Este artículo ofrece una aproximación psicoanalítica al Derecho en el contexto de un mercado global como el actual. El propósito es explicar la ruptura entre Derecho, mercado y política, como consecuencia de la globalización económica, y proponer un esquema para pensar su posible articulación. Para explicar la ruptura entre Derecho, mercado y política, se describen tres modos de relación con el Derecho en la evolución de la economía de mercado, en analogía con los modos de relación con la ley edípica (...) en las tres estructuras psíquicas que define Lacan (psicótica, neurótica, perversa); la conclusión es que el modo de relación con el Derecho en el contexto económico actual corresponde a una estructura perversa. Para pensar la posible articulación entre Derecho, mercado y política, se recurre a una analogía con los tres registros de lo psíquico según Lacan -Simbólico, Imaginario, y Real-, y al concepto de sinthome, como solución singular que permite anudar esos tres registros. Les deux auteurices ont proposé à Corentin Lê de se joindre, le temps d’un échange, à leurs déambulations théoriques.

Trata-se de uma pesquisa de natureza bibliográfica, com abordagem quanti-qualitativa, de caráter descritivo-exploratório que objetiva analisar a produção do conhecimento do Curso de Educação Física da Universidade do Estado do Pará em Altamira, no período de 2011-2018. Os achados apontam uma evolução do modo de produzir conhecimento, pois constatou-se uma redução dos vazios analíticos presentes nas pesquisas analisadas. Conclui que há um aumento no rigor cientifico presente nas produções devido uma maior utilização de técnicas, metodologias e teorias consistentes para a (...) verificação da realidade pesquisada e para a elaboração das respostas (R) dos problemas (P) investigados. The purpose of cognitive diagnostic modeling is to classify students' latent attribute profiles using their responses to the diagnostic assessment. In recent years, each diagnostic classification model makes different assumptions about the relationship between a student's response pattern and attribute profile. The previous research studies showed that the inappropriate DCMs and inaccurate Q-matrix impact diagnostic classification accuracy. Artificial Neural Networks have been proposed as a promising approach to convert a pattern of item responses into a diagnostic classification in some research (...) studies. However, the ANNs methods produced very unstable and unappreciated estimation unless a great deal of care was taken. In this research, we combined ANNs with two typical DCMs, the deterministic-input, noisy, “and” gate model and the deterministic-inputs, noisy, “or” gate model, within a semi-supervised learning framework to achieve a robust and accurate classification. In both simulated study and real data study, the experimental results showed that the proposed method could achieve appreciated performance across different test conditions, especially when the diagnostic quality of assessment was not high and the Q-matrix contained misspecified elements. This research study is the first time of applying the thinking of semi-supervised learning into CDM. Also, we used the validating test to choose the appropriate parameters for the ANNs instead of using typical statistical criteria. (shrink)

