Post–World War II developments concerning citizenship and access as one of the dimensions of citizenship are examined through the prism of noncitizenship and rights, using the drafting of the asylum paragraph of the 1949 Grundgesetz of the Federal Republic of Germany as a specific case study. The aim of this article is to look into the creation of the right to asylum in West Germany, to examine its political history by exploring its development and by searching for its conceptual, political, (...) and rhetorical origins. The article investigates the birth of the unique conceptualization of asylum in the debates of the Parliamentary Council, the constitutional and quasi-parliamentary assembly responsible for the writing of the postwar Basic Law, and examines the political choices, motivations, and compromises behind its creation. To connect the matter of asylum to a wider problematic related to noncitizens and rights, the article benefits from the political philosophy of Hannah Arendt, with reference to her writings on human rights and refugees in the immediate post–World War II period. Según la interpretación que la autora realiza del juicio reflexivo y su vinculación con la comunidad ampliada presente en la concepción kantiana de sensus communis, es posible considerar una redefinición del juicio ahora más ligada a la contingencia de la acción y a la pluralidad de los (...) espectadores en el ámbito de la esfera política. En síntesis, se trata de señalar los aspectos más problemáticos de la localización del legado de Kant en los últimos trabajos de Arendt a la vez que llamar la atención sobre la cuestión concerniente a la importancia del aporte kantiano a los ejes centrales del debate de la teoría política contemporánea. I discuss Arendt’s claim that science and its uses should become a matter of political discussion. The suggestion that science can be discussed and monitored by lay people is based on her interpretation of modern science. Modern science results from a flight from the human condition, which in her view should be reversed by means of the public debate. I conclude that Arendt’s political approach should in fact be called a moral approach. Arendt’s arguments can be reduced (...) to a traditional humanistic critique of science, interpreted as a version of Kant’s antinomy between the cognitive and the moral interests of reason, according to which scientists must be prevented from treating human beings as a natural species like any other. One cannot separate the material exile suffered by Hannah Arendt from the way she transformed it into one of the central themes of her thought. In her specific case, this topic meant a recount of her experiences. The contribution of this exceptional thinker was the outcome of the elaboration of her heartbreaking experience in universal terms. In this paper, we will join her on her journey through different places and moments in order to give sense to her situation as (...) an exiled person, taking into consideration the context that marked her Jewish condition as a pariah. We will see afterwards how she explained this to herself in two main topics of her life: freedom for the human condition and the different ways in which the Jews could return to the world after being segregated. If there were any doubt concerning the fecundity, richness, indeed, ambiguity of Hannah Arendt’s oeuvre, it will be laid to rest by The Cambridge Companion to Hannah Arendt. This collection of generally excellent articles on her work instantiates the plurality of perspectives that was so much a part of her philosophical position. It opens with Dana Villa’s “Introduction: The Development of Arendt’s Political Thought,” which begins with her work on totalitarianism and ends with her appropriation of Kant’s (...) theory of judgment. Although necessarily sketchy, his presentation is eminently plausible. He notes the sometimes rigidity of Arendt’s distinctions, for example, the political and the social, but defends her opposition of the life of the mind and the life of the citizen. Villa remarks that she turns toward Athens for “the simple reason that [it was] the first flowering of democracy”. However, as the diversity of opinions concerning her relationship to the Greek polis testify, there is nothing simple in her relationship to Athens. In fact, it is this topic that could be read as a kind of leitmotif running through the work of most of her commentators. In this limited space I cannot comment on each of the articles contained in the collection. I will only mention those that I was particularly taken by. (shrink)

This article offers a close reading of Hannah Arendt's book On Revolution. It exposes the ambivalence of Arendt with regard to tragedy and mimesis. This ambivalence is not just her own; it is inherent in the treatment of tragedy and mimesis throughout the history of political thought. In spite of Arendt's argument that privileges the limited American Revolution against the boundless French one, in her rhetoric and in her storytelling Arendt presents a unitary but dialectical picture (...) of revolution, where suffering and foundation are inseparably intertwined. The founding public action of revolutionaries implies a crisis of mimetic passions (of fear and pity) which threatens to undo, but also set the stage for, revolution. This negative, passionate and passive side of revolution helps us to come to terms with the non-productive but emancipatory revolutions in the Eastern Europe of 1989-91. (shrink)

