Este artigo tem como escopo fazer uma interpretação fenomenológica do texto da aula de habilitação pronunciada por Martin Heidegger em 1915 na Universidade de Friburgo. Apesar de ser um texto citado muitas vezes pelos estudiosos da obra heideggeriana, pouco se conhece a seu respeito e, sobretudo, que e como algumas ideias – as quais serão desenvolvidas em Ser e tempo (1927) – já estão embrionariamente presentes na referida aula. Nesse sentido, seguindo a indicação do próprio título, pretende-se evidenciar em que (...) sentido há uma diferença fundamental, segundo Heidegger, entre o conceito de tempo na história e na física. Aspecto importante da presente interpretação consiste em vir acompanhada da tradução inédita de trechos significativos do texto em questão. (shrink)

Zusammenfassung Ansätze einer globalen Religionsgeschichte haben entscheidend zum Verständnis von Allgemeinbegriffen wie Religion als historisch gewachsen und veränderlich beigetragen. Ebenso haben sie aufgezeigt, dass das Verständnis von Religion in Wechselwirkung mit anderen Allgemeinbegriffen wie Nation geprägt ist. Geschlecht findet in diesen Untersuchungen bislang kaum Berücksichtigung. Dabei bestehen Wechselwirkungen zwischen Geschlecht, Nation und Religion, die wir in diesem Aufsatz in dem Vergleichsmoment von Mutterschaft aufzeigen wollen. Anhand von Fallbeispielen aus Sri Lanka, Israel und Nigeria machen wir deutlich, wie der Vergleichsmoment Mutterschaft (...) in unterschiedlichen Kontexten funktioniert, wie Identitäten daran konstruiert werden, welche Auswirkungen sich dadurch auf Religion, Nation und Geschlecht ergeben und wie Mutterschaft sowohl als Unterdrückungsmechanismus dient, als auch Handlungsmacht darin möglich ist. Due to the COVID-19 pandemic having radically changed the way we now work, many recent studies have focused on employees’ experiences and well-being, their performance and job satisfaction, and ways to ensure the best support for them when working from home. However, less attention has been given to managers’ experiences in adapting to the new role of distance management and supporting them with this transition. This study aims to explore how managers experienced distance management, and the perceived organizational support, and (...) the effect of organizational support has on their JSA during the first year of the COVID-19 pandemic. Data from 1,016 line, middle and top managers in Danish workplaces were collected in March 2021, 1 year after the start of the COVID-19 pandemic. We applied descriptive statistics, ANOVA, and partial least square structural equation modeling to investigate the relation of perceived organizational support and the JSA of distance managers. Control variables were the respondents’ demographic characteristics, specifically gender, age, and management level. The study offers insights into the managerial experiences of becoming a distance manager, helps to understand the relationship between POS and managers’ JSA, and shows a positive relationship similarly for the managers as for employees. The study shows that most managers found their work as distance managers more demanding and worked more hours. The data demonstrate that managers received the most support from their own employees and manager peers, whereas administrative support was largely lacking. The data also show that the majority of the managers prefer to manage from the office, but similarly, they can continue managing from a distance if needed post-pandemic. The study adds to the literature on workplaces’ transitioning to distance management and hybrid work and contributes to understanding the role of POS and managers’ JSA during this transition. Consequently, if an organization aims to offer hybrid work, improving support from top management and in-house support functions would help maintain or increase managers’ JSA. (shrink)

ABSTRACTIt has been widely believed that individuals transform high-intensity shame into anger because shame is unbearably painful. This phenomenon was first coined “humiliated fury,” and it has since received empirical support. The current research tests the novel hypothesis that shame-related anger is not universal, yet hinges on the cultural meanings of anger and shame. Two studies compared the occurrence of shame-related anger in North American cultural contexts to its occurrence in Japanese contexts. In a daily-diary study, participants rated anger and (...) shame feelings during shame situations that occurred over one week. In a vignette study, participants rated anger and shame in response to standardised shame vignettes that were generated in previous research by either U.S. or Japanese respondents. The Aristotelian discussion of this theme has focused the attention of researchers and commentators on the question of practical reason. The main problem has been to determine if the end is fixed by moral virtue alone while practical reason is concerned only with the deliberation on the "means" that contribute to the end, or if practical wisdom plays a role as well in the determination of the end.

