Barbey & Sloman (B&S) attribute base-rate neglect to associative processes (like retrieval from memory) that fail to adequately represent the set structure of the problem. This commentary notes that associative responses can also lead to base-rate overweighting. We suggest that the difference between the two patterns is related to the distinction between decisions from experience and decisions from description.

This article described three heuristics that are employed in making judgements under uncertainty: representativeness, which is usually employed when people are asked to judge the probability that an object or event A belongs to class or process B; availability of instances or scenarios, which is often employed when people are asked to assess the frequency of a class or the plausibility of a particular development; and adjustment from an anchor, which is usually employed in numerical prediction when a relevant value (...) is available. These heuristics are highly economical and usually effective, but they lead to systematic and predictable errors. A better understanding of these heuristics and of the biases to which they lead could improve judgements and decisions in situations of uncertainty. (shrink)

Research on cross-border reproductive care has shown how the geographical, historical, economic and political contexts in which egg donation takes place shape this transnational practice. As many women offer their oocytes due to their precarious conditions, they become seen as ‘bioavailable bodies’. The presence of these bioavailable bodies is key to the emergence of global egg donation hotspots. We argue that feminist research needs to go beyond the conceptualization of egg donors as bioavailable bodies. We suggest the analysis of ‘reproductive (...) biographies’ as an innovative way to understand the entanglements of the global bioeconomy with intimate experiences of reproduction. We suggest advancing current feminist discussions around clinical labour by studying the entanglements between the global bioeconomy, a neoliberalized healthcare system, systematic feminicide and women’s reproductive biographies, and by revealing how women’s decision to donate results from gendered dependencies, obligations of care and coercive moments in egg donors’ reproductive biographies. Eye tracking is used to investigate human choice procedures. We infer from eye movement patterns in choice problems where the deliberation process is clear to deliberations in problems of choice between two lotteries. The results indicate that participants tend to compare prizes and probabilities separately. The data provide little support for the hypothesis that decision makers use an expected utility type of calculation exclusively. This is particularly true when the calculations involved in comparing the lotteries are complicated.

In his recent Ars Disputandi article, ‘Some Difficulties for Amos Yong’s Disability Theology of the Resurrection,’ Ryan Mullins argues that Yong’s proposals are fundamentally misguided by Stanley Hauerwas’ dictum – which states that to ‘eliminate the disability means to eliminate the subject’ – and that therefore Yong’s disability theology of the resurrection body encounters potentially insuperable difficulties or is not sufficiently justified in the face of more traditional accounts. In response to Mullins’ criticisms, clarifications are offered with regard to (...) both the role of Hauerwas’ notion in Yong’s theology and the theological basis for claims regarding the persistence of the marks of impairment in the resurrection body. This book offers a fresh account of one of the remarkable figures in the Renaissance, Giovanni Pico della Mirandola (1463-1494), by focusing on a neglected aspect of his work; his reading of scholasticism and its reception in the fifteenth century.

The contribution inquires what impact pragmatism and phenomenology had and still have on education? A logical starting point to answer this question is to back to the roots as it were and to relate Otto Friedrich Bollnow and John Dewey with respect to their understanding of experience and the role experience plays in education. Both have defended their understanding of experience in the context of major debates in the field of education. Dewey in 1938 after facing major criticism for the (...) idea of a progressive education, which defines the foundations of the the process of learning on experiences rather than on a canon of knowledge. Bollnow positions himself in the methodological dispute of the 1960s and 1970s concerning a philosophical versus an empirical approach in education. Focusing on experience, Bollnow takes a third position in this debate, arguing that experience, while being empirical, needs to be interpreted hermeneutically. Amos points out that Bollnow and Dewey share the quest for orienting education toward experience, but also draws attention to some major differences. Dewey’s account of experience is an optimistic one. Bollnow on the other hand points to the danger of incrustation and rigidity of well-experienced positions. (shrink)

Amos departs from Austin, who Amos considered "the true founder of the science of law", in important fundamentals. In this text, Amos sets out to draw a "clear line of demarcation between ethical & legal conceptions".

Moral distress has been well reviewed in the literature with established deleterious side effects for all healthcare professionals, including nurses, physicians, and others. Yet, little is known about the quality and effectiveness of interventions directed to address moral distress. The aim of this integrative review is to analyze published intervention studies to determine their efficacy and applicability across hospital settings. Of the initial 1373 articles discovered in October 2020, 18 were appraised as relevant, with 1 study added by hand search (...) and 2 after a repeated search was completed in January and then in May of 2021, for a total of 22 reviewed articles. This review revealed data mostly from nurses, with some studies making efforts to include other healthcare professions who have experienced moral distress. Education-based interventions showed the most success, though many reported limited power and few revealed statistically lowered moral distress post intervention. This may point to the difficulty in adequately addressing moral distress in real time without adequate support systems. Ultimately, these studies suggest potential frameworks which, when bolstered by organization-wide support, may aid in moral distress interventions making a measurable impact. (shrink)

In order to inquire into the possibility of a theory of education which, when constructed, will not turn out to be one-sided, three possibilities must be considered.

