This Article analyzes the interaction between the burden of proof and evidentiary discovery rules. Both sets of rules can affect incentives for prospective injurers to invest in evidence technology. This interaction becomes acutely important in the private international law setting, where jurisdictions are split on the question whether the burden of proof should be treated as a substantive or procedural matter. When a tort occurs in Europe, but the case is litigated in American courts, treating the burden of proof as (...) a procedural matter preserves the complementarity of incentives created by the burden of proof and evidentiary rules. We use a lab experiment to examine whether and how leaders influence workers’ (un)ethical behavior through financial reporting choices. We randomly assign the role of leaders or workers to subjects, who can choose to report an outcome via automatic or self-reporting. Self-reporting allows for profitable and undetectable earnings manipulation. We vary the leaders’ ability to choose the reporting method and to punish workers. We show that workers are more likely to choose automatic reporting when their leader voluntarily does so and (...) can assign punishment. Even workers who choose self-reporting tend to cheat less when their leader chooses automatic reporting. Nonetheless, most leaders do not opt for automatic reporting in the first place: they often choose self-reporting and punish workers who rather choose automatic reporting. Collectively, our results reveal a dual effect of leadership on ethical behaviors in organizations: workers behave more ethically if their leader makes ethical choices, but often leaders do not make ethical choices in the first place. This article explores how corporate governance processes and structures are being used in large Australian companies to develop, lead and implement corporate responsibility strategies. It presents an empirical analysis of the governance of sustainability in fifty large listed companies based on each company’s disclosures in annual and sustainability reports. We find that significant progress is being made by large listed Australian companies towards integrating sustainability into core business operations. There is evidence of leadership structures being put in place to ensure (...) that board and senior management are involved in sustainability strategy development and are then incentivised to monitor and ensure implementation of that strategy through financial rewards. There is evidence of a willingness to engage and communicate clearly the results of these strategies to interested stakeholders. Overall, there appears to be a developing acceptance amongst large corporations that efforts towards improved corporate sustainability are not only expected but are of value to the business. We suggest that this is evidence of a managerial shift away from an orthodox shareholder primacy understanding of the corporation towards a more enlightened shareholder value approach, often encompassing a stakeholder-orientated view of business strategy. However, strong underlying tensions remain due to the insistent market emphasis on shareholder value. (shrink)

Following extensive examination of published and unpublished materials, we provide a history of the use of dexamethasone in pregnant women at risk of carrying a female fetus affected by congenital adrenal hyperplasia (CAH). This intervention has been aimed at preventing development of ambiguous genitalia, the urogenital sinus, tomboyism, and lesbianism. We map out ethical problems in this history, including: misleading promotion to physicians and CAH-affected families; de facto experimentation without the necessary protections of approved research; troubling parallels to the history (...) of prenatal use of diethylstilbestrol (DES); and the use of medicine and public monies to attempt prevention of benign behavioral sex variations. Critical attention is directed at recent investigations by the U.S. Food and Drug Administration (FDA) and Office of Human Research Protections (OHRP); we argue that the weak and unsupported conclusions of these investigations indicate major gaps in the systems meant to protect subjects of high-risk medical research. While discussions of the imagination have been limited in philosophy of science, this is beginning to change. In recent years, a vast literature on imagination in science has emerged. This paper surveys the current field, including the changing attitudes towards the scientific imagination, the fiction view of models, how the imagination can lead to knowledge and understanding, and the value of different types of imagination. While substantial evidence is emerging internationally of positive increases in the participation of women on company boards, there is less evidence of any significant change in the proportion of women in senior executive ranks. This paper describes evidence of positive changes in the number of women on boards in Australia. Unfortunately these changes are not mirrored in the senior executive ranks where the proportion of women remains consistently low. We explore some of the reasons for these disproportionate changes and examine (...) the likely effect of the recent amendments to the Australian stock exchange’s corporate governance code designed to improve gender diversity both on boards and throughout organisations. Based on the early corporate response to these regulatory changes, it is interesting to consider whether Australia’s approach in promoting voluntary self-regulation at the corporate level may be as effective in the long run as the emerging trend in Europe to apply legislated quotas for female corporate board representation. Interview evidence is presented suggesting that the primary reasons for the lack of women in leadership are not simply lack of opportunity at the apex of the corporation, but issues at mid-management level that are unlikely to be resolved by mandatory board quotas. In some circumstances carefully monitored voluntary targets may be more effective at promoting cultural and strategic change at the heart of the corporation. In summary, mandatory quotas may achieve early and significant results in terms of female board representation. However, voluntary targets for women’s participation on boards and in executive ranks may promote more effective cultural and practical change in support of greater representation of women in leadership. Thought experiments (TEs) are important tools in science, used to both undermine and support theories, and communicate and explain complex