The huge amounts spent on store security and crime prevention worldwide, not only costs international businesses, but also amounts to a hidden tax on those law-binding consumers who bear higher prices. Most previous research has focused on shoplifting and ignored many other ways in which consumers cheat businesses. Using a hybrid of both qualitative research and survey approaches in four countries, an index of 37 activities was developed to examine consumers’ unethical activities across UK, US, France, and Austria. The findings (...) indicate that around three quarters of consumers in all four countries can be classified as heavy offenders for these minor cheats. The paper argues that government agencies, marketers, and retailers should adopt more pro-active preventative approaches, rather than reactive loss limitation measures to combat unethical behavior. Previous studies have found Forsyth’s Ethical Position Questionnaire (EPQ) to vary between countries, but none has made a systematic evaluation of its psychometric properties across consumers from many countries. Using confirmatory factor analysis and multi-group LISREL analysis, this paper explores the factor structure of the EPQ and the measurement equivalence in five societies: Austria, Britain, Brunei, Hong Kong and USA. The results suggest that the modified scale, measuring idealism and relativism, was applicable in all five societies. Equivalence was found across (...) This book brings together an international group of scholars to discuss the ramifications of Heidegger's Black Notebooks for philosophy and the humanities. In contrast to both those who seek to exonerate Heidegger and those who simply condemn him, they urge careful reading and rereading of his work to turn Heideggerian thought against itself.

We study the preservation of certain properties under products of classes of finite structures. In particular, we examine indivisibility, definable self-similarity, the amalgamation property, and the disjoint n-amalgamation property. We explore how each of these properties interacts with the lexicographic product, full product, and free superposition of classes of structures. Additionally, we consider the classes of theories which admit configurations indexed by these products. In particular, we show that, under mild assumptions, the products considered in this article do not yield (...) new classes of theories. (shrink)

Legal scholars attribute a great deal of importance to the linguistic dimension behind recodification. According to them, language contributes greatly to the improvement of both the accessibility and clarity of the law. Nevertheless, little research on the linguistic aspects of codification exists within both linguistics and legal theory. Consequently, it seems worthwhile to study this linguistic dimension more in depth. To this aim, the recent legislative proposals to recodify various economic, civil and criminal codes in Belgium serve as a useful (...) case study to improve our understanding of the linguistic challenges of recodification. In this article we will look at the linguistic comments made by the Belgian Council of State, a state organ which offers technical advice to the legislator, on the relevant proposals and consider the type of linguistic comments made, and, their implementation by the legislator. On the one hand, such an analysis allows us to single out the linguistic problems accompanying the Belgian recodification and, on the other, to elaborate on them with the help of the insights provided by legal theory. In doing so, we hope for our analysis to be a useful point of reference both for research on the Belgian recodification and other legal/linguistic approaches to recodification in general. (shrink)

Heidegger's later thought is a thinking of things, so argues Andrew J. Mitchell in The Fourfold. Heidegger understands these things in terms of what he names "the fourfold"--a convergence of relationships bringing together the earth, the sky, divinities, and mortals--and Mitchell's book is the first detailed exegesis of this neglected aspect of Heidegger's later thought. As such it provides entré to the full landscape of Heidegger's postwar thinking, offering striking new interpretations of the atomic bomb, technology, plants, animals, (...) weather, time, language, the holy, mortality, dwelling, and more. What results is a conception of things as ecstatic, relational, singular, and, most provocatively, as intrinsically tied to their own technological commodification. This study examines the relationship between the ethical behavior and customer orientation of insurance sales agents engaged in the selling of complex services, e.g. health, life, auto, and property insurance. The effect of ethical and customer-oriented behavior, measured by the SOCO scale (Saxe and Weitz, 1982), on the annual premiums generated by the agents is also investigated. Customeroriented sales agents are found to engage in less unethical behavior than their sales-oriented counterparts. Further, sales-oriented agents are found to perceive greater levels (...) of unethical behavior among their significant others. Alarmingly, higher levels of sales premiums are found among those agents who engage in unethical behavior. (shrink)

