A provocative case for the inherently political nature of language In The Politics of Language, David Beaver and Jason Stanley present a radical new approach to the theory of meaning, offering an account of communication in which political and social identity, affect, and shared practices play as important a role as information. Neutrality functions as an ideal in deliberation—we are supposed to have a neutral standpoint in debate, speak without bias or taking sides. We argue against the ideal of neutrality. We sketch how a theory of meaning could avoid commitment even to the coherence of a neutral space of discourse for exchanging reasons. In a model that accepts the ideal of neutrality, what makes propaganda exceptional is its non-neutrality. However, a critique of propaganda cannot take the form of “clearing out” the (...) obstacles for a “neutral space of discourse for exchanging reasons”, since that is to misunderstand how speech works. Such a critique would suggest that any emotive appeal is fundamentally undemocratic, and would delegitimize almost all historical protest movements. In this paper, we contrast a neo-Fregean picture of the neutral core of language with our own practice-based view, a view that takes political propaganda and the language of protest as central cases, and in which all language practice is understood as fundamentally perspectival. Two experiments report on the construction of the Sense of Agency Rating Scale (SOARS), a new measure for quantifying alterations to agency. In Experiment 1, 370 participants completed a preliminary version of the scale following hypnosis. Factor analysis revealed two underlying factors: Involuntariness and Effortlessness. In Experiment 2, this two factor structure was confirmed in a sample of 113 low, medium and high hypnotisable participants. The two factors, Involuntariness and Effortlessness, correlated significantly with hypnotisability and pass rates for ideomotor, challenge (...) and cognitive items. Twelve week test-retest correlations showed that Involuntariness was highly stable, but Effortlessness only moderately stable. Analysis of the combined datasets from Experiments 1 and 2 showed both SOARS scores were significantly related to the derived factors of Woody, Barnier, and McConkey's (2005) 4-factor model of hypnotisability. This scale clarifies conceptual confusion around agentive action and provides empirical support for a multifactorial account of sense of agency. (shrink)

The huge amounts spent on store security and crime prevention worldwide, not only costs international businesses, but also amounts to a hidden tax on those law-binding consumers who bear higher prices. Most previous research has focused on shoplifting and ignored many other ways in which consumers cheat businesses. Using a hybrid of both qualitative research and survey approaches in four countries, an index of 37 activities was developed to examine consumers’ unethical activities across UK, US, France, and Austria. The findings (...) indicate that around three quarters of consumers in all four countries can be classified as heavy offenders for these minor cheats. The paper argues that government agencies, marketers, and retailers should adopt more pro-active preventative approaches, rather than reactive loss limitation measures to combat unethical behavior. This study examines the relationship between the ethical behavior and customer orientation of insurance sales agents engaged in the selling of complex services, e.g. health, life, auto, and property insurance. The effect of ethical and customer-oriented behavior, measured by the SOCO scale (Saxe and Weitz, 1982), on the annual premiums generated by the agents is also investigated. Customeroriented sales agents are found to engage in less unethical behavior than their sales-oriented counterparts. Further, sales-oriented agents are found to perceive greater levels (...) of unethical behavior among their significant others. Alarmingly, higher levels of sales premiums are found among those agents who engage in unethical behavior. (shrink)

Legal scholars attribute a great deal of importance to the linguistic dimension behind recodification. According to them, language contributes greatly to the improvement of both the accessibility and clarity of the law. Nevertheless, little research on the linguistic aspects of codification exists within both linguistics and legal theory. Consequently, it seems worthwhile to study this linguistic dimension more in depth. To this aim, the recent legislative proposals to recodify various economic, civil and criminal codes in Belgium serve as a useful (...) case study to improve our understanding of the linguistic challenges of recodification. In this article we will look at the linguistic comments made by the Belgian Council of State, a state organ which offers technical advice to the legislator, on the relevant proposals and consider the type of linguistic comments made, and, their implementation by the legislator. On the one hand, such an analysis allows us to single out the linguistic problems accompanying the Belgian recodification and, on the other, to elaborate on them with the help of the insights provided by legal theory. In doing so, we hope for our analysis to be a useful point of reference both for research on the Belgian recodification and other legal/linguistic approaches to recodification in general. (shrink)

