Wie kann der Begriff der Menschenwürde begründet werden - und wie lassen sich Menschenrechte global absichern? Ethische Leitlinien für die klinische Praxis erfreuen sich zunehmender Beliebtheit. Damit klinisch-ethische Leitlinien aber überhaupt erfolgreich wirksam werden können, ist noch Pionierarbeit zu leisten. Solche Leitlinien müssen wissenschaftlich stärker fundiert und ihre praktische Anwendbarkeit muss verbessert werden. In dieser Arbeit werden die ersten Schritte des Projekts METAP zur methodischen Entwicklung und praktischen Implementierung einer Leitlinie für eine patientengerechte Versorgung am Krankenbett beschrieben und zur Diskussion gestellt. Das Projekt orientiert sich methodisch an der Entwicklung medizinischer Leitlinien und generiert damit eine forschungs- (...) und konsensgestützte Leitlinie, die systematischer Evaluation und Modifikation unterliegt und Rechenschaft über ihre wissenschaftliche Fundierung gibt. Zusätzlich zur Leitlinie bietet das Projekt in der Form eines Handbuchs ein Entscheidungsfindungsverfahren an, welches unter anderem deliberative Aspekte unterstützt. Das Handbuch konzentriert sich auf ethische Fragen der Mikroallokation und liefert darüber hinaus Informationen über empirische, ethische und rechtliche Grundlagen für Therapieentscheidungen. Anhand eines Eskalationsmodells können unterschiedliche Instrumente nach Bedarf als ethische Lösungsstrategien eingesetzt werden, von der Kurzfassung im Kitteltaschenformat („Leporello“) mit den wichtigsten Fakten, weiterführenden Texten und Empfehlungen mit normativen und prozeduralen Hinweisen, über stationsinterne Lösungsversuche bis hin zum Ethikkonsil. Klinische Partner sind von Beginn an aktiv in den Entwicklungsprozess eingebunden und verbessern so die Praxistauglichkeit und Akzeptanz sowie die Ausrichtung des Instrumentariums an den tatsächlichen Bedürfnissen. Dieses partnerschaftliche, partizipative Vorgehen scheint eine wichtige Voraussetzung dafür zu sein, dass METAP in der Klinik Fuß fassen konnte. (shrink)

Recently, ethical guidelines for clinical practice have gained increased popularity, but in order to become useful they require more pioneer’s work. Clinical-ethical guidelines need to be based on a scientific foundation and their practicability must be improved. We present and put to discussion the initial steps of the METAP Project about the development and practical implementation of a clinical-ethical guideline dedicated to a fair resource-allocation at the bedside. -/- With its methodological orientation, the project represents a guideline which is based (...) on both research and consensus-building, undergoing systematic evaluation and modification. In addition to the guideline, the project comes with a manual (a tool kit) including a procedural instrument for making decisions supporting deliberative aspects. It focuses on issues of micro-allocation; furthermore, it provides empirical, ethical and legal basics for making fair treatment decisions that should help to prevent overtreatment, undertreatment or discrimination in patient care. We propose an Escalation Model with various instruments serving as problem solving strategies that correspond to the respective needs; these instruments include a pocket-summary (“Leporello”) with the most important facts; further reading material; normative and procedural recommendations; ward-specific strategies, and also the option of clinical ethics consultation. -/- Clinical partners have been actively involved in the developmental process from the beginning and contributed to the practical applicability, acceptance and a valid need-orientation of the whole tool kit. This partnership and the participatory approach seem to have helped METAP to gain a foothold in the clinic. (shrink)

The use of Intelligent Assistive Technology in dementia care opens the prospects of reducing the global burden of dementia and enabling novel opportunities to improve the lives of dementia patients. However, with current adoption rates being reportedly low, the potential of IATs might remain under-expressed as long as the reasons for suboptimal adoption remain unaddressed. Among these, ethical and social considerations are critical. This article reviews the spectrum of IATs for dementia and investigates the prevalence of ethical considerations in the (...) design of current IATs. Our screening shows that a significant portion of current IATs is designed in the absence of explicit ethical considerations. These results suggest that the lack of ethical consideration might be a codeterminant of current structural limitations in the translation of IATs from designing labs to bedside. Based on these data, we call for a coordinated effort to proactively incorporate ethical considerations early in the design and development of new products. (shrink)

