Sandra Field, Jeffrey Flynn, Stephen Macedo, Longxi Zhang, and Martin Powers discussed Powers’ book China and England: The Preindustrial Struggle for Social Justice in Word and Image at the American Philosophical Association’s 2020 Eastern Division meeting in Philadelphia. The panel was sponsored by the APA’s “Committee on Asian and Asian-American Philosophers and Philosophies” and organized by Brian Bruya.

Martin Luther King, Jr.’s “Letter from a Birmingham Jail” has been canonized as an essential statement of the political theory of civil disobedience. This article examines the early reception of King’s essay and the development of the liberal idea of civil disobedience it has become synonymous with to argue that its canonization coincided with, and displaced, the radicalization of King’s developing thinking about disobedience. It examines published and archival writings from 1965 through 1968 to reconstruct King’s power-oriented theory of (...) “mass” civil disobedience as it developed in response to the dual challenges of white backlash and Black Power. The basic challenge of mass civil disobedience is how to mobilize liberating acts of taking power without undercutting the possibility of transformative integration through sharing power. To articulate this dilemma, this article draws on an undertheorized category from John Rawls’s A Theory of Justice to conceptualize disobedience as a practice of militant love. (shrink)

In a letter to M. Coray, Thomas Jefferson distinguished two distinct notions of political authority. The first was that of ancient Greece, which was characterized by “slavery” and the subjection of the population. Jefferson’s characterization was astute insofar as Aristotle regarded some groups as privileged to rule “by nature,” while all other hereditary groups were fit only to be ruled. The second type, referring to governments of “the present age,” rejected that standard in favor of equality and the promotion of (...) the people’s “happiness.” Unexpectedly, the dichotomy between hereditary privilege systems and egalitarian service to the people maps onto the contrast between “feudal” and “bureaucratic” systems in late imperial Chinese theory. In other words, this insight into the nature of authority was known to theorists both in China and in the “West,” suggesting that it captures something fundamental about the nature of “authority.” This essay probes the dichotomy in two ways, theoretical and historical. In theory, “feudal” systems, east and west, seem to be informed by a substance metaphor, and so both Aristotle and his early modern followers conflated authority with social status, and imagined the latter as a hereditary, noble substance such as gold. In this model, social groups are necessarily ranked, with gold being nobler, for instance, than brass. Because authority inheres in the person as a substance, authority is personalistic. In other words, there is no clear, external standard for checking abuses of power. Classical Chinese bureaucratic theory imagined authority as a tally. In that case, an officer’s performance had to match the office’s public charge. Because the assignment of office is merit-based, tally systems tend to be more egalitarian. Moreover, they naturally provide an external standard for checking abuse, namely, the officer’s effect on the people’s “happiness.” Historically, these two paradigms clashed in England and Europe during the seventeenth and eighteenth centuries, when translations of Chinese texts became available. Using translingual analysis, this essay traces the transformation of authority from a substance model to a tally model in the thinking of several Enlightenment writers, culminating in the writings of Thomas Jefferson. This work makes a substantial reexamination of the social processes behind the labelling of patients in hospital care. Taking an interpretive perspective, the author analyses the social construction of patient labels, identifying strategies for and the consequences of giving and receipt of 'good' and 'bad' labels.

