Penetrating and illuminating, these essays firmly install Merleau-Ponty among the most innovative and critically debated thinkers of the past half century.

This article critically examines Jürgen Habermas’s theory of democracy as developed in Between Facts and Norms. In particular, it focuses on the concept of communicative power and argues that there is a crucial ambiguity in Habermas’s use of this concept. Since communicative power is the key normative resource that is supposed to counter the norm-free steering media of money and administrative power, its role within the theory must be made clear. The article begins by explaining the normative and social-theoretic foundations (...) of the theory. Then it highlights the normative importance of the public sphere in Habermas’s two-track model of deliberative politics, before turning to the problems with the concept of communicative power. In this article I challenge two arguments central to Hugh Baxter's critical interpretation of Habermas in his recent book, Habermas: The Discourse Theory of Law and Democracy (2011). Both arguments focus on whether Habermas’ system -lifeworld model of society can successfully make space for democratic politics. Baxter highlights problems with both Habermas’ The Theory of Communicative Action [hereafter cited as TCA] and Habermas’ attempts to fix those problems in Between Facts and Norms [hereafter cited as BFN]. Thus, engaging Baxter on (...) these issues provides an opportunity to think about how to read two of Habermas’ most significant texts in relation to each other. Baxter stresses discontinuities but I draw attention to important continuities. The first discontinuity highlighted by Baxter is between TCA's functionalism and BFN's normative approach. By contrast, in section I my article stresses elements of TCA that have been under-appreciated in general and by Baxter in particular, challenging us to rethink aspects of the standard reading of functionalist versus normative moments in the trajectory of Habermas’ thought. More specifically, in the second discontinuity Baxter identifies in BFN a significant shift in Habermas’ understanding of the nature of a ‘system’. I challenge this interpretation in section II and provide what I think is a superior reconstruction of the model presented in BFN. (shrink)

