“Modern slavery,” a term used to describe severe forms of labor exploitation, is beginning to spark growing interest within business and society research. As a novel phenomenon, it offers potential for innovative theoretical and empirical pathways to a range of business and management research questions. And yet, development into what we might call a “field” of modern slavery research in business and management remains significantly, and disappointingly, underdeveloped. To explore this, we elaborate on the developments to date, the potential drawbacks, (...) and the possible future deviations that might evolve within six subdisciplinary areas of business and management. We also examine the value that nonmanagement disciplines can bring to research on modern slavery and business, examining the connections, critiques, and catalysts evident in research from political science, law, and history. Based on archival and ethnographic data, this article analyzes the iconic-making, iconoclastic unmaking, and iconographic remaking of national identifications. The window into these processes is the career of Saint John the Baptist, patron saint of French Canadians and national icon from the mid-nineteenth century until 1969, when his statue was destroyed by protesters during the annual parade in his honor in Montréal. Relying on literatures on visuality and materiality, I analyze how the saint and his attending symbols were deployed in (...) processions, parades, and protests. From this analysis, I develop the sociological concept of aesthetic revolt, a process whereby social actors rework iconic symbols, redefining national identity in the process. The article offers a theoretical articulation and an empirical demonstration of how the context, content, and the form of specific cultural objects and symbols—national icons—are intertwined in public performance to produce eventful change, and shows why and how the internal material logic and the social life of these icons shape the articulation of new national identities. O presenta artigo se constitui em um estudo interpretativo a respeito dos efeitos da inserção maciça de tecnologias conectadas à rede mundial de computadores, em nossa cultura. Celebradas a ponto de se alastrarem como objeto de desejo por toda a parte, essas tecnologias, sobretudo as mídias móveis, têm se tornado ubíquas e não há um único segmento da sociedade que não tenha sido tocado por essa inserção. A educação formal em nosso país, por meio de políticas públicas como o Programa (...) Nacional de Tecnologia Educacional – Proinfo, procurou introduzir nas escolas da rede recursos para agregar qualidade ao nosso ensino básico, sabidamente precário. Entretanto a iniciativa se depara com resistências de toda a sorte, tanto por parte de gestores quanto de professores. Esse artigo pondera sobre essas resistências procurando ultrapassas questões, tais como falta de capacitação dos gestores, incidência de problemas técnicos ou mera falta interesse nas tecnologias. Busca pistas dessa oposição silenciosa a partir das alterações promovidas pela “virtualidade” na relação simbólica do sujeito com o meio, incidindo na esfera de sua identidade. (shrink)

Reasoning with cases has been a primary focus of those working in AI and law who have attempted to model legal reasoning. In this paper we put forward a formal model of reasoning with cases which captures many of the insights from that previous work. We begin by stating our view of reasoning with cases as a process of constructing, evaluating and applying a theory. Central to our model is a view of the relationship between cases, rules based on cases, (...) and the social values which justify those rules. Having given our view of these relationships, we present our formal model of them, and explain how theories can be constructed, compared and evaluated. We then show how previous work can be described in terms of our model, and discuss extensions to the basic model to accommodate particular features of previous work. This pragmatic study addresses the question of the plural realities that emerge from perception, based on an empirical analysis of the tasting activity of wine amateurs and olfactory experts. Though they share the same requirement of rooting taste in the product under scrutiny, they also significantly differ regarding the constraints with which their tasting results have to comply: repeatability for experts’ tasting results, and activity contiunuation for amateurs. Both therefore foster the emergence of two contrasting realities: a stabilized one for (...) experts; an ‘un-stabilized’ one for amateurs. Both happen to fit with the ‘fiction’ and the ‘reference’ modes of existence of Latour’s inventory, which extends and relaunches the analysis of the coexistence of activities initiated by the works on ‘boundary objects’ some decades ago. Finally, the notion of taste is reinterpreted as a translation operator between tasting realities. (shrink)

