It is assumed institutions of higher education are a means to upward socioeconomic mobility and in turn a way of addressing poverty that is tied to certain racialized/sexualized bodies. Joseph Carens in his 2013 book Ethics of Immigration argues we should not criminalize undocumented migrants. Instead, we should view them as irregular immigrants who are entitled to some general human rights. This article focuses on Caren's discussion of criminalization in light of recent scholarship by John Marquez and Natalie Cisneros pertaining to the Latina/o border death toll, generalized violence, and discourses on undocumented pregnant migrante females as multiplying rats and anchor babies. This article argues that simply relying on a (...) democratic state model to understand the realities of border militarization is not sufficient because it does not perform some of the explanatory functions performed by other non-ideal theories. By synthesizing the views of Cisneros and Marquez, this article distinguishs thick and thin senses of excessive border enforcement and outlines a notion of the racial/sexual state of expendability as a way of making better sense of these violent realities. Sean Meighoo opens up the debate with the observation that recent radical antiracist and anticolonial discourses tend to focus solely on interrogating the privilege of dominant discursive terms within these discourses, like “black-white,” “colonizer-colonized.” Hereby, they fail to adequately dismantle or deconstruct the binary opposition that informs these terms. Meighoo stakes the claim that the conceptual order of race and colonialism should be dismantled or deconstructed by questioning the binary opposition of the aforementioned terms. In engaging his position, Tracey Nicholls (...) endorses that our individual messy, complex, and entangled narratives be introduced into the analytic academic space so that its dichotomies can be sundered through the narratives of other experience. Grant Silva argues that different accounts about colonization that account for the variegated axes of oppression through which the coloniality of knowledge is manifested be developed. Finally, Ernesto Rosen Velásquez directs attention to the ubiquity of coloniality in a world marked by euro-modern colonialism. In his reply, Meighoo reiterates his position that those who seek to make critical interventions in antiracist and anticolonial debates should critically engage with their own complicity with power. The first part of my hypothesis, then, is simple enough, and would be accepted in principle by most students of Plato: the dramatic structure of the dialogues is an essential part of their philosophical meaning. With respect to the poetic and mathematical aspects of philosophy, we may distinguish three general kinds of dialogue. For example, consider the Sophist and Statesman, where Socrates is virtually silent: the principal interlocutors are mathematicians and an Eleatic Stranger, a student of Parmenides, although one who (...) is not always loyal to his master's teaching of what might be called monadic homogeneity. In these dialogues, the mathematical character of philosophy is not merely emphasized but exaggerated, and any attempt to interpret them must take this fact into account. Otherwise, we shall not be able to understand why the Stranger seems to classify the general's art in the same species of the genus hunting as the louse catcher. The significance of this step, which does not stem from humanitarian considerations, but rather illustrates how the human becomes invisible from the mathematical viewpoint, contributes its share to the obscurity of these two dialogues. Second, there are dialogues like the Phaedrus and Symposium, in which the style, the interlocutors, and even the subject-matter seem to be largely poetic and rhetorical. Here, the overwhelming impression is of enthusiasm, divine madness, and intoxication in speech and deed. Finally, there are dialogues like the Philebus and Republic, in which it is not so easy to say whether poetry or mathematics predominates, if indeed either may be said to do so. (shrink)

Abstract This paper illustrates how Aristotle's topological theses about change in Physics 5-6 can help address metaphysical issues. Two distinctions from Physics 5. 1 are discussed: changing per se versus changing per aliud ; motion versus change. Change from white to black is motion and alteration, whereas change from white to not white is neither. But is not every change from white to black identical with a change from white to not white? Theses from Physics 6 refute the identity. Is (...) change from white to black at least accompanied by change from white to not white? Perhaps, but given further theses from Physics 6, this supposition yields unwelcome consequences. Most likely, when something changes from white to black it changes merely per aliud , not per se , from white to not white. Genuine change between white and not white is found elsewhere; its admission has bearing on Aristotle's theory of perception. (shrink)

