (shrink)

Much recent philosophical attention has been devoted to the prospects of the Best System Analysis of chance for yielding high-level chances, including statistical mechanical and special science chances. But a foundational worry about the BSA lurks: there don’t appear to be uniquely correct measures of the degree to which a system exhibits theoretical virtues, such as simplicity, strength, and fit. Nor does there appear to be a uniquely correct exchange rate at which the theoretical virtues trade off against one (...) another in the determination of an overall best system. I argue that there’s no robustly best system for our world – no system that comes out best under every reasonable measure of the theoretical virtues and exchange rate between them – but rather a set of ‘tied-for-best’ systems: a set of very good systems, none of which is robustly best. Among the tied-for-best systems are systems that entail differing high-level probabilities. I argue that the advocate of the BSA should conclude that the high-level chances for our world are imprecise. (shrink)

ZusammenfassungVor dem Hintergrund, dass in den Medien und der Öffentlichkeit thematisierte und dargestellte Arztbilder stets auch auf die öffentliche Meinung und die Vorstellungen der Menschen von Ärzten wirken, spürt der Artikel der Frage nach, welches Arztbild die amerikanische TV-KrankenhausserieDr. House transportiert und welche Ausprägung das dargestellte Arzt-Patienten-Verhältnis einnimmt. Hierbei werden die medizinethischen Reflexionen durch eine detaillierte medienwissenschaftliche Genre-Einordnung und dramaturgische Analyse eingerahmt und unterstützt. Zudem werden als Analyseinstrumentarium die vier Modelle des Arzt-Patienten-Verhältnisses nach Emanuel/emanuel herangezogen. Dieser interdisziplinäre Forschungsansatz zeigt, dass (...) die Hauptfigur der Serie, der Arzt Dr. Gregory House, durchaus als Gegenentwurf einesmodernen Arztes, der fürsorglich, nicht-direktiv und stets im Sinne desinformed consent handelt, konzipiert und präsentiert wird. Doch ist daraus nicht zu schließen, dass die Figur des Dr. House einseitig als Paternalist gezeichnet ist. Die Kategorisierung und Einordnung des Dr. House und der von ihm repräsentierten Arzttugenden ist vielmehr entlangaller Elemente des gesellschaftlichen Arztideals vorzunehmen, zu denen eine entsprechende wissenschaftlich-medizinische Kompetenz, die Orientierung an objektivierbaren Indizien, die Verpflichtung auf das naturwissenschaftliche, evidenzbasierte Ideal, eine angenehme Kommunikation mit dem Patienten sowie die nötige, gebotene Aufklärung zählen. So wird in der Analyse deutlich, dass die Darstellung von Dr. House vielschichtiger ist und immer wieder auf ethische Dilemma-Situationen in der Medizin verweist. Diese wirkmächtige dramatisch-filmische Darstellung von Konfliktsituationen im diagnostisch-therapeutischen Kontext sollte daher auch in der kommunikationswissenschaftlichen Wirkungsforschung vertieft werden. The Humean best systems account identifies laws of nature with the regularities in a system of truths that, as a whole, best conforms to scientific standards for theory-choice. A principled problem for the BSA is that it returns the wrong verdicts about laws in cases where multiple systems, containing different regularities, satisfy these standards equally well. This problem affects every version of the BSA because it arises regardless of which standards for theory-choice Humeans adopt. In this (...) paper, we propose a Humean response to the problem. We invoke pragmatic aspects of Humean laws to show that the BSA, despite violating some of our intuitive judgements, can capture everything that is relevant for scientific practice. (shrink)