Beginning with this definition of the (...) prerational meaning of truth, Detienne proceeds to elaborate the complex conceptual and historical contexts from which emerges the philosophical notion of truth still influencing Western philosophy today. Emerging infectious diseases such as Ebola, Hendra, SARS, West Nile, Hepatitis E and avian influenza have led to a renewed recognition of how diseases in human beings, wildlife and livestock are interlinked. The changing prevalence and spread of such infections are largely determined by human activities and changes in environment and climate—where the latter are often also caused by human activities. Since the beginning of the 21st century, these insights have been brought together under the heading of OneHealth—a concept that (...) calls for interdisciplinary collaboration between various sciences as well as professional practices to promote and protect the health of human and non-human animals and the natural environment. Just as insights from public health have led to a broadened focus for health policy and medical care, from treating individual patients to protecting and promoting population health, OneHealth calls for an even broader perspective, including a concern for the environment and animals, and for social-cultural factors that affect human, animal and environmental health. OneHealth not only covers collaborative work to understand and control zoonotic diseases, but also other ways in which interactions between animals, plants and humans may positively or negatively impact on each other’s health. Thus, studies in veterinary medicine and environmental sciences may lead to new insights in human medicine, and vice versa. Acknowledgment of the links between environmental, animal and social health is of course not a novel insight. Hippocrates already pointed to the importance of a clean environment as a requirement for good health; the early public health movements emphasized hygienic living conditions including good-quality housing, sewage systems and clean air and water; and the founders of modern medicine such as William Osler and Rudolf Virchow promoted …. In spite of vast global improvements in living standards, health, and well-being, the persistence of absolute poverty and its attendant maladies remains an unsettling fact of life for billions around the world and constitutes the primary cause for the failure of developing states to improve the health of their peoples. While economic development in developing countries is necessary to provide for underlying determinants of health – most prominently, poverty reduction and the building of comprehensive primary health systems – inequalities in (...) power within the international economic order and the spread of neoliberal development policy limit the ability of developing states to develop economically and realize public goods for health. With neoliberal development policies impacting entire societies, the collective right to development, as compared with an individual rights-based approach to development, offers a framework by which to restructure this system to realize social determinants of health. The right to development, working through a vector of rights, can address social determinants of health, obligating states and the international community to support public health systems while reducing inequities in health through poverty-reducing economic growth. At an international level, where the ability of states to develop economically and to realize public goods through public health systems is constrained by international financial institutions, the implementation of the right to development enables a restructuring of international institutions and foreign-aid programs, allowing states to enter development debates with a right to cooperation from other states, not simply a cry for charity. At the height of the COVID-19 crisis in the Netherlands a shortness of intensive care beds was looming. Dutch professional medical organizations asked a group of ethicists for assistance in drafting guidelines and criteria for selection of patients for intensive care treatment in case of absolute scarcity, when medical selection criteria would no longer suffice. This article describes the Dutch context, the process of drafting the advice and reflects on the role of ethicists and lessons learned. We argue that timely (...) interaction between clinical and ethical expertise is necessary since the distinction between medical and non-medical considerations is not as clearcut as sometimes assumed. Furthermore, pragmatic considerations related to the specifics of an epidemic are of importance, for example, in relation to prioritizing health care workers. As a consequence, any protocol already present before the pandemic would need alterations to fit the current situation. The ‘fair innings’ criterion we proposed, rephrased as an argument of intergenerational solidarity, was considered reasonable by professionals as well as patient organizations. While it is desirable to draft ethical guidelines in ‘peacetime’ as a matter of pandemic preparedness, the pressure of an actual crisis facilitates decision-making, although it will also complicate a more democratic approach. For contagious diseases like measles a successful immunization program can result in herd protection. Small outbreaks may still occur but fade out soon, because the possibilities for the pathogen to spread in the ‘herd’ are very small. This implies that people who refuse to participate in such a program will still benefit from the protection it offers, but they don’t do their part in maintaining protection. Isn’t that a case of freeriding—and isn’t that unfair towards all the people who do (...) collaborate? If so, that might be considered an additional ground for making vaccination mandatory or compulsory.In this paper I argue that vaccination refusal can be considered as freeriding, but that this might not be unfair. The public good of herd protection is a peculiar public good because it supervenes on private benefits that are enjoyed by all who do opt for vaccination. For vaccinated individuals, the additional benefit of herd protection comes about, as it were, for free, and hence they can’t complain that others benefit without sharing in the burdens. There are however still other grounds for making vaccination compulsory or at least for seeing refusal as a morally wrong choice. (shrink)