Zusammenfassung Childs’ Rekonstruktion der Genealogien wird bestätigt: Der Pfeiler ist wahrscheinlich von Cherẽi und nicht von Cheriga errichtet worden. Die am Ende der Südseite erwähnten Schlachten fanden wahrscheinlich nicht später als 428 v. Chr. statt. Die auf der Ostseite erwähnten Aktionen sind wahrscheinlich nicht später als 424 v. Chr., weil Ertaχssiraza unmittelbar vor einer Aktion des Dynasten Teϑϑiweibi erwähnt wird und daher mit Artaxerxes I. gleichzusetzen ist. In einer zuvor berichteten militärischen Aktion erscheinen Miϑrapata, Aruwãtijesi und die „Triere des Cherẽi“. (...) Am Beginn der Nordseite gibt es einen Sprung bis wahrscheinlich 412/411 v. Chr., als der Satrap Tissaphernes in Kaunos tätig war. Am Ende des Prosatextes ist wahrscheinlich in ]welẽ der Name des Dynasten Ddenewele zu sehen, als „sein Sohn“, d. h. Cherẽis Sohn und Nachfolger. Die griechischen Verse danach rühmen den Sohn des Harpagos, und sein Name sollte nach dem Καρικα γένος zu [Καρ.]ις ergänzt werden, nicht zu [Γεργ]ις. Die ihm zugeschriebene Tötung von sieben arkadischen Hopliten an einem Tag erklärt die sonst kryptische Zahl CII im Feldzug gegen Tlos. Die anschließenden B-lykischen Verse gelten aber Cheriga, und das Nordgedicht mag zu seinen Lebzeiten gedichtet worden sein, weil er hier handelnd auftritt. Der einzige chronologische Fixpunkt ist die Schlacht an der Mykale 428 v. Chr., von der auf der Südseite berichtet wird. Im Westgedicht tritt eine Frau namens Muni an die Stelle des Cheriga, und das könnte seine Frau sein, die nach dem Tod des Cherẽi die Herrschaft übernommen haben könnte. Dieses Bild von der Pfeiler-Chronologie ist vereinbar mit Müselers Chronologie der dynastischen Münzen mit den Namen von Cheriga, Teϑϑiweibi, Cherẽi und Ddenewele. Allerdings können im Rahmen dieses Konzepts andere auf dem Pfeiler vorkommende Dynasten wie Trbbẽnimi, Miϑrapata und Aruwãtijesi nicht mit den gleichnamigen Münzprägern identisch sein, mit der möglichen Ausnahme des Punamuwa. Außerdem ist der Cheriga der Münzen zwar sicher mit dem Cheriga auf dem Pfeiler identisch, aber offenbar nicht mit Cheriga, dem Vater des Erbbina in den Letoon-Inschriften. Doch der Dynast Waχssepddimi auf dem Pfeiler ist möglichwerweise identisch mit dem älteren der beiden Weχssere genannten Dynasten, der im Xanthostal unmittelbar nach der Herrschaft des Kuprlli Münzen prägte. Traditional state v. state war is largely a relic. How then does a nation-state protect itself - preemptively - against the unseen enemy? Existing international law - the Caroline Doctrine, UN Charter Article 51, Security Council Resolutions 1368 and 1373 - do not provide sufficiently clear guidelines regarding when a state may take preemptive or anticipatory action against a non-state actor. This article proposes rearticulating international law to allow a state to act earlier provided sufficient intelligence is available. After examining (...) international law, this article proposes a process-based "strict-scrutiny" approach to self-defense. Under this approach, the executive will have to convince a court, based on relevant, reliable, viable, and corroborated intelligence, that preemptive action is appropriate. This process leads to a check on the power o the executive by placing a judicial check on preemptive action, consequently establishing objective legal criteria for operational counterterrorism. Despite the fact that six years have passed since 9/11, the Pentagon's recent decision to try six Guantanamo detainees for capital crimes such as terrorism and support of terrorism made national headlines. William Glaberson, "U.S. Charges 6 With Key Roles in 9/11 Attacks", N.Y. Times, Feb. 11, 2008, at A1. In this Debate, Professors Amos N. Guiora, of the University of Utah, and John T. Parry, of Lewis & Clark Law School, attempt to settle the question of what sort (...) of forum is most appropriate to try the thousands of individuals in U.S. custody who are suspected of terrorism. Professor Guiora considers three forum options: treaty-based international terror courts, traditional Article III courts, and a hybrid option he calls domestic terror courts. Ultimately, Professor Guiora argues in favor of domestic terror courts, which he describes as being able to balance the legitimate rights of the individual with the equally legitimate national security rights of the state. He considers this option to be the most practical and expedient policy solution, necessitated by an untenable tension between the understanding that some of the detainees present a genuine threat to American national security, and an awareness that indefinite detention violates constitutional principles and fundamental concepts of morality. Professor Parry agrees that current U.S. policy toward detainees has been misguided, but does not believe that innovations of the sort proposed by Professor Guiora are necessary. Rather, he suggests that policymakers should choose Article III courts rather than hybrid courts for trials of suspected terrorists, with military courts as a fallback option. Professor Parry points to research that shows that the federal government is often able to prosecute suspected terrorists in federal court, and therefore considers alternative proposals to Article III courts to be solution[s] in search of a problem. Professor Parry realizes that trial in federal court will not be possible for every suspected terrorist, and concludes that, [f]or people who pose a risk but whose conduct may not violate federal criminal law, prolonged preventive detention is the best choice. The starting-point and, at the same time, the foundation of recent scholarship on the Arabic translations of Aristotle's Metaphysics are Maurice Bouyges' excellent critical edition of the work in which the extant translations of the Metaphysics are preserved – i.e. Averroes' Tafsīr of the Metaphysics – and his comprehensive account of the Arabic translations and translators of the Metaphysics in the introductory volume. Relying on the texts made available by Bouyges and the impressive amount of philological information conveyed in his (...) edition, subsequent scholars have been able to select and focus on more specific topics, providing, for example, a closer inspection of the Arabic translations of the single books of the Metaphysics, or a detailed comparison of some of these translations with the original text of the Metaphysics. A new trend of research in recent times has been the study of these versions as part of the wider context of the Graeco-Arabic translation movement. (shrink)