It has been argued by Hull and others that a remnant of essentialism impeded taxonomic progress until systematists abandoned attempting to define taxa on the basis of characters necessary and sufficient for group membership. The advent of cladistics suggests instead that it is an essentialistic view of characters, not of taxa, that should be abandoned, and that only a transformational view of characters allows evolutionary novelties to be identified, much less explained. Conventional Darwinian explanations are not tautologous but are difficult (...) to test and scarcely explain evolutionary novelties, probably because of their emphasis on genetic rather than epigenetic (developmental) processes. The four essays in this volume examine the most central issues that face liberal democratic regimes. They tackle the protection of individual liberty, the basic principles of ethics, the benefits and the costs of representative institutions, and the central importance of gender equality in society.

Confessions both hold a great promise and pose a grave danger. When the accused speaks against his interest and assumes responsibility for criminal actions this is viewed as a compelling sign of guilt. It is not, therefore, for naught that the confession has been crowned the "queen of evidence." Yet research conducted in the last few decades has shown that a substantial number of confessions are false, ranking the out of court confession high among the factors leading to the conviction (...) of innocent people. The acceptance of DNA testing, has further substantiated this finding, igniting a renewed interest in out-of-court confessions. It is hard to assess the magnitude of social harm caused by the widespread and persistent resort to obtaining confessions, but one thing is evident from the vast literature on the matter: this evidentiary mechanism is currently overused, much beyond the optimal level. The reasons for this over-use are varied, among them the fact that confessions are readily available for law enforcement officers, and that those in charge of trying the facts tend to overwhelmingly convict based on out-of-court confessions, while underestimating the associated dangers. As a result, confessions have come to play a paramount role in the criminal justice system. Many attempts have been made to deal with confession-based wrongful convictions. Examples include the Miranda rules or the requirements for varying degrees and types of corroborating evidence. To date, all the rules and proposals share a common characteristic: They all attempt to correct the evidentiary fallacies associated with out-of-court confessions by evidentiary means, whether admissibility oriented or weight oriented. In the article we argue that none of the proposed mechanisms is likely to solve the problem. The root of the problem lies in the fact that the entire criminal justice system is currently organized around confessions. Law enforcement officers focus on obtaining confessions and the prosecution uses it as its evidentiary centerpiece. Further restricting admissibility or requiring a higher degree of corroboration will not change this trend. Moreover, the confessional lure is too strong to resist. Like the Sirens' Song, the confession casts a spell on all those subjected to it and, no matter how strong a corroboration we require, we will eventually fall back on the confession. We propose an entirely different solution to the tendency to over-use confessions, one that utilizes penal means to change the incentive structure within the criminal justice system. We propose to incorporate into the sentencing guidelines a mandatory reduction of the criminal sanction whenever an out-of-court confession is introduced into evidence by the prosecution. In other words, our proposal is to elevate the cost of using out-of court confessions, as compared to other types of evidence. The article will demonstrate how placing such a "sentencing price tag" on the use of out-of-court confessions will correct the current bias in favor of using this evidence and induce law enforcement officials to seek extrinsic evidence, thus turning confessions into a residual evidentiary devise. The article will also show that the proposed regime will improve the court's ability to distinguish between true and false confessions. After discussing the proposed model's normative appeal, the article will proceed to deal with possible criticisms which can be leveled against it, whether retributive, utilitarian or expressive. Mi propósito es presentar un bosquejo del sentido histórico del concepto de realismo político situándolo en los contextos de la Realpolitik alemana y de la escuela realista de las relaciones internacionales. De este modo, pretendo mostrar las relaciones contextuales del realismo político, la localización de su antagonismo con el liberalismo y la invención retrospectiva de una tradición (...) realista como resultado de una serie de apropiaciones intelectuales y políticas. This article is a historiographical and conceptual attempt of clarification and delimitation to offer an alternative view to the studies of the realist political theory. I pretend to put forward an outline of the historical sense of the concept of political realism, placing it on the contexts of German Realpolitik and the realist school of international relations. Thus, I pretend to show the contextual relations of political realism, the location of its antagonism against liberalism and the retrospective invention of a realist tradition as a result of a set of intellectual and political additions. Segundo a tese minimalista, todo efeito contextual sobre a avaliação de uma dada sentença resulta ou bem de uma variação nos parâmetros contextuais selecionados por morfemas indexicais, ou bem de uma mu- dança nas circunstâncias de avaliação. O contextualismo coloca dois tipos de desafio a esta tese. Por um lado, em pelo menos alguns casos, diferentes ocorrências de uma mesma sentença parecem ter avaliações divergentes que não podem ser explicadas pela tese minimalista. Por outro, parece haver asserções que são avaliadas (...) relativamente a parâ- metros que não são selecionados pelos morfemas utilizados pelo falan- te. As motivações contextualistas não se limitam a estes desafios. Uma motivação positiva é a associação de diferentes esquemas conceituais a um mesmo lexema. Outra motivação reside na dimensão implícita do pensamento e da ação, o que se traduz em elementos não articulados de asserções. Em ambos os casos, o contexto desempenha um papel na determinação da proposição expressa. (shrink)