The European Corporate Sustainability Framework (ECSF) is, among other concepts, based on a phase-wise development approach as described by Clare Graves' Levels of Existence Theory. As much as corporate sustainability has a sequence of adequate interpretations, aligned with each development level, also the notion of business excellence can be defined at multiple levels, as this paper demonstrates. Furthermore, the authors analyze the current EFQM Excellence Model for particular biases towards various development levels and suggest a new and innovative two-step approach (...) to assessing organizational performance with respect to organizational excellence (OE) and corporate sustainability. According to the organization's ambition, the assessment is either limited to a shareholder approach, mainly focusing at optimal usage of resources, or it also includes an additional assessment format based on the stakeholder approach, with specific reference to the organization's performance on the financial, social and ecological bottom line. This paper demonstrates the need and feasibility of an EFQM-Based assessment tool with a combined focus on corporate sustainability and OE. (shrink)

Some screening tests for donor blood that are used by blood services to prevent transfusion-transmission of infectious diseases offer relatively few health benefits for the resources spent on them. Can good ethical arguments be provided for employing these tests nonetheless? This paper discusses—and ultimately rejects—three such arguments. According to the ‘rule of rescue’ argument, general standards for cost-effectiveness in healthcare may be ignored when rescuing identifiable individuals. The argument fails in this context, however, because we cannot identify beforehand who will (...) benefit from additional blood screening tests. On the ‘imposed risk’ argument, general cost-effectiveness standards do not apply when healthcare interventions impose risks on patients. This argument ignores the fact that imposing risks on patients is inevitable in healthcare and that these risks can be countered only within reasonable limits. Finally, the ‘manufacturing standard’ argument premises that general cost-effectiveness standards do not apply to procedures preventing the contamination of manufactured medical products. We contend that while this argument seems reasonable insofar as commercially manufactured medical products are concerned, publicly funded blood screening tests should respect the standards for general healthcare. We conclude that these particular arguments are unpersuasive, and we offer directions to advance the debate. (shrink)

Generally, simulations are carried out to answer specific questions. The assessment of the reliability of an answer depends on the kind of question investigated. The answer to a 'why' question is an explanation. The premises of an explanation have to include invariant relationships, and thus the reliability of such answer depends on whether the domain of invariance of the relevant relationships covers the domain of the question. Environmental pollution and greenhouse gas emissions that contribute to climate change have adverse impacts on global health. Somewhat paradoxically, health care systems that aim to prevent and cure disease are themselves major emitters and polluters. In this paper we develop a justification for the claim that solidaristic health care systems should include sustainability as one of the criteria for determining which health interventions are made available or reimbursed – and which not. There is however a complication: most adverse health effects (...) due to climate change do occur elsewhere in the world. If solidarity would commit us to take care of everyone’s health, worldwide, it might imply that solidaristic health system cannot justifiably restrict universal access to their own national populations. In response we explain health solidarity is to be considered as a moral ideal. Such an ideal does not specify what societies owe to whom, but it does have moral implications. We argue that ignoring sustainability in political decision making about what health care is to be offered, would amount to betrayal of the ideal of solidarity. (shrink)