The essays in Powerful Arguments reconstruct the standards of validity underlying argumentative practices in a wide array of late imperial Chinese discourses, from the Song through the Qing dynasties. The fourteen case studies analyze concrete arguments defended or contested in areas ranging from historiography, philosophy, law, and religion to natural studies, literature, and the civil examination system. By examining uses of evidence, habits of inference, and the criteria by which some arguments were judged to be more persuasive than others, the (...) contributions recreate distinct cultures of reasoning. Together, they lay the foundations for a history of argumentative practice in one of the richest scholarly traditions outside of Europe and add a chapter to the as yet elusive global history of rationality. Transgressing power investigates the violation of the normal and familiar trends of literature in order to circulate a new discourse by which a new identity is reframed. Hence, the study of power in Martin Amis's novels, as an important technique of identity re-definition, is not (...) taken into consideration in the light of Foucault's theory of power. The objective of this study is to examine the role applied by transgression as a technique of subverting the common discourse of power in the field of identity re-formation. The study investigates the concept of power manipulated in Amis's Money to define the identity of the 'New Man'. Accordingly, the Foucauldian theory of power is taken as a framework of this study. The study reveals a conclusion in which the transgressive aspects of power are effectively utilized by Amis to re-define the identity of his protagonist in the novel. Although John Self-has finally lost his name and fortune, which are necessary demands to define one's self-in the patriarchal society, he finds his own new identity away from the materialistic norms of the common discourse. ]]>. The aim of this article is to clarify the relation between genealogy and history and to suggest a methodological reading of Nietzsche's Genealogy of Morals. I try to determine genealogy's specific range of objects, specific mode of explication, and specific textual form. Genealogies in general can be thought of as drastic narratives of the emergence and transformations of forms of subjectivity related to power, told with the intention to induce doubt and self-reflection in exactly those readers whose (collective) history is (...) narrated. The main interest in understanding the concept of genealogy and revisiting Nietzsche's introduction of it into philosophy lies in understanding how a certain way of writing and a certain textual practice function that successfully call into question current judgments, institutions and practices. Nietzsche's example, I argue, can provide a paradigm for a critical practice that accounts for historical processes of subject formation in terms of power and turns them against given forms of subjectivity. This book contributes to the literature on the ethical use of power and political skills to lead whole system change within school districts.

Thomas Piketty’s Capital and Ideology constitutes a landmark achievement in furthering our understanding of the history of inequality, and presents valuable proposals for constructing a future economic system that would allow us to transcend and move beyond contemporary forms of capitalism. This article discusses Piketty’s conceptions of ideology, property, and ‘inequality regimes’, and analyses his approach to social justice and its relation to the work of John Rawls. I examine how Piketty’s proposals for ‘participatory socialism’ would function not only to (...) redistribute income and wealth, but also to disperse economic power within society, and I discuss the complementary roles of redistribution and predistribution in his proposals, and Piketty’s place in a tradition of egalitarian political economy associated with James Meade and Anthony Atkinson. Having elaborated on Piketty’s account of the relationship between economic policy and ideational change, and his important idea of the ‘desacralization’ of private property, I develop ‘seven theses’ on his proposals for participatory socialism, examining areas in which his approach could be enhanced or extended, so as to create a viable twenty-first century version of democratic socialism. I distinguish two versions of the "basic" argument for the incompatibility of god's foreknowledge and human freedom to do otherwise. I discuss various examples which purport to show that the first version is unsound. These examples seem to be cases in which an agent can do something, And if he were to do that thing, The past would have been different from what it actually was. I argue that these examples apply only to the first, And not to the second (...) version of the incompatibilities argument. (shrink)

This article examines the meaning and significance of the concept of constituent power in constitutional thought by showing how it acts as a boundary concept with respect to three types of legal thought: normativism, decisionism and relationalism. The concept can be fully appreciated, it suggests, only by adopting a relationalist method. This relationalist method permits us to deal with the paradoxical aspects of constitutional founding creatively and to grasp how constituent power, as the generative aspect of the political power relationship, (...) works not only at founding moments but also within the dynamics of constitutional development. Relationalism realizes this ambition by exposing the tension between unity and hierarchy in constitutional foundation and the tension between the people-as-one and the people-as-the governed in the course of constitutional development. It contends, contrary to normativist claims, that constituent power remains a central concept of constitutional thought. (shrink)

