In their important paper “Autonomous Agents”, Floridi and Sanders use “levels of abstraction” to argue that computers are or may soon be moral agents. In this paper we use the same levels of abstraction to illuminate differences between human moral agents and computers. In their paper, Floridi and Sanders contributed definitions of autonomy, moral accountability and responsibility, but they have not explored deeply some essential questions that need to be answered by computer scientists who design artificial agents. One such question (...) is, “Can an artificial agent that changes its own programming become so autonomous that the original designer is no longer responsible for the behavior of the artificial agent?” To explore this question, we distinguish between LoA1 (the user view) and LoA2 (the designer view) by exploring the concepts of unmodifiable, modifiable and fully modifiable tables that control artificial agents. We demonstrate that an agent with an unmodifiable table, when viewed at LoA2, distinguishes an artificial agent from a human one. This distinction supports our first counter-claim to Floridi and Sanders, namely, that such an agent is not a moral agent, and the designer bears full responsibility for its behavior. As software developers design artificial agents , they often have to wrestle with complex issues, issues that have philosophical and ethical importance. This paper addresses two key questions at the intersection of philosophy and technology: What is deception? And when is it permissible for the developer of a computer artifact to be deceptive in the artifact’s development? While exploring these questions from the perspective of a software developer, we examine the relationship of deception and trust. Are developers using deception to (...) gain our trust? Is trust generated through technological “enchantment” warranted? Next, we investigate more complex questions of how deception that involves AAs differs from deception that only involves humans. Finally, we analyze the role and responsibility of developers in trust situations that involve both humans and AAs. (shrink)

In this paper we address the question of when a researcher is justified in describing his or her artificial agent as demonstrating ethical decision-making. The paper is motivated by the amount of research being done that attempts to imbue artificial agents with expertise in ethical decision-making. It seems clear that computing systems make decisions, in that they make choices between different options; and there is scholarship in philosophy that addresses the distinction between ethical decision-making and general decision-making. Essentially, the qualitative (...) difference between ethical decisions and general decisions is that ethical decisions must be part of the process of developing ethical expertise within an agent. We use this distinction in examining publicity surrounding a particular experiment in which a simulated robot attempted to safeguard simulated humans from falling into a hole. We conclude that any suggestions that this simulated robot was making ethical decisions were misleading. (shrink)

This paper applies social-relational models of moral standing of robots to cases where the encounters between the robot and humans are relatively brief. Our analysis spans the spectrum of non-social robots to fully-social robots. We consider cases where the encounters are between a stranger and the robot and do not include its owner or operator. We conclude that the developers of robots that might be encountered by other people when the owner is not present cannot wash their hands of responsibility. (...) They must take care with how they develop the robot’s interface with people and take into account how that interface influences the social relationship between it and people, and, thus, the moral standing of the robot with each person it encounters. Purpose This paper aims to explore the ethical and social impact of augmented visual field devices, identifying issues that AVFDs share with existing devices and suggesting new ethical and social issues that arise with the adoption of AVFDs. Design/methodology/approach This essay incorporates both a philosophical and an ethical analysis approach. It is based on Plato’s Allegory of the Cave, philosophical notions of transparency and presence and human values including psychological well-being, physical well-being, privacy, deception, informed consent, ownership and property and (...) trust. Findings The paper concludes that the interactions among developers, users and non-users via AVFDs have implications for autonomy. It also identifies issues of ownership that arise because of the blending of physical and virtual space and important ways that these devices impact, identity and trust. Practical implications Developers ought to take time to design and implement an easy-to-use informed consent system with these devices. There is a strong need for consent protocols among developers, users and non-users of AVFDs. Social implications There is a social benefit to users sharing what is visible on their devices with those who are in close physical proximity, but this introduces tension between notions of personal privacy and the establishment and maintenance of social norms. Originality/value There is new analysis of how AVFDs impact individual identity and the attendant ties to notions of ownership of the space between an object and someone’s eyes and control over perception. We demonstrate that different categories of software raise different ethical concerns with respect to whether software ought to be Free Software or Proprietary Software. We outline the ethical tension between Free Software and Proprietary Software that stems from the two kinds of licenses. For some categories of software we develop support for normative statements regarding the software development landscape. We claim that as society's use of software changes, the ethical analysis for that category of software must necessarily be repeated. The recent high-profile financial difficulties of Harvard Pilgrim Health Care, the largest HMO in Massachusetts and consistently rated as one of the top ten HMOs in the nation, shed light on many problems common to health insurers throughout the country. This article explores those difficulties in the context of the short but complicated history of Harvard Pilgrim, and its regulatory and competitive environments. The state legislation which made a receivership proceeding possible for Harvard Pilgrim offered some protection for subscribers, but (...) failed to provide the means for achieving a long term solution. The statute merely presented a method for staving off immediate collapse by temporarily protecting the plan from dissolution, and forcing the plan's contracting providers to continue delivering care even if owed money by the plan. Our primary focus is on analysis of the concept of voluntariness, with a secondary focus on the implications of our analysis for the concept and the requirements of voluntary informed consent. We propose that two necessary and jointly sufficient conditions must be satisfied for an action to be voluntary: intentionality, and substantial freedom from controlling influences. We reject authenticity as a necessary condition of voluntary action, and we note that constraining situations may or may not undermine voluntariness, depending on the (...) circumstances and the psychological capacities of agents. We compare and evaluate several accounts of voluntariness and argue that our view, unlike other treatments in bioethics, is not a value-laden theory. We also discuss the empirical assessment of individuals? perceptions of the degrees of noncontrol and self-control. We propose use of a particular Decision Making Control Instrument. Empirical research using this instrument can provide data that will help establish appropriate policies and procedures for obtaining voluntary consent to research. (shrink)

