This paper provides a detailed analysis of how, according to Kant, the moral badness of some third parties’ actions can be established with certainty (by anyone, not only by the agent’s own conscience or by God). This account helps clarify why Kant affirms that some forms of wrongdoing (of which there are a “multitude of woeful examples”) can be demonstrated to be immoral, while excluding the possibility of proving the moral goodness of any action. A statement of hyperarithmetic analysis is a sentence of second order arithmetic S such that for every Y⊆ω, the minimum ω-model containing Y of RCA0 + S is HYP, the ω-model consisting of the sets hyperarithmetic in Y. We provide an example of a mathematical theorem which is a statement of hyperarithmetic analysis. This statement, that we call INDEC, is due to Jullien [13]. To the author's knowledge, no other already published, purely mathematical statement has been found with this property (...) until now. We also prove that, over RCA0, INDEC is implied by [Formula: see text] and implies ACA0, but of course, neither ACA0, nor ACA 0+ imply it. We introduce five other statements of hyperarithmetic analysis and study the relations among them. Four of them are related to finitely-terminating games. The fifth one, related to iterations of the Turing jump, is strictly weaker than all the other statements that we study in this paper, as we prove using Steel's method of forcing with tagged trees. The fiduciary nature of the patient-physician relationship requires clinicians to act in the best interest of their patients. Patients are vulnerable due to their health status and lack of medical knowledge, which makes them dependent on the clinicians’ expertise. Competent patients, however, may reject the recommendations of their physician, either refusing beneficial medical interventions or procedures based on their personal views that do not match the perceived medical indication. In some instances, the patients’ refusal may jeopardize their health or life (...) but also compromise the clinician’s moral responsibility to promote the patient’s best interests. In other words, health professionals have to deal with patients whose behavior and healthcare decisions seem counterproductive for their health, or even deteriorate it, because of lack of knowledge, bad habits or bias without being the patients’ free voluntary choice. The moral dilemma centers on issues surrounding the limits of the patient’s autonomy (rights) and the clinician’s role to promote the well-being of the patient (duties). In this paper we argue that (1) the use of manipulative strategies, albeit considered beneficent, defeats the purpose of patient education and therefore should be rejected; and (2) the appropriate strategy is to empower patients through patient education which enhances their autonomy and encourages them to become full healthcare partners as opposed to objects of clinical intervention or entities whose values or attitudes need to be shaped and changed through education. First, we provide a working definition of the concept of patient education and a brief historical overview of its origin. Second, we examine the nature of the patient-physician relationship in order to delineate its boundaries, essential for understanding the role of education in the clinical context. Third, we argue that patient education should promote self-rebiasing, enhance autonomy, and empower patients to determine their therapeutic goals. We defend, from a contractarian perspective, that the fair price of an insurance policy is the amount that the contracting parties agree when they are both equally uncertain about the insured event. Drawing on the approach developed by R. Sugden in _The Community of Advantage_, we answer two standard objections raised against contractarianism in the actuarial sciences: (1) people are not wise enough to assess their actuarial risks; (2) they are not rational enough to decide which insurance policy suits them (...) better. We show under which circumstances people can make fair actuarial agreements, without presupposing any objective risk or rationality benchmarks. (shrink)

Making use of facilitating payments is a very widespread form of corruption. These consist of small payments or gifts made to a person – generally a public official or an employee of a private company – to obtain a favour, such as expediting an administrative process; obtaining a permit, licence or service; or avoiding an abuse of power. Unlike the worst forms of corruption, facilitating payments do not usually involve an outright injustice on the part of the payer as they (...) are entitled to what they request. This may be why public opinion tends to condone such payments; often they are assumed to be unavoidable and are excused on the grounds of low wages and lack of professionalism among public officials and disorganisation in government offices. Many companies that take the fight against “grand” corruption very seriously are inclined to overlook these “petty” transgressions, which are seen as the grease that makes the wheels of the bureaucratic machine turn more smoothly. Despite this, facilitating payments have a pernicious effect on the working of public and private administrations: all too often they are the slippery slope to more serious forms of corruption; they impose additional costs on companies and citizens; and in the long run they sap the ethical foundations of organisations. Although many articles on corruption mention facilitating payments, there have been no systematic studies from a company’s point of view. This article thus focuses on facilitating payments from the point of view of the company that makes the payment, either as the active partner (when it is the company that takes the initiative) or as the passive partner (when the official or employee is the instigator). This article serves as an introduction to the collection of papers in this monographic issue on “What the European tradition can teach about Corporate Social Responsibility” and presents the rationale and the main hypotheses of the project. We maintain that corporate social responsibility (CSR) is an ethical concept, that the demands for socially responsible actions have been around since before the Industrial Revolution and that companies have responded to them, especially in Europe, and that the content of CSR has evolved (...) over time, depending on historical, cultural, political, and socio-economic drivers and particular conditions in different countries and also at different points in time. Therefore, there is not – and probably cannot be – a unique, precise definition of CSR: one global standard for CSR is unlikely. (shrink)