The debate over the civilian use of nuclear power is highly polarised. We argue that a reasonable response to this deep disagreement is to maintain that advocates of both camps should modify their positions. According to the analysis we propose, nuclear power is neither entirely right nor entirely wrong, but rather right and wrong to some degree. We are aware that this non-binary analysis of nuclear power is controversial from a theoretical point of view. Utilitarians, Kantians, and other moral theorists (...) make sharp, binary distinctions between right and wrong acts. However, an important argument speaking in favour of our non-binary analysis is that it better reflects our considered intuitions about the ethical trade-offs we face in discussions of nuclear power. The aim of this article is to make this argument sharp by explaining how it can be rendered compatible with, and supported by, the Capability Approach, which is quickly becoming one of the most influential frameworks for thinking about human development. There are two perspectives from which formal theories can be viewed. On the one hand, one can take a theory to be about some privileged models. On the other hand, one can take all models of a theory to be on a par. In contrast with what is usually done in philosophical debates, we adopt the latter viewpoint. Suppose that from this perspective we want to add an adequate truth predicate to a background theory. Then on the one hand the (...) truth theory ought to be semantically conservative over the background theory. At the same time, it is generally recognised that the central function of a truth predicate is an expressive one. A truth predicate ought to allow us to express propositions that we could not express before. In this article we argue that there are indeed natural truth theories which satisfy both the demand of semantical conservativeness and the demand of adequately extending the expressive power of our language. We study the expressive power in the finite of the logic Fixed-Point+Counting, the extension of first-order logic which is obtained through adding both the fixed-point constructor and the ability to count. To this end an isomorphism preserving (`generic') model of computation is introduced whose PTime restriction exactly corresponds to this level of expressive power, while its PSpace restriction corresponds to While+Counting. From this model we obtain a normal form which shows a rather clear separation of the relational vs. the arithmetical (...) side of the algorithms involved. In parallel, we study the relations of Fixed-Point+Counting with the infinitary logics L r ∞ω (∃ ≥ m ) m∈ω and the corresponding pebble games. The main result, however, involves the concept of an arithmetical invariant. By this we mean a functor taking every finite relational structure to an expansion of (an initial segment of) the standard arithmetical structure. In particular its values are linearly ordered structures. We establish the existence of a family of arithmetical invariants (J r ) r≥ 1 with the following properties: $\bullet$ The invariants themselves can be evaluated in polynomial time. $\bullet$ A class of finite relational structures is definable in Fixed-Point+Counting if and only if membership can be decided in polynomial time on the basis of the values of one of the invariants. $\bullet$ The invariant J r classifies all finite relational structures exactly up to equivalence with respect to the logic L r ∞ω (∃ ≥ m ) m∈ω . We also give a characterization of Fixed-Point+Counting in terms of sequences of formulae in the L r ωω (∃ ≥ m ) m∈ω : It corresponds exactly to the polynomial time computable families (φ n ) n∈ω in these logics. Towards a positive assessment of the expressive power of Fixed-Point+Counting, it is shown that the natural extension of fixed-point logic by Lindström quantifiers, which capture all the PTime computable properties of cardinalities of definable predicates, is strictly weaker than what we get here. This implies in particular that every extension of fixed-point logic by means of monadic Lindstrom quantifiers, which stays within PTime, must be strictly contained in Fixed-Point+Counting. (shrink)

The idea of predistribution has the potential to offer a valuable and distinctive approach to political philosophers, political scientists, and economists, in thinking about social justice and the creation of more egalitarian economies. It is also an idea that has drawn the interest of politicians of the left and centre-left, promising an alternative to traditional forms of social democracy. But the idea of predistribution is not well understood, and stands in need of elucidation. This article explores ways of drawing the (...) conceptual and normative distinction between predistribution and redistribution, examining those general categories when considering the roles of public services and fiscal transfers, and looking at the ways in which government policies can empower and disempower different individuals and groups within the economy. This article argues that the most initially plausible and common-sensical ways of drawing the distinction between predistributive and redistributive public policies collapse when put under analytical pressure. It concludes that the distinction between predistribution and redistribution is best seen in terms of the aims or effects of policies rather than a deeper division of policy types, and argues that, once seen in those terms, predistribution is a central concern of social justice. In her book, Real Knowing (Cornell UP, 1996), and in many articles, she argues, in opposition to many post-structuralists and pragmatists, for the preservation of a notion of truth as partly referential albeit inextricably tied to a context. Furthermore, and in connection to this, she also critiques pure proceduralism in the normative dimension, defending instead a notion of normativity that is substantive but context related, thus, not universal or absolute.

