Post–World War II developments concerning citizenship and access as one of the dimensions of citizenship are examined through the prism of noncitizenship and rights, using the drafting of the asylum paragraph of the 1949 Grundgesetz of the Federal Republic of Germany as a specific case study. The aim of this article is to look into the creation of the right to asylum in West Germany, to examine its political history by exploring its development and by searching for its conceptual, political, (...) and rhetorical origins. The article investigates the birth of the unique conceptualization of asylum in the debates of the Parliamentary Council, the constitutional and quasi-parliamentary assembly responsible for the writing of the postwar Basic Law, and examines the political choices, motivations, and compromises behind its creation. To connect the matter of asylum to a wider problematic related to noncitizens and rights, the article benefits from the political philosophy of Hannah Arendt, with reference to her writings on human rights and refugees in the immediate post–World War II period. This article is based on a qualitative longitudinal study that followed the subjective experiences of both people living with dementia and their family members during the early stages of the illness. The purpose of this article is to describe and reflect on the ethical and methodological issues that occurred during data collection. The article focuses on the situation of the person with dementia and the family member and the role of the researcher when conducting the research interviews. Based on the (...) results of this study, conducting research interviews with people with dementia and their family members poses several ethical and methodological challenges that must be addressed. In doing so, ethically sound dementia-specific research methods will be actively developed enhancing our understanding of living with dementia and providing new insights into the care of people with dementia and their family members. This study investigated Finnish nurses’ experiences and views on end-of-life decision making and compared them with physicians’ views. For this purpose, a questionnaire was sent to 800 nurses, of which 51% responded. Most of the nurses had a positive attitude towards and respect for living wills, more often than physicians. Most also believed that a will had an effect on decision making. Almost all of the nurses considered it their responsibility to talk to physicians about respecting living wills. Do-not-resuscitate (DNR) (...) orders were often interpreted to imply partial or complete palliative (symptom-orientated) care, which may cause confusion. Half of the nurses reported that a DNR decision was discussed always or often with a patient who was able to communicate; physicians were more positive in this respect. Surprisingly, many nurses (44%) stated that active treatment continued too long. Two-thirds thought that their opinions were taken into account sufficiently, even though only half believed that, in general, they had some impact. (shrink)

Objectives: This study investigated Finnish physicians’ experiences of decisions concerning living wills and do not resuscitate orders and also their views on the role of patients and family members in these decisions.Design: A questionnaire was sent to 800 physicians representing the following specialties: general practice ; internal medicine ; neurology , and oncology .Results: The response rate was 56%. Most of the respondents had a positive attitude toward , and respect for living wills, and 72% reported situations in which such (...) a will would have been helpful, although experience with their use was limited. The physicians reported both benefits and problems with living wills. Thirteen per cent had completed a living will of their own. Half did not consider living wills to be reliable if they were several years old. Do not resuscitate orders were interpreted in two ways: resuscitation forbidden or only palliative care required . The respondents also documented DNR orders differently. Seventy two per cent discussed DNR decisions always or often with patients able to communicate, and even 76% discussed DNR orders with the family members of patients unable to communicate. Most respondents were able to approach a dying patient without difficulty. They also felt that education in general was needed.Conclusions: In general Finnish physicians accept living wills, but find they are accompanied by several problems. Many problems could be avoided if physicians and patients conducted progressive discussions about living wills. The differing interpretations of DNR orders are a matter of concern in that they may affect patient treatment. The promotion of patient autonomy with respect to treatment seems rather good, but the limitations of the study need to be kept in mind. (shrink)

Our aim was to study how nurses interpret patient autonomy in end-of-life decision making. This study built on our previous quantitative study, which evaluated the experiences of and views on end-of-life decision making of a representative sample of Finnish nurses taken from the whole country. We performed qualitative interviews with 17 nurses and analysed these using discourse analysis. In their talk, the nurses demonstrated three different discourses, namely, the ‘supporter’, the ‘analyst’ and the ‘practical’ discourses, each of which outlined a (...) certain position for patients and relatives, and a certain identity for the nurses in end-of-life decision making. The nurses’ talk showed notable differences when compared with that of physicians, highlighting the differences that take place in respect of the image of a person’s work, professional culture, professional identification and responsibilities. An important finding was that the nurses often described their participation in end-of-life decision making in terms of indirect influence. (shrink)