Ismael aims for an understanding of the nature of an embedded perspective of agents in a world. If successful, this would explain a cluster of ways in which from an embedded perspective, we experience the world in an array of temporally asymmetric ways. Moreover, these are ways that have led many philosophers to rather metaphysically inflationary views about the nature of time, according to which time itself really is dynamical, and is characterized by the movement of an objectively (i.e., non-perspectival) (...) present. Ismael aims to explain these features of our experience without positing any such metaphysical picture. She argues that there are constraints which prevent us from taking this Olympian conception of the world and our place in it, and that these, jointly, explain why we experience the world in these temporally asymmetric ways. We take up two related questions. First, what it would mean to say that these constraints are not merely epistemic, and second, how far these constraints get us in explaining why we experience the world in these ways. (shrink)

Metaphysics is largely an a priori business, albeit a business that is sensitive to the findings of the physical sciences. This chapter has two aims. The first is to defend a particular conception of the methodology of a priori metaphysics by, in part, exemplifying that methodology and revealing its results. The second is to present a new account of holes. These two aims dovetail nicely. The chapter provides a better analysis of the concept ′hole′ that yields a more plausible metaphysical (...) story about holes. The authors defend a new, functionalist, analysis of holes, which, unlike its rivals, neither misidentifies nor renders them implausibly eliminativist about holes under various different metaphysical suppositions about the nature of space. Future-bias is the preference, all else being equal, for negatively valenced events be located in the past rather than the future, and positively valenced ones to be located in the future rather than the past. Strong risk aversion is the preference to pay some cost to mitigate the badness of the worst outcome. People who are both strongly risk averse and future-biased can face a series of choices that will guarantee them more pain, for no compensating benefit: they will be (...) pain pumped. Thus, combining these preferences is rationally impermissible. Dougherty (2011) argues that this gives us reason to think that future-bias is rationally impermissible. This argument, and a similar one presented by Greene and Sullivan (2015), relies on the idea that if several preferences are not rationally combinable, then in the absence of some explanation of why they are not combinable, we should conclude that (at least) one of them is rationally impermissible. We take up this question by, inter alia, reflecting on the empirical results of a study we ran that probes people’s risk averse and future-biased preferences. We argue that the data, in conjunction with other considerations, suggests that we should not infer from the irrationality of the combination of these preferences to the irrationality of one of the preferences singly. We also argue that given the descriptive data about these preferences, there is no reason to think that, if one of them is rationally impermissible, then it is future-bias. (shrink)