By Jacques Dupuis, S.J. Maryknoll, New York: Orbis Books. 1997. xiv + 433 pp. There may not be another individual more qualified than Jacques Dupuis to write this book. He has not only spent a lifetime teaching and serving in a part of the (...) world where the encounter between Christianity and other faiths has been particularly pressing (India), but he has also previously reflected intensively and published widely on this topic. Even more impressive, however, is the fact that the scholarship that emerges in this volume reflects Dupuis as a faithful Catholic Christian, both in the sense of paying sincere heed to the wide range of the Roman Church's official teachings on this and related topics (he taught for years at the Gregorian University in Rome and edited, with Josef Neuner, the massive The Christian Faith in the Doctrinal Documents of the Catholic Church 1 ) and in the sense of thinking along with others in the universal community of faithful Christians. Here we have a master theologian practicing his craft, working within a community of theological inquirers, bringing out, displaying, and putting to work old things and new in the effort to understand one of the most crucial issues of our time.The result is a comprehensive and lucid discussion of Christian theology of religions that is indispensable as an introduction to students without any knowledge of the landscape even while it also serves as a handy status questionis to those already [End Page 157] familiar with the terrain. The first half of the book (part 1) is an overview of the history of Christian approaches to other faiths, beginning with the biblical material, continuing through the Logos spermatikos theology of the early Fathers, the developments surrounding the Extra ecclesiam nulla salus ("no salvation outside the Church") axiom over the centuries, and the pre- and post-Vatican II attempts to develop a theology of religions in the Catholic Church. This part concludes by summarizing the paradigm shifts from ecclesiocentrism to (in order) christocentrism, theocentrism, and regnocentrism/soteriocentrism. Throughout the discussion--especially of the pre-twentieth-century history that focused much more so on the fate of the unevangelized--Dupuis manages to provide important connections to developments in Christian thinking about the role of the religions in the divine scheme of things.The second half of the volume (part 2) presents seven of the most difficult theological questions in Christian theologia religionum today. First, concerning the covenant: is there only one, or are there many? Is salvation history particular, or universal? Dupuis' provisional response is that there is one cosmic covenant that is never revoked. This covenant is revealed according to what he calls a "trinitarian rhythm" whereby God covenants through his Word, in his Spirit, and this covenant includes the witnesses of God left in other religions as well. Second, concerning revelation: does revelation come to us from "without," or emerge from "within" ourselves? What about the sacred texts of other traditions? How are Christians to understand the fullness of the revelation in Jesus Christ vis-à-vis other faiths? Dupuis' answer is that divine revelation is indeed scattered among the various religions, even if fully captured only in Christ, and that these revelations are thereby differentiated but complementary. 2 Third, concerning the divine mystery: is the "Real" beyond the categories of "personal" and "impersonal"? Is God one, or many (triune)? Dupuis responds that the religions have complementary and converging insights into the divine reality. Fourth, concerning Jesus Christ: is he one among many savior figures? What does the uniqueness of Christ mean? Is there a distinction or an absolute identity between Jesus and Christ? Is the Christ particular, or universal? Dupuis posits a "searching christology" whereby God reveals Godself in and through the images and symbols of the religions and through which humankind therefore responds to the divine graciousness.
