If one takes seriously the idea that a scientific language must be extensional, and accepts Quine’s notion of truth-value-related extensionality, and also recognizes that a scientific language must allow for singular terms that do not refer to existing objects, then there is a problem, since this combination of assumptions must be inconsistent. I will argue for a particular solution to the problem, namely, changing what is meant by the word ‘extensionality’, so that it would not be the truth-value that had (...) to be preserved under the substitution of co-extensional expressions, but the state of affairs that the sentence described. The question is whether or not elementary sentences containing empty singular terms, such as ‘Vulcan rotates’, are extensional in the substitutivity sense. Five conditions are specified under which extensionality in the substitutivity sense of such sentences can be secured. It is demonstrated that such sentences are state-of-affairs-as-extension-related extensional. This implies that such sentences are also truth-value-related extensional in Quine’s sense, but not truth-value-as-extension-related extensional. (shrink)

In the following the details of a state-of-affairs semantics for positive free logic are worked out, based on the models of common inner domain - outer domain semantics. Lambert's PFL system is proven to be weakly adequate (i.e., sound and complete) with respect to that semantics by demonstrating that the concept of logical truth definable therein coincides with that one of common truth-value semantics for PFL. Furthermore, this state-of-affairs semantics resists the challenges stemming from the slingshot argument since logically equivalent (...) statements do not always have the same extension according to it. Finally, it is argued that in such a semantics all statements of a certain language for PFL are state-of-affairs-related extensional as well as salva extensione extensional, even though their salva veritate extensionality fails. In Popper's Logik der Forschung, a theoretical system is a set of sentences that describe a particular sub-area of science, in particular of empirical science. The goal of axiomatizing a theoretical system is to specify a small number of "axioms" describing all presuppositions of the sub-area under consideration, so that all other sentences of this system can be derived from them by means of logical or mathematical transformations. The paper discusses two philosophical interpretations of these proper axioms. First, proper axioms (...) stipulate the use of the signs for the basic concepts of the system. Consequently, the proper axioms turn out to be analytic relative to a class of interpretations of the underlying logic. Hence, they cannot be falsified by refuting their logical consequences because these consequences are analytic as well. Secondly, proper axioms are synthetic, falsifiable and uncertain sentences. Hence, they are not immunized against falsification by refuting their logical consequences. (shrink)

The search for the extensions of sentences can be guided by Frege’s “principle of compositionality of extension”, according to which the extension of a composed expression depends only on its logical form and the extensions of its parts capable of having extensions. By means of this principle, a strict criterion for the admissibility of objects as extensions of sentences can be derived: every object is admissible as the extension of a sentence that is preserved under the substitution of co-extensional expressions. (...) The question is: what are the extensions of elementary sentences containing empty singular terms, like ‘Vulcan rotates’. It can be demonstrated that in such sentences, states of affairs as structured objects (but not truth-values) are preserved under the substitution of co-extensional expressions. Gödel’s slingshot-argument proceeds from a referential theory of definite descriptions and from the principle of compositionality for reference. It outlines a metasemantic proof of Frege’s thesis that all true sentences refer to the same object—as well as all false ones. Whereas Frege drew from this the conclusion that sentences refer to truth-values, Gödel rejected a referential theory of definite descriptions. By formalising Gödel’s argument, it is possible to reconstruct all premises that are needed for the derivation of Frege’s thesis. For (...) this purpose, a reference-theoretical semantics for a language of first-order predicate logic with identity and referentially treated definite descriptions will be defined. Some of the premises of Gödel’s argument will be proven by such a reference-theoretical semantics, whereas others can only be postulated. For example, the principle that logically equivalent sentences refer to the same object cannot be proven but must be assumed in order to derive Frege’s thesis. However, different true (or false) sentences can refer to different states of affairs if the latter principle is rejected and the other two premises are maintained. This is shown using an identity criterion for states of affairs according to which two states of affairs are identical if and only if they involve