Computational philosophy is the use of mechanized computational techniques to unearth philosophical insights that are either difficult or impossible to find using traditional philosophical methods. Computational metaphysics is computational philosophy with a focus on metaphysics. In this paper, we (a) develop results in modal metaphysics whose discovery was computer assisted, and (b) conclude that these results work not only to the obvious benefit of philosophy but also, less obviously, to the benefit of computer science, since the new computational techniques that (...) led to these results may be more broadly applicable within computer science. Emotion suppression has been found to have negative psychological and social consequences in Western cultural contexts. Yet, in some other cultural contexts, emotion suppression is less likely to have negative consequences; relatedly, emotion suppression is also more common in those East-Asian cultural contexts. In a dyadic conflict study, we aim to conceptually replicate cultural differences found in previous research with respect to the prevalence and consequences of emotion suppression,and extend previous research by testing whether cultural differences are larger for some (...) than for other types of negative emotions. We postulate that cultural differences in suppression are less pronounced for socially engaging emotions than socially disengaging emotions, because the former foster the relationship, whereas the latter emphasize individual goals. Belgian and Japanese couples engaged in a 10-min conflict interaction followed by video-mediated recall, during which participants rated their emotions and emotion suppression every 30 s. As predicted, Japanese participants reported more suppression than their Belgian counterparts, but the cultural difference was more pronounced when participants experienced more socially disengaging emotions than when they experienced more socially engaging emotions. These results suggest that the type of emotion should be considered when describing cultural differences in emotion suppression. Finally, and consistent with previous research, emotion suppression was negatively associated with interaction outcomes in Belgian couples, but not in Japanese couples. (shrink)

Entendemos que, embora o tempo seja tematizado em vários outros textos da juventude ou mesmo em obras heideggerianas mais tardias, é visível nesta conferência de 1924 a preocupação do pensador em conceber, de uma maneira tematicamente explícita, um novo conceito de tempo. Nossa proposta inicial restringe-se, por um lado, em avistar e evidenciar as ideias condutoras da (...) elaboração heideggeriana do conceito de tempo, razão pela qual muitos temas conexos não poderão ser especificamente abordados neste artigo; por outro lado, temos a preocupação de apontar para uma série de estudos voltados particularmente para este texto fundamental dos caminhos trilhados por Heidegger entre 1915 e 1930. Along with the Strait of Malacca and the Singapore Straits, the Strait of Hormuz is arguably the most important bottleneck in international navigation because a large part of the global oil production needs to be shipped through this passage, which is only a few kilometers wide. In the context of the dispute about Iran’s nuclear program and new sanctions, Iran has threatened to close the Strait of Hormuz for international shipping, effectively cutting off many Western countries from important oil imports. (...) In this article, the legality of such action as well as the legality of the mere threat to close the Strait of Hormuz are investigated. In addition to the International Law of the Sea, general rules of international law and the international law of armed conflict are taken into consideration. Particular emphasis is put on the sovereignty of other states, which is infringed upon by such threats on the part of the Iranian leadership. First, the question has to be answered whether a passage through these waters would be transit passage through a Strait or normal passage through the coastal state’s territorial sea. The authors of the article conclude that the regime of transit passage applies qua lex specialis, as far as the part of the Strait of Hormuz, which is included in Iran’s territorial waters, is concerned. The next step is to ask the question whether preventing such a passage as well as threatening to prevent such a passage are permissible for Iran. In this context, the potential abuse of otherwise permitted traffic separation schemes is highlighted. Traffic separation schemes are of particular importance in narrow but highly frequented bodies of water, such as the Strait of Hormuz. In addition, the contemporary Iranian state practice has received some attention. One issue to be considered in more detail is the requirement that foreign warships receive authorization from the coastal state prior to entry into the territorial sea. This approach might be incompatible with the right to innocent passage under both the Law of the Sea Convention and customary international law, as there is no clear legal source, which provides for this requirement. Finally, the authors look at the question of the legality of the mere threat to close the Strait of Hormuz as opposed to actually closing the Strait. The sovereignty of other states may be affected to such an extent that such threats already amount to a violation of international law. In light of the historic precedents during the Iran-Iraq War, these threats should not be dismissed lightly. Iran would be well advised to refrain from such rhetoric. (shrink)