Drawing from the example of Asian elephant conservation in Laos, this article primarily intends to reveal the elephantocentric vision adopted by mainstream conservation project in direction to the species. In the second part, I will present some ethnographic notes collected among local population who daily live and work with pachyderms. These notes will help in opening up a broader and more ecocentric approach of elephant conservation by highlighting links between biological and cultural diversity. There is a longstanding debate in the stakeholder literature as to who and what really counts as the stakeholders of the firm. Likewise, there have been discussions on whether nature should be considered a stakeholder of the firm. However, one seldom encounters any definitions of the key concepts, that is of nature or the natural environment . We seek to contribute to the debate by taking a closer look at what this thing called nature actually is. In addition, we discuss (...) the implications of this conceptual refinement for the stakeholder model. In order to reinforce the status of the natural environment in the stakeholder model, we propose that any visualisation of a stakeholder network should be embedded in the natural environment. Despite the invaluable role that women play in the peacebuilding process, statistics still show this as a male-dominated field. Since media narratives have the power to frame reality providing the public with preferred lenses to understand it, this study asks, How do media narratives frame the role of Afghan women in conflict resolution? To address this question, we combine Frame Theory (Entman, R. M. (1993). Framing: Toward clarification of a fractured paradigm. Journal of Communication, 43(4), 51–58) and Critical Discourse Analysis (...) (van Dijk, T. A. (2015). Critical discourse analysis. In D. Tannen, H. E. Hamilton, & D. The samples include 32 articles published between 2018 and 2022 on different sources ranging from traditional news outlets to magazines, newsrooms, intergovernmental organizations, and think tanks. Findings show that media narratives perpetuate unfair gendered expectations, failing to effectively render the irreplaceable role of women in peacebuilding. Frames confirm the double bind of hegemonic femininity (Schneiker, A. (2021). The UN and women's marginalization in peace negotiations. Throughout his literary career Walker Percy read and studied the philosophical thought of Charles Sanders Peirce in an attempt to re-present in language the world as Percy knew it. Beginning in 1984 and ending in 1990, the year of his death, Percy corresponded with Kenneth Laine Ketner about the "semiotic" of Peirce. Their letters - honest, instructive, and often filled with down-home humor - record an epistolary friendship of two men both passionately interested in Peirce's theory of signs. The popularity of Fair Trade is increasing swiftly in many parts of the World. However, there is still a paucity of research analysing the northern fair trade actors outside the Anglo-American communities. This paper contributes by presenting a qualitative study of how the Finnish World Shop movements’ key actors understand the movement’s role and position in the rapidly changing operating environment. The study depicts the polyphonic nature of this particular democratic social movement and discusses how success, public trust and the (...) importance of different stakeholders become constructed in various ways within it. This paper is a first attempt to study the problem of aggregation of individual ordinal probabilistic beliefs in an Arrowian framework. We exhibit some properties an aggregation rule must fulfil; in particular we prove the existence of a “quasi-dictator”.

While proponents of sustainability reporting believe in its potential to help corporations be accountable and transparent about their social and environmental impacts, there has been growing criticism asserting that such reporting schemes are utilized primarily as impression management tools. Drawing on Goffman’s self-presentation theory and its frontstage/backstage analogy, we contrast the frontstage sustainability discourse of a sample of large U.S. oil and gas firms to their backstage corporate political activities in the context of the passage of the American-Made Energy and (...) Good Jobs Act, also known as the Arctic National Wildlife Refuge Bill. The ANWR Bill was designed to allow oil exploration within the most sensitive environmental areas in the Refuge and this bill was vigorously debated in the United States Congress in 2005 and 2006. Our results suggest that the firms’ sustainability discourse on environmental stewardship and responsibility contrasts sharply with their less visible but proactive political strategies targeted to facilitate the passage of the ANWR Bill. This study thus contributes to the social and environmental accounting and accountability literature by highlighting the relevance of Goffman’s frontstage/backstage analogy in uncovering and documenting further the deceptive nature of the discourse contained in stand-alone sustainability reports. In addition, it seeks to contribute to the overall understanding of the multifaceted nature of sustainability reporting by placing it in relation to corporate political activities. (shrink)