The Guarded Negation Fragment (GNFO) is a fragment of first-order logic that contains all positive existential formulas, can express the first-order translations of basic modal logic and of many description logics, along with many sentences that arise in databases. It has been shown that the syntax of GNFO is restrictive enough so that computational problems such as validity and satisfiability are still decidable. This suggests that, in spite of its expressive power, GNFO formulas are amenable to novel optimizations. In this (...) article we study the model theory of GNFO formulas. Our results include effective preservation theorems for GNFO, effective Craig Interpolation and Beth Definability results, and the ability to express the certain answers of queries with respect to a large class of GNFO sentences within very restricted logics. Respect for an individual’s autonomy determines that doctors should inform patients if their illness is terminal. This becomes complicated when the terminal diagnosis is recent and death is imminent. The authors examine the admission to paediatric intensive care of an adolescent with terminal respiratory failure. While fully ventilated, the patient was kept sedated and comfortable but when breathing spontaneously he was capable of non-verbal communication and understanding. Once resedated and reintubated, intense debate ensued over whether to wake the patient to (...) tell him he was going to die. The authors discuss the ethical arguments that surrounded their decision. In the final decades of the 20th century, issues such as identity, Otherness and the role of social and cultural boundaries have been prominent in social theory, sociology and cultural studies. In this context, an analysis of Bauman's work is important because it raises pertinent questions pertaining to the nature of social and cultural boundaries and the nature of boundary construction under modernity. The metaphors of inside and outside and the idea of the boundary are significant in Bauman's critique of (...) modernity's search for a meta-order and in his examination of strangerhood. The article illustrates how this ordering process manifests itself at the individual and societal levels of modernity. Bauman's contention is that modernity's search for a meta-order leads to the construction of boundaries and to exclusionary practices. It is the presence of the Third, for Bauman, which threatens the certainty of order. Different images of the stranger in Bauman's work are identified and the ways in which Bauman's conception of freedom and `community' is intrinsically linked to his work on the ambivalent stranger are demonstrated. In an effort to ensure access to justice, Australian courts have fashioned a unique hybrid opt in-opt out process known as “closed classes.” The rationale that underlies closed classes is to prevent free-riding that may undercut the position of funders and class action law firms reliant upon entering into agreements with a critical mass of class members. However, multiple closed classes also pose problems for respondents seeking the comfort of finality. To secure settlement and thus ultimately benefit participating class members, (...) Australian courts have formulated a procedure whereby the closed class is opened and nonparticipating class members are invited to either register their claims or opt out so that thereafter those who do not register and those who opt out are effectively precluded by res judicata from making further related claims. We argue that Australian courts’ support of closed classes, while driven by pragmatism, has produced unintended consequences. Many relate to the ethical dilemmas faced by class action law firms and litigation funders seeking to advance the interests of participating class members over and above those of nonparticipating class members. The Full Federal Court has recently approved an alternative common fund approach. However, questions remain as to whether Australian courts are appropriately equipped to measure and compare the alternative transaction costs associated with the current and proposed approach, and whether they are appropriately equipped to determine the commercial rectitude and fairness of litigation funding agreements. Over the last two decades J.N. Williams has developed an account of the absurdity of such utterances as Its raining but I dont believe it that is both intuitively plausible and applicable to a wide variety of forms that this so-called Moorean absurdity can take. His approach is also noteworthy for making only minimal appeal to principles of epistemic or doxastic logic in its account of such absurdity. We first show that Williams places undue emphasis upon assertion and belief: It (...) is similarly absurd for a person to accept a proposition P as a supposition for the sake of argument while denying that her state of mind is one of supposing P, yet Williams has no account of this. Williams approach is then modified to account for such a case. That modification employs a principle of doxastic logic that is at least plausible as the one on which Williams relies, while being unlike his principle in applying to cases other than belief. Part intellectual history, part critical theory, The Last Man Takes LSD challenges the way we think about both Michel Foucault and modern progressive politics. One fateful day in May 1975, Foucault dropped acid in the southern California desert. In letters reproduced here, he described it as among the most important events of his life, one which would lead him to completely rework his History of Sexuality. That trip helped redirect Foucault's thought and contributed to a tectonic shift in the intellectual (...) life of the era. He came to reinterpret the social movements of May '68 and reposition himself politically in France, embracing anti-totalitarian currents and becoming a critic of the welfare state. Mitchell Dean and Daniel Zamora examine the full historical context of the turn in Foucault's thought, which included studies of the Iranian revolution and French socialist politics, through which he would come to appreciate the possibilities of autonomy offered by a new force on the French political scene that was neither of the left nor the right: neoliberalism. Two experiments report on the construction of the Sense of Agency Rating Scale (SOARS), a new measure for quantifying alterations to agency. In Experiment 1, 370 participants completed a preliminary version of the scale following hypnosis. Factor analysis revealed two underlying factors: Involuntariness and Effortlessness. In Experiment 2, this two factor structure was confirmed in a sample of 113 low, medium and high hypnotisable participants. The two factors, Involuntariness and Effortlessness, correlated significantly with hypnotisability and pass rates for ideomotor, challenge (...) and cognitive items. Twelve week test-retest correlations showed that Involuntariness was highly stable, but Effortlessness only moderately stable. Analysis of the combined datasets from Experiments 1 and 2 showed both SOARS scores were significantly related to the derived factors of Woody, Barnier, and McConkey's (2005) 4-factor model of hypnotisability. This scale clarifies conceptual confusion around agentive action and provides empirical support for a multifactorial account of sense of agency. (shrink)

