Preview: 2020, the year the coronavirus pandemic spread globally, marked the twenty-fifth year since the publication of Pierre Hadot’s work Philosophy as a Way of Life. In that time, what began as the research specialization of just a few scholars has become a growing area of philosophical and metaphilosophical inquiry, bringing together researchers from around the globe. Hadot’s key ideas of spiritual exercises, and the very idea of PWL, have been applied to a host of individual thinkers from across the (...) history of philosophy: from the Hellenistic and Roman-era philosophers of direct concern to Hadot, through renaissance thinkers like Petrarch, Lipsius, Montaigne, Descartes, or Bacon, into nineteenth-century thinkers led by Schopenhauer, Kierkegaard, and Nietzsche.In more recent years, more global reflections on the “very idea” of PWL have begun to emerge, as well as dedicated journal editions. In these more recent PWL studies, some of the manifold research questions have begun to be explored, which were opened up by the studies of Pierre and Ilsetraut Hadot, as well as its reception in Michel Foucault’s later work. What implications, after all, does understanding the history of PWL, and the predominance of this metaphilosophical conception in the history of Western thought, have for how we understand the practice of philosophy today? Does recovering the alternative understandings of philosophy as a practice in history necessarily lead to a criticism of contemporary, solely academic or theoretical modes of philosophizing, or is the idea of PWL one which has only historiographical force? Experiments in particle physics have hitherto failed to produce any significant evidence for the many explicit models of physics beyond the Standard Model (BSM) that had been proposed over the past decades. As a result, physicists have increasingly turned to model-independent strategies as tools in searching for a wide range of possible BSM effects. In this paper, we describe the Standard Model Effective Field Theory (SM-EFT) and analyse it in the context of the philosophical discussions about models, theories, and (bottom-up) (...) effective field theories. We find that while the SM-EFT is a quantum field theory, assisting experimentalists in searching for deviations from the SM, in its general form it lacks some of the characteristic features of models. Those features only come into play if put in by hand or prompted by empirical evidence for deviations. Employing different philosophical approaches to models, we argue that the case study suggests not to take a view on models that is overly permissive because it blurs the lines between the different stages of the SM-EFT research strategies and glosses over particle physicists' motivations for undertaking this bottom-up approach in the first place. Looking at EFTs from the perspective of modelling does not require taking a stance on some specific brand of realism or taking sides in the debate between reduction and emergence into which EFTs have recently been embedded. Der Aachener Physiker Michael Krämer sucht am Genfer Teilchenbeschleuniger LHC nach neuen Naturgesetzen. Ein Gespräch über die aufwändige Suche nach Erkenntnis, den Wert philosophischen Reflektierens und die größten offenen Fragen der Physik.

Diese Publikation handelt von der Beziehung zwischen dem Staat und dem Islam im allgemein-politischen und im schulischen Kontext, wobei der Islam neben anderen islamischen Institutionen in erster Linie von der Islamischen Glaubensgemeinschaft in Österreich (IGGÖ) vertreten wird. Der IGGÖ - ebenso wie anderen Kirchen und Religionsgesellschaften (KuR) - werden im österreichischen Religionsrechtssystem weitreichende Autonomierechte eingeräumt, vor allem in der Schule in Form eines konfessionellen Religionsunterrichts (RU). Zur Erforschung dieser Beziehung in der Schule wird ein rechts- und politikwissenschaftlicher Blick auf die (...) rechtlichen Rahmenbedingungen und die soziale Wirklichkeit des Islams und des RU der IGGÖ (IRU) in Wiener Mittelschulen geworfen. Konsequenterweise wird auch auf die verschiedenen involvierten Akteur*innen geblickt, insb. auf muslimische Schüler*innen und Eltern, Religionslehrer*innen, Fachinspektor*innen und sonstige Autoritäten der IGGÖ sowie Schuldirektor*innen, Bildungsdirektionen und das Bildungsministerium. Dafür wurden im Rahmen einer qualitativen Sozialforschung sieben (Schul-)Autoritäten der IGGÖ (IGGÖ-SA) als 'Vertreter*innen des Islams' und sechs Wiener Mittelschuldirektor*innen (MSD) als 'staatliche Vertreter*innen' interviewt. Die Interviews verfolgten drei Zwecke: 1) die Ergründung negativer rechtlicher, politischer, gesellschaftlicher und religionsgesellschaftlicher Einflussfaktoren auf die allgemeine Beziehung zwischen dem Staat und dem Islam bzw. der IGGÖ (und den Muslim*innen); 2) die Erhebung von Herausforderungen, Spannungen und Konflikten sowie Idealvorstellungen in der schulpolitischen, -bürokratischen, -organisatorischen, individuellen und korporativen Beziehungsdimension, sowie 3) die Erforschung von persönlichen Einstellungen und Haltungen von IGGÖ-SA und MSD zum Islam und dem IRU in der Schule sowie - vonseiten der IGGÖ-SA - zum Staat und der Gesellschaft. Während der dritte Zweck in dieser Publikation nur eine untergeordnete Rolle einnimmt, liegt das Hauptaugenmerk auf den abstrahierten Spannungsfeldern des 'gelebten Rechts' im Sinne der sozialen Wirklichkeit in den entsprechenden Beziehungsdimensionen, die in einer rechtssoziologischen Analyse dem normativem Recht gegenübergestellt und entlang idealtypischer Einstellungen und Haltungen auf Ursachen, Wirkungen und Lösungen untersucht werden. Die Analysethemen umfassen mitunter die Einbeziehung von Fachinspektor*innen für Religion in die Bildungsdirektionen, den Streit über die Abkürzung der IGGÖ für die Eintragung in Zeugnisse, die Schwierigkeiten in der Organisation mit dem RU, das (religiöse) Verhalten muslimischer Schüler*innen und Eltern in der Schule sowie die Grenzen der Lehre im IRU im Rahmen der staatsbürgerlichen Erziehung. Diesbezügliche Idealvorstellungen zu den Herausforderungen ermöglichen abschließend aus einer sozialintegrativen und pluralistischer Perspektive der IGGÖ-SA die Konturierung eines Österreichischen Islams bzw. eines idealtypischen IRU. This paper argues that there are two irreducibly distinct negative concepts of liberty: freedom as non-prevention, and freedom as non-coercion. Contemporary proponents of the negative view, such as Matthew Kramer and Ian Carter, have sought to develop the Hobbesian idea that freedom is essentially a matter of physical non-prevention. Accordingly, they have sought to reduce the freedom-diminishing effect of coercion to that of prevention by arguing that coercive threats function to diminish freedom by preventing people from performing certain combinations (...) of actions. Against this, this paper argues that coercion diminishes people’s freedom in ways that cannot be fully captured in terms of prevention. Focusing on two types of case, those involving coercive threats and those involving coercive preference manipulation, it argues that non-coercion and physical non-prevention are importantly different goods. It concludes that a complete negative account of liberty must draw not only on the (Hobbesian) ‘non-prevention’ strand of the negative tradition but also on its (Hayekian) ‘non-coercion’ strand. This paper seeks to clarify and defend the proposition that moral realism is best elaborated as a moral doctrine. I begin by upholding Ronald Dworkin’s anti-Archimedean critique of the error theory against some strictures by Michael Smith, and I then briefly suggest how a proponent of moral realism as a moral doctrine would respond to Smith’s defense of the Archimedeanism of expressivism. Thereafter, this paper moves to its chief endeavor. By differentiating clearly between expressivism and quasi-realism, the paper highlights (...) both their distinctness and their compatibility. In so doing, it underscores the affinities between Blackburnian quasi-realism and moral realism as a moral doctrine. Finally, this paper contends—in line with my earlier work on these matters—that moral realism as a moral doctrine points to the need for some reorienting of meta-ethical enquiries rather than for the abandoning of them. During the past few decades, Michael Moore has written incisively on an array of matters concerning the relationships between law and morality. While reflecting on those relationships, he has plumbed the nature of morality itself in impressive depth. Among the topics which he has addressed, the problem of torture has been prominent and controversial. It is a problem, moreover, that has led to some of his most searching enquiries into the character of moral obligations. This paper offers a brief account of Finnis' Natural Law Legal Theory (NLLT), primarily as it is presented in Natural Law and Natural Rights, and then defends Finnis' NLLT against the recent legal positivist criticism made by Matthew H. Kramer.