Republicanism is increasingly attracting more attention from political philosophy. However, a mere hermeneutical approach it is usually used, which tends to neglect the political, social and economic circumstances that shaped this tradition of thought. This article addresses the modern conception of republican freedom with the North American and the French case through the work of two of their most representative figures, Thomas Jefferson and Maximilien Robespierre. The article defends that the political, juridical and economic government – the republican political economy– (...) devised by both, keeps important similarities that the current political philosophy cannot ignore. To illustrate this relationship, it is shown that both thinkers received a deep and similar influence of natural law philosophy and of fiduciary theory when thinking and trying to implement their models of government and their idea of ownership. This paper sheds further light on the role of quantification in corporate environmental disclosures. Quantification is an inherently social practice, which has attracted a fair amount of academic interest in recent years. At the same time, in the field of social and environmental accounting there is a paucity of research on quantification or the role it plays for organisations, for organisational communication and in societies more broadly. Accordingly, in this paper, we will draw on a qualitative case study to discuss (...) the potential implications that might arise from the use of quantified information in corporate environmental disclosures. Our case study illustrates the diverse effects of quantification suggested in the prior literature by placing them in the context of corporate environmental disclosures. We discuss how quantification implies fake precisionism and promotes commensuration of incomparables, thereby limiting the discussion to themes and questions preferred by company management. We maintain that quantification, while appearing to produce neutral and value-free information, has a substantive ethical dimension through how it implicates accountability relationships as well as the respective power relations between diverse stakeholders in societies. The study provides insights on why large Finnish municipalities are engaging in sustainability reporting. The dataset consists of the sustainability disclosures of five large Finnish cities and of a set of interviews conducted with the personnel responsible for composing the sustainability reports in these cities. Preliminary findings suggest that this rising practice is again an example of a fad, arising as the public sector organizations mimic the corporate sector without anyone really pondering whether the municipalities and the public sector as (...) a whole truly need a similar practice the corporations have. We maintain that there are better ways to use a municipality’s scarce resources than imitating the corporate sustainability reporting practices through producing a sustainability report, the main task of which seems to be to exist. Este artículo discute la llamada economía colaborativa para señalar, en primer y segundo lugar, algunas dificultades que aparecen (o pueden aparecer) a la hora de comprenderla tanto en términos analíticos como conceptuales. En tercer lugar, expone dos de las interpretaciones más extendidas actualmente para, en cuarto lugar, centrarse en aquella que atribuye a la economía colaborativa un carácter emancipador. En particular, se discuten tres importantes limitaciones a las que usualmente debe hacer frente dicha perspectiva: el excesivo protagonismo que otorga a (...) las comunidades colaborativas y al principio de paraigualdad; su modo de entender la racionalidad humana; y su visión a-institucional y meramente psicológica de la naturaleza y el funcionamiento de los mercados. El artículo concluye sugiriendo que, para lograr que la economía colaborativa despliegue su potencial emancipador, se requieren instituciones sociales y políticas que pongan a funcionar dicha colaboración en beneficio de todas y todos.This paper discusses the so-called collaborative economy, first and second, by pointing out some difficulties that appear (or can appear) in its understanding, both in conceptual and analytical terms. In the third section, two of its most currently widespread interpretations are analysed, while the fourth section focusses in the one that imputes to it an emancipatory character. In particular, three of this interpretation’s most usual boundaries are analysed: the excessive prominence that it confers to collaborative communities and to the principle of egalitarianism; its understanding of the human rationality; and its a-institutional and its mere psychologic approach to the nature and the functioning of markets. The paper concludes by suggesting that, in order to collaborative economy deploy its emancipatory potential, social and political institutions that turns collaboration in benefiting everyone are required. This paper intends to explore the topic of consciousness in relation to the domain of the contemporary dream, its narration and interpretation. "Consciousness" involves the experience and interplay of dream, fantasy and "reality." Hence an ethnography of the dreaming subject involves several interlinked domains: the cultural construction of dream symbolism, dream narration, and dream interpretation within and through a group setting. The paper is based on findings from a recent ethnographic study of dreamwork groups in the U.K. Examples from the (...) study will explore how personal identity and consciousness is represented and invented through the production of socially informed imaginative contents in both dreamwork and guided fantasy. In this book, Tarja Laine provides insights into how traumatic cinema invites profound affective engagement with the pathology of memory that lies at the heart of trauma. The author reveals that traumatic cinema communicates the inability to process a traumatic event by means of its aesthetic specificity as a time-based medium.

Two enzymes involved in the synthesis of pyrimidine and purine nucleotides, CTP synthase (CTPS) and IMP dehydrogenase (IMPDH), can assemble into a single or very few large filaments called rods and rings (RR) or cytoophidia. Most recently, asymmetric cytoplasmic distribution of organelles during cell division has been described as a decisive event in hematopoietic stem cell fate. We propose that cytoophidia, which could be considered as membrane‐less organelles, may also be distributed asymmetrically during mammalian cell division as previously described for (...) Schizosaccharomyces pombe. Furthermore, because each type of nucleotide intervenes in distinct processes (e.g., membrane synthesis, glycosylation, and G protein‐signaling), alterations in the rate of synthesis of specific nucleotide types could influence cell differentiation in multiple ways. Therefore, we hypothesize that whether a daughter cell inherits or not CTPS or IMPDH filaments determines its fate and that this asymmetric inheritance, together with the dynamic nature of these structures enables plasticity in a cell population. We consider situations of multiple referendum: finitely many yes-or-no issues have to be socially assessed from a set of approval ballots, where voters approve as many issues as they want. Each approval ballot is extended to a complete preorder over the set of outcomes by means of a preference extension. We characterize, under a mild richness condition, the largest domain of top-consistent and separable preference extensions for which issue-wise majority voting is Pareto efficient, i.e., always yields out a Pareto-optimal outcome. (...) Top-consistency means that voters’ ballots are their unique most preferred outcome. Over the last two decades republican thought has attracted a growing interest from political, moral and legal scholars. These contemporary theoretical syntheses of ‘neo-republican’ thought have been closely related to intellectual history and the idea of recovering an overshadowed tradition of political thought. In this vein, a classical set of historical moments and places and specific political practices within those contexts appear to be the main source of what republicanism meant – and what it could mean today.