In this essay I explore the role of dialectics for how social theory can take account of the problem of structure and agency, or, determination and freedom, in a critical and emancipatory way. I discuss the limits and possibilities of dialectical, and of anti-dialectical, criticisms of Hegelian dialectics. For this purpose, I look at Judith Butler’s discussion of dialectics and the concepts of ‘sex’ and ‘gender’ in her writings between 1987 ( Subjects of Desire ; republished 1999) and 1990 ( (...) Gender Trouble , republished 2000). Butler’s book Gender Trouble remains a key text of contemporary feminist theory. Butler formulates in this book a critique of Simone de Beauvoir’s The Second Sex based on her claim that Beauvoir makes a distinction between ‘sex’ and ‘gender’ that implies the notion of the sexed body as a pre-cultural entity. In her earlier writings, though, her evaluation of de Beauvoir had been much more positive. The change in Butler’s evaluation of de Beauvoir is part of her increasing rejection of dialectics: Butler rejected in Gender Trouble any form of Hegelian dialectics with reference to Luce Irigaray’s (1985) claim that it is ‘phallogocentric’. Although Butler subsequently returned to Hegelian themes, she seems never to have revoked this claim made in her most momentous work. I argue that this change in the theoretical structure of Butler’s argument weakens her critique of identity politics and I suggest reading Butler backwards, from Gender Trouble to the more open discussion of dialectics in her earlier texts. Drawing on Adorno’s Negative Dialectics and other formulations of critical theory, I argue that the valid aspects of the critique of Hegelian dialectics can better be formulated as a dialectical critique of dialectics (Adorno; Butler, 1987a) than as a rejection of dialectics (Derrida; Irigaray; Butler, 1990). Retracing the genealogy of Butler’s argument will be a necessary backdrop, too, for evaluating her more recent comments on the Hegelian and ‘Frankfurt School’ traditions such as her Adorno Lectures given in Frankfurt am Main, Germany, in November 2002. Many nursing homes have an influenza vaccination policy in which it is assumed that express (proxy) consent is not necessary. Tacit consent procedures are more efficient if one aims at high vaccination rates. In this paper I focus on incompetent residents and proxy consent. Tacit proxy consent for vaccination implies a deviance of standard proxy consent requirements. I analyse several arguments that may possibly support such a deviance. The primary reason to offer influenza vaccination is that vaccinated persons have a (...) significantly reduced risk of getting the flu. This reason however cannot support the assumption that each nursing home resident is ‘better off ’ if she is vaccinated. Neither can it support tacit proxy consent policies. More promising are arguments that take the collective nature of infectious diseases into account. A potentially strong, but ultimately insufficient, argument for non‐express consent is that vaccination contributes to prevention of harm to others. Other arguments emphasise the importance of group protection: herd immunity. I discuss three collective reasons for aiming at herd immunity: solidarity, a common interest in reducing the risk of illness, and a common interest in the prevention of an influenza outbreak. The latter argument appears to be most important. An outbreak is not just detrimental to the health of residents; it is detrimental to their everyday social life as well. Outbreaks can be seen as a collective evil. My analysis shows that there are valid (though not necessarily sufficient) moral arguments for a tacit proxy consent policy. (shrink)

