The aim of this chapter is to describe a type of law governing involuntary treatment that is based on decision-making capability and not on risk of harm to self or others. It is consistent with the legal and ethical principles followed in general medicine, and non-discriminatory against people with a mental illness. The rationale behind the proposal is outlined, as well as its principles and main features. It is argued that this type of law could be adapted to the needs (...) of low and middle-income countries without sacrificing its underlying principles, and that it lends itself to such adaptation much better than traditional mental health legislation. BackgroundAmidst expanding roles in education and policy making, questions have been raised about the ability of Clinical Ethics Committees (CEC) s to carry out effective ethics consultations (CECons). However recent reviews of CECs suggest that there is no uniformity to CECons and no effective means of assessing the quality of CECons. To address this gap a systematic scoping review of prevailing tools used to assess CECons was performed to foreground and guide the design of a tool to evaluate the quality (...) of CECons.MethodsGuided by Levac et al’s (2010) methodological framework for conducting scoping reviews, the research team performed independent literature reviews of accounts of assessments of CECons published in six databases. The included articles were independently analyzed using content and thematic analysis to enhance the validity of the findings.ResultsNine thousand sixty-six abstracts were identified, 617 full-text articles were reviewed, 104 articles were analyzed and four themes were identified – the purpose of the CECons evaluation, the various domains assessed, the methods of assessment used and the long-term impact of these evaluations.ConclusionThis review found prevailing assessments of CECons to be piecemeal due to variable goals, contextual factors and practical limitations. The diversity in domains assessed and tools used foregrounds the lack of minimum standards upheld to ensure baseline efficacy.To advance a contextually appropriate, culturally sensitive, program specific assessment tool to assess CECons, clear structural and competency guidelines must be established in the curation of CECons programs, to evaluate their true efficacy and maintain clinical, legal and ethical standards. Recent studies show that racism still exists in the American medical profession, the fact of which legitimizes the historically long-legacy of mistrust towards medical profession and health authorities among African Americans. Thus, it was suspected that the participation of black patients in end-of-life care has always been significantly low stemmed primarily from their mistrust of the medical profession. On the other hand, much research finds that there are other reasons than the mistrust which makes African Americans feel reluctant to the (...) end-of-life care, such as cultural-religious difference and genuine misunderstanding of the services. If so, two crucial questions are raised. One is how pervasive or significant the mistrust is, compared to the other factors, when they opt out of the end-of-life care. The other is if there is a remedy or solution to the seemingly broken relationship. While no studies available answer these questions, we have conducted an experiment to explore them. The research was performed at two Philadelphia hospitals of Mercy Health System, and the result shows that Black patients’ mistrust is not too great to overcome and that education can remove the epistemic obstacles as well as overcome the mistrust. Two types of logical consequence are compared: one, with respect to matrix and designated elements and the other with respect to ordering in a suitable algebraic structure. Particular emphasis is laid on algebraic structures in which there is no top-element relative to the ordering. The significance of this special condition is discussed. Sequent calculi for a number of such structures are developed. As a consequence it is re-established that the notion of truth as such, not to speak of tautologies, is (...) inessential in order to define validity of an argument. (shrink)

Although the following essay does not strictly fall within the discipline of classical Indian philosophy, in which our Journal specializes, we publish it here for two reasons: (1) K. C. Bhattacharya was an outstanding philosopher of India in the past generation, and his thought was deeply influenced by his thorough study of classical Indian Vedanta and Jainism, as well as by the study of Kant (four of our consulting editors were his direct students). (2) His view about the notion of (...) the speakable and philosophy is unique, and it has remained opaque to most of us. Hence some discussion will be illuminating. (shrink)