Renowed historian E.P. Thompson (1924-1993) single-handedly changed the marxist understanding of class and class consciousness in his pivotal book The Making of the English Working Class (1963). Thompson not only took issue with the economic and technological determinism that plagued marxist theory, he also took issue with philosophers — Althusser, Foucault, Horkheimer, Adorno, Marcuse, etc. — who variously described history as a process without a subject. Thompson was wary of philosophers. He nonetheless approvingly quotes Maurice Merleau-Ponty (1908-1961) in his polemical (...) essay The Poverty of Theory (1978). This surprising reference went unnoticed to this day. Following Thompson’s original reference to Merleau-Ponty’s The Structure of Behavior (1942) leads one to a number of observations that the french philosopher made to history, social classes and class counsciousness in works such as Phenomenology of Perception (1945), Sense and Non-Sense (1948) and the Adventures of the Dialectic (1955). Those various observations show that Thompson and Merleau-Ponty shared the same phenomenological understanding of class consciousness. (shrink)

Noël Carroll has suggested that scary films scare because our emotions are structured by the disgusting and dangerous properties of the films’ monsters. By contrast, this essay argues that some scary films scare through more direct means than can be explained by entertaining in thought, say, the impure properties of Count Dracula. It is the film itself that disgusts and frightens, by ‘taking over’ the spectator so that their consciousness of the film is ‘contaminated’ by the ‘spirit’ of horror. In (...) this essay, I discuss this state of ‘being done by disgust-horror through Roman Polanski’s Repulsion (1965). In my reading, Repulsion is about ultrasensitivity to the world and the subsequent, insane fear of intimacy that the film itself directly induces in its spectator. The spectator is threatened with possession in a fashion analogous to the way in which Carole’s apartment (her own mind) keeps her captive in her own disgust. This disgust that Carole feels is not merely disgust towards men, but disgust towards the world in general. The effect of this is the devastating, disgusting, schizophrenic terror of being unable to trust one’s own senses. (shrink)

According to Gérard Genette, the chief function of an authorial preface is to ensure that the text is read properly. In other words, the purpose of the preface is to attract the reader’s attention and to steer him or her toward a particular understanding of the book. A preface, then, aims to get readers to read the book and often on certain terms, i.e., the author’s. As such, the authorial preface of Marx’s Capital (1867) is especially important — it allows (...) us to understand how Marx himself hoped to be understood by his readers. Commentators, whether hostile or sympathetic, usually focus on the postface to the second edition of Marx’s work. We will instead focus on the preface to the first edition, as to uncover Marx’s immediate political aims and ethical concerns. (shrink)

Within cinematic horror, trauma as a concept has often been used as an allegorical strategy to work through collective anxieties. This article on It Follows (David Robert Mitchell, 2014) and Get Out (Jordan Peele, 2017) strikes another note. It argues that, by their aesthetic qualities, both films are rendered traumatic in their affective orientation, both toward the cinematic world and toward the spectator. It analyses the two films through trauma as an affective-aesthetic strategy that puts emphasis on the edge of (...) the frame as well as on the offscreen space. This strategy evokes a sinister mood that exists independently of the protagonists, allowing us to meaningfully feel the effects of their trauma as we engage with the film. Especially the use of the offscreen space in both films contributes to the “traumatic mood” of the films, but it also functions to immerse the spectator in the invisible filmic world. In this way, It Follows and Get Out embody trauma as a denial of relief from dread, which we both recognize in the characters' experience, and feel in our own bodies through the effective creation of ever-present threat. Este artículo propone una lectura de la Crítica del Juicio a partir de los conceptos psicoanalíticos de idealización y de sublimación. La idealización se refleja en la noción kantiana de un fin final, el sumo bien, como el ideal que permite pensar la realización del mundo moral en el mundo de la naturaleza; por su parte, el proceso de sublimación aparece como el “reverso” del enjuiciamiento sobre el gusto. Esa correspondencia entre la sublimación y el enjuiciamiento permite describir una función (...) normativa de la sublimación análoga en el arte y en la moral. La perspectiva psicoanalítica de la sublimación explica así la lectura ético-política de la obra que ha venido haciendo la ética contemporánea, a partir del enjuiciamiento estético. (shrink)