O presente trabalho tem como objetivo apresentar a noção do perdão que Hannah Arendt desenvolve no capítulo 5 do livro A condição Humana, em especial, no subcapítulo “A irreversibilidade e o poder de perdoar”. Para Arendt, Jesus de Nazaré foi o descobridor do papel do perdão na arena do espaço público. Antes de apresentar os motivos pelos quais Arendt menciona alguns textos do Novo Testamento, será necessário compreender o contexto político que a impulsionou escrever: a descoberta que (...) para os regimes totalitários, os homens são supérfluos. As “fábricas de morte” são laboratórios que tentam modificar a natureza humana. A teologia cristã é requisitada por Arendt para responder uma questão encontrada já nas últimas páginas das Origens do Totalitarismo: Há perdão para qualquer tipo de ação? Há perdão para o que não se pode punir e punição para o que não se pode perdoar? Das páginas do Novo Testamento, Arendt encontra inspiração para refletir sobre tais circunstâncias. (shrink)

Robert Hanna presents a fresh view of the Kantian and analytic traditions that have dominated continental European and Anglo-American philosophy over the last two centuries, and of the connections between them. But this is not just a study in the history of philosophy, for out of this emerges Hanna's original approach to two much-contested theories that remain at the heart of contemporary philosophy. Hanna puts forward a new 'cognitive-semantic' interpretation of transcendental idealism, and a vigorous defense of (...) Hanna Pitkin explains that Arendt’s defense of collective political action tends to reify and mystify an opposing concept Arendt calls ‘the Social’. Was Arendt actually right about the rise of ‘the Social’? Does the deep-set global mass entertainment culture tend to sap action even when it purportedly celebrates it? And what can viewing publics and counter-publics tell us about the meaning and reception of ‘the Social’, especially in this massively online era? This article surveys different ways (...) of thinking about the basic problem presented by American popular action cinema, and especially big-budget Hollywood action films, through an Arendtian lens. In presenting this overview, the article looks to reorient traditional philosophical concerns about screen violence and its censorship, and to offer a holistic reappraisal of ‘the Social’ and ‘action’ by placing democratic theory in closer dialogue with film studies. Many philosophers claim that it is always intrinsically good when people get what they deserve and that there is always at least some reason to give people what they deserve. I highlight problems with this view and defend an alternative. I have two aims. First, I want to expose a gap in certain desert-based justifications of punishment. Second, I want to show that those of us who have intuitions at odds with these justifications have an alternative account of desert at (...) our disposal – one that may lend our intuitions more credibility. An observation of Hume’s has received a lot of attention over the last decade and a half: Although we can standardly imagine the most implausible scenarios, we encounter resistance when imagining propositions at odds with established moral (or perhaps more generally evaluative) convictions. The literature is ripe with ‘solutions’ to this so-called ‘Puzzle of Imaginative Resistance’. Few, however, question the plausibility of the empirical assumption at the heart of the puzzle. In this paper, we explore empirically whether the difficulty we (...) witness in imagining certain propositions is indeed due to claim type (evaluative v. non-evaluative) or whether it is much rather driven by mundane features of content. Our findings suggest that claim type plays but a marginal role, and that there might hence not be much of a ‘puzzle’ to be solved. (shrink)