Ralph Kingston, inBureaucrats and Bourgeois Society, argues that government employees constituted the core of the French bourgeoisie in the eighteenth and nineteenth centuries. The book lends support to the Marxist interpretation of the Revolution, not as a breakthrough of a capitalist bourgeoisie, but as a conflict originating in a social structure whose economic surplus was appropriated politically. This review posits that the peasants’ subsistence strategies constrained the economic evolution of the country and led well-to-do families to invest in shares of (...) governmental authority and careers in the civil service rather than in private enterprises. The slow economic growth and pursuit of state offices represent underlying continuities between the Old Regime and the nineteenth century. The notable changes resulted from the popular uprisings of 1789–93 and the rationalisation of the state apparatus during the revolutionary decade. (shrink)

The long agony of the mixed constitution that began in the civil wars which raged in Iberia, France, the Low Countries, and England and seemed settled by the widespread adoption of the maxims of reason of state, revived at the end of the period, with revolution in Poland, Denmark, Sweden, Geneva, and, more famously, [End Page 725] British North America and France. The problem, classically, turned on the location of sovereignty, or supreme authority, in political systems designed to balance and diffuse rather than concentrate power. When budget deficits and fratricidal culture wars raised the cry of “necessity”—with the knowledge, of course, that necessity knew no law—estates and kings across Europe found themselves at daggers drawn. The claim that the ruler, who naturally was wholly committed to the common good, had therefore the ability to take emergency action was used both by those accustomed to rule and those newly attained to it by force. The pursuit of an “interest” that was identified with the nation’s effectively marginalized discussions of right and law while still serving an essentially constitutional, justificatory role in political debate. But if unchecked authority was necessary in order to meet the challenge of a world characterized by change and chance and thus had to reside somewhere, was there anything that made its exercise by one body more appropriate than another? This was the question that lay behind the late eighteenth-century repudiation of the reason of state “solution” to the problem of the mixed constitution. The answer, which clearly underpinned the establishment in fact of what had first been theorized already a century earlier, was that only consent could legitimate the exercise of sovereignty in time of necessity.1Representation, in one form or another, was the acknowledged solution to the problem formulated by Hobbes: “the name of Tyranny, signifieth nothing more, nor less, than the name of Sovereignty, be it in one, or many men, saving that they that use the former word are understood to be angry with them they call Tyrants.” But representation also acknowledged the reality behind the charged category of “citizenship”: most people in most places could not be said to live the life of the active citizen celebrated in Roman republican literature. Hence Hobbes’s attack on recourse to classical exempla in general, and the Libertas of Lucca in particular. The idea of civis as law-abiding subject was as radical a redrawing of the terms of debate as the identification of human nature with unsociability. Insofar as politics, classically, justified itself as the means for individual self-perfection, the practice of the ancient citizen could be conceived of as the practice of that best life speculated upon by philosophers. For the represented citizen, however, politics necessarily occupied a more subsidiary position. What, then, defined the best life to which he could aspire?There is no simple answer to this question, and the early modern ambivalence has persisted into our own time... (shrink)