phenomena. Their interest within philosophy of science has been dominated by a narrow question: How do TEs increase knowledge? My aim is to push beyond this to consider their broader value in scientific practice. I do this through an investigation into the scientific imagination. Part one explores questions regarding TEs as “experiments in the imagination” via a debate concerning the epistemic (...) status of computer simulations in science. I outline how, against Hacking, TEs also have “a life of their own” and I argue against accounts that privilege experiments over simulations (and by extension TEs) in light of their capacity to surprise in a productive way. Part two develops a pluralist account of the nature of the imagination in science. At its core, my view is that when we attend to a number of examples of TEs and consider the context in which they are used, we see that TEs engage a variety of our imaginative capacities. Existing monistic views fail to recognise the richness of the imagination and its potential in science. Part three looks to the “beauty” of TEs which is currently overlooked in the aesthetics of science literature. I put forward a new account that demonstrates the epistemic value of aesthetic features in science by showing how an appropriate fit between form and content enhances the usability of a TE, and its effectiveness as a prompt for our imagination. This also enables a more nuanced take on the proposed similarities between TEs and literary fictions. In the concluding chapter, I outline ways in which the core features of my account can be extended beyond TEs to illuminate the significance of the imagination and aesthetic values in other areas of science. The development of executive functions is recognizably correlated to culture, contextual and social factors. However, studies considering all the basic EF are still scarce in Brazil, most notably in the Northeast region, which is known for its social inequality and economic gap. This study aimed to analyze the developmental trajectories and structure of four EF, namely inhibition, flexibility, working memory and planning. In addition, the potential effects of socioeconomic status and gender were examined. The sample included 230 Brazilian children between (...) 7-12 years old, homogeneously distributed by age, gender and type of school. The EF were assessed through the Brazilian version of the Child Executive Functions Battery. A global effect of age was found for most of the EF measures evaluated. Gender effect was mostly non-significant, except for 4 of the 12 tasks. There was a significant SES effect on 8 tasks, all in favor of private school children. Exploratory factorial and correlation analysis showed a 4-factor EF structure, corroborating the theoretical distribution considered in the CEF-B. A developmental progression is evident in the results for all of the EF measures evaluated. While gender had little influence on EF, SES seems to significantly impact the development of EF. As normative data are still lacking in Northeast Brazil, this study may help to understand EF development trajectories and provide tools for neuropsychological evaluation. (shrink)

To reduce ambiguity across a conversation, interlocutors reach temporary conventions or referential precedents on how to refer to an entity. Despite their central role in communication, the cognitive underpinnings of the interpretation of precedents remain unclear, specifically the role and mechanisms by which information related to the speaker is integrated. We contrast predictions of one-stage, original two-stage, and extended two-stage models for the processing of speaker information and provide evidence favoring the latter: we show that both stages are sensitive to (...) speaker-specific information. Using an experimental paradigm based on visual-world eye tracking in the context of a referential communication task, we look at the moment-by-moment interpretation of precedents and focus on the temporal profile of the influence of the speaker and linguistic information when facing ambiguity. We find two clearly identifiable moments where speaker-specific information has its effects on reference resolution. We conclude that these two stages reflect two distinct cognitive mechanisms, with different timings, and rely on different representational formats for encoding and accessing information about the speaker: a cue-driven memory retrieval process that mediates language processing and an inferential mechanism based on perspective-taking abilities. A pesar de los innumerables beneficios, hay varias críticas y preocupaciones en relación con el uso de la Inteligencia Artificial (IA), especialmente en Brasil, donde no hay ninguna legislación federal en vigor hasta el momento. Las legislaciones estatales existentes y los proyectos de ley que se están votando en el Congreso, como el PL 21/20, son defectuosos e incompletos, especialmente en lo que respecta a algunas aplicaciones de la IA que implican altos riesgos para los derechos y libertades fundamentales, además (...) de traer a menudo un sesgo potencial, duplicando o potenciando el racismo institucionalizado existente en la sociedad u otras formas de discriminación. Existe una inequidad codificada que propicia infraestructuras injustas, sinembargo, donde hay poder hay resistencia, y en este sentido es necesario señalar la importancia de las contra codificaciones basadas en la solidaridad y que repiensan la justicia, es decir, un enfoque emancipador de la tecnología. Este es el cambio paradigmático necesario, y siendo necesario, tiene que ser posible y debe buscarse con el máximo esfuerzo. Comentamos y discutimos, en esta nota, algunas de las reconceptualizaciones normativas y aplicaciones diversas del paradigma de la Justicia Global. Los trabajos de Pogge compilados en Hacer justicia a la humanidad proporcionan una visión de conjunto del objetivo pragmático de su pensamiento: erradicar la pobreza severa. Discutimos, en primer lugar, su operación de otorgar carácter negativo a los derechos económicos y sociales por considerarlo erróneo y desencaminado tanto en la teoría como en sus repercusiones prácticas. Finalmente, enjuiciamos favorablemente su reflexión (...) acerca de la Equidad de Género en el contexto de los debates en torno a la medición de la pobreza y la analítica de las desigualdades. Su problematización a este respecto, permitiría una fructífera intersección con la crítica feminista a los marcos teóricos hegemónicos del desarrollo humano y a los impactos de la globalización sobre las mujeres.
