This essay is meant to draw the principle outlines of the development of a specific modern issue of penalty. Deriving from an erosion of Augustine's dominating paradigm of retribution as a balance of two equivalent “evils” the legitimation of modern punishment was not sought in ef ficient deterrence only – as utilitarian philosophers suggested. More deeply, a modern justification of punishment was developed within the political philosophy of Kant, Fichte and Hegel by successively unfolding its close relation to the concept (...) of freedom. This does not only stress the criminal's own responsibility but also relies on the condition of a developed rule of law. As a result punishment was not only meant to restore sovereignty, often based on a social contract, but also the fundamental relation of mutual recognition between individuals. Adhering to a substantial understanding of the modern state under the rule of law this concept of penal law draws a marked distinction between “punishment” and “war” and also sets a clear limit to tendencies of expanding criminality beyond the rule of law. Regarding its philosophical impact it predominantly must be put forward against all measures which negate or extinguish the criminal's personality as a whole, such as torture, death penalty or life imprisonment. This essay explores the philosophical sources of the modern prohibition of torture by tracing different systematic steps in the difficult moral struggle against torture. It will be shown that the reluctance to embrace an outright ban on torture does not originate only from ancient convictions but also from the internal tensions between sovereignty and freedom in the context of the legitimation of the modern state. Starting with the universally empathic approach of 16th century’s humanists the moral condemnation of torture shifted (...) its focus successively from matters such as pity or the protection of bodily integrity to the recognition of human self-determination. During the Age of Enlightenment, the ambiguity of the modern concept of the state is even more clearly revealed. Political arguments against torture are put forward by utilitarians only stressing, again, the futility of bodily pain. Kant and Hegel, however, though developing human dignity as a matter of principle stick to retribution and the strict enforcement of the rule of law. Their approach overemphasizes certain notions of sovereignty and leads to perplexing consequences. This can be shown also with regard to the actual debate concerning exceptions from the general prohibition of torture. (shrink)