Pour cela, il retrace le processus de migration des savoirs indigénistes depuis leur contexte d'origine au Mexique jusqu'au Brésil, et les transformations qu'ils connaissent au cours de leur trajectoire jusqu'à aujourd'hui, en s'appuyant sur la notion de « traditions de savoirs » pour la gestion des populations qui se sont développées à partir de l'époque coloniale. Cette approche participe d'une anthropologie du colonialisme, en ce qu'elle étudie les (...) conceptions de la diversité culturelle des populations dans les administrations publiques brésiliennes et les façons de gouverner celles-ci. Desde el pasado a la más rabiosa actualidad, se trata de mostrar cómo (...) hay otra forma de enseñar la utopía, que puede ser un pensamiento racional, y algo más pragmático, de lo que quizás nos inculcaron, algo con una vigencia y una potencialidad que diversas fuentes, desde la investigación social, y educativa, pueden atestiguar. In this article we aim to distinguish between the transhuman and posthuman condition, according to their anthropological, ontological, and ethical natures. We will show that the current historical moment can be considered the beginning of a transhuman civilisation, given that the characteristics of the transhuman are already present in today’s human being. We will show that a series of decisive limitations for belonging to the human condition are in the process of being transcended due to acquisition of attributes of divinity (...) that human beings do not currently possess: omnipotence, omnipresence , ex nihilo creation – starting from the divine creative ideation – and immortality. Humans are increasingly taking on the attributes of divinity in the process of human enhancements. We will discuss the ways in which technology allows the human to overcome these limitations, elevating humans past their current condition, in a process in which they gain technological transcendence. Excepting immortality, all other limitations, once exceeded, generate a transhuman condition. Immortality generates a posthuman condition, since it can only be obtained by modifying the human ontological status from that of a biological being to that of a resident being in informatics networks. In order to clarify this process, we will discuss the concepts of everlastingness and artificial life prolongation. (shrink)

This paper introduces a formal concept of ideology and ideological system. The formalization takes ideologies and ideological systems to be situated in agent societies. An ideological system is defined as a system of operations able to create, maintain, and extinguish the ideologies adopted by the social groups of agent societies. The concepts of group ideology, ideological contradiction, ideological dominance, and dominant ideology of an agent society, are defined. An ideology-based concept of social group is introduced. Relations between the proposed formal (...) concept of ideology and the classical concepts of ideology elaborated in social sciences are examined. A computational notation is presented, to support the realization of ideological systems in computationally implemented agent societies. The adequacy of the approach for the formal modeling and analysis of ideological issues is illustrated through three case studies. (shrink)

Corruption (bribery, extortion, blackmail, favor‐currying, abuse of insider information, nepotism, favoritism, mafias, protection rackets, siphoning off funds, laundering illicit money) is a source of concern for governments, entrepreneurs, private individuals, non‐governmental organizations, companies – indeed, for society as a whole, on a number of levels; economic, sociopolitical, and ethical. The purpose of this article is primarily to explain why corruption is a cause for concern for companies. It begins by explaining what corruption is, describing how it occurs and offering a (...) causal explanation, and then goes on to describe how it occurs in companies and why it is a cause of concern for them. Este trabajo presenta los resultados preliminares obtenidos en la conformación del Atlas Iberoamericano en Bioética que ha desarrollado el Centro Anáhuac de Desarrollo Estratégico en Bioética (CADEBI) respecto a la identificación y análisis de las instituciones de Bioética existentes en la Región. Se realizó una revisión documental a través de motores de búsqueda, bases de datos, redes sociales y otras fuentes. La información obtenida se agrupó en seis diferentes categorías de acuerdo con la estructura, objetivos y actividades que desarrollan. De (...) esta manera, se realizó un diagnóstico inicial con base en las fuentes documentales disponibles en la Web. Como parte de los resultados, se identificaron 157 instituciones en 25 países; así como la variación en la densidad institucional, concentrándose principalmente en España (29 instituciones), México (26 instituciones), Argentina (17 instituciones), Brasil (13 instituciones), Chile (11 instituciones) y Colombia (8 instituciones). Además, se resalta la importancia de las comisiones nacionales de bioética en el desarrollo institucional, señalando la relación entre el avance científico y tecnológico de los países y el desarrollo de la bioética. El texto concluye con la propuesta de crear un Observatorio de la Red Iberoamericana de Bioética para documentar y promover el intercambio institucional y científico en la Región, así como algunas recomendaciones derivadas del desarrollo de este trabajo. Esse texto é um escrito que, ao final, é um termo médio entre um Artigo e um Ensaio. O objetivo é expor nossa compreensão sobre o sentido d“o material” e as implicações onto(epistemo)lógicas desta concepção no pensamento de Karl Marx. Em plano geral, primeiramente, nosso texto discorre sobre o que nomeamos de “a questão primeira”, qual seja: o que é “o material” no interior e no contexto dos escritos de Marx? Para cumprir essa tarefa procedemos com leituras de textos marxianos (...) visando identificar, neles, passagens importantes aonde o conceito de “material” é pressuposto, citado ou implicado. No segundo momento do texto, afirmamos que os resultados das análises do sentido d“o material” nos possibilitam induzir e/ou deduzir que o materialismo de Marx é dialético. Por fim, apresentamos algumas conclusões que decorrem do aceite da validade e veracidade da tese de que Marx pensa dialeticamente, de que seu materialismo é dialético. (shrink)