In this article I draw upon the social ontologies developed by John Searle, Roy Bhaskar, Margaret Archer and Tony Lawson in order to distinguish between power and leadership. To do so, I distinguish the different organizing principles behind natural phenomena, collective phenomena and institutional phenomena, and argue that an understanding of those different organizing principles is essential to a clearer conceptualization of power and leadership. Natural power and cultural power, as I argue, depend upon the organizing principles of natural phenomena, (...) and differ depending on whether those organizing principles have been transformed by humans, in which case it becomes cultural power, or not, in which case it simply is natural power. Leadership emerges with the ability of making other humans share mental states through collective intentionality. Institutional power, in contrast, is connected to the creation of a deontology of rights and obligations that provide what Searle calls desire-independent reasons for action. (shrink)

A previous research ethics article by the authors provided evidence to support the claim that the New Zealand Ethics Committee was a powerless ethics committee. Ethics review applicants were not formally obliged to seek ethics review, and any committee recommendations were given on a ‘take it or leave it’ basis. One year later, the capacity of applications has doubled, and NZEC finds its core assumptions challenged as funders and government agencies now compel contracted researchers to make use of this free (...) service. Moreover, NZEC has expanded into research areas inhabited by market researchers, long shy of ethics review. Review requirements and remit expansion challenges some, but not all, aspects of NZEC’s assumption of powerlessness as NZEC remains committed to research ethics, not research governance, and it adheres to the principles of the New Brunswick Declaration to respect applicants the same way it expects applicants to respect participants. This annual survey of applicants makes NZEC accountable to its applicants, providing evidence once more that NZEC’s expeditious and cordial review of applications is considered different from traditional ethics review. This article is the attempt of an historically oriented analysis focused on the role of Nigerian music as a cultural hub for the export of African cultural influences into the Black diaspora in the United States and its anticipation by the Free Jazz/Avantgarde-scene as well as the import of key-values related to the Black Power-movement to the African continent. The aim is to demonstrate the leading role and international impact of Nigeria's cultural industry among sub-saharan African nation states and its (...) specific ability to absorb and incorporate elements of Western culture. -/- After a short discussion of African influences on jazz music in general and the socio-political, cultural, and artistic context in which Free Jazz emerged, examples for the articulation of African consciousness among influencing key figures such as saxophonist John Coltrane or the Art Ensemble of Chicago are being presented. Furthermore, the personal and ideological links between the Avantgarde Jazz-scene and the Black Power-movement - especially the Black Panther Party - are made transparent. -/- In a second step the central influence of the Nigerian drum-pioneer Babatunde Olatunji on the Africanization of US-Jazz musicians, his personal and creative impact on John Coltrane, as well as the Black Power-movement is being highlighted. On the other hand, Coltrane, Free Jazz, and the Black Panther Party are being portrayed as a central creative and ideological turn in the career and work of Fela Kuti and towards political activism and his efforts to implement and apply the Africa-inspired Black Power -struggle of the US on the African continent in order to fight post-colonial forms of oppression. -/- . I argue here that first person speech on sexual violence remains an important dimension of the movement for social change in regard to sexual violence, and that the public speech of survivors faces at least three groups of obstacles: 1) the problem of epistemic injustice, that is, injustice in the sphere of knowledge 2) the problem of language and power, and 3) the problem of dominant discourses. I explain and develop these points and end with a final argument concerning the (...) critical importance of speaking publicly on these areas of human experience. (shrink)

Media increasingly accuse firms of exploiting suppliers, and these allegations often result in lurid headlines that threaten the reputations and therefore business successes of these firms. Neither has the phenomenon of supplier exploitation been investigated from a rigorous, ethical standpoint, nor have answers been provided regarding why some firms pursue exploitative approaches. By systemically contrasting economic liberalism and just prices as two divergent perspectives on supplier exploitation, we introduce a distinction of common business practice and unethical supplier exploitation. Since supplier (...) exploitation is based on power, we elucidate several levels of power as antecedents and investigate the role of ethical climate as a moderator. This study extends Victor and Cullen’s ethical climate matrix according to a supply chain dimension and is summarized in an integrated, conceptual model of five propositions for future theory testing. Results provide a frame of reference for executives and scholars, who can now delineate unethical exploitation and understand important antecedents of the phenomenon better. (shrink)

