Is it allowable for your government, or anyone else, to influence or coerce you 'for your own sake'? This is a question about paternalism, or interference with a person's liberty or autonomy with the intention of promoting their good or averting harm, which has created considerable controversy at least since John Stuart Mill's On Liberty. Mill famously decried paternalism of any kind, whether carried out by private individuals or the state. In this volume of new essays, leading moral, political and (...) legal philosophers address how to define paternalism, its justification, and the implications for public policy, professional ethics and criminal law. So-called 'libertarian' or non-coercive paternalism receives considerable attention. The discussion addresses the nature of freedom and autonomy and the relation of individuals to law, policy and the state. This research explores the relationship of variant degrees of a country’s economic freedom to the ethical profiles of millennial business students, specifically an individual’s personal value orientation and post-conventional reasoning. Grounded in Social Identity, Personal Values, and Cognitive Moral Development theories, we construct an ethical profile to compare responses provided by millennial business students from eight countries. Our results suggest that a country’s degree of economic freedom has some association with an individual’s ethical profile, yet we also discuss other national (...) influences on an ethical profile. The Church-Turing Thesis is widely regarded as true, because of evidence that there is only one genuine notion of computation. By contrast, there are nowadays many different formal logics, and different corresponding foundational frameworks. Which ones can deliver a theory of computability? This question sets up a difficult challenge: the meanings of basic mathematical terms are not stable across frameworks. While it is easy to compare what different frameworks say, it is not so easy to compare what they mean. We (...) argue for some minimal conditions that must be met if two frameworks are to be compared; if frameworks are radical enough, comparison becomes hopeless. Our aim is to clarify the dialectical situation in this bourgeoning area of research, shedding light on the nature of non-classical logic and the notion of computation alike. (shrink)

Philosophers have predominantly regarded morality and aesthetics judgments as fundamentally different. However, whether this claim is empirically founded has remained unclear. In a novel task, we measured brain activity of participants judging the aesthetic beauty of artwork or the moral goodness of actions depicted. To control for the content of judgments, participants assessed the age of the artworks and the speed of depicted actions. Univariate analyses revealed whole-brain corrected, content-controlled common activation for aesthetics and morality judgments in frontopolar, dorsomedial and (...) ventrolateral prefrontal cortex. Temporoparietal cortex showed activation specific for morality judgments, occipital cortex for aesthetics judgments. Multivariate analyses revealed both common and distinct whole-brain corrected representations for morality and aesthetics judgments in temporoparietal and prefrontal regions. Overall, neural commonalities are more pronounced than predominant philosophical views would predict. They are compatible with minority accounts that stress commonalities between aesthetics and morality judgments, such as sentimentalism and a valuation framework. (shrink)

We characterize the class of c.e. degrees that bound a critical triple as those degrees that compute a function that has no ω-c.e. approximation.

There are only a few ethical regulations that deal explicitly with robots, in contrast to a vast number of regulations, which may be applied. We will focus on ethical issues with regard to “responsibility and autonomous robots”, “machines as a replacement for humans”, and “tele-presence”. Furthermore we will examine examples from special fields of application (medicine and healthcare, armed forces, and entertainment). We do not claim to present a complete list of ethical issue nor of regulations in the field of (...) robotics, but we will demonstrate that there are legal challenges with regard to these issues. In this paper we argue that in recent literature on mechanistic explanations, authors tend to conflate two distinct features that mechanistic models can have or fail to have: plausibility and richness. By plausibility, we mean the probability that a model is correct in the assertions it makes regarding the parts and operations of the mechanism, i.e., that the model is correct as a description of the actual mechanism. By richness, we mean the amount of detail the model gives about the (...) actual mechanism. First, we argue that there is at least a conceptual reason to keep these two features distinct, since they can vary independently from each other: models can be highly plausible while providing almost no details, while they can also be highly detailed but plainly wrong. Next, focusing on Craver's continuum of ?how-possibly,? to ?how-plausibly,? to ?how-actually? models, we argue that the conflation of plausibility and richness is harmful to the discussion because it leads to the view that both are necessary for a model to have explanatory power, while in fact, richness is only so with respect to a mechanism's activities, not its entities. Relying on an expanded view of leadership and the moral reasoning framework developed by Lawrence Kohlberg (1981), this study explores the moral reasoning of the chief executive officers at the 11 largest automobile manufacturers in the world. Using the CEO's letter to their stakeholders found in the organizations' annual social responsibility reports, the CEOs' moral reasoning is compared to other managers' moral reasoning, and the moral reasoning exhibited within the CEO group is analyzed for differences due to regional location. Contrary (...) to conventional understanding based on prior research, the CEOs in our sample did not exhibit moral reasoning at a higher level than a cross section of managers but there were differences within the sample of CEOs when looking at nationality. Implications of these results for CEOs, managers, academics, and others are explored. (shrink)