Este texto aborda la concepción de la propiedad republicana-jeffersoniana y defiende que el principio político-filosófico que subyace a la misma es el del pacto fiduciario. Para ello se exponen las características de las relaciones fiduciarias diferenciándolas a su vez de las contractuales. Para ilustrar este tipo de relaciones, se abordan dos casos de estudio estrechamente relacionados en el republicanismo de Jefferson: las instituciones políticas y la propiedad. Se pretende así mostrar que su concepción republicana-fiduciaria es la que alimenta el principio (...) de la “utilidad pública” de la propiedad privada presente todavía hoy en el constitucionalismo moderno y democrático. This paper addresses the Jeffersonian-republican conception of property and defends that the political-philosophical principle that underlies it is that of the fiduciary agreement. In order to do so, the characteristics of fiduciary relationships are exposed, differentiating them from the contractual ones. To illustrate this type of relationships, two closely related case studies in Jefferson’s republicanism are addressed: political institutions and property. The aim is thus show that his republican-fiduciary rationale is the one that feeds the principle of eminent domain of private property which is still present in modern and democratic constitutionalism. The conception of property is usually moulded upon diverting historical and political-philosophical frameworks. The current interest on the commons illustrates these divergences when they come up between a ‘pure’ public and a ‘pure’ private form of ownership. This conceptual triad misleads by conflating private property with an absolute property right while equating public property with a centralised political regime. This article traces the republican conception of property in order to show how it draws a legal and philosophical continuum around different (...) forms of ownership, based on a fiduciary principle underlying the relationship between the sovereign or principal and its agent. Despite modern socialism apparently left aside the question of the commons, the republican-fiduciary rationale was reformulated according to the modern industrial capitalist society. (shrink)

There are two major possible responses to the question: what (if anything) can justify a basic income experiment? An experiment might be justified either because it gathers positive empirical evidence supporting rolling out a basic income, or because it justifies the moral desirability of such a measure. This paper critically explores both responses, the “empirical” and “ethical claim” in light of the Barcelona B-MINCOME pilot, alongside other similar experiments. We sustained that although the empirical claim is necessary, there seems to (...) be sufficient data to easily predict that all future experiments are to gather positive results too. Consequently, we argue that experiments are particularly well-equipped to foster debates on the work ethics and on the ethical dimension of social policies and welfare regimes in general. (shrink)

This paper looks at the current state-of-the-art and at potential changes in CSR thinking in a developing country: Romania. It seeks to understand what kind oftransformations are emerging in this field and what are the reasons behind them. The analysis is interpretative, using discourse analysis and focuses on the articles of the weekly Romanian business publication Capital. The results indicate that the local business environment features the characteristics of wild capitalism, largely contradicting the idea of responsibility. However, foreign actors have (...) recently entered the local environment, acting as travelling vehicles of Western ideas and inducing positive developments in business social behaviour. This study upholds that emerging trends in the business social thinking in Romania are not an outcome of local societal expectations but, rather, are brought from abroad and sold to the local community. Charles Sanders Peirce , the most important and influential of the classical American philosophers, is credited as the inventor of the philosophical school of pragmatism. The scope and significance of his work have had a lasting effect not only in several fields of philosophy but also in mathematics, the history and philosophy of science, and the theory of signs, as well as in literary and cultural studies. Largely obscure until after his death, Peirce's life has long been a subject of (...) interest and dispute. Unfortunately, previous biographies often confuse as much as they clarify crucial matters in Peirce's story. Ketner's new biographical project is remarkable not only for its entertaining aspects but also for its illuminating insights into Peirce's life, his thought, and the intellectual milieu in which he worked. A distinguished panel of essayists address many key issues in Peirce's thought.