No presente trabalho tentaremos apresentar, em um primeiro momento, os aspectos gerais da leitura que Althusser fez da obra de Maquiavel, com o fito de compreender de que modo nosso autor entende o momento político da fundação do Estado. Em um segundo momento, objetivamos contrapor essa posição com outros dois modos de entender a instituição ou fundação do político, embora também a partir de Maquiavel, considerando as propostas de Hanna Arendt e de Maurice Merleau-Ponty. Por fim, esforçar-nos-emos por (...) extrair algumas conclusões a respeito da produtividade e dos limites que cada um desses modelos hermenêuticos oferecem-nos para pensar o fenômeno da instituição política. Each of the books that Hannah Arendt published in her lifetime was unique, and to this day each continues to provoke fresh thought and interpretations. This was never more true than for Eichmann in Jerusalem, her account of the trial of Adolf Eichmann, where she first used the phrase “the banality of evil.” Her consternation over how a man who was neither a monster nor a demon could nevertheless be an agent of the most extreme evil evoked derision, outrage, (...) and misunderstanding. The firestorm of controversy prompted Arendt to readdress fundamental questions and concerns about the nature of evil and the making of moral choices. Responsibility and Judgment gathers together unpublished writings from the last decade of Arendt’s life, as she struggled to explicate the meaning of Eichmann in Jerusalem. At the heart of this book is a profound ethical investigation, “Some Questions of Moral Philosophy”; in it Arendt confronts the inadequacy of traditional moral “truths” as standards to judge what we are capable of doing, and she examines anew our ability to distinguish good from evil and right from wrong. We see how Arendt comes to understand that alongside the radical evil she had addressed in earlier analyses of totalitarianism, there exists a more pernicious evil, independent of political ideology, whose execution is limitless when the perpetrator feels no remorse and can forget his acts as soon as they are committed. Responsibility and Judgment is an essential work for understanding Arendt’s conception of morality; it is also an indispensable investigation into some of the most troubling and important issues of our time. I argue that legal punishment is morally wrong because it’s too morally risky. I first briefly explain how my argument differs from similar ones in the philosophical literature on legal punishment. Then I explain why legal punishment is morally risky, argue that it’s too morally risky, and discuss objections. In a nutshell, my argument goes as follows. Legal punishment is wrong because we can never sufficiently reduce the risk of doing wrong when we legally punish people. We can never sufficiently (...) reduce this risk because wrongful punishment is much worse than wrongful non-punishment and because punishment’s permissibility depends on the answers to a variety of difficult philosophical questions about which we’re fallible. The financial sector has seen a transformation towards ‘sustainable’ finance particularly in Europe, driven also by unprecedented regulatory reforms. At the same time, many are sceptical about the real impact of these reforms, fearing that they are triggering a paradoxical financialisation of sustainability. Building on recent research on institutional logics and institutional fields formation, we examine changes in the EU regulatory dynamics as characterised by shifts in framing the relationship between sustainability and finance. Deploying a longitudinal approach, consisting of archival (...) data and semi-structured interviews, we explore the development of EU sustainable finance regulation as an extended, interactive and contested process. Specifically, we suggest that regulatory dynamics depend on the hybrid configuration of the social constituencies supporting sustainable finance reforms and on shifts in the overall prevalence of the financial logic in society. Our paper sheds light on the inherent contradictions and limitations of sustainable finance as a means for transformative sustainability reforms. (shrink)

The study aims to lay the groundwork for systematically investigating children’s peer discourse at different age levels with a view to delimiting the role of peer talk for pragmatic development. An interdisciplinary stance to the study of children’s peer talk is argued for, considering it simultaneously as the arena for the co-construction of childhood cultures as well as an arena for development. We propose a four-dimensional model of discursive events, meant to capture both dimensions simultaneously. The model takes into account (...) the dynamic interplay among the type of activity children are engaged in, the overall thematic frame of the event, its internal framing by the children themselves and the genre used. The model is applied to the analysis of natural peer talk at two age levels, preschoolers and fourth graders, focusing mainly on variation along the dimension of keying. The two age groups studied are shown to share a rich repertoire of keyings and genres, but to differ in their relative salience and modes of realization by age. Our analysis suggests that peer talk offers children ample opportunities to listen in, practice and display conversational as well as academic discursive skills, and hence may very well prove a crucial site for pragmatic development. Our aim was to study how nurses interpret patient autonomy in end-of-life decision making. This study built on our previous quantitative study, which evaluated the experiences of and views on end-of-life decision making of a representative sample of Finnish nurses taken from the whole country. We performed qualitative interviews with 17 nurses and analysed these using discourse analysis. In their talk, the nurses demonstrated three different discourses, namely, the ‘supporter’, the ‘analyst’ and the ‘practical’ discourses, each of which outlined a (...) certain position for patients and relatives, and a certain identity for the nurses in end-of-life decision making. The nurses’ talk showed notable differences when compared with that of physicians, highlighting the differences that take place in respect of the image of a person’s work, professional culture, professional identification and responsibilities. An important finding was that the nurses often described their participation in end-of-life decision making in terms of indirect influence. (shrink)