Sungmoon Kim’s Confucian Democracy in East Asia: Theory and Practice is a brilliant and engaging contribution to our understanding of democratic theory and practice.1 The title of my comment here emphasizes the innovative way in which Kim moves from practice to theory by relying on the vibrant Confucian civil society in South Korea as both the normative inspiration for and practical reflection of his model of Confucian democracy. The success of any cosmopolitan political project depends on the development of forms of transnational solidarity that go beyond particularist commitments of kin, community, or nation. In this paper, I analyze how transnational solidarity can be generated around basic human rights. Rather than presupposing strong conceptions of a common humanity or a pre-existing sentiment of universal benevolence, I propose that the global discourse on human rights itself – an ongoing, dynamic, and dialogical process carried out within global public spheres – (...) be considered a form of or at least as a developing source for transnational solidarity. Together with the politics of human rights promoted by NGOs within global public spheres, this global discourse can contribute to constructing transnational solidarity around human rights. But a human right to basic subsistence, and commitment to fulfilling the correlative duties to the global poor, must be central to the cross-cultural dialogue on human rights for their to be adequate transnational solidarity around a global human rights regime. In Solidarity, Hauke Brunkhorst brings a powerful combination of theoretical perspectives to bear on the concept of "democratic solidarity," the bond among free and equal citizens. Drawing on the disciplines of history, political philosophy, and political sociology, Brunkhorst traces the historical development of the idea of universal, egalitarian citizenship and analyzes the prospects for democratic solidarity at the international level, within a global community under law. His historical account of the concept outlines its development out of, and its departure from, (...) the less egalitarian notions of civic friendship in the Greco-Roman world and brotherliness in the Judeo-Christian tradition. He then analyzes the modernization of Western societies and the destruction of the older, hierarchical solidarities. The problems of exclusion that subsequently arose -- which stemmed from growing individualization in society as well as from the exclusion of certain groups from the benefits of society -- could be solved only with democratic solidarity in the form of its "institutional embodiment," the democratic constitution. Finally, Brunkhorst examines the return of these exclusion problems as a result of economic globalization. Analyzing the possibilities for democratic self-governance at a global level, Brunkhorst finds in recent global protest movements the beginnings of a transnational civic solidarity. Brunkhorst's normative and sociological account, mediating between these two perspectives, demonstrates the necessity of keeping normative requirements systematically attuned with conditions of social reality. Contemporary philosophical pluralism recognizes the inevitability and legitimacy of multiple ethical perspectives and values, making it difficult to isolate the higher-order principles on which to base a theory of justice. Rising up to meet this challenge, Rainer Forst, a leading member of the Frankfurt School's newest generation of philosophers, conceives of an "autonomous" construction of justice founded on what he calls the basic moral right to justification. Forst begins by identifying this right from the perspective of moral philosophy. Then, through (...) an innovative, detailed critical analysis, he ties together the central components of social and political justice—freedom, democracy, equality, and toleration—and joins them to the right to justification. The resulting theory treats "justificatory power" as the central question of justice, and by adopting this approach, Forst argues, we can discursively work out, or "construct," principles of justice, especially with respect to transnational justice and human rights issues. As he builds his theory, Forst engages with the work of Anglo-American philosophers such as John Rawls, Ronald Dworkin, and Amartya Sen, and critical theorists such as Jürgen Habermas, Nancy Fraser, and Axel Honneth. Straddling multiple subjects, from politics and law to social protest and philosophical conceptions of practical reason, Forst brilliantly gathers contesting claims around a single, elastic theory of justice. Jeff Flynn’s comments on my methodological pluralism as well as the way I do political theory, namely explanatory evaluation, capture remarkably well what I struggled with most in writing Confucian Democracy in East Asia: Theory and Practice. That believing truly as a matter of luck does not generally constitute knowing has become epistemic commonplace. Accounts of knowledge incorporating this anti-luck idea frequently rely on one or another of a safety or sensitivity condition. Sensitivity-based accounts of knowledge have a well-known problem with necessary truths, to wit, that any believed necessary truth trivially counts as knowledge on such accounts. In this paper, we argue that safety-based accounts similarly trivialize knowledge of necessary truths and that two ways of responding (...) to this problem for safety, issuing from work by Williamson and Pritchard, are of dubious success. Followers of Wittgenstein allegedly once held that a meaningful claim to know that p could only be made if there was some doubt about the truth of p. The correct response to this thesis involved appealing to the distinction between the semantic content of a sentence and features attaching to its use. It is inappropriate to assert a knowledge-claim unless someone in the audience has doubt about what the speaker claims to know. But this fact has nothing to do with (...) the semantic content of knowledgeascriptions; it is entirely explicable by appeal to pragmatic facts about felicitous assertion. (shrink)

Deliberative democracy entails a commitment to deciding political questions on their merits. To that end, people engage in an exchange of reasons in a shared endeavour to arrive at the right answer or the best judgement they can make in the circumstances. Of course, in practice a shared judgement may be impossible to reach. Yet while compromise may seem a natural way of dealing with the disagreement that deliberation leaves unresolved – for example, some deliberative theorists argue that a willingness (...) to compromise manifests respect for the considered views of others, even as we continue to disagree with them – the relationship between deliberation and compromise is not as straightforward as one might think. To explain why, this paper contrasts conflicts of judgement with conflicts of preference, interest and value to show why greater attention needs to be paid to the character of the decision to be made. Richard Jeffrey is beyond dispute one of the most distinguished and influential philosophers working in the field of decision theory and the theory of knowledge. His work is distinctive in showing the interplay of epistemological concerns with probability and utility theory. Not only has he made use of standard probabilistic and decision theoretic tools to clarify concepts of evidential support and informed choice, he has also proposed significant modifications of the standard Bayesian position in order that it provide a (...) better fit with actual human experience. Probability logic is viewed not as a source of judgment but as a framework for explaining the implications of probabilistic judgments and their mutual compatability. This collection of essays spans a period of some 35 years and includes what have become some of the classic works in the literature. Could space consist entirely of extended regions, without any regions shaped like points, lines, or surfaces? Peter Forrest and Frank Arntzenius have independently raised a paradox of size for space like this, drawing on a construction of Cantor’s. I present a new version of this argument and explore possible lines of response.