An apparently quite specific question that was addressed by both Confucius and Socrates has attracted much attention in Sino-Hellenistic comparative philosophy. Their respective responses to the question of how a son should respond if his father commits a crime are found in Confucius' Analects 13:18 and in Plato's Euthyphro. This essay assesses three comparative analyses of these responses with particular reference to their underlying assertions of commonality, that is, the assumptions or presuppositions of commonality that serve to justify the comparative (...) exercise in the first instance. The authors suggest that two of the analyses assert commonality between their two responses from a Confucian standpoint, while the third constructs commonality from a Socratic standpoint. The authors argue that the response of Confucius focuses specifically on the issue of xiao in the concrete situation presented to him, whereas Socrates uses the issue to investigate the different question known as the "Euthyphro dilemma." Some brief conclusions are drawn regarding comparative philosophical analysis in general and about comparing the responses of Confucius and Socrates in these passages in particular. (shrink)

Religious exemptions have a long history in American law, but have become especially controversial over the last several years. The essays in this volume address the moral and philosophical issues that the legal practice of religious exemptions often raises.

In contrast to vertical gene transfer from parent to offspring, horizontal (or lateral) gene transfer moves genetic information between different species. Bacteria and archaea often adapt through horizontal gene transfer. Recent analyses indicate that eukaryotic genomes, too, have acquired numerous genes via horizontal transfer from prokaryotes and other lineages. Based on this we raise the hypothesis that horizontally acquired genes may have contributed more to adaptive evolution of eukaryotes than previously assumed. Current candidate sets of horizontally acquired eukaryotic genes may (...) just be the tip of an iceberg. We have recently shown that adaptation of the thermoacidophilic red algaGaldieria sulphurariato its hot, acid, toxic‐metal laden, volcanic environment was facilitated by the acquisition of numerous genes from extremophile bacteria and archaea. L’échec du sommet de Vilnius à la fin de 2013 et les récents événements ukrainiens ont mis en évidence les conséquences liées au refus de la prise en compte de l’histoire des partenaires dans la négociation que développe l’Union européenne avec ses voisins orientaux. Ils montrent que les expériences collectives alimentées à des sources historiques différentes sont autant de ressources que les acteurs mobilisent pour faire valoir d’autres dimensions temporelles. Sans une communauté de références partagées, à la base des intérêts (...) collectifs, les asymétries entre les joueurs ne peuvent que croître. L’examen du processus d’élargissement et celui de la Politique européenne de voisinage mettent en valeur les limites de la stratégie de la Commission quand elle prétend s’appuyer sur la socialisation des élites pour contrer les conflits. Les résultats se mesurent en termes de déclarations sans suite quand les idées constitutives de l’UE et le transfert des compétences ne sont d’aucun poids. L’analyse des deux séquences permet de conclure que les temporalités sont un enjeu de la négociation et que l’ « européanisation » n’est pas le modèle de toute négociation possible. (shrink)

Contemporary proponents of Confucian political philosophy often ignore the fact that any sizeable future Confucian political order will have to accommodate many “non-Confucians.” The guiding question of this paper is therefore the following: how could a Confucian political philosophy, if it can at all, adequately take into account a plurality of comprehensive worldviews? I first turn to John Rawls and his account of these terms and of reasonable pluralism more generally. I then examine some particularly relevant developments and criticism of (...) Rawls’ account. Finally, I offer a discussion of some recent proposals for a Confucian political philosophy, and examine to what extent each recognizes the fact of pluralism, sees it as a challenge, and deals with it in a persuasive manner. The paper concludes with a depiction of two major stumbling blocks that might stand firmly in the way of such a pluralism-accommodating political Confucianism. (shrink)

Although the AICPA Code of Professional Conduct emphasizes the importance of education in ethics, very little is known about how and when the Code and the topic of ethics can be presented to enhance the effectiveness of ethics-oriented education. The purpose of this research was to provide preliminary evidence about the ethical development of students prior to, and immediately following, such courses. We found that: (1) accounting students, after taking an auditing course which emphasized the AICPA Code, reasoned at higher (...) levels than students who had not taken the course; (2) there were no differences in moral reasoning levels when accounting and non-accounting majors were compared prior to an auditing course; and (3) there was a significant relationship between the Seniors' levels of ethical development and the choice of an ethical versus unethical action. It was concluded that an auditing course emphasizing the 'spirit' of the Code can have a positive impact on the ethical behaviour of some of the future members of the accounting profession. (shrink)

For two decades the German edition of this book has been a standard reference point for students of the philosophy of the social sciences in Germany. In matters of discontinuation of life-sustaining treatment, traditional role of the family to speak on behalf of the incompetent patient is questionable. We explore the reasons why physicians perceive patient autonomy to be transferrable to family members. Principle of patient autonomy may not suffice when futile treatment is demanded and may serve to erode the ethical integrity of medical profession. An enhanced role for bioethics committees is proposed when physicians propose to discontinue life-sustaining treatment against the wishes of the patient (...) or their families. (shrink)