Die Arbeit verfolgt Entwicklungslinien eines auf praktische Vernunft gestützten Republikmodells an Hand der exemplarischen Bedeutung der aristotelischen Politik und ihrer Rezeption durch Thomas von Aquin. Diesen werden auch entscheidende Weichenstellungen für die Ausbildung des modernen Staatsbegriffs und seines begrifflichen Instrumentariums politischer Vernünftigkeit zugerechnet. Teil 1 stellt das aristotelische Modell der auf den Begriff des Menschen als Menschen gegründeten "bürgerlichen Gesellschaft" vor, in der sich ein gegenüber der Beliebigkeit tatsächlicher Herrschaftsan-massungen kritischer ursprünglicher Zusammenhang zwischen dem Verständnis "politischer Herr-schaft" und der wechselseitigen (...) "Anerkennung" konkret freier und gleicher Bürger präsent hält. Dieser ruht jedoch auf einschränkenden Voraussetzungen politischer Subjektivität und deren unmittelbarer Bindung an institutionelle Rahmenbedingungen auf, wie sie aus einem spezifisch antiken Verständnishorizont, näherhin aus dem aristotelischen Konzept entelechialer Teleologie, erläutert werden. Der Versuch einer Einordnung in Grundlinien des umfassenden systematischen Kontexts in Metaphysik, Physik und praktischer Philosophie soll gerade durch den gegenüber der unbestrittenen aktuellen Relevanz neuzeitlichen Freiheitsethos differenzierenden und nicht ungeschichtlich-planen Zugang zu diesem Politikmodell auch aktualisierende Perspektiven eröffnen. So soll etwa durch die Erläuterung der aristotelischen Teleologiekonzeption, die anhand des Paradigmas der Naturbewegung eingeführt wird, sowie des dazu korrespondierenden Ethos "vernünftigen Strebens" das etwaige Verständnis einer vorgängigen materialen Zweckbindung der Politik, im Sinne etwa einer herkömmlichen "Werteethik", distanziert werden. Das Verhältnis Naturteleologie - Praxis wird nicht deduktiv, sondern als ein solches der Strukturanalogie bei gleichzeitiger methodischer Abgrenzung verstanden. Teil 2 widmet sich der Herausarbeitung systematischer Akzentverschiebungen und Umformungen im Spannungsfeld der Konfrontation von aristotelischer Teleologie bzw. praktischer Vernunft mit einer von der Perspektive der Geschichtlichkeit geprägten Offenbarungsreligion bei Thomas von Aquin. Im Zeichen eines vorläufig theologisch gewonnenen universalen Freiheitsverständnisses vollzieht sich auch ein Strukturwandel politischer Öffentlichkeit, der zunächst eine institutionelle Verdünnung des republikanischen Ideals herbeiführt. Durch die Rücknahme des Ziels der Politik vom konkreten Bürger-ethos in die Universalität und den nunmehr transzendentalen Anspruch des Begriffs des "bonum commune" wird gleichzeitig aber auch ein Prozess der Pluralisierung und Dynamisierung gesellschaft-licher und individueller Zielsetzungen und Praxisformen freigesetzt. Entscheidende Bedeutung kommt dabei dem Stellenwert des thomasischen "Gesetzes" zu, in dem - jenseits einer material-deduktiven oder imperialistischen Konzeption - ein dezidiert praktisch-handlungsleitendes Gesetzesverständnis zum Vorschein kommt. Dieses führt die sittlich-politische Anerkennung stiftende Funktion der "koinonia politike" weiter und leitet in seinem Anspruch gesteigerter "Allgemeinheit"--Dies sowohl im Rückgang auf ein transzendentales Prinzip seiner Begründung wie auch in der Ausweitung seines Adressaten-kreises - zur Neuzeit über. Spectroscopy is a scientific topic at the interface between Chemistry and Physics, which is taught at high school level in relation with its fundamental applications in Analytical Chemistry. In the first part of the paper, the topic of spectroscopy is analyzed having in mind the well-known Johnstone’s triangle of chemistry education, putting in evidence the way spectroscopy is usually taught at the three levels of chemical knowledge: macroscopic/phenomenological, sub-microscopic/molecular and symbolic ones. Among these three levels, following Johnstone’s recommendations the macroscopic (...) one is the most useful for high school students who learn spectroscopy for the first time. Starting from these premises, in the second part of the paper, we propose a didactic sequence which is inspired by the historical evolution of spectroscopic instruments from the first spectroscopes invented by Gustav Kirchhoff and Robert Bunsen in 1860 to the UV–vis spectrophotometers which became common since the 1960s. The idea behind our research is to analyze the conceptual advancements through the history of spectroscopy and to identify the key episodes/experiments and spectroscopic instruments. For each of them, a didactic activity, typically an experiment, is then proposed underlining the relevant aspects from the chemistry education point of view. The present paper is the occasion to reflect on the potentialities of an historical approach combined with a laboratorial one, and to discuss the role of historical instruments and related technological improvements to teach spectroscopy. Hilary Putnam is one of the world’s leading philosophers. His highly original and often provocative ideas have set the agenda for a variety of debates in philosophy of science, philosophy of mind and philosophy of language. In the literature, the pragmatic dimension of metaphors has been clearly acknowledged. Metaphors are regarded as having different possible uses, especially pursuing persuasion. However, an analysis of the specific conversational purposes that they can be aimed at achieving in a dialogue and their adequacy thereto is still missing. In this chapter, we will address this issue focusing on the classical distinction between the explanatory and persuasive uses of metaphors, which is, however, complex to draw at an analytical level and often (...) blurred and controversial also from a theoretical point of view. Building on the analysis of explanation in different theories and fields of study, we show how it can be conceived as characterized by a cognitive and a pragmatic dimension, where the transference of understanding is used pragmatically for different dialogical goals - such as informing, making a joint decision, and most importantly persuading. In this sense, the cognitive effects of understanding are not incompatible with a persuasive dialogical purpose. This theoretical proposal will be applied to examples drawn from the medical context, to show how a pragmatic approach to explanation can account for the complexity of the cases that can be found in actual dialogical contexts. We propose to analyze well-known cases of "imaginative resistance" from the philosophical literature (Gendler, Walton, Weatherson) as involving the inference that particular content should be attributed to either: (i) a character rather than the narrator or, (ii) an unreliable, irrational, opinionated, and/or morally deviant "first person" narrator who was originally perceived to be a typical impersonal, omniscient, "effaced" narrator. We model the latter type of attribution in terms of two independently motivated linguistic mechanisms: accommodation of a discourse referent (Lewis, Stalnaker, (...) Kamp) and 'cautious' updating as a model of non-cooperative information exchange (Eckardt). (shrink)

A number of philosophical projects require a proper understanding of the modal aspects of agency, or of what I call ‘the agentive modalities.’ I propose a general account of the agentive modalities, one which takes as its primitive the decision-theoretic notion of an option. I relate this account to the standard semantics for ‘can’ and to the viability of some positions in the free will debates.

Probability as understood today, namely as a quantitative notion expressible by means of a function ranging in the interval between 0–1, took shape in the mid-17th century, and presents both a mathematical and a philosophical aspect. Of these two sides, the second is by far the most controversial, and fuels a heated debate, still ongoing. After a short historical sketch of the birth and developments of probability, its major interpretations are outlined, by referring to the work of their most prominent (...) representatives. The final section addresses the question of whether any of such interpretations can presently be considered predominant, which is answered in the negative. (shrink)