There are two main ways in which things with minds, like us, differ from things without minds, like tables and chairs. First, we are conscious--there is something that it is like to be us. We instantiate phenomenal properties. Second, we represent, in various ways, our world as being certain ways. We instantiate representational properties. Jeff Speaks attempts to make progress on three questions: What are phenomenal properties? What are representational properties? How are the phenomenal and the representational related?

The Face of the Other and the Trace of God contain essays on the philosophy of Emmanuel Levinas, and how his philosophy intersects with that of other philosophers, particularly Husserl, Kierkegaard, Sartre, and Derrida. This collection is broadly divided into two parts: relations with the other, and the questions of God.

The article retraces three important steps along the path of Derrida’s Heidegger interpretation in The Beast and the Sovereign, Volume II. Readings of The Fundamental Concepts of Metaphysics, Introduction to Metaphysics, and “The Onto-Theo-Logical Constitution of Metaphysics” complement and further develop Derrida’s deconstruction of Heidegger, which revolves around the term “Walten” and its role in the world-formation that makes community possible. The analysis of what Derrida calls the hyper-sovereignty of Walten reveals an ethico-political ambiguity in Heidegger’s texts. On the one (...) hand, this hyper-sovereignty registers as a super-sovereign violence that founds theological-political world-constructs through the exclusion of those deemed other. On the other hand, like différance it serves as the condition of impossibility of a common world. Following Derrida’s provocation, I develop this second sense to argue that the dissolution of the common world entails an ethical imperative to carry the other with whom one has nothing in common. Certain realists about properties and relations identify them with universals. Furthermore, some hold that for a wide range of meaningful predicates, the semantic contribution to the propositions expressed by the sentences in which those predicates figure is the universal expressed by the predicate. I here address ontological issues raised by predicates first introduced to us via works of fiction and whether the universal realist should accept that any such predicates express universals. After assessing arguments by Braun, D. and Sawyer, S. (...) for fictional universal anti-realism, I propose a novel, Kripke-inspired argument for the same conclusion. I ultimately defend the claim that while this argument presents the strongest case for fictional universal anti-realism, it is nonetheless unsound. I conclude that nothing stands in the way of accepting that some fictional predicates express fictional universals. (shrink)

People with the kind of preferences that give rise to the St. Petersburg paradox are problematic---but not because there is anything wrong with infinite utilities. Rather, such people cannot assign the St. Petersburg gamble any value that any kind of outcome could possibly have. Their preferences also violate an infinitary generalization of Savage's Sure Thing Principle, which we call the *Countable Sure Thing Principle*, as well as an infinitary generalization of von Neumann and Morgenstern's Independence axiom, which we call *Countable (...) Independence*. In violating these principles, they display foibles like those of people who deviate from standard expected utility theory in more mundane cases: they choose dominated strategies, pay to avoid information, and reject expert advice. We precisely characterize the preference relations that satisfy Countable Independence in several equivalent ways: a structural constraint on preferences, a representation theorem, and the principle we began with, that every prospect has a value that some outcome could have. Written by one of the greatest figures in the field of probability theory, the book is both a summation and synthesis of a lifetime of wrestling with these problems and issues. After an introduction to basic probability theory, there are chapters on scientific hypothesis-testing, on changing your mind in response to generally uncertain observations, on expectations of (...) the values of random variables, on de Finetti's dissolution of the so-called problem of induction, and on decision theory. Decision theorists widely accept a stochastic dominance principle: roughly, if a risky prospect A is at least as probable as another prospect B to result in something at least as good, then A is at least as good as B. Recently, philosophers have applied this principle even in contexts where the values of possible outcomes do not have the structure of the real numbers: this includes cases of incommensurable values and cases of infinite values. But in these contexts the usual (...) formulation of stochastic dominance is wrong. We show this with several counterexamples. Still, the motivating idea behind stochastic dominance is a good one: it is supposed to provide a way of applying dominance reasoning in the stochastic context of probability distributions. We give two new formulations of stochastic dominance that are more faithful to this guiding idea, and prove that they are equivalent. (shrink)
