Purpose The purpose of this paper is to inform or alert readers to the extensive use and ready availability of genetic information that poses varying degrees of social and legal danger. The eugenics movement of the 1920s and the general acceptance of genetic essentialism provide context for considering contemporary examples of the problem. Design/methodology/approach This paper takes an argumentative approach, supporting proposals with ideas from historical and current research literature. Findings The limits of data protection, extensive use of direct-to-consumer genetic (...) testing and use of genetic information in white nationalist circles portend a resurgence of eugenic beliefs from a century ago. Social implications Research-based recommendations may help to avoid extreme consequences by encouraging people to make informed decisions about the use of genetic information. Originality/value The paper counterposes contemporary understanding of genetic testing and data accessibility with the much older ideology of eugenics, leading to concerns about how white nationalists might further their aims with 21st century technology. Definitions of death are often referred to as legal fictions since brain death was conceived in the mid-twentieth century. Reference to legal fiction is generally paired with bioethicists’ concern that it facilitates post-mortem tissue donation and the health system generally, by determining death earlier on the continuum of dying and availing more viable tissue and therapeutic resources for others. The author argues that spatio-legal theory, drawing from legal geography, can account for the heterogeneity of effects that the fiction has in (...) spatially managing bodies (e.g., physicians, patient, family) at the bedside. The legal fiction is produced in physicians’ socio-legal practices, coordinating decision-making according to geographies of scarcity and severable, self-contained live- and dead-bodies. The determination liminally exists between private and public, enacting a sterile, affectless ordering of bodies but administered in the spectacle of sovereign death-making, conveying authority whilst managing patient’s and family’s consents. Spatialising traces of anatamo-politics and biopolitics thereby congeal and are enacted heterogeneously in and through the legal form of the fiction, securing preferred constructions of the body in the management of mortality. These spatio-legal features of the legal fiction are described from their collision with case law and literature that document competing nomoi produced from or secreted by antinomian bodies. We developed a technique to examine the effects of emotional content and context on verbal memory. Two sets of sentences were devised: in the first, each sentence was emotionally arousing due to the inclusion of an emotional “target” word. In the second set, “targets” were replaced with well-matched neutral words. Subjects read aloud a selection of emotional and neutral sentences, and were then surprised with memory tasks after a range of time delays. Emotional target words were remembered significantly better than (...) neutral words in all experiments. Recognition of emotional words was relatively stable despite increasing delays between encoding and recognition testing, in contrast to memory for neutral words, which decayed over time. Memory for neutral non-target words was enhanced when words had been presented in an emotional context. The results confirm the phenomenon of emotional enhancement of memory at short and long delays and suggest that emotional context may be encoded independently of word meaning. (shrink)

We examined how information from multiple communication channels can inform social norms about local food purchasing. The concept of social exposure was used as a guide. Social exposure articulates how information in social, symbolic, and physical environments contributes to normative perceptions. Data was collected from a sample in Wisconsin. Results indicated that information from communication channels representing symbolic, social, and physical environments all contributed to normative perceptions. We also found that for individuals who frequent farmers’ markets, information from some communication (...) channels was relatively less strongly associated with injunctive norms. It may be that when first-hand, experiential information is available to inform norms, individuals rely less on information available through other communication channels. Future work might further explore how farmers’ markets foster information sharing in communities, as such information may contribute to normative perceptions. (shrink)