El presente ensayo indaga en el habitar como acción colectiva y su relación con la materia con que se construye el objeto habitado, proponiendo el término “xeno-metamórfico” para designar posibles estrategias que permitan nuevas formas de habitar basadas en la construcción en bahareque. En primer lugar, se hace una aproximación a los términos de espacio, territorio, lugar y paisaje como categorías que permiten clasificar aquello que habitamos para, en segundo lugar, indagar en cómo habitamos estas categorías. Au début du deuxième livre des Seconds Analytiques ( APo. ), Aristote présente quatre types de recherche possible, qu’il distingue de la manière suivante : la recherche du que ; la recherche du pourquoi ; la recherche de si c’est ; et la recherche de ce que c’est. Le sens propre et les connexions mutuelles du premier, deuxième et quatrième types de recherche ne posent pas de grand problème, ayant par ailleurs été partiellement exposés dans d’autres contextes. Il en va (...) cependant autrement du troisième type de recherche. La pertinence de telles difficultés peut être saisie par la double lecture que permet la clause grecque ei estin (« si c’est ») qui s’y rapporte. Devons-nous la comprendre dans le sens de « si telle chose est (ou : si telle chose existe ) » (par exemple, « si le centaure existe ») ou dans le sens de « si ceci est tel » (par exemple, « si ceci est un centaure »)? Dans le but de répondre à cette question, nous adopterons le programme suivant : 1. En premier lieu, nous ferons une analyse aussi proche et détaillée que possible de APo. II 1-2, de manière à déterminer le sens qui doit y être donné à la clause ei estin (« si c’est »). 2. Nous chercherons ensuite à démontrer la conclusion à laquelle nous avons abouti en nous aidant des chapitres suivants des APo., chapitres dans lesquels la question est à nouveau explicitement et implicitement invoquée. 3. Enfin, nous analyserons les autres passages du corpus aristotélicien dans lesquels la critique a relevé de supposées « hypothèses d’existence », et ce, de manière à vérifier si ceux-ci sont susceptibles d’une lecture compatible avec celle qui aura été donnée de APo. II 1-2. Nous en conclurons que l’on ne retrouve aucune trace de préoccupations existentielles dans les passages qui ont fait l’objet de cette recherche ni, en général, dans les passages connexes du corpus aristotélicien. Ainsi, la lecture existentielle de la clause ei estin et des hypothèses scientifiques qui y sont liées sont plutôt le fruit d’une contamination moderne. (shrink)