The border war between semantics and pragmatics has an early version in the dispute between Mates and Cavell. While Mates argues for a strict separation between semantic inferences and mere pragmatic regularities, Cavell argues for a “logic of ordinary language”, identifying the commitments following the act of saying something. This answer gives a clue to the contemporary debate between minimalists and contextualists: we may either think that pragmatic inferences are only effective after the proposition is grasped, or think that it (...) is part of the determination of what is said. However, Cavell has also another answer, that seems much less amenable to logical regimentation: we understand what an agent is committed to as we evaluate what is appropriate to do in a given situation. In this latter case, there is no logic to backtrack to the very determination of what is said: the agent is attuned to the complexity of her contexts of action, but it does not lead to a local adjustment of concepts. This is precisely what a semanticist does, according to Predelli: she is attuned to the complexity of human purposes, and represents this contextual sensitivity at points of evaluation of sentences, but does not build this complexity into his semantic system. Predelli is at odds both with minimalists and contextualists in this respect, and we can see the specificity of his position as we construe different maps of the theoretical landscape. A bit of historical perspective opens up new ways to see some current discussions. (shrink)

Ockham has a very particular definition of modality: every term that is predicable of a whole sentence is a modal term. His definition reaches well beyond “necessary,” “possible,” “contingent” and “impossible,” including predicates such as “known” and “believed,” but also “written” and “spoken.” He provides a general framework for inferences including every term covered by his definition of modality. However, there is a proper modal syllogistic in Ockham only for the Aristotelian modalities, that combines two distinct semantic apparatus, constituted by (...) Ockhamist modal predicates, on the one hand, and by modal and modally modified copulae, on the other. For the development of a syllogistic for the Aristotelian modalities, both are needed. There is no similar apparatus for other modalities in Ockham. (shrink)

