This work offers a new theory of what it means to be a legal person and suggests that it is best understood as a cluster property. The book explores the origins of legal personhood, the issues afflicting a traditional understanding of the concept, and the numerous debates surrounding the topic.

La filosofía de la historia se ha debatido durante siglos en una estéril lucha entre idealistas y materialistas. El libro de Ignacio Ellacuría es un intento de superar esa dicotomía clásica. Tomando como punto de partida algunos conceptos fundamentales de la filosofía de Zubiri, Ellacuría cree posible asumir y a la vez criticar ambos extremos, desde una actitud más realista. De ahí el título del libro. Es importante destacar que la historia, para Ignacio Ellacuría, es el lugar de realización de (...) la ética. La historia no está hecha, se construye, es un proceso de creación de posibilidades humanas, y, en tanto que tal, una labor ética. La tesis de Zubiri de que el hombre tiene que hacerse cargo de la realidad, en Ellacuría se transforma en esta otra: el ser humano está obligado a encargarse de la realidad, y a cargar con ella. Este es el imperativo ético. Imperativo que, por otra parte, no sólo le obliga individualmente al hombre, en el reducto de la propia conciencia, al modo del idealismo, ni tampoco sólo en tanto que miembro de una clase social, como en el marxismo, sino como sujeto a la vez individual y específico, como miembro a la vez solitario y solidario de la especie humana. La obra póstuma de Ignacio Ellacuría constituye sin duda su más ingente trabajo intelectual en el campo de la filosofía, y representa, por su calidad y contenido, una pieza clave para comprender no solamente su producción estrictamente filosófica, sino también su pensamiento teológico y socio-político. This analysis examines the practice of care providers in residential aged care lying to residents with dementia. Qualitative data were collected through multiple methods. Data here represents perceptions from registered and enrolled nurses, personal care assistants, and allied health professionals from five residential aged care facilities located in Queensland, Australia. Care providers in residential aged care facilities lie to residents with dementia. Lying is conceptualized as therapeutic whereby the care provider’s intent is to eliminate harm and also control behaviour. Care (...) providers of residents with dementia in RACFs need guidance around lying. An ethical framework cognisant of an ethical theory of good and ethical theory of right supplemented by a theory of virtue is proposed. A complimentary four stage communication strategy that promotes truth telling as a first option while also recommending the lie as a suitable strategy is also promoted. (shrink)

Exploring history pertinent to evolutionary developmental biology (hereafter, Evo-devo) is an exciting prospect given its current status as a cutting-edge field of research. The first and obvious question concerns where to begin searching for materials and sources. Since this new discipline adopts a moniker that intentionally juxtaposes ‘evolution’ and development’, individuals, disciplines, and institutional contexts relevant to the history of evolutionary studies and investigations of ontogeny prompt themselves. Each of these topics has received attention from historians and thus there is (...) both primary and secondary material from which to draw. For example, many historians have documented the historical trajectories of genetics and embryology, their split, and various relations (or lack thereof), especially in the first three decades of the 20th century. The “erasing race” effect is the reduction of the salience of “race” as an alliance cue when recalling coalition membership, once more accurate information about coalition structure is presented. We conducted a random-effects model meta-analysis of this effect using five United States studies (containing nine independent effect sizes). The effect was found (ρ = 0.137, K = 9, 95% CI = 0.085 to 0.188). However, no decline effect or moderation effects were found (a “decline effect” in this context would be (...) a decrease in the effect size over time). Furthermore, we found little evidence of publication bias. Synthetically correcting the effect size for bias stemming from the use of an older method for calculating error base rates reduced the magnitude of the effect, but the it remained significant. Taken together, these findings indicate that the “erasing race” effect generalizes quite well across experimental contexts and would, therefore, appear to be quite robust. We reinterpret the theoretical basis for these effects in line with Brunswikian evolutionary-developmental theory and present a series of predictions to guide future research in this area. (shrink)

Part one is a brief summary of the principal theories of feeling. Part two is devoted to "sensory" or "bodily" pleasure and unpleasure. These forms of feeling, it is argued, 'depend on an analogue of conation existing in the organism, a nisus to maintain, or to carry out to the (...) full extent, the functioning proper to the bodily system.' Part three -- the piece de resistance (about half the book) -- deals with the relation of pleasure and unpleasure to the main instincts. Parts four, five and six take up a number of classical problems: the relation of pleasure and unpleasure to sensation, their relation to desire, the relativity of feelings, the qualitative variety of feelings, and the psychology of values.