The sociology of science has shown that the scientific quest for truth, framed by the search for objectivity was granting objects of knowledge the form of independent and autonomous things, “data” already given and preexisting their observation. But do “real” objects only fit the form of data or things? If not, to which other form and objectivity do they fit? The author considers the question by examining the dispute between scientists and vintners on the issue of terroir, a complex combination (...) of viticulture and wine-making practices and agro-climactic factors, which gives wines a particular taste, or terroir typicity. For scientists who are unable to reduce it to a stable list of determining factors, terroir is an unfounded notion, an imaginary social construction, and an economic barrier. Producers, on the other hand, along with the wider distribution network of terroir wines, consider terroir as a real object, although one whose manifestations cannot be evaluated using the same procedures as those of scientists. By analyzing how proof of terroir is implemented, the author uncovers a regime of existence of objects different from the scientific regime: a pluralist one governed by critical discussion from which objects emerge as distributed results of a production process. Accidents involving autonomous vehicles raise difficult ethical dilemmas and legal issues. It has been argued that self-driving cars should be programmed to kill, that is, they should be equipped with pre-programmed approaches to the choice of what lives to sacrifice when losses are inevitable. Here we shall explore a different approach, namely, giving the user/passenger the task of deciding what ethical approach should be taken by AVs in unavoidable accident scenarios. We thus assume that AVs are equipped with what we (...) call an “Ethical Knob”, a device enabling passengers to ethically customise their AVs, namely, to choose between different settings corresponding to different moral approaches or principles. Accordingly, AVs would be entrusted with implementing users’ ethical choices, while manufacturers/programmers would be tasked with enabling the user’s choice and ensuring implementation by the AV. This paper proposes an argumentation-based procedure for legal interpretation, by reinterpreting the traditional canons of textual interpretation in terms of argumentation schemes, which are then classified, formalized, and represented through argument visualization and evaluation tools. The problem of statutory interpretation is framed as one of weighing contested interpretations as pro and con arguments. The paper builds an interpretation procedure by formulating a set of argumentation schemes that can be used to comparatively evaluate the types of arguments used in cases of (...) contested statutory interpretation in law. A simplified version of the Carneades Argumentation System is applied in a case analysis showing how the procedure works. A logical model for statutory interpretation is finally presented, covering pro-tanto and all-things-considered interpretive conclusions. -/- . (shrink)

The starting point of this study is the observation of a new importance of philosophy « in the post-metaphysical era » (according to the expression of J.-L. Schlegel) in the analysis of the religious fact and the significance of the Bible in Western culture, including the most contemporary. The recent Chilean film El Cristo ciego/Blind Christ by director Christopher Murray (2016) offers an emblematic example of the problems posed by the interpretation of a work that questions the mystery of transcendence (...) in a context marked both by the radical immanence of the characters’ experience and by the explicit and massive reference to the New Testament. The short narratives of the main character will be analyzed as parables (exegetic approach) and will be interpreted in the light of the Christology of liberation (cf. Jon Sobrino) and the philosophy of deconstruction (cf. J.-L. Nancy), which will lead to the question of the epistemological coherence of the proposed analysis. (shrink)

The idea that liberal democratic legitimacy presupposes the final authority of the state in solving the juridictional boundary question depends upon the argument according to which Westphalian sovereignty has evolved in a liberal democratic direction. From this point of view, sovereignty is internally limited by liberal democratic principles. However, I argue that it is rather public politics, more than Westphalian sovereignty, that has been transformed, in liberal states, and that hence, there is an enduring tension between democratic legitimacy and state (...) sovereignty. Le « féminisme de la subsistance », à l’intersection du féminisme, de l’écologie et de l’anticapitalisme, a été remis en lumière par des théoricien·nes et activistes du Nord et du Sud dans les années 2010. L’étude des sociétés paysannes montre que l’accomplissement par les femmes des tâches vitales pour le groupe a été sous-estimé et leur confère puissance, sacralité et autonomie, en particulier pour assurer l’égale répartition des biens de subsistance. Face aux critiques dénonçant cet essentialisme, l’auteure propose un « (...) écoféminisme vernaculaire » qui s’appuie sur les pratiques concrètes des femmes intégrant agriculture, artisanat, travaux de mécanique et de maçonnerie, agirs familiaux. Car, sous sa forme moderne, le travail domestique est doublement aliéné : non seulement, il n’est pas rémunéré, mais il est coupé de ses potentialités productives de subsistance pour se cantonner à la consommation et au care. Les écoféministes de la subsistance veulent s’opposer aux vocations « naturelles » des femmes et imaginer des perspectives : se réapproprier et partager collectivement des fonctions nourricières de base dans un monde où s’impose de façon accélérée l’aménagement agro-industriel de la planète. Hoerl & McCormack claim that the temporal updating system only represents the world as present. This generates puzzles regarding the phenomenology of temporal experience. We argue that recent models of reinforcement learning suggest that temporal updating must have a minimal temporal structure; and we suggest that this helps to clarify what it means to experience the world as temporally structured.