In his lifetime, Ralph Waldo Emerson became the most widely known man of letters in America, establishing himself as a prolific poet, essayist, popular lecturer, and an advocate of social reforms who was nevertheless suspicious of reform and reformers. Emerson achieved some reputation with his verse, corresponded with many of the leading intellectual and artistic figures of his day, and during an off and on again career as a Unitarian minister, delivered and later published a number of controversial sermons. Emerson’s (...) enduring reputation, however, is as a philosopher, an aphoristic writer (like Friedrich Nietzsche) and a quintessentially American thinker whose championing of the American Transcendental movement and influence on Walt Whitman, Henry David Thoreau, William James, and others would alone secure him a prominent place in American cultural history. We investigate the extension of monadic second-order logic of order with cardinality quantifiers "there exists uncountably many sets such that... " and "there exists continuum many sets such that... ". We prove that over the class of countable linear orders the two quantifiers are equivalent and can be effectively and uniformly eliminated. Weaker or partial elimination results are obtained for certain wider classes of chains. In particular, we show that over the class of ordinals the uncountability quantifier can be effectively (...) and uniformly eliminated. Our argument makes use of Shelah's composition method and Ramsey-like theorem for dense linear orders. (shrink)

The idea of experience has been taken at face value in scholarly accounts of the migration experience, consequently very little attention has been given to how this idea has acquired its meaning and how it relates to the category of the ‘migration experience’. This article provides an analytical investigation into the nature of the phenomenon known as the ‘migrant experience’; firstly, by examining mediated and non-mediated conceptions of experience as well as an alternative account of experience associated with strangeness/disruption. Through (...) this conceptual lens, I then critically consider how the migration experience, as an analytical construct, has been constituted through a spatial–temporal framework, a critical migration perspective, and within the phenomenological and existential accounts. In conclusion, these approaches, as I will demonstrate, are not necessarily mutually exclusive, rather they complement and, at times, are in tension with each other. Such an examination will provide some conceptual clarity that is currently lacking in empirical work on an ‘experience’ categorized as migration. (shrink)

Andrew Simester’s new book, Fundamentals of Criminal Law: Responsibility, Culpability, and Wrongdoing, is a masterful analysis of the doctrines of the general part of the criminal law and the multiple, overlapping functions that those doctrines serve. Along the way, Simester makes explicit what criminal law theorists routinely presuppose—that the ordinary words “blameworthiness” and “culpability” pick out the same moral concept. This essay argues that this assumed equivalence is mistaken: two concepts are in play, not one. Roughly, to be blameworthy is (...) to be justly liable to blaming practices in virtue of being at fault, and to be culpable is to act in a fashion that manifests or issues from insufficient concern for morally weighty interests. Culpability is not identical to blameworthiness, but rather a ground of blameworthiness: to be culpable is one way to be at fault, thus one way to be blameworthy. More importantly, culpability is not the exclusive ground of blameworthiness; an agent can be at fault, hence blameworthy, without being culpable. This essay defends these conceptual claims and draws forth some implications for two theses that Simester advances: that it is morally permissible to punish persons for criminal negligence and that it is unjust to punish persons who don’t deserve it. A Marriage Made in Hell Where did they come from, these furiously self-righteous “social justice warriors”? The growing radicalism and intolerance on the American left is the result of the strange union of Nietzsche’s “will to power” and a secularized Puritan moralism. In this penetrating study, Mark T. Mitchell explains how this marriage made in hell gave birth to a powerful and destructive political and social movement. Having declared that “God is dead,” Friedrich Nietzsche identified the “will to power” (...) as the fundamental force of human life. There is no good or evil in a Nietzschean world—only the interests of the strong. Reason and the common good have no place there. The Puritan, by contrast, is morally rigorous, zealous to promote virtue and punish vice. America’s Puritan tradition, now thoroughly de-Christianized, has been reduced to a self-righteous moral absolutism that focuses on the faults of others, intent on avenging the sins of society, institutions, and the past in pursuit of the secularized ideals of equality, diversity, and social justice. As Nietzsche’s ideas have permeated our culture, a new generation of radicals has embraced the rhetoric and tactics of the will to power. But the strength of America’s residual Puritanism keeps them only half-baked Nietzscheans. More Christian than they care to admit, they cling to a moralism that Nietzsche would despise. The incoherence of their mixed creed dooms social justice warriors to perpetual frustration. Their identity politics generates ever more radical demands that can never be satisfied, further fracturing a society in desperate need of a unifying myth. We seem to be left with only two options, Mitchell concludes—Nietzsche or Christ, the will to power or the will to truth. The choice is bracingly simple. (shrink)