The Guarded Negation Fragment (GNFO) is a fragment of first-order logic that contains all positive existential formulas, can express the first-order translations of basic modal logic and of many description logics, along with many sentences that arise in databases. It has been shown that the syntax of GNFO is restrictive enough so that computational problems such as validity and satisfiability are still decidable. This suggests that, in spite of its expressive power, GNFO formulas are amenable to novel optimizations. In this (...) article we study the model theory of GNFO formulas. Our results include effective preservation theorems for GNFO, effective Craig Interpolation and Beth Definability results, and the ability to express the certain answers of queries with respect to a large class of GNFO sentences within very restricted logics. Respect for an individual’s autonomy determines that doctors should inform patients if their illness is terminal. This becomes complicated when the terminal diagnosis is recent and death is imminent. The authors examine the admission to paediatric intensive care of an adolescent with terminal respiratory failure. While fully ventilated, the patient was kept sedated and comfortable but when breathing spontaneously he was capable of non-verbal communication and understanding. Once resedated and reintubated, intense debate ensued over whether to wake the patient to (...) tell him he was going to die. The authors discuss the ethical arguments that surrounded their decision. Much attention has been paid recently to the role of anomalous experiences in the aetiology of certain types of psychopathology, e.g. in the formation of delusions. We examine, instead, the top-down influence of pre-existing beliefs and affective factors in shaping an individual’s characterisation of anomalous sensory experiences. Specifically we investigated the effects of paranormal beliefs and alexithymia in determining the intensity and quality of an altered state of consciousness . Fifty five participants took part in a sweat lodge ceremony, a (...) traditional shamanic ritual which was unfamiliar to them. Participants reported significant alterations in their state of consciousness, quantified using the ‘APZ’ questionnaire, a standardized measure of ASC experience. Participants endorsing paranormal beliefs compatible with shamanic mythology, and those showing difficulty identifying feelings scored higher on positive dimensions of ASC experience. Our findings demonstrate that variation in an individual’s characterisation of anomalous experiences is nuanced by pre-existing beliefs and affective factors. (shrink)

Emerson achieved some reputation with his verse, corresponded with many of the leading intellectual and artistic figures of his day, and during an off and on again career as a Unitarian minister, delivered and later published a number of controversial sermons. The empirical phenomenon at the center of this paper is projection, which we define (uncontroversially) as follows: (1) Definition of projection An implication projects if and only if it survives as an utterance implication when the expression that triggers the implication occurs under the syntactic scope of an entailment-cancelling operator. Projection is observed, for example, with utterances containing aspectual verbs like stop, as shown in (2) and (3) with examples from English and Paraguayan Guaraní (Paraguay, Tupí-Guaraní).1 The Guaraní example in (...) (2) and its English translation have at least the following implications: (i) Carla has previously smoked, and (ii) Carla stopped smoking. Projective contents, which include presuppositional inferences and Potts's conventional implicatures, are contents that may project when a construction is embedded, as standardly identified by the FAMILY-OF-SENTENCES diagnostic. This article establishes distinctions among projective contents on the basis of a series of diagnostics, including a variant of the family-of-sentences diagnostic, that can be applied with linguistically untrained consultants in the field and the laboratory. These diagnostics are intended to serve as part of a toolkit for exploring projective contents across languages, thus (...) allowing generalizations to be examined and validated crosslinguistically. We apply the diagnostics in two languages, focusing on Paraguayan Guaraní, and comparing the results to those for English. Our study of Paraguayan Guaraní is the first systematic exploration of projective content in a language other than English. Based on the application of our diagnostics to a wide range of constructions, four subclasses of projective contents emerge. The resulting taxonomy of projective content has strong implications for contemporary theories of projection, which were developed for the projective properties of particular subclasses and fail to generalize to the full set of projective contents. In the final decades of the 20th century, issues such as identity, Otherness and the role of social and cultural boundaries have been prominent in social theory, sociology and cultural studies. In this context, an analysis of Bauman's work is important because it raises pertinent questions pertaining to the nature of social and cultural boundaries and the nature of boundary construction under modernity. The metaphors of inside and outside and the idea of the boundary are significant in Bauman's critique of (...) modernity's search for a meta-order and in his examination of strangerhood. The article illustrates how this ordering process manifests itself at the individual and societal levels of modernity. Bauman's contention is that modernity's search for a meta-order leads to the construction of boundaries and to exclusionary practices. It is the presence of the Third, for Bauman, which threatens the certainty of order. Different images of the stranger in Bauman's work are identified and the ways in which Bauman's conception of freedom and `community' is intrinsically linked to his work on the ambivalent stranger are demonstrated. The Phenomenological Mind, by Shaun Gallagher and Dan Zahavi, is part of a recent initiative to show that phenomenology, classically conceived as the tradition inaugurated by Edmund Husserl and not as mere introspection, contributes something important to cognitive science. (For other examples, see “References” below.) Phenomenology, of course, has been a part of cognitive science for a long time. It implicitly informs the works of Andy Clark (e.g. 1997) and John Haugeland (e.g. 1998), and Hubert Dreyfus explicitly uses it (e.g. (...) 1992). But where the former use phenomenology in the background as broad context and Dreyfus uses it primarily (though not exclusively) as a critique of conventional AI, Gallagher and Zahavi wish to indicate a positive and constructive place for it within cognitive science. They do not recommend that we simply accept pronouncements of thinkers like Husserl, Heidegger, Sartre and Merleau‐Ponty and apply them to questions of cognition, but that we use revised forms of phenomenology to illuminate dimensions of cognitive experience that are missing in current research. The book is presented as an “introduction to philosophy of mind and cognitive science” written from a phenomenological perspective. It seeks to justify the use of phenomenology in cognitive science by showing what kinds of questions it asks and answers, the variety of uses to which it has recently been put and the fruitfulness of some of its findings. The catalog of topics, for the most part, matches other introductions to the philosophy of mind, such as questions of method, consciousness, perception, intentionality, embodiment, action, agency and other minds. One issue presented here that is not generally dealt with in existing philosophy of mind and cognitive science texts is temporality, a mainstay of the continental tradition. After an introductory chapter that places phenomenology in the context of other approaches, the book lays out the main tenets of phenomenological method. Here, one encounters expected components of phenomenology: the epoché (described below), phenomenological reduction, eidetic variation, and so on. This traditional fare is soon followed by some potential surprises, namely, attempts to “naturalize” phenomenology, a few attempts to formalize it, and the emergence of ‘neurophenomenology’. Each of these is a bit surprising because Husserl was a vocal critic of naturalism, seeing transcendental phenomenology as an alternative to the empirical study of consciousness. He was also skeptical about the possibilities of mathematizing phenomenology. Gallagher and Zahavi acknowledge these points, but since they are not repeating history or undertaking exegesis, strict adherence to canonical phenomenology is not required. Russell and Strawson sparked a well known debate on the subject of Linguistic Presupposition inspiring many linguists and philosophers to follow suit, including Frege, whose work initiated the modern study in this area. Beaver begins with the most comprehensive overview and critical discussion of this burgeoning field published to date. He then goes on to motivate and develop his own account based on a Dynamic Semantics. This account is a recent line of theoretical work in which the Tarskian emphasis (...) on truth conditions is questioned. The central plank of the theory of meaning is a formal account of the change in information effected by use of language on hearers or readers. The proposal thus consolidates ideas of Stalnaker, Karttunen and Heim, all of whom had suggested that such an account was needed. At the same time it provides a new impulse and motivation to Dynamic Semantics itself. (shrink)