It includes a canonical development of Abstract Object Theory [AOT], a metaphysical theory that distinguishes between ordinary and abstract objects. This article reports on recent work in which AOT has been successfully represented and partly automated in the proof assistant system Isabelle/HOL. Initial experiments within this framework reveal a crucial but overlooked fact: a deeply-rooted and known paradox is reintroduced in AOT when the logic of complex terms (...) is simply adjoined to AOT’s specially formulated comprehension principle for relations. This result constitutes a new and important paradox, given how much expressive and analytic power is contributed by having the two kinds of complex terms in the system. Its discovery is the highlight of our joint project and provides strong evidence for a new kind of scientific practice in philosophy, namely, computational metaphysics. Our results were made technically possible by a suitable adaptation of Benzmüller’s metalogical approach to universal reasoning by semantically embedding theories in classical higher-order logic. This approach enables one to reuse state-of-the-art higher-order proof assistants, such as Isabelle/HOL, for mechanizing and experimentally exploring challenging logics and theories such as AOT. Our results also provide a fresh perspective on the question of whether relational type theory or functional type theory better serves as a foundation for logic and metaphysics. (shrink)

The author is well known for his Études d'Estétique Médiévale in three volumes which are an indispensable guide to the several orientations in medieval aesthetics. One year later de Bruyne published this work, a manageable, brief version of the first one. As the author himself indicates in the "Introduction," the general conclusions of the Etudes are presented in an accessible way. Quotations have been reduced and most references refer to the longer work. Unfortunately, this makes the book completely dependent on (...) the Etudes. For that reason this book offers an interesting introduction not to the specialist or to the researcher but to the reader who wants to enjoy the spirit that inspired medieval aesthetics. (shrink)

Normative economics and a hermeneutic approach to interpretation of legal norms are only compatible if - and this is the exception - such legal norms have the goal of accomplishing economic efficiency. But economic analysis of law as a positive approach may be used in the legal interpretation process in order to evaluate different options of norm interpretations. In fields of law where economic issues are at stake such a methodological evaluation of interpretative variants are superior to common sense analysis (...) and should be applied. But even in fields where non-economic issues play a major role an economic analysis is a helpful tool in order to get aware of the opportunity costs of economically sub-optimal solutions. Economic analysis of law thus becomes an integral part of the norm interpretation process without colliding with the autonomy of the legal decision enhancing the rationality of the endeavour. The patristic tradition has long censured or denied debts to Epicurean thought. Thus it is surprising to find that Augustine requires and uses Epicurean arguments at three moments in the Confessions essential his theory of friendship: the pear tree incident, the death of his friend, and the decision not to form a philosophical community. I argue that the classical definition of friendship is inadequate to solve these problems. Furthermore, reworking Augustine’s theory of friendship with the use/enjoyment doctrine developed in The (...) Trinity fails to resolve them. Thus the problems raised in the Confessions cannot be exposed or solved through Augustine’s own theoretical framework. I argue that they are, however, central to the Epicurean theory of friendship, which addresses them specifically, and that the Epicurean insistence on the mortality of the soul produces the central problem for Augustine’s notion of friendship. Forced expropriations of immovable property were common during the Communist era in Eastern Europe. Today, many of the former owners or their heirs are interested in regaining legal ownership of such properties, often decades after the ownership has been reallocated to others. Therefore, the conflict between old and new owners is often resolved in favour of the new owners. While this is understandable from a contemporary political perspective, this approach results in a perpetuation of the results of an earlier human (...) rights violation, thereby resulting in a new human rights violation which will have to be measured against the European Convention on Human Rights (ECHR) if the state in question has ratified it prior to deciding how to handle the long-term effects of expropriations. Firstly, in the article we will devote ourselves to the interpretation of the right to property with an emphasis on the problem of expropriation. Above all, we will elaborate on the definition of the term “property” as well as positive and negative obligations of the Member States regarding this right. Finally, we will address the question of expropriations prior to the entry into force of the Convention and just compensation under Article 41 ECHR. Interpretation of the right to property will be supported by the jurisprudence of the European Court of Human Rights. (shrink)