the same objects and have the same necessary and sufficient condition for obtaining. According to the principle of compositionality, the meaning of a composed expression depends only on its logical form and the meaning of its descriptive sub-expressions. This dependence can be understood as the substitutivity of expressions that have the same meaning without changing the meaning of the composed expression. In this book the hidden complexity of Frege's and Quine's conceptions of extensionality is revealed. The insights gained by this analysis as well as two versions of the principle of compositionality are used (...) in a formal reconstruction of Gödel's and Quine's versions of the slingshot argument. Empty individual expressions are needed to reconstruct the actual use of scientific language as well as to make logic free from existence assumptions. According to Quine, a language must be extensional to be adequate for the purposes of science. By means of Lambert's non-extensionality argument it can be demonstrated that a language containing empty individual expressions cannot be extensional as long as truth-values are the extensions of sentences. This book investigates the soundness of Lambert's argument and examines the question of (...) whether and how extensionality of a language for free logic can be secured. To achieve these aims, the notion of extensionality is thoroughly analyzed and two new semantic approaches to free logic are developed in which states of affairs, but not truth-values, are the extensions of sentences. These two semantic approaches are defended against the slingshot argument. In this way, two possible solutions to the problem of extensionality arise which use non-existent objects in two different ways: whereas in dual domain semantics non-existent objects serve as referents of empty singular terms, in single domain semantics they serve as hole marker objects that mark the holes in states of affairs where an object is missing due to an irreferental individual expression. Free logics aim at freeing logic from existence assumptions by making them explicit, e.g., by adding an existence premisse to the antecedence of the classical axiom-schema of Universal Instantiation. Their historical development was motivated by the problem of empty singular terms, and that one of simple statements containing at least one such singular term: what is the referential status of such singular terms and what truth-value, if any, do such statemants have? Free logics can be classified with regard to their (...) respective answers to these problems. Negative free logics assume that non-existent objects cannot have any properties at all; hence, in particular, they cannot be self-identical or rotate. Positive free logics believe that non-existents can be self-identical according to the Leibnizian concept of identity. Neutral free logics think that statements of self-identity are truth-valueless because of the Fregean principle of compositionality. Since only in negative free logic, but not in positive free logic, two statements of the forms "a = a" and "E!a" are logically equivalent, one also can define only for NFL, but not for PFL, existence by self-identity. Bei Nietzsches Texten handelt es sich häufig um Reaktionen auf seine breitgestreuten Lektüren. Sein Lesen ist zugleich ein Schreiben, und es verläuft ebenso selektiv und assoziativ wie aneignend: So werden unter Nietzsches Hand etwa Lesefrüchte aus naturwissenschaftlichen Lexika ästhetischen Überlegungen einverleibt oder ethno-anthropologische Fachbücher im Kontext philosophiegeschichtlicher Einordnungsversuche zitiert. Die Interpretation von Nietzsches Schriften ist daher stets auf eine philologisch-differenzierte Quellenarbeit angewiesen, die zugleich auch philosophisch-hermeneutischen Ansprüchen genügt. Nur so findet die spezifische Gemengelage aus Eigenem und Fremdem in Nietzsches Texten (...) ebenso adäquate Berücksichtigung wie die Vielzahl der handschriftlichen Lesespuren in den bis heute erhaltenen Büchern aus seiner persönlichen Bibliothek. In Nietzsche verstehen, Christian Niemeyer aims at “correcting mistaken readings of Nietzsche” (10), by which he means clichéd misunderstandings of Nietzsche as a racist eugenicist, an advocate of a superiority of “German nature,” an anti-Semite, a warmonger, and a nihilistic negator of any ethics. In other words, the book addresses those aspects that portray Nietzsche as a kind of proto-Nazi. In doing so, Niemeyer also exposes the “genealogies” of such misreadings, in good Nietzschean style. The concept of fairness as mutual advantage has been developed in the tradition of social contract theory. In this framework society is seen as an enterprise that coordinates the activities of its members in order to advance their interests. All acceptable social rules are in the interest of each member of society. Rules are agreed unanimously – no rules can be enforced against the interest of someone. It is assumed that individuals are basically self-interested and rational. The importance of Dilthey Why read Dilthey today? Why study the ideas of a nineteenthcentury German philosopher some seventy years after his death? ...