Ce travail s’interroge sur les raisons de ce qui a fait le succès de la sociologie de Georges Gurvitch de 1945 à sa mort , et entend se démarquer d’une explication qui se contente de faire valoir le rôle institutionnel actif qu’eut Gurvitch dans ce qu’on a coutume d’appeler la « refondation » de la sociologie française après 1945. En effet, un examen du contenu de ses textes suggère que son projet intellectuel était en phase avec les préoccupations de nombre (...) de sociologues à ce moment-là, certes soucieux de construire une sociologie plus empirique inspirée du modèle américain, mais aussi de conserver une ambition théorique susceptible de fournir des concepts opérationnels pour traiter les grandes questions sociales. Ainsi Gurvitch a proposé un paradigme alternatif qui, tout en illustrant une volonté certaine de « reconstruire » la sociologie, a défendu l’idée d’une continuité de la tradition sociologique en France. Il semble que sa réception a été plus favorable que ce que les textes consacrés à la question laissent entendre.This paper considers the reasons for the success of the sociology of Georges Gurvitch from 1945 until his death in 1965. The approach proposed here intends to differentiate itself from the widespread explanation that focuses essentially on the active institutional role that Gurvitch played in the rebuilding of French sociology after 1945. An examination of the contents of his texts suggests that, at that time, the focus of Gurvitch’s interests were in line with the preoccupations of other sociologists who were certainly anxious to construct a more empirical sociology inspired by the American model, but also to conserve a theoretical ambition capable of providing the operational concepts to address the significant social questions. So Gurvitch proposed an alternative paradigm, while proclaiming his desire to « rebuild » sociology, also defended the idea of a certain continuation of the sociological tradition in France. It seems that its reception was much more favourable than we are led to believe by current texts that consider the question today. (shrink)

Control measures directed at carriers of multidrug-resistant organisms are traditionally approached as a trade-off between public interests on the one hand and individual autonomy on the other. We propose to reframe the ethical issue and consider control measures directed at carriers an issue of solidarity. Rather than asking “whether it is justified to impose strict measures”, we propose asking “how to best care for a person’s carriership and well-being in ways that do not imply an unacceptable risk for others?”. A (...) solidarity approach could include elevating baseline levels of precaution measures and accepting certain risks in cases where there is exceptionally much at stake. A generous national compensation policy that also covers for costs related to dedicated care is essential in a solidarity approach. An additional benefit of reframing the questions is that it helps to better acknowledge that being subjected to control measures is a highly personal matter. (shrink)

A typical difference between social science and natural science is the degree in which control is possible. Strategies in both sciences to obtain true facts are consequently different. Measurement errors are due to background noise. Laboratories are environments in which background conditions can be controlled. As a result, accurate observations { measurement results close to the true values of the measurands { can only be obtained in laboratories. Therefore, measuring instruments are built such that they function as mini laboratories. However, (...) observations in social science are usually passive, in the sense that control of background conditions is impossible. Models are built to solve this problem of (lack of) control. They function as nonmaterial laboratories by aiming at precision, that is reducing the spread of the measurement errors. The application of models as measuring instruments necessitates a shift of the requirement of accuracy to the requirement of precision, which is a feature of the instrument and not of the environment. Notwithstanding the fact that a lot, if not most, of science is done outside the laboratory, most literature in the history and philosophy of science, when discussing the experimental method, focus only on experimentation “within the walls of a laboratory” . To fill this embarrassing gap, Astrid Schwarz has written an excellent book on field experimentation. The field, however, is a much more messy site than a clean lab. In an introduction to a special issue of Osiris on field science, (...) Kuklick and Kohler list a number of the problems related to science in the field: As scientific rigor is defined by the standards of the laboratory, the field is considered to be “a site of compromised work: field sciences have dealt with problems that resist tidy solutions, and they have not excluded amateur participants” . To discuss science in the field, we will have to take account of a methodological tension between laboratory and field standards of evidence and reasoning. .. (shrink)

When observing or measuring phenomena, errors are inevitable, one can only aspire to reduce these errors as much as possible. An obvious strategy to achieve this reduction is by using more precise instruments. Another strategy was to develop a theory of these errors that could indicate how to take them into account. One of the greatest achievements of statistics in the beginning of the 19th century was such a theory of error. This theory told the practitioners that the best thing (...) they could do is taking the arithmetical mean of their observations. This average would give them the most accurate estimate of the value they were searching for. Soon after its invention, this method made a triumphal march across various sciences. However, not in all sciences one stood waving aside. This method, namely, only worked well when the various observations were made under similar circumstances and when there were very many of them. And this was not the case for e.g. meteorology and actuarial science, the two sciences discussed in this paper. (shrink)