This article investigates the use of natural law in biolaw from the specific perspective of an attorney practising before the European Court of Human Rights. Starting from an exploration of the question of who is a human and thereby to be protected under the European Convention on Human Rights (ECHR), particular emphasis is placed on the right to life under Art. 2(1) ECHR. It is shown that natural law can – and should – impact the interpretation of the European Convention (...) on Human Rights and that concrete consequences follow from this approach, most notably the requirement to ensure that every human being, including the unborn, is actively protected as concerns the right to life. Within the Irish government there is a discussion regarding the possibility of limiting the legal protection afforded to the confessional secret. This paper addresses the question of whether this suggestion, if it were to be implemented by the legislature, would be compatible with the right to religious freedom under Article 9 of the European Convention on Human Rights (ECHR). This text will also highlight the role of the confessional secret in canon law and the protection of it under German law. (...) Catholic priests, should this plan that is currently under discussion be implemented, were obliged to disclose the knowledge gained in confession to law enforcement authorities. The canonical consequence of such a breach of the confessional secret would be excommunication. In such cases priests therefore would only have the choice between breaking the law (which would probably also be punishable under criminal law) and excommunication, with all the resulting disadvantages. In this paper, the canonical law rules regarding confession are presented before the provisions relating to the confessional secret in § 53 para. 1 No. 1 of the Code of Criminal Procedure, § 383 para. 1 No. 4 of the Code of Civil Procedure and § 139 para. 2 of the Criminal Code are discussed. Specifically, the question is raised as to whether a duty of priests to co-operate with the law enforcement authorities may be established by law. Here in particular the protection of the confessional secret under the protection of freedom of religion under Article 9 of the European Convention on Human Rights will be discussed. It has to be noted however that the protection afforded by Article 9 of the European Convention on Human Rights extends far less than the scope of § 53 para. 1 No. 1 of the Code of Criminal Procedure, § 129 para. 2 of the Criminal Code and § 383 para. 1 No. 4 of the Code of Civil Procedure, as Art. 9 ECHR only protects the confessional secret as far as it is required from a religious point of view, but not a general pastoral secret. The article then includes a discussion on the limitations of Article 9 ECHR. Limitations of Article 9(1) ECHR on religious freedom under Article 9(2) ECHR are only permitted if they are prescribed by law and necessary in a democratic society for the protection of public order, health, morals or the rights of others. This is discussed against the background of the legislative goal of more effective law enforcement. As a result, a limitation of the protection of confessional secret through normal (sub-constitutional, domestic) laws, despite the understandable goal of more effective law enforcement, is not compatible with Article 9 of the ECHR. This review presents first ever literature survey on historical development of farm animal welfare indicators and assessment in the Danube region. This area, encompassing European Eastern countries and the Balkans, is to a large extent heterogeneous in terms of culture and language. However, international publications were disproportionally small compared to the amount of research institutions and animal welfare activities present in the region. Therefore, the authors aimed at investigating the published literature, focusing on country level and on native languages. Data (...) were collected for the 1980–2015 period referring to scientific papers published in international and national journals, papers and abstracts in proceedings of the international and national conferences, reviews, monographs, short communications, Ph.D., Master and Graduation theses. Welfare assessment of all farm animal species was observed including fish. Over 180 papers were in line with the preselected index. Data collected showed that publishing dynamics grew rapidly towards the last decade. Most of the studies were focused on animal welfare indicators such as stress, injuries and mutilations, behaviour, body condition and management practices. Cattle, chickens, pigs and sheep were the predominant species investigated. The study revealed that experts from the region were greatly involved in the studies of animal welfare indicators and assessment, contributing to development of the currently most widely used animal welfare assessment protocols, thus having an important role in animal welfare research and protection. This article on the epistemology of computational models stems from an analysis of the Gaïa hypothesis. It begins with James Kirchner’s criticisms of the central computational model of GH: Daisyworld. Among other things, the model has been criticized for being too abstract, describing fictional entities and trying to answer counterfactual questions. For these reasons the model has been considered not testable and therefore not legitimate in science, and in any case not very interesting since it explores non actual issues. (...) This criticism implicitly assumes that science should only be involved in the making of models that are “actual” and “specific”. I challenge both of these criticisms in this article. First by showing that although the testability—understood as the comparison of model output with empirical data—is an important procedure for explanatory models, there are plenty of models that are not testable. The fact that these are not testable has nothing to do with their being “abstract” or “what-if” but with their being predictive models. Secondly, I argue that “abstract” and “what-if” models aim at epistemic purposes distinct from those pursued by “actual and specific models”. Abstract models are used to propose how-possibly explanation or to pursue theorizing. What-if models are used to attribute causal or explanatory power to a variable of interest. The fact that they aim at different epistemic goals entails that it may not be accurate to consider the choice between different kinds of model as a “strategy“. (shrink)