We investigate the extension of monadic second-order logic of order with cardinality quantifiers "there exists uncountably many sets such that... " and "there exists continuum many sets such that... ". We prove that over the class of countable linear orders the two quantifiers are equivalent and can be effectively and uniformly eliminated. Weaker or partial elimination results are obtained for certain wider classes of chains. In particular, we show that over the class of ordinals the uncountability quantifier can be effectively (...) and uniformly eliminated. We study the preservation of certain properties under products of classes of finite structures. In particular, we examine indivisibility, definable self-similarity, the amalgamation property, and the disjoint n-amalgamation property. We explore how each of these properties interacts with the lexicographic product, full product, and free superposition of classes of structures. Additionally, we consider the classes of theories which admit configurations indexed by these products. In an effort to ensure access to justice, Australian courts have fashioned a unique hybrid opt in-opt out process known as “closed classes.” The rationale that underlies closed classes is to prevent free-riding that may undercut the position of funders and class action law firms reliant upon entering into agreements with a critical mass of class members. However, multiple closed classes also pose problems for respondents seeking the comfort of finality. To secure settlement and thus ultimately benefit participating class members, (...) Australian courts have formulated a procedure whereby the closed class is opened and nonparticipating class members are invited to either register their claims or opt out so that thereafter those who do not register and those who opt out are effectively precluded by res judicata from making further related claims. We argue that Australian courts’ support of closed classes, while driven by pragmatism, has produced unintended consequences. Many relate to the ethical dilemmas faced by class action law firms and litigation funders seeking to advance the interests of participating class members over and above those of nonparticipating class members. The Full Federal Court has recently approved an alternative common fund approach. However, questions remain as to whether Australian courts are appropriately equipped to measure and compare the alternative transaction costs associated with the current and proposed approach, and whether they are appropriately equipped to determine the commercial rectitude and fairness of litigation funding agreements. This paper distinguishes between definiteness and determinacy. Definiteness is seen as a morphological category which, in English, marks a uniqueness presupposition, while determinacy consists in denoting an individual. Definite descriptions are argued to be fundamentally predicative, presupposing uniqueness but not existence, and to acquire existential import through general type-shifting operations that apply not only to definites, but also indefinites and possessives. Through these shifts, argumental definite descriptions may become either determinate or indeterminate. The latter option is observed in examples like (...) ‘Anna didn’t give the only invited talk at the conference’, which, on its indeterminate reading, implies that there is nothing in the extension of ‘only invited talk at the conference’. The paper also offers a resolution of the issue of whether possessives are inherently indefinite or definite, suggesting that, like indefinites, they do not mark definiteness lexically, but like definites, they typically yield determinate readings due to a general preference for the shifting operation that produces them. The idea of experience has been taken at face value in scholarly accounts of the migration experience, consequently very little attention has been given to how this idea has acquired its meaning and how it relates to the category of the ‘migration experience’. This article provides an analytical investigation into the nature of the phenomenon known as the ‘migrant experience’; firstly, by examining mediated and non-mediated conceptions of experience as well as an alternative account of experience associated with strangeness/disruption. Through (...) this conceptual lens, I then critically consider how the migration experience, as an analytical construct, has been constituted through a spatial–temporal framework, a critical migration perspective, and within the phenomenological and existential accounts. In conclusion, these approaches, as I will demonstrate, are not necessarily mutually exclusive, rather they complement and, at times, are in tension with each other. Such an examination will provide some conceptual clarity that is currently lacking in empirical work on an ‘experience’ categorized as migration. (shrink)