Background Shared responsibility is an essential part of family-centred care and it characterizes the relationship between parents and healthcare professionals. Despite this, little is known about their shared responsibility for decision-making in neonatal intensive care units. Aim The aim of this scoping review was to identify previous studies on the subject and to summarize the knowledge that has been published so far. Method The review was conducted using electronic searches in the CINAHL, PubMed, Scopus and PsycINFO databases and manual searches (...) of the reference lists of the selected papers. The searches were limited to peer-reviewed papers that had been published in English from 2010 to September 2021. The data were selected based on inclusion and exclusion criteria and the findings were inductively summarized. We identified eight papers that met the inclusion criteria. Ethical considerations: The scoping review was conducted according to good scientific practice by respecting authorship and reporting the study processes accurately, honestly and transparently. Results The results showed that shared responsibility for decision-making was based on the parents’ intentions, but the degree to which they were willing to take responsibility varied. The facilitating and inhibiting factors for shared responsibility for decision-making were related to the communication between parents and professionals. The impact was related to the parents’ emotions. Conclusion It is essential that parents and professionals negotiate how both parties will contribute to their shared responsibility for decision-making. This will enable them to reach a mutual understanding of what is in the infants’ best interests and to mitigate the emotional burden of decisions in neonatal intensive care units. More research is needed to clarify the concept of shared responsibility for decision-making in this intensive care context. (shrink)

Adherence to professional ethics in nursing is fundamental for high-quality ethical care. However, analysis of the use and impact of nurses’ codes of ethics as a part of professional ethics is limited. To fill this gap in knowledge, the aim of our review was to describe the use and impact of the Code of Ethics for Nurses with Interpretive Statements published by the American Nurses Association as an example of one of the earliest and most extensive codes of ethics for (...) nurses with their interpretative statements and constituting a strong basis for the International Council of Nurses’ Code of Ethics for Nurses. We based our review on previous literature using a scoping review method. We included both non-scientific and scientific publications to provide an analysis of codes of ethics which can be utilized in development and revision of other nurses’ codes of ethics. In the searches, we used CINAHL and PubMed databases limiting publications to texts with a connection to the Code of Ethics for Nurses published from January 2001 to November 2022 and written in English. Searches yielded 1739 references, from which 785 non-scientific and 71 scientific publications were included for analysis of the data. Although non-scientific and scientific publications addressed different number of categories, the results indicated that in the both groups the use and impact focused on professional ethics, nursing practice, and work environment and less on education, research, or social health issues. Nurses’ ethical standards were not addressed in non-scientific publications, and clinical issues and leadership were not in focus in scientific publications. To increase evidence-based knowledge of the impact of codes of ethics additional research is needed. Good scientific conduct was followed. (shrink)