The fields of linguistic pragmatics and legal interpretation are deeply interrelated. The purpose of this paper is to show how pragmatics and the developments in argumentation theory can contribute to the debate on legal interpretation. The relation between the pragmatic maxims and the presumptions underlying the legal canons are brought to light, unveiling the principles that underlie the types of argument usually used to justify a construction. The Gricean maxims and the arguments of legal interpretation are regarded as presumptions subject (...) to default used to justify an interpretation. This approach can allow one to trace the different legal interpretive arguments back to their basic underlying presumptions, so that they can be compared, ordered, and assessed according to their defeasibility conditions. This approach allows one to understand the difference between various types of interpretive canons, and their strength in justifying an interpretation. (shrink)

Situé dans une approche interactionniste du développement du langage, l’article propose une démarche méthodologique pour étudier l’étayage dans sa dynamique dialogique, pour laquelle le recours à un corpus s’avère indispensable. L’article comprend plusieurs parties : sont présentées d’une part les différentes facettes de l’étayage d’un point de vue théorique, d’autre part la construction d’un outil opérationnel sous la forme d’une grille d’analyse des conduites étayantes des adultes et des réactions des enfants. Enfin, quelques résultats issus d’une recherche sur les interactions (...) mère-enfant, à titre illustratif de la démarche, montrent la façon dont les activités effectuées par les participants façonnent leurs conduites. Over 50,000 youth, mostly between the ages of 13 and 17 years, migrated to the United States without familial accompaniment in the fiscal year 2018. The tripartite process of pre-flight, flight, and resettlement exposes these unaccompanied immigrant children to multiple, and often ongoing, traumatic events that can significantly and adversely impact their mental health into adulthood. However, the ethical considerations for psychologists working with this growing population, with limited exceptions, remain largely unaddressed. As more and more UIC flee their home (...) countries due to violence, abuse, and economic instability only to experience further stressors during the processes of detainment, custodial placement, and acculturative adjustment in the US, there is an increasing need for psychological services; thus, the importance of preparation of mental health providers is increasingly significant. Psychologists must have the requisite skills and knowledge of the complex experiences of UIC, and of how these intersect with salient cultural, developmental, and systemic factors, as a means of providing competent and ethical mental health treatment. The present article highlights several ethical issues that arise when providing psychological services to UIC, with particular consideration paid to the embeddedness of UIC in various organizational entities with which psychologists will likely need to interface when working with this population. Implications and recommendations for practicing psychologists and training programs are discussed. (shrink)

An increasing number of studies about teacher’s induction issues mention that it is essential to take into account the types of support needs of beginning teachers to offer them adequate support. Few researchers have accurately portrayed the types of support needs felt by novice teachers and focused on the degree of agreement between the type of support needs felt and the perceived support received. This research used data drawn from a French-language survey (n = 156) and semi-directed interviews (n = (...) 10) conducted in Quebec with novice teachers. Quantitative analyzes using association measures on types of support needs and perception of support received indicate that the support perceived by teachers is largely inconsistent with the types of support needs felt. The interviews provide a better understanding of the quantitative results and suggest some possible solutions. (shrink)

The feminist critique of reason has formed a large part of the dramatic expansion in the literature of feminist philosophy since the early 1980s. The critique has been controversial. It has often been seen – both by its practitioners and by its outraged opponents – as a critique of prevailing ideals and practices of philosophy. Some have seen it as the legitimate expression of the concerns of women alienated from, and marginalized within, the prevailing structures of professional philosophy. Others have (...) seen in it nothing but a perversely reasoned commitment to irrationalism. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. This article presents the foundation of research around which other contributions in this issue are structured. It follows from a larger study aimed at supporting the professional development of beginning teachers with respect to their personal epistemology. The study explores the link between beliefs and practices in continuing education.It is an avenue that is still little used in research, particularly in Quebec, where research has focused more often on pre-service teachers. Previous studies identified highlight inconsistencies between expressed beliefs (epistemological and (...) pedagogical) and actual teaching practices. These concepts that are central to our approach. They will be clarified and illustrated in this article with the help of portraits of two high school natural science (NS) teachers offering a particular look at the tensions present in the belief-practice articulations. These two portraits are elaborated mostly from qualitative data drawn from explanatory interviews, from which similarities and dissimilarities emerge with regard to the question studied. The article conclude with suggestions for accompanying beginning teachers in resolving these tensions. (shrink)