It appears that in mixed quotations like the following, the quoted expression is used and mentioned at the same time: (1) George says Tony is his ``bestest friend''. Most theories seek to account for this observation by assuming that mixed quotations operate at two levels of content at once. In contradistinction to such two-dimensional theories, we propose that quotation involves just a single level of content. Quotation always produces a change in meaning of the quoted expression, and if the quotation (...) is mixed the shift is, to a first approximation at least, from '...' to ``what x calls '...''', where x is a variable whose value is determined by the context. We argue that quotation is generally context dependent in various ways, and that some of these ways are presuppositional in nature; we present a detailed analysis of the presuppositions in question. I argue that free indirect discourse should be analyzed as a species of direct discourse rather than indirect discourse. More specifically, I argue against the emerging consensus among semanticists, who analyze it in terms of context shifting. Instead, I apply the semantic mechanisms of mixed quotation and unquotation to offer an alternative analysis where free indirect discourse is essentially a quotation of an utterance or thought, but with unquoted tenses and pronouns.

In this essay, Lugones introduces a systemic understanding of gender constituted by colonial/modernity in terms of multiple relations of power. This gender system has a light and a dark side that depict relations, and beings in relation as deeply different and thus as calling for very different patterns of violent abuse. Lugones argues that gender itself is a colonial introduction, a violent introduction consistently and contemporarily used to destroy peoples, cosmologies, and communities as the building ground of the "civilized" West. My aim in this paper is to investigate what epistemic role, if any, do appeals to representations play in cognitive neuroscience. I suggest that while at present they seem to play something in between a minimal and a substantive explanatory role, there is reason to believe that representations have a substantial contribution to the construction of neuroscientic explanations of cognitive phenomena.

In this Chapter, Maria Kronfeldner discusses whether psychological essentialism is a necessary part of dehumanization. This involves different elements of essentialism, and a narrow and a broad way of conceptualizing psychological essentialism, the first akin to natural kind thinking, the second based on entitativity. She first presents authors that have connected essentialism with dehumanization. She then introduces the error theory of psychological essentialism regarding the category of the human, and distinguishes different elements of psychological essentialism. On that basis, Kronfeldner (...) connects historical, socio-psychological, and philosophical insights in order to show that although essentialism can act as a catalyst for dehumanization, it is not necessary for it. Examples relate to dehumanization in the context of colonialism and evolutionary thinking, to the history of dehumanizing women from Aristotle to 19th-century craniology, and to contemporary self-dehumanization and ‘lesser mind’ attribution. Karttunen observes that a presupposition triggered inside an attitude ascription, can be filtered out by a seemingly inaccessible antecedent under the scope of a preceding belief ascription. This poses a major challenge for presupposition theory and the semantics of attitude ascriptions. I solve the problem by enriching the semantics of attitude ascriptions with some independently argued assumptions on the structure and interpretation of mental states. In particular, I propose a DRT-based representation of mental states with a global belief-layer and a (...) variety of labeled attitude compartments embedded within it. Hence, desires and other non-doxastic attitudes are asymmetrically dependent on beliefs. I integrate these mental state representations into a general semantic account of attitude ascriptions which relies on the parasitic nature of non-doxastic attitudes to solve Karttunen’s puzzle. Understanding how activity in the brain leads to a subjective percept is of great interest to philosophers and neuroscientists alike. In the last years, neurophysiological experiments have approached this problem directly by measuring neural signals in animals as they experience well-defined visual percepts. Stimuli in these studies are often inherently ambiguous, and thus rely upon the subjective report, generally from trained monkeys, to provide a measure of perception. By correlating activity levels in the brain to this report, one can speculate (...) on the role of individual neurons and groups of neurons in the formation and maintenance of a particular percept. However, in order to draw valid conclusions from such experiments, it is critical that the responses accurately and reliably reflect what is perceived. For this reason, a number of behavioural paradigms have been developed to control and evaluate the truthfulness of responses from behaving animals. Here we describe several approaches to optimizing the reliability of a monkey's perceptual report, and argue that their combination provides an invaluable approach in the study of subjective visual perception. I provide a novel semantic analysis of proper names and indexicals, combining insights from the competing traditions of referentialism, championed by Kripke and Kaplan, and descriptivism, introduced by Frege and Russell, and more recently resurrected by Geurts and Elbourne, among others. From the referentialist tradition, I borrow the proof that names and indexicals are not synonymous to any definite description but pick their referent from the context directly. From the descriptivist tradition, I take the observation that names, and to some (...) extent indexicals, have uses that are best understood by analogy with anaphora and definite descriptions, that is, following Geurts, in terms of presupposition projection. The hybrid analysis that I propose is couched in Layered Discourse Representation Theory. Proper names and indexicals trigger presuppositions in a dedicated layer, which is semantically interpreted as providing a contextual anchor for the interpretation of the other layers. For the proper resolution of DRSs with layered presuppositions, I add two constraints to van der Sandt's algorithm. The resulting proposal accounts for both the classic philosophical examples and the new linguistic data, preserving a unified account of the preferred rigid interpretation of both names and indexicals, while leaving room for non-referential readings under contextual pressure.