Two recent high-quality articles, including one in this journal, have challenged the Inclusivist and Incorporationist varieties of legal positivism. David Lefkowitz and Michael Giudice, writing from perspectives heavily influenced by the work of Joseph Raz, have endeavored—in sophisticated and interestingly distinct ways—to vindicate Raz's contention that moral principles are never among the law-validating criteria in any legal system nor among the laws that are applied as binding bases for adjudicative and administrative decisions in such a system. This article critically examines Porter and Kramer’s shared value concept to identify its boundaries and limits as a framework for understanding the role of philanthropy and CSR relative to the role of business in society. Cases of implementation and alternative perspectives on innovation reveal that, despite its appeal and uptake in corporate and philanthropic circles, shared value merely advances the conventional rhetoric that what is good for business is good for society. The shared value approach narrows what counts as (...) social value and avoids the friction between business and society. The consequence is that the approach is problematic as a framework for addressing sustainability and development, and an insufficient basis for decision-making about philanthropy and CSR. (shrink)

The central insights of Philip Pettit’s republican account of liberty are that (1) freedom consists in the absence of domination and (2) non-domination is not reducible to what is commonly called ‘negative liberty’. Recently, however, Matthew Kramer and Ian Carter have questioned whether the harms identified by Pettit under the banner of domination are not equally well accounted for by what they call the ‘pure negative’ view. In this article, first I argue that Pettit’s response to their criticism is (...) problematic insofar as it produces the following dilemma: either Pettit must concede that domination which one regards as consistent with one’s own best interests does not limit one’s freedom or he must embrace the implication that one can be forced to be free, a result he explici tly wants to avoid. Second, I argue that, despite the inadequacy of Pettit’s response, he is ultimately right in thinking that domination and negative liberty are sometimes compatible. My central contention, then, is that neither Pettit’s non-domination view nor Carter and Kramer’s pure negative view are able to account for the loss of liberty one suffers under conditions of domination. Dennoch bestätigen sie einander in der für beide zentralen Lehre von der untrennbaren Verbundenheit von Erkennen, Handeln, Fühlen und Selbstbewußtsein. Versucht man aber diese Lehre konsequent als schlechthin apriorische Einsicht zu verstehen, so löst sie sich unweigerlich in leere Redewendungen auf. Die tiefe Bedeutung, um die es durchaus bereits bei Fichte geht, kommt der Einsicht in die Einheit des Menschen in Erkennen, Handeln, Fühlen und Selbstbewußtsein (...) eigentlich erst dann zu, wenn man wie Whitehead die Last des rein aprioristischen Denkens abwirft. The proper evaluation of a theory's virtues seems to require taking into account what the theory is indirectly or implicitly committed to, in addition to what it explicitly says. Most extant proposals for criteria of theory choice in the literature spell out the relevant notion of implicit commitment via some notion of entailment. I show that such criteria behave implausibly in application to theories that differ over matters of entailment. A recent defence by Howard Peacock of such a criterion against (...) this objection is examined and rejected. I go on to a develop a better proposal on which, roughly speaking, a theory is counted committed to a claim if and only if its best fully explicit extension is explicitly committed to the claim. Such extensions in turn are evaluated by ordinary standards of theory choice adapted to the case of theories assumed to articulate their intended content in a fully explicit fashion. (shrink)

Kramer was one of the most visionary musical thinkers of the second half of the 20th century. In his The Time of Music, he approached the idea of the many different ways that time itself is articulated musically. This book has become influential among composers, theorists, and aestheticians.