Purpose The purpose of this paper is to present a systematic literature review of empirical studies into online platforms for political participation. The objective was to diagnose the relationship between different types of digital participatory platforms, the real possibilities of participation generated by those initiatives and the impact of such participation on the decision-making process of governmental representatives. Design/methodology/approach A systematic literature review was conducted using pre-defined terms, expressions and criteria. A total of 434 articles from 1995 to 2015 were (...) gathered from the Web of Science database. And, 32 studies were selected from those articles for meta-synthesis, and the cases investigated were evaluated according to the e-participation ladder model. Findings The results indicated that online political participation worldwide remains timid both in quantity and quality. We have witnessed the growth of a kind of “rhetorical participation” promoted by policy-makers and the rise of a “participatory despotism”, in which only the privileged partake, while the majority remains silent. Practical implications The solutions found to promote increased participation and ensure its effectiveness ranged from shaping the platform design in accordance with citizens’ capacities and interests to a need for profound political–administrative change, which includes the world’s public agencies adopting a more transparent, inclusive and collaborative approach to decision-making. Originality/value This paper proposes a systematic review, mapping the studies on online platforms for political participation, analysing the questions, methods and conclusions found by the authors and evaluating each case study with a participation ladder. Social theory has a discovered and discoverable past and a complex, contested, dynamic, and anxious present. All of these adjectives save the last one-anxious-are reflected in various ways and with differing emphases throughout this handbook. I will say something about "anxious" below, but before doing so will offer a rationale for producing this multi-authored, two-volume overview reflecting the diversity of theory work in sociology and offering a sense of both where the discipline has come and where it is today. There (...) is no univocal answer to the question, What does social theory mean? Since the institutionalization of sociology in the academy and its development of subfields, theory has found a place in the overall educational structure of the discipline, in a manner akin to the way that methodology has. That is to say, both theory and methodology have been viewed in some fashion as essential to sociological inquiry, and thus relevant to all of the substantive subfields within it. At the same time, it became clear early on that consensus regarding the meaning of theory has proven elusive. As World War II came to an end and the rapid expansion in higher education was about to commence, Robert K. Merton (1945), the protégé of Talcott Parsons, claimed that six types of analysis had come to be described as sociological theory. Over six decades later, Gabriel Abend (2008) identified seven distinct though sometimes overlapping meanings attributed to theory-a figure that Omar Lizardo (2014) thinks is at the lower end of the actual number of different meanings. Can consideration of the emotions help to solve the problem of other minds? Intuitively, it should. We often think of emotions as public: as observable in the body, face, and voice of others. Perhaps you can simply see another's disgust or anger, say, in her demeanour and expression; or hear the sadness clearly in his voice. Publicity of mind, meanwhile, is just what is demanded by some solutions to the problem. But what does this demand amount to, and do emotions (...) actually meet it? This paper has three parts. First, I consider the nature of the problem of other minds. Second, I consider the publicity of emotions. And third, I bring these together to show how emotions can help to solve the problem. Recently, Michael Huemer has defended the Principle of Phenomenal Conservatism: If it seems to S that p, then, in the absence of defeaters, S thereby has at least some degree of justification for believing that p. This principle has potentially far-reaching implications. Huemer uses it to argue against skepticism and to defend a version of ethical intuitionism. I employ a reductio to show that PC is false. If PC is true, beliefs can yield justification for believing their contents in cases (...) where, intuitively, they should not be able to do so. I argue that there are cases where a belief that p can behave like an appearance that p and thereby make it seem to one that p. (shrink)

According to Edmund Husserl in the Prolegomena to Pure Logic, which constitutes the preliminary rational foundation for – and also the entire first volume of – his Logical Investigations, pure logic is the a priori theoretical, nomological science of „demonstration“.1 For him, demonstration includes both consequence and provability. Consequence is the defining property of all and only formally valid arguments, i. e., arguments that cannot lead from true premises to false conclusions. And provability is the property of a logical system (...) such that, for every truth of logic in that system, there is, at least in principle, a rigorous step-by-step logically valid procedure demonstrating its validity according to strictly universal, ideal, and necessary logical laws. In this way, the laws of pure logic completely determine its internal structure. Moreover, these laws and these proofs are all knowable a priori, with selfevident insight. This essay is based on a double perspective provided by literary reading and philosophy for approaching the problem of evil through a critical analysis of certain texts and characters constructed and represented in them, particularly Kant’s theodicy essay and its most important pre-text, the Book of Job. This methodology yields a novel approach to the familiar issue of theodicy vs. anti-theodicy. This collection of articles from both distinguished and emerging authors working at the intersections of philosophy, literary theory, media, and technology does not intend to fix new moral rules. Instead, the volume explores the ethos of digital environments, asking how we can orient ourselves in them and inviting us to renewed moral reflection in the face of dilemmas they entail.