After critiquing some earlier attempts (including those of Marcus Singer and Frances Howard–Snyder) to ground objections to actual–consequence act utilitarianism (ACAU) on human cognitive limitations, I present two new objections with this same foundation. Both start with the observation that, because human cognitive abilities are not up to the task of reliably recognizing utility–maximizing actions, any agents who are recognizably human – including the best possible humans, morally speaking – are certain to perform many actions every day that ACAU (...) says are immoral, and to perform some actions over the course of their lives that it says are highly immoral. The first objection is that, if Mill's analysis of what it means to call an action wrong is accurate, then ACAU entails a conclusion that no one will accept, viz., that the morally–best humans possible ought to undergo constant punishment. The second objection is that ACAU entails that even the morally–best humans possible are bad moral agents in some respect. This conclusion, while unpalatable, is not so obviously unacceptable as the first. However, I do briefly consider some ways in which it might be possible to demonstrate that it is false and thereby complete a reductio of ACAU. (shrink)

The function of Nietzsche in our present intellectual life is a salient example of the continued vitality of the nineteenth-century in the thought of today. In Germany, in France, in Italy, and in the United States new work of editing and commentary has made Nietzsche a current force. The monumental Colli-Montinari edition, which includes many of Nietzsche’s hitherto unpublished notebooks and drafts, is the most conspicuous evidence of this on the textual side. This edition will make available in German, French, (...) Italian, and Japanese versions a far more complete and accurate Nietzsche than we have had. Mention should also be made of the new English translations by Walter Kaufmann. These have made good versions of most of Nietzsche’s books available to those with no German, though the Kaufmann translations are far less complete than the Colli-Montinari edition. On the side of commentary, the bibliography of new work on Nietzsche is enormous. Two collective volumes may be mentioned. They indicate at least a sketch map of this rugged terrain: The New Nietzsche: Contemporary Styles of Interpretation, edited and introduced by David D. Allison, and Nietzsche Aujourd’hui? The new work appropriates Nietzsche for present purposes. Ideas which may seem especially characteristic of the literature and philosophy of our own day are found to have been already worked out by Nietzsche in his own way. These would include linguistic, artistic, historical, social, and psychological concepts. Among these is Nietzsche’s systematic putting in question of the idea that the self is a substantial and integral entity. (shrink)

In her keynote address to the Kristeva Circle 2014, Julia Kristeva argued that European Humanism dating from the French Revolution paradoxically paved the way for “those who use God for political ends” by promoting a completely and solely secular path to the political. As an unintended result of this movement this path has led, in the late 20 th and early 21 st centuries, to the development of a new form of nihilism that masks itself as revolutionary but in fact (...) is the opposite, in Kristeva’s view. Kristeva analyzed the culture of religious fundamentalism as “adolescent” in the sense that the adolescent, in contrast to the child, is a believer rather than a questioner. Although the psychoanalytic consideration of religious fundamentalism added a new dimension to attempts to explain the increase of this phenomenon in the late 20 th and 21 st centuries, Kristeva’s subsequent linkage of fundamentalism to the revolts in French suburbs in 2005 and beyond fell short of an insightful critique by neglecting the historical context of France’s colonial history. The pulse-taking scene in Laurence Sterne’s 1768 Sentimental Journey Through France and Italy is representative of the fiction. The episode, in which Yorick palpates the wrist of a Parisian grisette or shopgirl, engages with both literal and figurative matters of the heart. Scholars have long speculated about what Sterne may have meant when he described Sentimental Journey as a “work of redemption.” None has connected Yorick’s discourse of sensibility to a contemporary Catholic controversy of which, circumstantial evidence suggests, Sterne may (...) have been aware. This controversy could well have informed the Anglican Sterne’s equivocal rapprochement with Catholic practice. In 1765, Pope Clement XIII approved some measure of devotion to the Sacred Heart of Jesus. He thus gave credence to the visions of the nun Marguerite-Marie Alacoque, which occurred between 1673 and 1675. After the second Jacobite uprising, in the late 1740s, the young Sterne had joined with his rabidly anti-Papist uncle Jacques to prosecute the nuns of Micklegate Bar outside York, who occupied one of only two convents left in England. In Sentimental Journey, which develops its own tragicomic theory of the Sacred Heart, Sterne may make eccentric amends for his former zealotry. (shrink)