On Exceeding Determination and the Ideal of Reason: Immanuel Kant, William Desmond, and the Noumenological Principle examines the critical philosophy of Immanuel Kant, as it bears on theological principles. Focusing on the foundational ideas (of self, world, and God) that constitute Kant's metaphysical system, Shaw argues that these ideal projections of the rational structures of the thinking subject only conceal and obfuscate the more robust sense of the real that exists behind all phenomenal appearances. This book aims to critically assess (...) the theological content presented in the philosophy of Kant whilst reconstructing and developing some of Kant's more obscure points on the epistemological limitations of pure reason and the borders of knowledge itself. Shaw draws into dialogue with the writings of the contemporary philosopher William Desmond to demonstrate some of the problems of Kantian thought when it comes to the deeper mysteries of being. Desmondian philosophy proves to be a powerful influence over much of this work, as Shaw advances upon the delicate nexus where philosophy and theology convene. As a bold addition to this work, Shaw lays the groundwork for a new discourse in theology and the philosophy of religion: "Noumenology". Noumenology, which is Shaw's response to the deficiencies in methods concerning many of the modern approaches to phenomenology, is a call for the recalibration of the starting point for eidetic inquiry through the proposal of a non-discursive approach to the sensible, emotional, and intellectual - or perhaps, the all together spiritual. To accomplish this, Shaw reaches back to Kant for a heterodox approach to the language and content surrounding the noumenonal to set forth his theological interpretation of the "Noumenological Principle". Baggini presents summaries of (...) Hume's most famous philosophical arguments, along with biographical details about Hume's life, but always with the aim of learning from Hume about living well. He also discusses his own visits to several locations of importance to Hume.Over the course of The Great Guide, Baggini suggests many "Humean maxims and aphorisms" related to the good life. Some are drawn from Hume's own writings, such as the maxim that "the greatest part of mankind float betwixt vice and virtue." Others are arrived at by considering aspects of Hume's own life and character, including his failings. For example, after considering Hume's racism, Baggini clearly has his own admiration for Hume in mind when he suggests the maxim "never slavishly follow even the greatest minds, for they too have prejudices, weaknesses, and blind spots."Baggini begins by describing those parts of Edinburgh and southern Scotland that Hume would have known in his youth. He recounts the young Hume's rejection of religious belief and of the Stoic project of attempting to find happiness by making oneself independent of others. Like volume 3 of the same series, (...) the collection was published posthumously, with editorial work undertaken by Carol Atack, Malcolm Schofield, and David Sedley. Part I contains seven essays on topics in ontology and epistemology; part II contains four essays on physics and optics. The figures examined include the usual suspects—Plato and Aristotle (plus an appearance by Aquinas)—but Burnyeat also draws our attention to some less appreciated accomplices to the ancient philosophical project: the Platonist commentator Numenius of Apamea, the Pythagorean Archytas of Tarentum, and Anaxarchus of Abdera, a follower of Democritus. The result is a collection that showcases one of Burnyeat's greatest strengths: his ability to identify the clues left for us in ancient texts and to produce from them compelling and exquisitely detailed accounts of what ancient philosophers were thinking and why.One of the final papers of the volume illustrates Burnyeat's detective acumen. "Archytas and optics" starts from the following question: Why is optics absent from the mathematical curriculum Plato sketches in the Republic? Burnyeat hypothesizes that if mathematical optics existed when the Republic was written, Plato likely excised it from the curriculum on the grounds that the discipline would lead the student to focus on visible things and their appearances. The bulk of the paper is devoted to establishing the antecedent of this conditional. Burnyeat argues that mathematical optics did exist at the time of the Republic's writing, and he posits the noncanonical Pythagorean Archytas as its founder. To recognize the significance of this lacuna in the Republic's curriculum and to provide a persuasive identification of the founder of an entire discipline is already to make a substantial contribution to scholarship. But how Burnyeat arrives at his central conclusion is equally impressive. He takes the reader on a tour of Aristotle, Plato, and Iamblichus, fragment 4 of Archytas, and the Apologia of Apuleius (whom readers might better recognize as the novelist responsible for The Golden [End Page 345] Ass). The result is not only an answer to the paper's central question, but a deeper understanding of the broader intellectual network in which canonical figures like Plato and Aristotle operated.No fragment is too small to catch Burnyeat's notice, nor is any line in a manuscript too faint. Part I of the collection includes Burnyeat's famous