The particular situation of the French administrative detention center medical units appears to be an exemplary case to study the difficulties facing medical practice. Indeed, the starting point of our inquiry was an amazing observation that needed to be addressed and understood: why are professional interpreters so seldom requested in ADC medical units, where one would expect that they would be “naturally” present? Aiming to fully explore the meanings of the “absent interpreter”, this article takes into account the possible meanings (...) of this situation: the recourse to professional interpreters in France is far from expected given cumulative evidence of its benefits; perceptions of illegal immigrants and medical habitus itself may both hamper the use of a third party; the ADCs are a very stressful place for healthcare professionals, with conflicting missions, political issues enmeshed with medical goals, and heavy affective burden that may lead to self-protection. Silencing voices of suffering others might be seen as the hidden indecent truth of the “absent interpreter”. These reflections open a window to a larger issue with regard to the full range of medicine: what are the place, the role and the function of patient’s words and narratives in contemporary medicine? The highly invested somatic perspective and its political corollary giving primacy to bare life harbor potential risks of obscuring speeches and undervaluing narratives. (shrink)

And there remains today "professional" Whiteheadians who claim that this work can - or even should - be bracketed by anyone wishing to get a clear picture of Whitehead's true speculative agenda. Jürgen Habermas is well known for his scholarly works on the theoretical foundations of the human sciences. The New Conservatism brings to light another side of Habermas's talents, showing him as an incisive commentator on a wide range of contemporary themes.The 1980s have been a crucial decade in the political life of the Federal Republic of Germany. The transformations that accompanied a shift from 13 years of Social Democratic rule to government by the conservative Christian Democrats are captured in this (...) series of insightful, often passionate political and cultural commentaries. In this paper, we analyse the fruitfulness of Ronald Giere’s comparative model for causation in populations. While the original model was primarily developed to capture the meaning of causal claims in the biomedical and health sciences, we want to show that the model is not only useful in these domains, but can also fruitfully be applied to other scientific domains. Specifically, we demonstrate that the model is fruitful for characterizing the meaning of causal claims found in classical genetics, epidemiology and (...) electoral sociology. Additionally, we propose an adapted comparative model which is needed to get a grip on higher level causal claims. We show that such claims are present in population genetics, epidemiology and electoral systems research. We conclude with some reflections on the implications of our findings for the issue of causal pluralism. (shrink)

This short masterwork in twentieth-century philosophy provides both a major reinterpretation of Hegel and insight into the evolution of Adorno's critical theory. The first study focuses on the relationship of reason, the individual, and society in Hegel, defending him against the criticism that he was merely an apologist for bourgeois society. The second study examines the experiential content of Hegel's idealism, considering the notion of experience in relation to immediacy, empirical reality, science, and society. The third study, "Skoteinos," is an (...) unusual and fascinating essay in which Adorno lays out his thoughts on understanding Hegel. In his reflections, which spring from his experience teaching at the Goethe University in Frankfurt, questions of textual and philosophical interpretation are intertwined.Rescuing the truth value of Hegel's work is a recurring theme of the critical theory of the Frankfurt School, and nowhere is this goal pursued with more insight than in these three studies. The core problem Adorno sets for himself is how to read Hegel in a way that comprehends both the work and its historical context, thereby allowing conclusions to be drawn that may seem on the surface to be exactly opposed to what Hegel wrote but that are, nevertheless, valid as the present truth of the work. It is the elaboration of this method of interpretation, a negative dialectic, that was Adorno's underlying goal.Adorno's efforts to salvage the contemporaneity of Hegel's thought form part of his response to the increasingly tight net of social control in the aftermath of World War II. In this, his work is related to the very different attempts to undermine reified thinking undertaken by the various French theorists. Researchers and managers alike are becoming increasingly interested in the topic of unethical consumer behavior. Where most studies view unethical behavior as something that is identifiable per se, the authors of the present article believe that it only exists because it has been constructed by people operating within a specific context. Hence the efforts made by this paper to explore, at the level of one specific organization, how interactions between employees and consumers might lead to the construct of unethical consumers. (...) Based on a case study of France’s AMDM—a mutual insurance company set up to serve a client base comprising motorcyclists—the paper addresses how one group of consumers ends up being categorized as unethical by revealing the existence of a sensemaking process within the target organization. This process develops in three main phases: the nurturing of a shared ethos; the protection of employees’ recognized status; and the demonization of any group of consumers threatening this status. Managers incorporating this sensemaking process can avoid or mitigate the negative effects befalling organizations when these kinds of unethical consumer behavior are constructed. (shrink)

O artigo aborda a discussão entre John Rawls e Jürgen Habermas no que diz respeito ao processo democrático e à neutralidade. Indica que a formação do processo democrático acontece de maneira distinta em uma perspectiva liberal e republicana e que ambos os autores assimilam essa questão de forma diferente. No que se refere à neutralidade, embora tanto Rawls quanto Habermas defendam uma prioridade do justo sobre o bem, o intuito é mostrar que as implicações derivadas de suas perspectivas também são (...) distintas. Trata-se de uma das críticas fundamentais de Habermas a Rawls e um dos principais pontos de desacordo entre as duas perspectivas sobre o liberalismo político. (shrink)