B a c k g r o u n d. This article reveals the understanding of the concept of nature in the works of the American philosopher Henry David Thoreau. Henry David Thoreau is an American philosopher, poet, essayist, naturalist and political activist. Together with Ralph Waldo Emerson, his friend and mentor, he is considered one of the founders of the transcendentalist movement. Transcendentalism was a powerful movement of American philosophy of the 19th century. It was characterized by focusing on (...) the problem of human self-knowledge, human's returning to own essence, living in harmony with nature, as well as criticism of modern society and active abolitionism. M e t h o d s. The article uses both general scientific methods and special methods, such as – the method of historical-philosophical reconstruction, which made it possible to reproduce the ideas of the American thinker, the hermeneutic method – for explaining individual positions of the philosopher. In addition, literary-critical methods were used, for the possibility of using various primary sources, and systematic method – to identify a systematized structure in the philosophical work of H. D. Thoreau. R e s u l t s. One of the main features of transcendentalism is a special interest in reflection on nature and a special approach to it. Thus, the concept of nature is present in most of H. D. Thoreau's works, and it is the central topic of his philosophical searches. The concept of nature in his works appears in different contexts, acquires different meanings. Thus, H. D. Thoreau talks about nature in the context of nature, in the context of poetic creativity, in his philosophical searches, in his vision of man and in his argumentation of his own political position. However, the different meanings that H. D. Thoreau attaches to the concept of nature do not contradict each other, but, on the contrary, complement and clarify his understanding of nature. C o n c l u s i o n s. This article proposes to consider the use of the concept of nature by H. D. Thoreau in the following aspects: Nature and Peculiarities of nature as a subject of scientific knowledge. Nature and The relationship between nature and culture through the relationship between "the wild" and society. Nature and From naturalism to humanism. This important book proposes a new account of the nature of language, founded upon an original interpretation of Wittgenstein. The authors deny the existence of a direct referential relationship between words and things. Rather, the link between language and world is a two-stage one, in which meaning is used and in which a natural language should be understood as fundamentally a collection of socially devised and maintained practices. In a recent New Yorker cartoon, a man is fixing a sink. His partner, standing nearby skeptically asks, “Do you really know what you are doing, or do you only google-​know?” This cartoon perfectly captures the mixed relationship we have with googling, or knowing via digital interface, particularly via search engines. On the one hand, googling is now the dominant source of socially useful knowledge. The use of search engines for this purpose is almost completely integrated into many of our (...) lives. On the other, the point the cartoon is making resonates with nearly all of us: users often recognize that there are risks and trade-​offs associated with gaining certain kinds of information via online search. These facts about googling make it particularly interesting to the applied epistemologist. Our practices involving search engines not only have a distinctive character, that character puts some traditional epistemic questions in a new light. This chapter will examine two of those questions. The first concerns the extent to which googling raises problems similar to familiar quandaries surrounding testimonial knowledge. The second –​and more radical –​concerns whether googling is a type of distributed or extended knowledge. (shrink)

This study examined cognitive predictors of susceptibility to orientation illusions: Poggendorff, Ponzo, and Zöllner. It was assumed that lower efficiency of information processing in WM and higher field dependence are conducive to orientation illusions. 61 architects aged M = 29, +/- 1.6, and 49 university students aged M = 23.53, +/- 4.24, were tested with Witkin’s EFT to assess their field dependence; the SWATT method was used as a measure of WM efficiency, and susceptibility to visual illusions was verified with (...) a series of computer tasks. We obtained a small range of the explained variance in the regression models including FDI and WM indicators. On the basis of WM efficiency indicators, we managed to confirm the existence of memory predictors of susceptibility to illusions. Among the architects, lower efficiency of WM processing and higher field dependence are responsible for greater susceptibility to orientation illusions. (shrink)