Partial logics can give rise to flexible predictions without postulating any ad hoc ambiguities. The lexical entry schema accommodates two main points of variation, which makes it possible to capture the differences in meaning among these terms: (i) semantic type (restricted to the class of modifiers), and (ii) constraints on the current question under discussion or the strength ranking over its alternative possible answers. We discuss presupposition, the phenomenon whereby speakers mark linguistically the information that is presupposed or taken for granted, rather than being part of the main propositional content of a speech act. Expressions and constructions carrying presuppositions are called “presupposition triggers”, forming a large class including definites and factive verbs. The article first introduces the range of triggers, the basic properties of presuppositions such as projection and cancellability, and the diagnostic tests used to identify them. The reader is then introducedto major (...) models of presupposition from the last 50 years, separated into three classes: Frege-Strawson derived semantic models, pragmaticmodels such as that offered by Stalnaker, and dynamic models. Finallywe discuss some of the main current issues in presupposition theory. These involve accommodation, which occurs when a hearer's knowledge state is adjusted to meet the speaker's presuppositions; presupposition failure, which occurs when a presupposition is false; the interaction between presuppositions and attitudes; and the triggering problem, i.e., the problem of explaining why presuppositions occur in the first place. This book develops Non-Identity Theodicy as an original response to the problem of evil. It constructs an ethical framework for theodicy by sketching four cases of human action where horrendous evils are either caused, permitted, or risked, either for pure benefit or for harm avoidance.

Previous studies have found Forsyth’s Ethical Position Questionnaire (EPQ) to vary between countries, but none has made a systematic evaluation of its psychometric properties across consumers from many countries. Using confirmatory factor analysis and multi-group LISREL analysis, this paper explores the factor structure of the EPQ and the measurement equivalence in five societies: Austria, Britain, Brunei, Hong Kong and USA. The results suggest that the modified scale, measuring idealism and relativism, was applicable in all five societies. Equivalence was found across (...) In this paper the Centering model of anaphoraresolution and discourse coherence(Grosz et al. 1983, 1995)is reformulated in terms of Optimality Theory (OT)(Prince and Smolensky 1993). One version of the reformulated modelis proven to be descriptively equivalent to an earlier algorithmicstatement of Centering due to Brennan, Friedman and Pollard(1987). However, the new model is stated declaratively, and makesclearer the status of the various constraints used in the theory. Inthe second part of the paper, the model is extended, demonstratingthe advantages of the (...) OT reformulation, and capturing formallyideas originally described by Grosz, Joshi and Weinstein. Mindfulness is becoming increasingly popular in the workplace. This likely relates to a growing body of research linking mindfulness to a range of psychological outcomes such as reduced anxiety, depression and increased subjective wellbeing. However, while mindfulness has received a great deal of attention in clinical research, the evidence for workplace relevant benefits is less established. Additionally, outside of clinical research, mindfulness studies have rarely been replicated. Recent evidence suggests that the cognitive skills cultivated during meditation may be instrumental in (...) reducing biased thinking and increasing prosocial behaviour, but these findings have not been previously tested in a workplace setting. Specifically, mindfulness has been linked to reductions in implicit age bias, sunk-cost decision-making bias and increases in organisational citizenship behaviours. In two experiments using a workplace and laboratory sample, the present investigation aimed to test the reliability and generalisability of previous findings that a brief mindfulness meditation can reduce age and sunk-cost decision-making biases. To more directly test the potential positive benefits of mindfulness in a workplace setting, this study also investigated the impact of a mindfulness intervention on intention to perform OCB. While meditation significantly increased OCB intent, predictions relating to bias were not supported. Considerations for the degree to which empirical evidence aligns with claims in popular culture, along with implications for the practical uses of mindfulness in the workplace are explored. (shrink)