One of the most significant changes in modern healthcare delivery has been the evolution of the paper record to the electronic health record (EHR). In this paper we argue that the primary change has been a shift in the focus of documentation from monitoring individual patient progress to recording data pertinent to Institutional Priorities (IPs). The specific IPs to which we refer include: finance/reimbursement; risk management/legal considerations; quality improvement/safety initiatives; meeting regulatory and accreditation standards; and patient care delivery/evidence based practice. (...) Following a brief history of the transition from the paper record to the EHR, the authors discuss unintended or contested consequences resulting from this change. These changes primarily reflect changes in the organization and amount of clinician work and clinician‐patient relationships. The paper is not a research report but was informed by an institutional ethnography the aim of which was to understand how the EHR impacted clinicians and administrators in a large, urban hospital in the United States. The paper was also informed by other sources, including the philosophies of Jacques Ellul, Don Idhe, and Langdon Winner. (shrink)

Giuseppe Franco hat mich mit süditalienischer Liebenswürdigkeit dazu eingeladen, einen kleinen Beitrag zum vorliegenden Hommage-Band zu schreiben, in dem ich von meiner „intellektuellen Beziehung“ zu Dir und „von der Bedeutung des Kritischen Rationalismus“ für meinen „eigenen Denkweg“ berichte. Kennengelernt haben wir einander vor inzwischen 53 Jahren kurz nach Deinem Dienstantritt an der Mannheimer Wirtschaftshochschule. Ich studierte damals in Wien, vor allem bei Bela Juhos, der in einer Art Dachkammer der Alten Universität seine Seminare, z. B. eines über „Wissenschaftstheorie und Quantenmechanik“ (...) mit maximal zehn älteren Studenten und bereits habilitierten Wissenschaftsphilosophen abhielt, sowie beim Altmeister Victor Kraft, dessen Privatissime-Veranstaltungen in seiner Wohnung in der Walfischgasse von noch weniger, handverlesenen Geistesschaffenden besucht wurden. Hans Peter Riegel zählt zu den wenigen Künstlern, die gleichzeitig als Autor tätig sind. Das Insolvenzrecht gehört zu dem Kernbestand der Regelwerke, die das Vertrauen der Rechtsgenossen in eine Rechtsordnung sichern. Es regelt die Bedingungen allseitiger Haftung eines Schuldners und steckt damit zugleich den Rahmen ab, innerhalb dessen die Gläubiger erwarten können, dass ihre Rechte in einer und durch eine Reorganisation und Sanierung des schuldnerischen Unternehmens gewahrt werden. Die faktische Wirkung des Insolvenzrechts endet nicht an nationalstaatlichen Grenzen. Das Insolvenzverfahren ist nach seinem Anspruch auf universelle Geltung angelegt. In fast allen Mitgliedstaaten der Europäischen Union (...) gilt heute als innerstaatliches Recht ein gemeinsames Recht grenzüberschreitender Insolvenzverfahren. Dieses gemeinsame europäische Recht strahlt auf die innerstaatlichen Reformbemühungen aus - es hat Einfluss auf die Insolvenzgesetzgebung. Die innerstaatlichen Gesetzgebungen werden zudem von UNCITRAL-Modellgesetzgebungen beeinflusst. Die wissenschaftliche Diskussion geht zusehends auf die damit ausgelösten Konvergenzbewegungen ein; die Praxis bedarf rechtsdogmatischer Aufklärung über die komplexer werdenden Regelungen des Insolvenzrechts und der Unterrichtung über die Strukturen und Problemstellungen ausländischer europäischer und außereuropäischer Insolvenzrechte, auch und gerade in ihrer Wechselwirkung mit dem deutschen Recht. Die Schriftenreihe der DZWIR ist ein Forum dieser Diskussionen. Sie wird in loser Folge monographische Untersuchungen zu Grundsatzfragen des deutschen, europäischen und internationalen Insolvenzrechts veröffentlichen. Damit leistet diese Schriftenreihe einen Beitrag ebenso zur rechtsdogmatischen Klärung von Streitfragen wie nicht minder zur Unterstützung der europäischen Integration der nationalstaatlichen Insolvenzrechte.