Complexe significabilia are the significate of whole sentences, irreducible to what is signified by categorematic sub-sentential components. It has been propounded firstly by Adam Wodeham. Wodeham construes his argument for the postulation of complexe significabilia as a middle way between William of Ockham and Walter Chatton. According to Wodeham, Ockham’s view implies a reflexive theory of mental acts, which goes against the phenomenology of the act of assent. Moreover, it leads to an anti-realist epistemology. We need therefore things outside the (...) mind to be object of the act of assent, which is also the conclusion reached by Chatton. However, against Chatton, Wodeham argues that things signified by the categorematic component of sentences cannot be the object of assent. In effect, sentences with different syncategorematic structures, but with the same categorematic components, would correspond to the same propositional attitude in Chatton’s framework, which is an unwelcome consequence. The result is that we need to postulate that the objects of assent are outside the mind, contra Ockham, that are not signified by sentential categorematic components, contra Chatton, but are irreducibly signified by the whole sentences. Physics says that it cannot deal with the mind-brain problem, because it does not deal in subjectivities, and mind is subjective. However, biologists still claim to seek a material basis for subjective mental processes, which would thereby render them objective. Something is clearly wrong here. I claim that what is wrong is the adoption of too narrow a view of what constitutes objectivity, especially in identifying it with what a machine can do. I approach the problem in the light of (...) two cognate circumstances: the measurement problem in quantum physics, and the objectivity of standard mathematics, even though most of it is beyond the reach of machines. I argue that the only resolution to such problems is in the recognition that closed loops of causation are objective; i.e. legitimate objects of scientific scrutiny. These are explicitly forbidden in any machine or mechanism. A material system which contains such loops is called complex. Such complex systems thus must possess nonsimulable models; i.e. models which contain impredicativities or self-references which cannot be removed, or faithfully mapped into a single coherent syntactic time-frame. I consider a few of the consequences of the above, in the context of thus redrawing the boundary between subject and object. (shrink)

El problema de la teodicea ha sido una de las grandes preocupaciones del pensamiento religioso en Occidente: si Dios es absolutamente bueno y omnipotente, ¿cómo puede existir el mal en el mundo?, y ¿por qué sufren los virtuosos y gozan los impíos? En la Antigüedad, el Libro de Job intentó ofrecer una respuesta que perduró hasta tiempos modernos. En el siglo XVII, Leibniz ofreció una respuesta mucho más racionalizada, propia de los tiempos modernos. Joseph de Maistre, un contrarrevolucionario del siglo (...) Contrario a las corrientes "políticamente correctas" de la academia latinoamericana, este ensayo sostiene que la globalización no es un fenómeno que debamos lamentar enteramente. El discurso anti-globalización se ha convertido en una suerte de moda intelectual, cuestión aprovechada por muchos demagogos para ganar audiencia. Tomando en consideración la obra de Karl Jaspers, el ensayo propone que la globalización es una continuación del "tiempo-eje", una transformación de la cual sería una hipocresía lamentarse.

Resumo: Peirce toma como verdadeiras as conclusões estáveis obtidas, a longo prazo, pela aplicação sistemática do método de pesquisa científica. Como notou Hacking, o realismo interno de Putnam duplica o processo de levar ao limite, pois acrescenta que também as normas ou padrões de racionalidade são produtos históricos que podem evoluir com o tempo e postula, no limite da investigação, uma situação epistemicamente ideal. Nossa intenção é examinar criticamente a proposta de Putnam de caracterizar a verdade como idealização da aceitabilidade (...) racional.: Peirce thinks that the truths are the stable conclusions reached by scientific inquiry continued long enough. As Hacking remarked, in Putnam's internal realism there is a double limiting process because the methods of inquiry can themselves grow. This paper aims at discussing Putnam's view that truth is an idealization of rational acceptability. (shrink)

Este ensayo critica la postura del multiculturalismo, movimiento filosóficopolítico en boga que defiende la igualdad de las culturas, pero ésta no está implicada en la igualdad natural de los hombres, y el relativismo, que defiende la igualdad de las culturas, es problemático desde un punto de vista lógico. La noción misma de igualdad llevaría a la conclusión paradójica de que las sociedades igualitarias son superiores a las sociedades jerárquicas. Igualmente, amerita destacar la singularidad de Occidente respecto a otras culturas. Det meste, vi ved om drømme, stammer fra de beretninger, vi giver, når vi er vågnet. Der findes ingen teknologi, som kan se direkte ind i vores drømme og fortælle os, hvad de handler om. For mange af os er det en lettelse, at vores drømme i det mindste fortsat er private. Dog kan vi få indsigt i drømme ved at studere sovende personers fysiologi, imens de sover.