In 1984, Derek Parfit, in his book Reasons and Persons, argued in favor of the reductionist view about persons, which at that time aroused a great deal of controversy. Although Parfit’s views were not accepted by the majority of the exponents of Western analytic philosophy, in Personal Identity and Buddhist Philosophy Mark Siderits observes that Parfit did not abandon the view that “the existence of a person just consists in the existence of a brain and a body and the occurrence (...) of a series of physical and psychological events”. The proposed study aims to explore the concepts of self and identity in the philosophy of Śamkarāchārya, the Vedantic philosopher. This critical study seeks to foreground Śamkara, the account of the self that overcomes the limitations of the physicalist and the mentalist accounts of the human self. It focuses on the questions of the ownership of the self, the stability of identity despite the change, the consciousness and its relation to the self. It explains the notion of self by equating (...) the self with the body or with the mind, which does not explain our sense of owning or possessing a body or a mind. The idea of self can be philosophically analyzed at two different conceptual levels: 1) one can deal with the notion of self at a metaphysical level attempting to understand the meaning and significance of this notion in general; 2) one could also deal with the notion of self along with its contextualities and particularities where one would want to understand particular conceptualization that the individual self undergoes depending upon its contexts and particularities of its situation. I would try to analyze the notion of self and Identity in Śamkara in both these senses. Other questions that arise with regard to self and identity are as follows: what kind of relationship the self bears with its identity, pre-given or constructed? Is there anything essential about the identity of the individual self? If we take up these questions, then the question of caste and gender also surface in this debate significantly. Conceptually, the self, in Śamkara’s thought, is explained concerning the ‘not self’. He argues that neither the body, nor the senses, nor even the mind can be equated with the self. That is why Brahman has been described negatively as “neti neti-not this not this”. What is the natural self and identity that one is experiencing here and now? How do we identify one self? What does it consist of? These are some of the questions that I will explicate in this paper. (shrink)

This study investigated the impact of value consonance on employee-based brand equity through the mediating role of teachers' self-efficacy and belongingness. For this purpose, a deductive approach was followed, and data were collected under a cross-sectional research design from academia through a questionnaire. Prior approval from the administration was sought before administrating the questionnaire on a large scale and a sample of 520 teachers was approached in the first phase. At this stage, 418 answered questionnaires were received, while in the (...) second wave, questions related to the teacher's self-efficacy and employee-based brand equity were asked from the respondents. Out of these 418 re-distributed questionnaires, 387 were received back and after discarding the partially filled and incomplete questionnaires, the useable sample size was left as 372. Data have been analyzed by using the structural equation modeling technique, which was assessed through measurement and structural model. Results indicate that value consonance can promote positive behaviors in the workplace. Moreover, teachers with high self-efficacy can develop based on brand equity. Similarly, employees with high-value consonance develop a sense of belongingness with their academic institutes. Limitations and future directions are also discussed. (shrink)

One of the popular theories in psychology that potentially contributes to the development of teaching and learning programs is brain dominance. According to this theory, the brain is categorized into two hemispheres based on personal traits and cognitive styles. It is interesting to investigate the correlation between brain dominance and second language learning. Therefore, this study set out to examine the correlation between brain dominance and the development of English reading, and speaking skills. For this purpose, the required data were (...) randomly gathered from 230 sophomore students in four different universities and were analyzed through a Pearson Chi-Square test, a Kruskal–Wallis test, and a Mann–Whitney test. Findings evidenced a significant correlation between brain dominance and reading skills. Three categories of brain dominance groups differ in reading skills in which moderate right-brain shows the highest score. Concerning the speaking skills, however, the results documented no significant correlation between brain dominance and speaking skills. Three groups of brain dominance were not significantly different in three aspects of speaking skills, including accuracy, fluency, and comprehensibility. The study concludes by proposing a range of implications and some avenues for further research. (shrink)

The paper considers two-agent order acceptance scheduling problems with different scheduling criteria. Two agents have a set of jobs to be processed by a single machine. The processing time and due date of each job are known in advance. In the order accepting scheduling problem, jobs are allowed to be rejected. The objective of the problem is to maximize the net revenue while keeping the weighted number of tardy jobs for the second agent within a predetermined value. A mixed-integer linear (...) programming formulation is provided to obtain the optimal solution. The problem is considered as an NP-hard problem. Therefore, MILP can be used to solve small problem instances optimally. To solve the problem instances with realistic size, heuristic and metaheuristic algorithms have been proposed. A heuristic method is used to determine and secure a quick solution while the metaheuristic based on particle swarm optimization is designed to obtain the near-optimal solution. A numerical experiment is piloted and conducted on the benchmark instances that could be obtained from the literature. The performances of the proposed algorithms are tested through numerical experiments. The proposed PSO can obtain the solution within 0.1% of the optimal solution for problem instances up to 60 jobs. The performance of the proposed PSO is found to be significantly better than the performance of the heuristic. (shrink)