paper "Kinēsis vs. energeia: a much-read passage in (but not of) Aristotle's Metaphysics." The central argument is that Metaphysics 9.6.1048b18–35 is out of place. It was written by Aristotle for a different context and should not be printed in book 9. Because this article is so well known, I will not dwell on the details of the argument, but once again Burnyeat's methodology is worthy of comment. The first part of the paper offers a careful examination of the Metaphysics's manuscript tradition that attends both to what is present and to what is absent. For example, we learn that the focus passage is missing from an entire branch of the tradition, which Burnyeat suggests is the result of a learned excision. Later, Burnyeat develops a psychological sketch of the scribe of manuscript Ab beginning from the observation that a faint line is drawn through part of the focus passage. He argues that the scribe's motivation is not disapproval of the passage's contents but a desire to keep his text and commentary in sync. Observations like these provide the foundation for Burnyeat's thesis about the philosophical import of the focus passage, and they demonstrate that the physical record can be just as vital to reconstructions of ancient philosophy as the words that the record preserves.Occasionally, Burnyeat offers more direct admonitions to his readers about how to approach ancient philosophy. Music is an inescapable part of social, cultural and political life, and has played a powerful role in mobilising support for popular movements demanding social justice. The impact of David Bowie, Prince and Bob Dylan, for example, on diversity awareness and legislative reform relating to sexuality, gender and racial equality respectively is still felt; with the latter receiving a Nobel Prize in 2016 for ‘having created new poetic expressions within the great American song tradition’. The influence of these composers (...) and performers reached far beyond the concert hall. Conversely, musical propaganda has been a common feature of many dictatorships, most notably Nazism’s Adolf Hitler and Communism’s Joseph Stalin, and is still instrumental in the election campaigns of political parties. US President Donald Trump’s winning retro classic rock campaign playlist conveyed an idealised version of the past which aligned with the tastes and interests of his core constituency, and evoked feelings of nationalistic pride and patriotism. The eclectic selection of upbeat music effectively masked the underlying capitalist initiatives, corporate greed and allegations of financial impropriety that characterised both the Democrat and Republican campaigns. Although unable to impart meaning with the same level of precision as language, music has a potentially broader semantic capacity due to its greater elasticity. It constitutes a common language which has the ability to create a community of people that sings, speaks, reasons, votes and even feels the same way. Accordingly, this article explores the symbiotic relationship between music and law, identity politics and social justice, via the lens of musical semiosis. (shrink)

Tom Stoppard is not the sort of playwright one might call anti-intellectual, yet he has persistently singled out the field of academic philosophy for special assault in his plays. Stoppard’s antipathy emerges from a history of contention between the theater and philosophy in England, one that originates in Friedrich Nietzsche’s Birth of Tragedy and its particular reception at the hands of George Bernard Shaw. Stoppard offers an apotheosis of this disputation in his 1972 farce Jumpers, which imagines a marriage between (...) a philosopher and an actress meant to demonstrate the superiority of the theater as a mode of speculative discourse. Based upon a study of arguments in the Treatise and the Enquiry, this work proposes a theory of motivation and of the making of moral judgements which defends much of John Hume's sentimentalism. However the author also argues for an equal partnership view of reason and feeling.

At the turn of the nineteenth and twentieth centuries a concerted effort was made in the discipline of fluid mechanics to make hidden and fleeting processes visible and to capture the results photographically. I examine two important cases. One concerns the photographs taken by H. S. Hele-Shaw in the 1890s showing the flow of a “perfect”, frictionless fluid. The other case deals with the photographs of boundary layer separation taken by Ludwig Prandtl. These were presented to the Third International Congress (...) of Mathematicians in Heidelberg in 1904. My concern in both cases will be with the relation of the photographs to the reality actually or putatively portrayed in the photograph. Superficially the two cases are very different. “Perfect” fluids were accepted as mere mathematical abstractions to which nothing real could correspond while the reality of the boundary layer has been accepted as a discovery of enormous physical and technical importance.