Paul Allen Miller shows how individual works of Anglo-American figures such as Toril Moi, Judith Butler, and Kaja Silverman, as well as movements such as queer theory, are rooted in feminist theoretical debates that began in (...) the sixties in France and have continued right up to the present day. In 1980, Michel Foucault's work makes two decisive turns. On the one hand, as announced at the start of his course at the Collège de France for that year, Le Gouvernement des vivants, his topic will be the modalities through which power constitutes itself in relation to truth. On the other hand, the texts on which he will concentrate will no longer be those of the early modern period. Rather, he begins with one by Dio Cassius on the emperor Septimius (...) Severus and then proceeds to spend the next two sessions offering a reading of Oedipus Tyrannus. He will concentrate on works from antiquity for the rest of his life. This book will offer the first detailed account of these lectures, examining both the development of their philosophical argument and the ancient texts on which that argument is based. This is the period during which Foucault also began work on Volumes 2 and 3 of the History of Sexuality. Yet, while there are clear overlaps between the work he was presenting in his course and the last books he published before his death, nonetheless the seminars are anything but rough drafts for the published work. Instead they offer a sustained encounter with the texts of the classical and early Christian era while seeking to trace a genealogy of the western subject as a speaker of truth. (shrink)

Ian Hacking is one of the most original and influential thinkers alive today. His Taming of Chance (Cambridge UP, 1990) was named to The Modern Library’s list of the 100 most important non-fiction books written in English since 1900. In 2001, he was the first Anglophone ever to be elected to a permanent chair at the Collège de France. Though he started in highly technical fields such as logic, statistical theory and formal philosophy of science, he soon moved on to (...) other domains, eventually making important contributions to the philosophy of language, Wittgenstein scholarship, the philosophical study of mental illness, the history of philosophy and more. This recent collection of Hacking’s work provides further confirmation of both the breadth and depth of his thought. (shrink)

In recent years there has been an extended debate about Enlightenment thought. Though many scholars have concluded that there were several 'Enlightenments,' some continue to make generalizations about the Englightenment and some speak about 'the Enlightment agenda.' After discussing the cult of the deathbed scene in eighteenth-century Britain and France, the author looks at three currents of Enlightment thought implicit in the deathbed 'projects' of David Hume, Samuel Johnson, and Jean Paul Marat. Although Hume and Johnson hold profoundly different views (...) of religion, their political thinking has much in common. Their reformist thought differs radically from what might be called the transformist thought of Marat, who hoped the French would become disinterested citizens whose civil religion was patriotism. Stephen Miller attempts to confute the idea that capitalist accumulation characterised the agriculture of the Île-de-France prior to the Revolution. Instead he tries to assimilate the agriculture of the north into theAnnalesmodel of neo-Malthusian agricultural cycles and Chayanovian subsistence economy which is supposedly characteristic of the Midi. I argue instead that the notion of a northern capitalist agriculture is rooted not only in the extensive modern research of Moriceau but in the political-economic writings of Turgot and Marx which have (...) been largely ignored. Accumulation in the sense of the growth of fixed and variable capital and emerging technological progress characterised northern agriculture. The persistence of small producers which Miller sees as an index of unchanging stasis might better be investigated in terms of the evolution over time of a reservoir of wage labour for larger-scale enterprises as pointed out by Kautsky.