Esse texto, um dos melhores exemplos do pensamento medieval, é um autêntico repositório simbólico do conhecimento da tradição abraâmica. Ao mesmo tempo, o mestre murciano atribui essa obra a uma experiência visionária na forma de conhecimento descendente do qual ele se sentia um mero transcritor. Este trabalho se propõe a analisar simbolicamente os desafios de um livro visionário e, por outro lado, os (...) recursos que ele utiliza: os profetas como arquétipos para justificar a antropologia transcendental do ser humano perfeito (insān al-kāmil) e a metodologia da "cadeia ligada" para legitimar um conhecimento além da razão. Recent neuro-psychoanalytic literature has emphasized the view that our subjective identity rests on ancient subcortical neuro-psychic processes expressing unthinking forms of experience, which are “affectively intense without being known” (Solms and Panksepp, 2012). Devoid of internal representations, the emotional states of our “core-Self” (Panksepp, 1998b) are entirely “projected” towards the external world and tend to be discharged through instinctual action-patterns. However, due to the close connections between the subcortical and the cortical midline brain, the emotional drives may also find a (...) way to be reflected within an intrinsic self-referential processing, evident when the organism is not actively engaged with the external world. Thanks to such endogenous functioning, the core-Self emotional dispositions are not overtly executed, but they are organized within coherent dynamic mental structures, called “feeling-toned complexes” by C.G. Jung and “unconscious phantasies” by Melanie Klein. The intrinsic self-referential dynamism of the ‘brainmind’ originated from REM sleep arousal and then evolved in the resting-state activity of a complex of cortico-limbic midline brain structures (CMS), also called Default Mode Network (DMN). From our neuro-ethological perspective, it is sustained by an “introverted” SEEKING activity leading to the subjective exploration of internally constructed virtual scenarios. This “mind wandering” function, implicated in dreaming, fantasy processing, remembering and thinking, is the essence of the imaginative function and constitutes the first form of reflection, where intentions and drives gain a primordial form of conscious (but not self-conscious) representation. During postnatal development, this original (“archetypal”) imaginative function is slowly attuned in a relational “transitional” space and may be expressed first in non-verbal and eventually in abstract-verbal social communicative patterns. Our view has noticeable implications for psychotherapy. Instead of trying to directly modify interpersonal, extrinsic relationships (a top-down approach), dysfunctional emotional-relational patterns may be modified by a process in which the patient is helped to let-go of the perceived feeling-objects in favor of an immersion, via the actual feeling, from the superficial level of perception towards a void feeling-state, empty of images. Only starting from this “anoetic” feeling-state, the deep imaginal creative and re-structuring self-referential activity may be reactivated by a process of spontaneous imagination. (shrink)

The main purpose of this article is to identify the inner human activity Peirce calls musement with the mental processes that arise through the workings of the brain’s default mode network. This network is a specific, recently anatomically defined brain system, which is most active when individuals are not focused on the external environment. In doing so, musement, which was defined by Peirce over a hundred years ago, will finally be situated within what today we understand as its neurobiological origin.

This international series publishes outstanding philosophical monographs and edited volumes about Wittgenstein. Publications may focus on his work as a whole or on specific topics. The series also addresses Wittgenstein's life, his sources, and the impact of his works. The volumes are peer-reviewed and present state-of-the-art Wittgenstein research. In the early Sixties, the Sicilian jurist Vittorio Frosini was the first to attempt an historicization of Hans Kelsen’s Italian inheritance. Frosini asserts that we cannot disregard the extreme outcomes of the reine Rechtslehre and in a lucid criticism of Kelsenism, he points out that the law is not an empty form of Kantian purity, but instead, structure, social praxis, and “morphology of the praxis”.

O sentido deste ensaio é o de pensar o sentido e o lugar da filosofia na época da globalização, mas por via de um recuo histórico, por forma a desafiar a visão dominante segundo a qual a globalização é um fenômeno atual. Para o efeito, procurarei abordar quatro questões: 1) Em que ambiente sociocultural, melhor, em que civilização, se dá a ruptura que conhecemos aqui por “primeira globalização”? 2) Que modo de consciência veio ela perturbar e alterar? 3) Que efeitos (...) teve sobre a filosofia tal perturbação? 4) Que tem o homem moderno e a filosofia atual a aprender com a resposta às três questões anteriores? The deep relationship between the Phaedo and the Parmenides has long been recognised. However, this relationship is usually seen from the point of view of the alleged criticism in Plato's Parmenides of the theory of ideas contained in the Phaedo and in the dialogues which are doctrinally akin to it. For this reason, the thesis argued for in this article is a much rarer one: namely, that the Parmenides represents, within the unity of Plato's thought, the single moment in which (...) the theory of ideas proposed in the Phaedo is radically demonstrated and the notion of 'idea' becomes fully clarified. The objective of this paper is to investigate both dialogues from the point of view of the notion of 'idea' that they implicitly propound, taking into consideration two crucial passages of the Phaedo and the Parmenides whose significance, although frequently ignored, permits overall such a notion to be established. Through this commentary it will then be possible to attain, as its final goal, an enlightening understanding of the nature of platonic 'idea'. But another consequence follows from it: the preclusion of the common, yet particularly misleading, translation of είδος by "Form". (shrink)

Dopo quasi un secolo dalla sua pubblicazione,infatti, l’opera suggerisce un cambio di prospettiva dai risvolti decisamentepratici. Lo scopo del presente contributo consiste nell’evidenziare, attraverso laprospettiva whiteheadiana, l’ossimorica natura dell’attuale diritto dell’ambientee nel proporre una possibile soluzione ai vulnera che affliggono la tutela degliecosistemi.