The article is based on an analysis of the works of the French historian Pierre Nora, who, trying to find a "true" history, comes to the opposition of history and memory. Outright political agitation and national imperatives are dominated in History, therefore history cannot be correct and objective. Instead of history, the philosopher believes, we should focus on the right memory. But when memory itself has been torn apart, it can only exist on the basis of "memory places" - mnemonic (...) places. The power of memory is preserved now in the places of memory that accumulate and preserve history. Places of memory have lost their physical or geographical meanings. Meaning and sense are made places of memory, important place for history. Due to the nature of the memory places, the multiplicities of their interpretations are the normal. And the past, therefore, became a poly semantic space, focused on the co-presence of many different versions of the interpretation of the same memorial structures (monuments, historical facts and events, texts of the past). Contrasting memory and history, P. Nora concludes about "the tyranny of memory (it is reminiscent of Reeker's statement). In his opinion, at any moment the memory is ready to lift history under itself, to "memorize" it, it deeply and dangerously distorts the meaning of words. Precisely because there is no collective memory, the places of memory appear that designed to compensate for its absence. When the space of memory disappears, mnemonic places appear. It is through mnemonic places (places of memory) as spaces that provide access to traditions, Nora moves from the present to the past. But the noble goal of finding the truth, of recreating traditions, has turned into honoring memory for political purposes, where the past has become the rhetorical construct of the present. Hence, the perception of truth is changing. Now, the truth is not in the "factuality" of the data, but in their "relevance". In the end, Nora makes a rather devastating conclusion for history- that the past has lost its meaning, the present historical consciousness gives meaning to all possible and valid versions of the past, and that official memory (politics of memory) is associated with practices of selective forgetting or memory. This chapter considers various arguments purporting to show that respect for animal rights is consistent with "therapeutic hunting"--that is, hunting undertaken as part of a plan to control wild animal populations. It concludes that these arguments fail. It also suggests that the implications of Regan's rights view may be more sweeping than are generally recognizes: the rights view seems to rule out not only therapeutic hunting, but also subsistence hunting.

В історії домінує, вважає філософ, якщо не відверта політична агітація, то національні імперативи, які ніяк не роблять історію справжньою та об’єктивною. Замість історії потрібно зосереджуватись на правильній пам’яті. Але в умовах, коли сама пам’ять стала розірваною, вона може існувати лише спираючись на «місця пам’яті» – мнемонічні місця. Сила пам’яті тепер зберігається в місцях пам’яті, які накопичують та зберігають історію. Тобто, місця (...) пам’яті втратили фізичний чи географічний сенси, і місцями пам’яті їх робить саме те, завдяки чому вони вислизають із простору історії – сенси, які вони несуть, смисли. Виходячи з такої природи місць пам’яті множинність їх інтерпретацій є нормою. А минуле, таким чином, виявляється полісемантичним простором, орієнтованим на співприсутність багатьох різноманітних версій інтерпретації одних і тих самих меморіальних структур (монументів, історичних фактів і подій, текстів минулого). Звідси випливає зміна уявлень про істинність. Тепер істина не у «фактичності» даних, а в їх «актуальності». Врешті-решт Нора робить досить нищівний для історії висновок, що минуле втратило сенс, історичну свідомість нині має виключно теперішнє, яке і наділяє сенсом усі можливі й припустимі версії минулого, і що офіційна пам`ять (політика пам’яті) пов’язана з практиками вибіркового забування чи пам`ятання. An observation of Hume’s has received a lot of attention over the last decade and a half: Although we can standardly imagine the most implausible scenarios, we encounter resistance when imagining propositions at odds with established moral (or perhaps more generally evaluative) convictions. The literature is ripe with ‘solutions’ to this so-called ‘Puzzle of Imaginative Resistance’. Few, however, question the plausibility of the empirical assumption at the heart of the puzzle. In this paper, we explore empirically whether the difficulty we (...) witness in imagining certain propositions is indeed due to claim type (evaluative v. non-evaluative) or whether it is much rather driven by mundane features of content. Our findings suggest that claim type plays but a marginal role, and that there might hence not be much of a ‘puzzle’ to be solved. (shrink)

