What can international courts say when criminals ask, by what right do you try me? Some authors attempt to draw a connection between humanity's responsibility to call offenders to account and the harm humanity has suffered as a consequence of the offender's crimes. Others have argued that there need not be a special connection between those calling to account and the offenders, as the right to punish offenders is a general right each and every person has. Both lines of argument (...) are ultimately unconvincing. Instead, I argue for a modified version of the second position which proposes a democratically based theory of responsibility for punishment held by international criminal law institutions. (shrink)

Several lines of evidence suggest that children born via Cesarean section are at greater risk for adverse health outcomes including allergies, asthma and obesity. Vaginal seeding is a medical procedure in which infants born by C-section are swabbed immediately after birth with vaginal secretions from the mother. This procedure has been proposed as a way to transfer the mother's vaginal microbiome to the child, thereby restoring the natural exposure that occurs during vaginal birth that is interrupted in the case of (...) babies born via C-section. Preliminary evidence indicates partial restoration of microbes. However, there is insufficient evidence to determine the health benefits of the procedure. Several studies, including trial, are currently underway. At the same time, in the clinic setting, doctors are increasingly being asked to by expectant mothers to have their babies seeded. This article reports on the current research on this procedure and the issues it raises for regulators, researchers, physicians, and patients. (shrink)

Though we agree with their argument that language is shaped by domain-general learning processes, Christiansen & Chater (C&C) neglect to detail how the development of these processes shapes language change. We discuss a number of examples that show how developmental processes at multiple levels and timescales are critical to understanding the origin of domain-general mechanisms that shape language evolution.

© Ginn et al. 2016.The indexing methods currently used for serial femtosecond crystallography were originally developed for experiments in which crystals are rotated in the X-ray beam, providing significant three-dimensional information. On the other hand, shots from both X-ray free-electron lasers and serial synchrotron crystallography experiments are still images, in which the few three-dimensional data available arise only from the curvature of the Ewald sphere. Traditional synchrotron crystallography methods are thus less well suited to still image data processing. Here, a (...) new indexing method is presented with the aim of maximizing information use from a still image given the known unit-cell dimensions and space group. Efficacy for cubic, hexagonal and orthorhombic space groups is shown, and for those showing some evidence of diffraction the indexing rate ranged from 90% to 151%. Whatever and however various ancient methods of philosophy may have been, in Anglo-American scholarship it is standard practice to first address established (...) scholarly interpretations as the primary entry point to critical discussionóoften displacing antiquity with a critical vocabulary of philosophical modernity. Scholars may come to understand each other better, but at the risk of asking the wrong questions or sacrificing ancient texts themselves as mere means of producing papers.Most scholars are progressives. They believe philosophy has advanced past the comparatively primitive wisdom of antiquity, and so such scholars feel perfectly entitled to make better sense of ancient texts, by patiently explaining what the ancients would have meant had they only been able to get it right. There are, of course, exceptions. And some papers in this collection suggest deeper faith in our philosophic fathers. So, the battle between the ancients and the moderns is joined once more, between those who would adorn their papers with footnotes for their peers and those who would attempt more anthropological an inquiry into ancient philosophic practices.Ian Mueller and Robert Bolton each address the same passage in Plato's Phaedo, both beginning with an article from Vlastos, first published in 1969. Mueller thoughtfully explores three different yet related accounts of what we might call scientific method in explaining Plato's views on natural change. Bolton wonders whether scholars are asking the wrong questions. Patricia Curd attempts a progressivist account of Eleatic thought, notwithstanding her recognition of the paucity of ancient sources. Complete with elaborately numbered sentences, Gail Fine focuses primarily on Burnyeat (1976) on Plato on Protagoras. Constance Meinwald presents a rather near-sighted account of two passages in the Philebus that employ the peras-apeiron distinction, with a view toward Plato's allegedly modernist mathematization of understanding. Lesley Brown revisits five pages of the Sophist that were hotly debated in the 1960s. With charity and elegance, she offers several plausible solutions to puzzles posed by previous scholars. Sometimes time smoothes over differences.A. A. Long's essay on Plato's presentation of Socrates in the Theaetetus might appear more philosophically anthropological. Yet Long reveals progressive sympathies, suggesting that Plato dispatches Socrates in the Theaetetus, so as to prepare the way for a more rigorously academic form of philosophizing, such as that exhibited in the Sophist. [End Page 111] In this way, Long speculates, Plato abandoned practical ethics for the academic life of research, so familiar to university professors and conference participants. It might be hard to square such speculation with Plato's Laws and the reception of Plato's writings among his own contemporaries. Still, Socrates' shifting role in Plato's dialogues is well worth pondering.By comparison, T. H. Irwin's contribution is wonderfully old-fashioned. His paper addresses the background knowledge to be presumed by ancient readers of Plato's dialogues and how that knowledge is artfully put to use in Plato's depiction of Socrates' reflections on the unity of virtue. By speculating on Plato's relation to his ancient readers, Irwin displaces many modernist preoccupations, though not without himself falling victim to that peculiar scholarly obsession of dating Plato's dialogues by their doctrines.With characteristic conservatism, Gisela Striker cautions scholars not to over-read Aristotle's Prior Analytics. While that extraordinary work may have deep implications for the history of formal logic, it probably was instead intended to be part of a general account of argument. In a similar vein, Charlotte Witt attempts to rescue Aristotle from scholars who would delimit Aristotle's multifarious uses of the "for the sake of" explanation, which altogether pervade his metaphysics, physics, biology and ethics. I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. Compreende-se a obra sob a perspectiva da ficção weird pela conjunção entre os elementos de futuridade da narrativa e os conflitos sociais do interior do Brasil, circunscritos a uma realidade histórica. Mixing cinematographic genres in a film that goes from Cangaço Cinema to Gore, Bacurau confronts us with a dystopia about the proliferation of surveillance and control technologies and, specially, about the proliferation of political systems of death.Keywords: Bacurau. We would be wrong to state that Plato’s approach to the Golden Age in the Statesman occurs through nostalgia, even if he stresses the immense distance between our world and that blessed time. After evoking the shepherd-god as a ruler, Plato shows that the completely abandoned disposition of the ruled is only justifiable in presence of an unbridgeable chasm between the two, such as that between gods and men, or men and beasts. The real question in the Statesman is how (...) to single out the peculiar form of knowledge possessed by the few men that are truly capable to rule. (shrink)