This chapter examines Davidson's treatment of emotions as complexly bound up with cognitive states such as belief, rather than as being essentially opposed to such states. Emotions on Davidson's view can be justified, and can be both causes of and reasons for action. We also consider Davidson's elucidation and defense of David Hume's analysis of pride and similar affective states. Objections to that elucidation and defense are discussed, and it is explained how Davidson could rebut those objections. This study examines a moderated/mediated model of ethical leadership on follower job satisfaction and affective organizational commitment. We proposed that managers have the potential to be agents of virtue or vice within organizations. Specifically, through ethical leadership behavior we argued that managers can virtuously influence perceptions of ethical climate, which in turn will positively impact organizational members’ flourishing as measured by job satisfaction and affective commitment to the organization. We also hypothesized that perceptions of interactional justice would moderate the ethical (...) leadership-to-climate relationship. Our results indicate that ethical leadership has both a direct and indirect influence on follower job satisfaction and affective commitment. The indirect effect of ethical leadership involves shaping perceptions of ethical climate, which in turn, engender greater job satisfaction and affective organizational commitment. Furthermore, when interactional justice is perceived to be high, this strengthens the ethical leadership-to-climate relationship. (shrink)

At Republic 435c-d and again at 504b-e, Plato has Socrates object to the city/soul analogy and declare that a “longer way” is necessary for gaining a more “exact grasp” of the soul. I argue that it is in the Philebus, in Socrates’ presentation of the “god-given” method of dialectic and in his distinctions of the kinds of pleasure and knowledge, that Plato offers the resources for reaching this alternative account. To show this, I explore (1) the limitations of the tripartition (...) of the soul that Socrates’ own objections in the Republic suggest, (2) the route of the “longer way” through the Eleatic dialogues to the Philebus, (3) the procedures that constitute the “god-given” method and the structure of the eidetic field it discloses, and (4) the resources that, considered in light of the method, Socrates’ distinctions of the kinds of pleasure and knowledge provide for the more “exact grasp” of the soul. In this essay, I revisit and extend my arguments for a view of science that is pluralistic, perspectival and pragmatist. I attempt to resolve mismatches between metaphysical assumptions, epistemological desiderata, and scientific practice. I consider long-held views about unity of science and reductionism, emergent properties and physicalism, exceptionless necessity in explanatory laws, and in the justification for realism. My solutions appeal to the partiality of representation, the perspectivism of theories and data, and the interactive co-construction of warranted claims for realism.

This book develops Non-Identity Theodicy as an original response to the problem of evil. It constructs an ethical framework for theodicy by sketching four cases of human action where horrendous evils are either caused, permitted, or risked, either for pure benefit or for harm avoidance.

Taking a pragmatist stance toward the practices and products of science shapes our answers to central philosophical questions. In argue that from within a perspective consisting of goals, actions and questions, what we say there is and what we say it does, is justified by the ongoing interactions among representative models, causal experience and experiment, and conceptual frameworks in reaching a fallible convergence to what is real. I offer a non-dichotomous alternative. I propose an alternative to fundamentalist approaches, arguing that (...) what we are justified in claiming as real phenomena are the affordances constructed from the integration of top-down and bottom-up strategies.