The financial sector has seen a transformation towards ‘sustainable’ finance particularly in Europe, driven also by unprecedented regulatory reforms. At the same time, many are sceptical about the real impact of these reforms, fearing that they are triggering a paradoxical financialisation of sustainability. Building on recent research on institutional logics and institutional fields formation, we examine changes in the EU regulatory dynamics as characterised by shifts in framing the relationship between sustainability and finance. Deploying a longitudinal approach, consisting of archival (...) data and semi-structured interviews, we explore the development of EU sustainable finance regulation as an extended, interactive and contested process. Specifically, we suggest that regulatory dynamics depend on the hybrid configuration of the social constituencies supporting sustainable finance reforms and on shifts in the overall prevalence of the financial logic in society. Our paper sheds light on the inherent contradictions and limitations of sustainable finance as a means for transformative sustainability reforms. (shrink)

Deep Freedom and Real Persons: A Study in Metaphysics Volume 3. Kantian Ethics and Human Existence: A Study in Moral Philosophy Volume 4. Kant, Agnosticism, and Anarchism: A Theological-Political Treatise Volume 5. Cognition, Content, and the A Priori: A Study in the Philosophy of Mind and Knowledge The fifth volume in the series, Cognition, Content, and (...) the A Priori, was published by Oxford University Press in 2015. So, with the present publication of the first four volumes in the series by Nova Science in 2019, all five volumes of The Rational Human Condition are now available in hard-copy and as e-books. All five books share a common aim, which is to work out a true general theory of human rationality in a thoroughly nonideal natural and social world. This philosophical enterprise is what Hanna calls rational anthropology. In the eleventh and most famous of his Theses on Feuerbach, Marx wrote that philosophers have only interpreted the world in different ways; the point is to change it. Hanna completely agrees with Marx that the ultimate aim of philosophy is to change the world, not merely interpret it. So, Marx and Hanna are both philosophical liberationists: that is, they both believe that philosophy should have radical political implications. But, beyond Marx, Hanna also thinks that the primary aim of philosophy (understood as rational anthropology) and its practices of synoptic reflection, writing, teaching, and public conversation is to change lives for the betterand ultimately, for the sake of the highest good. Then, and only then, can the human race act upon the world in the right way. The four volumes of The Rational Human Condition will therefore appeal not only to philosophers, but also to any other philosophically-minded person interested in the intellectual and practical adventure of synoptic, reflective thinking about the nature of our rational, but still ineluctably human, all-too-human lives. Being concerned with representation, this book is about an idea, a concept, a word. It is primarily a conceptual analysis, not a historical study of the way in which representative government has evolved, nor yet an empirical investigation of the behavior of contemporary representatives or the expectations voters have about them. Yet, although the book is about a word, it is not about mere words, not merely about words. For the social philosopher, for the social scientist, words are not "mere"; (...) they are the tools of his trade and a vital part of his subject matter. Since human beings are not merely political animals but also language-using animals, their behavior is shaped by their ideas. What they do and how they do it depends upon how they see themselves and their world, and this in turn depends upon the concepts through which they see. Learning what "representation" means and learning how to represent are intimately connected. But even beyond this, the social theorist sees the world through a network of concepts. Our words define and delimit our world in important ways, and this is particularly true of the world of human and social things. For a zoologist may capture a rare specimen and simply observe it; but who can capture an instance of representation (or of power, or of interest)? Such things, too, can be observed, but the observation always presupposes at least a rudimentary conception of what representation (or power, or interest) is, what counts as representation, where it leaves off and some other phenomenon begins. Questions about what representation is, or is like, are not fully separable from the question of what "representation" means. This book approaches the former questions by way of the latter. (shrink)