Criminal liability for acts committed by AI systems has recently become a hot legal topic. This paper includes three different contributions. The first contribution is an analysis of the extent to which an AI system can satisfy the requirements for criminal liability: accomplishing an actus reus, having the corresponding mens rea, possessing the cognitive capacities needed for responsibility. The second contribution is a discussion of criminal activity accomplished by an AI entity, with reference to a recent case involving an online (...) bot, the Random Darknet Shopper. This discussion will provide the context for the analysis of commonalities and differences between criminal activities by humans and by artificial systems. The third contribution concerns the evaluation of different ways of addressing criminal activities by AI systems in a regulatory perspective. (shrink)

Statutory interpretation involves the reconstruction of the meaning of a legal statement when it cannot be considered as accepted or granted. This phenomenon needs to be considered not only from the legal and linguistic perspective, but also from the argumentative one - which focuses on the strategies for defending a controversial or doubtful viewpoint. This book draws upon linguistics, legal theory, computing, and dialectics to present an argumentation-based approach to statutory interpretation. By translating and summarizing the existing legal interpretative canons (...) into eleven patterns of natural arguments - called argumentation schemes - the authors offer a system of argumentation strategies for developing, defending, assessing, and attacking an interpretation. Illustrated through major cases from both common and civil law, this methodology is summarized in diagrams and maps for application to computer sciences. The aim of the present paper is to analyse the archeology of the concept of contradiction, more precisely in Plato, and to reveal the influence that the latter had on Aristotle’s reflection on contradiction and contrariety. This paper will show that it is possible to find examples of a notion of contradiction in Plato’s refutative dialogues, in which Socrates is described as refuting his interlocutors by demonstrating the contrary of their initial thesis. However, Plato never used the word antiphasis to (...) name the act of contradicting oneself, but preferred the expression enantia legein heautôi, which means “to say the contrary to oneself”. In this paper, we provide an analysis of the concept of legal personality and discuss whether personality may be conferred on artificial intelligence systems (AIs). Legal personality will be presented as a doctrinal category that holds together bundles of rights and obligations; as a result, we first frame it as a node of inferential links between factual preconditions and legal effects. However, this inferentialist reading does not account for the ‘background reasons’ of legal personality, i.e., it does not explain why (...) we cluster different situations under this doctrinal category and how extra-legal information is integrated into it. We argue that one way to account for this background is to adopt a neoinstitutional perspective and to update the ontology of legal concepts with a further layer, the meta-institutional one. We finally argue that meta-institutional concepts can also support us in finding an equilibrium around the legal-policy choices that are involved in including (or not including) AIs among legal persons. We should seek to justify, from a moral perspective, policies associated with serious and irreversible risks to the health of human beings, their societies, and the environment for these risks may have great impacts on the autonomy of both existing and future persons. The ideal of discursive democracy provides a way of morally justifying such policies to both existing and future persons. It calls for the inclusive, informed, and uncoerced deliberation toward an agreement of both existing and future persons, which (...) can serve as a justificatory basis for such public policies. This agreement best protects their fundamental interests and basic needs, and garners their general acceptance. It does so by upholding their agency in decision-making processes and, more specifically, by counseling a maxim of precaution in their public reasoning. The aim of this maxim is to protect the social and environmental conditions that will enable members of existing and future generations to review and, if necessary, revise decisions made in the past but that impact upon them in the present. Precautionary public reasoning thus serves to uphold the decisional agency of existing and future persons, which is a necessary condition of their democratic involvement in the policies that affect them and thus of their autonomous existence defined by their conceptions of the good. L’Action catholique spécialisée a donné naissance pendant le deuxième tiers du XXe siècle au Mouvement populaire des familles (MPF) et à ses dérivés. Ces Mouvements se donnaient pour but la formation et la promotion du monde ouvrier par lui-même, notamment par le biais de la famille. Les mères de famille au foyer prenaient en charge les intérêts de leur quartier et de toutes les familles ouvrières, assumant ainsi une maternité sociale. Elles organisaient des délégations auprès des mairies, créaient et géraient (...) des services (Femmes de prisonniers pendant la Seconde Guerre mondiale, services de machines à laver, travailleuses familiales pendant les trente glorieuses…). Le modèle d’action du MPF entre en déclin avec la modernisation du pays puis, dans les années 1970 avec l’accès généralisé des femmes au travail. (shrink)