In this chapter, I investigate the metaphysical assumptions that medieval thinkers considered necessary in order to integrate the vegetative powers and processes into their conception of human beings as composed of a material body and an immaterial soul. My aim is to show that vegetative powers and processes are central to the late medieval debate on faculty psychology and on the unity or plurality of substantial forms. The chapter has two parts. First, I present three different accounts of (...) the ontological status of the vegetative powers in relation to the body and the soul, as found in Thomas Aquinas, William of Ockham, and John Buridan. All three maintain that the vegetative powers belong to the soul but disagree as to whether they are identical with it or somehow distinct from it, especially when the soul in question is immaterial. Second, I investigate how medieval thinkers accounted for the metaphysics behind the operations of the vegetative powers in human beings, who are endowed with immaterial souls, in particular when it comes to procreation and digestion. A pressing problem for the vegetative powers of human beings is how they can produce a new substance when this composite is supposed to include an immaterial soul which is not naturally generated. Regarding procreation, one can distinguish two different approaches: dispositional generation of material conditions and substantial generation of the body. A similar problem for human beings arises in nutrition and growth once this process is taken to be some kind of substantial change, namely, the corruption of food and the production of new parts of the living being. Two accounts can be distinguished: “transmateriation” of the matter of food into the nourished body and generation of parts of the body. (shrink)

Human rights are high priority norms that empower right holders to demand the benefits protected by their rights. This is no less true of socioeconomic human rights than civil and political human rights. I argue that realizing human socioeconomic rights requires that they be enacted into state law in such a way that individual right holders have the power to bring legal action in defense of their rights. Contrary to Thomas Pogge, it is not enough for states simply to provide (...) the benefits required by human rights. Unfortunately, limited resources mean that successful litigation by right holders threatens to disempower other right holders by distorting a fair distribution of limited resources, since those with the resources to litigate can command a disproportionate and unjust share of limited resources. Using the human right to health as an example, I argue that an important part of the solution requires specifying different aspects of the content of the right to health and adopting appropriately strong standards of judicial review. Michel Foucault’s formative years included the study not only of history and philosophy but also of psychology: two years after he took license in philosophy at the Sorbonne in 1948, he took another in psychology, and then obtained, in 1952, a Diplôme de Psycho Pathologie . From his earliest years at the Ecole Normale Superieur he had taken courses on general and social psychology with one of most influential psychologists of the time, Daniel Lagache, who was attempting to integrate psychoanalysis (...) with clinical methods.(Eribon 1991, 42) Foucault’s studies included experimentation and clinical instruction in which patients were presented in an amphitheatre just as in the days of Charcot. For several years after he had received his Diplôme, Foucault continued research in psychopathology, observing practices in mental hospitals, reportedly sometimes volunteering in experiments himself. He purchased the material required to administer Roschach tests, subjecting numerous friends to the inkblots, and became, when it was founded, the honorary president of the French Rorschach organization. Foucault’s first books were on the topic of the psychological characterization of madness and the development of clinical medicine, and his last books addressed the development of psychological norms within the establishment of modern prisons as well as within an increasingly scientific approach to sex. Thus, he worked at the intersections of philosophy and psychology throughout his life. Nonetheless, Foucault reported feeling an intense aversion to psychology no less than to philosophy.(Sheridan 1980, 5) Foucault’s oeuvre is almost exclusively focused on particular knowledges in the human sciences, especially those aspects which pertained to psychological theories of human behavior, capacity, and normative functioning. His historical approach to these, and his emphasis on the role of discourse, is readily reminiscent of Thomas Kuhn’s similarly historical approach to scientific method with its emphasis on the role of paradigms and the untranslatability of paradigm dependent objects..