Between 2017 and 2019, Barcelona was one of the first European cities to implement a basic income experiment, the B-MINCOME pilot, aimed at reducing poverty and social exclusion in a low-income area of the city. A new cash grant was designed along with a package of active policies. Four modalities of participation were then established depending on two criteria: whether attending these policies was mandatory or not, and whether participants’ additional income altered the amount of the grant or was instead (...) net added on top. The context which initially moulded the pilot is firstly explained. Then, the cash schema and the active policies are described followed by an explanation of its experimental design. The main results at individual, community and institutional levels formerly released in the official reports are now integrated and jointly addressed. Finally, conclusions discuss some issues raised by the pilot’s results in light of the findings gathered in other similar basic income experiments. (shrink)

Dramatic economic developments have served to highlight ethical questions and responses within business life in Finland, particularly regarding the crisis of the Finnish banking system. Other issues which have aroused public discussion are maintaining the natural biodiversity in the Northern hemisphere forests, and Finland's trade with Russia. In this discussion piece, eight scholars in geography, urban planning, and agri-food studies from the United States (US) and France engage in a bi-national comparison to deepen our collective understanding of food and land justice. We specifically contextualize land justice as a critical component of food justice in both the US and France in three key areas: access to land for cultivation, urban agriculture, and non-agricultural forms of food provisioning. The US and France are interesting cases to compare, considering the (...) differences and similarities in their colonial and agricultural histories, persistent and systemic race and class-based inequities in land access, and the roles of public bodies and social movements. In this paper, we synthesize literature, share reflections, and offer directions for future scholarship, including a broader comparative research agenda. An important difference we found is in the degree of scholarly attention to race and how it mediates access to land. We also observe that few scholars articulate a clear definition of justice in their work, nor do they share a common justice framework. We hope that this paper contributes to a more robust food and land justice framework for the use of scholars, practitioners and activists. (shrink)

Increasing evidence indicates that the coronavirus disease 2019 pandemic is associated with adverse psychological effects, including heightened levels of anxiety. This study examined whether COVID-19-related anxiety levels during the early stage of the pandemic predicted demanding working memory updating performance. Altogether, 201 healthy adults mostly from North America and the British Isles were recruited to this study via the crowdsourcing site www.prolific.co. The results showed that higher levels of COVID-19-related anxiety during the first weeks of the pandemic outbreak were associated (...) with poorer WM performance as measured by the n-back paradigm. Critically, the unique role of COVID-19-related anxiety on WM could not be explained by demographic factors, or other psychological factors such as state and trait anxiety or fluid intelligence. Moreover, across three assessment points spanning 5–6 weeks, COVID-19-related anxiety levels tended to decrease over time. This pattern of results may reflect an initial psychological “shock wave” of the pandemic, the cognitive effects of which may linger for some time, albeit the initial anxiety associated with the pandemic would change with habituation and increasing information. Our results contribute to the understanding of cognitive–affective reactions to a major disaster. (shrink)

Percy has been studied under several headings: Catholic, Southerner, Existentialist. Two such aspects, however, have been neglected: the strong influence of Charles Sanders Peirce, plus Percy’s deep competence in laboratory science. His typescript essay, “Peirce and Modern Semiotic,” presented here, shows that Percy was well ahead of his contemporaries in understanding the scientific and philosophical importance of Peirce’s Semeiotic, the Theory of Semeioses. Percy particularly pointed to the experiential importance of “taking the other’s meaning.” He regarded that common phenomenon as (...) vital, and genuine—a kind of event that behaviorists such as B. F. Skinner or Charles Morris explained away as nothing but a dynamic dyadic causal process. Percy’s essay definitively blocks those reductions. (shrink)

Philosophers affiliated with the Nyāya school of classical Indian philosophy developed an impressive species of realism. Nyāya philosophers defended direct realism in holding that we perceive bodies, not just their qualities or mental images of their qualities. This sort of realism has been out of favor for centuries in the West and faces a number of problems that the Nyāya knew and answered in a sophisticated way. Rather than focus on the Nyāya defense of direct realism, we focus on the (...) Nyāya defense of epistemological realism in order to explicate what Nyāya philosophers took to be implications of their view that we know something about the way things are in themselves. Specifically, we argue that the epistemological realism of the Nyāya philosophers commits them to a strong form of essentialism, which furthermore entails that substances exist and instantiate natural-kind universals.