This essay is broadly conceived as a study of how the emotional experience of shame can play an important role in the construction of personal identity. It considers, on the one hand, the way in which Greek culture conceives the social meaning of this emotion and, on the other, the double representation that Plato provides in the Symposium of two very different forms of pedagogy of shame. Using the Platonic text as a phenomenological source, the author discusses the general validity (...) and relevance to the Greek world of the anthropological scheme that opposes «shame cultures» to «guilt cultures», attributing evolutionary primacy to the latter in terms of the acquisition of individual moral autonomy. ArgumentIn 1877, a young mathematician named Joseph Boussinesq presented amémoireto theAcadémiedes sciences which demonstrated that some differential equations may have more than one solution. Boussinesq linked this fact to indeterminism and to a possible solution to the free will versus determinism debate. Boussinesq's main interest was to reconcile his philosophical and religious views with science by showing that matter and motion do not suffice to explain all there is in the world. His argument received mixed criticism that addressed both his (...) philosophical views and the scientific content of his work, pointing to the physical “realisticness” of multiple solutions. While Boussinesq proved to be able to face the philosophical criticism, the scientific objections became a serious problem, thus slowly moving the focus of the debate from the philosophical plane to the scientific one. This change of perspective implied a wide discussion on topics such as instability, the sensitivity to initial conditions, and the conservation of energy. The Boussinesq debate is an example of a philosophically motivated debate that transforms into a scientific one, an example of the influence of philosophy on the development of science. (shrink)

Il saggio si propone di mostrare la compresenza di aspetti collaborativi e competitivi all'interno della pratica del dialogo. Risalendo al di qua dell'esempio di Socrate, cui si riconosce in qualche modo l'invenzione di una ‘tecnica' del confronto tra interlocutori interessati alla ricerca della veritÀ, l'autrice intende mostrare le radici conflittuali della forma-dialogo e le implicazioni meno rassicuranti della dialettica discorsiva. Il tema del dialogo indica certo l'emergere di una possibilitÀ evolutiva nel cammino politico della civiltÀ: dalle passioni distruttive degli eroi (...) omerici all'impegno a perfezionare se stessi esponendosi a un pacifico confronto. Senza dimenticare, perň, che la natura dell'uomo si rispecchia in molti animali diversi e che il dialogo con lupi e sparvieri resta difficile. (shrink)

In the context of item response theory, linking the scales of two measurement points is a prerequisite to examine a change in competence over time. In educational large-scale assessments, non-identical test forms sharing a number of anchor-items are frequently scaled and linked using two− or three-parametric item response models. However, if item pools are limited and/or sample sizes are small to medium, the sparser Rasch model is a suitable alternative regarding the precision of parameter estimation. As the Rasch model implies (...) stricter assumptions about the response process, a violation of these assumptions may manifest as model misfit in form of item discrimination parameters empirically deviating from their fixed value of one. The present simulation study investigated the performance of four IRT linking methods—fixed parameter calibration, mean/mean linking, weighted mean/mean linking, and concurrent calibration—applied to Rasch-scaled data with a small item pool. Moreover, the number of anchor items required in the absence/presence of moderate model misfit was investigated in small to medium sample sizes. Effects on the link outcome were operationalized as bias, relative bias, and root mean square error of the estimated sample mean and variance of the latent variable. In the light of this limited context, concurrent calibration had substantial convergence issues, while the other methods resulted in an overall satisfying and similar parameter recovery—even in the presence of moderate model misfit. Our findings suggest that in case of model misfit, the share of anchor items should exceed 20% as is currently proposed in the literature. Future studies should further investigate the effects of anchor item composition regarding unbalanced model misfit. (shrink)

This essay argues that secrets and lies are not forms of withholding information but forms by which information is valorized. Lies are constructed: what is to be lied about, what a lie is to consist of, how it is to be told, and whom it is to be told to, all reveal a social imaginary about who thinks what and what constitutes credibility. Secrets are negotiated: continual decisions about whom to tell, how much to tell, and whom not to tell (...) describe social worlds, and the shape and weight of interactions therein. All of this makes lies and secrets extraordinarily rich historical sources. We might not see the truth distorted by a lie or the truth hidden by a secret, but we see the ideas and imaginings by which people disclose what should not be made public, and how they should carry out concealing one narrative with another. Such insights involve a step back from the project of social history, in which an inclusive social narrative is based on experience and individuals' ability to report it with some reliability, and suggests that historians need to look at social imaginings as ways to understand the ideas and concerns about which people lie and with which people construct new narratives that are not true. The study of secrets, however, links the study of social imaginings with the project of social history, as the valorization of information that results in the continual negotiation and renegotiation of secrets shows individuals and publics imagining the experiences labeled as secret because of the imagined power of a specific version of events.