Data-driven, decision-making technologies used in the justice system to inform decisions about bail, parole, and prison sentencing are biased against historically marginalized groups (Angwin, Larson, Mattu, & Kirchner 2016). But these technologies’ judgments—which reproduce patterns of wrongful discrimination embedded in the historical datasets that they are trained on—are well-evidenced. This presents a puzzle: how can we account for the wrong these judgments engender without also indicting morally permissible statistical inferences about persons? I motivate this puzzle and attempt an answer.

First published in Spanish in 2006, _Twenty Theses on Politics_ is a major statement on political philosophy from Enrique Dussel, one of Latin America’s—and the world’s—most important philosophers, and a founder of the philosophy of liberation. Synthesizing a half-century of his pioneering work in moral and political philosophy, Dussel presents a succinct rationale for the development of political alternatives to the exclusionary, exploitative institutions of neoliberal globalization. In twenty short, provocative theses he lays out the foundational elements for a politics (...) of just and sustainable coexistence. Dussel first constructs a theory of political power and its institutionalization, taking on topics such as the purpose of politics and the fetishization of power. As Dussel writes in Thesis 15, regarding the liberation praxis of social and political movements, “The winds that arrive from the South—from Nestor Kirchner, Tabaré Vásquez, Luiz Inácio Lula da Silva, Evo Morales, Hugo Chávez, Fidel Castro, and so many others—show us that things can be changed. The _people _must reclaim sovereignty!” Throughout the twenty theses Dussel engages with Latin American thinkers and activists and with radical political projects such as the World Social Forum. He is also in dialogue with the ideas of Marx, Hegel, Habermas, Rawls, and Negri, offering insights into the applications and limits of their thinking in light of recent Latin American political thought and practice. The last phase of Greek philosophy has until recently been less intelligently studied than any other, and in our understanding of its development there are still lamentable lacunae. Three errors in particular have in the past prevented a proper appreciation of Plotinus' place in the history of philosophy. The first was the failure to distinguish Neoplatonism from Platonism: this vitiates the work of many early exponents from Ficinus down to Kirchner. The second was the belief that the Neoplatonists, being (...) ‘mystics,’ were necessarily incomprehensible to the plain man or even to the plain philosopher. To have encouraged the persistence of this superstition in the nineteenth century is the least pardonable of Creuzer's many sins. The third was the chronological confusion involved in the ascription to Saint Paul's contemporary of the works of the pretended Dionysius Areopagita, which contain a fully-developed Neoplatonic theology. Though the fraud had been exposed by Scaliger, these writings continued down to the beginning of the nineteenth century to be used as evidence that the ‘Nsoplatonic trinity’ was an inferior imitation of the Christian one. When this false trail was at length abandoned the fashion for orientalizing explanations persisted in another guise: to the earliest historians of Neoplatonism, Simon and Vacherot, the school of Plotinus was ‘the school of Alexandria,’ and its inspiration was mainly Egyptian. Vacherot says of Neoplatonism that it is ‘essentially and radically oriental, having nothing of Greek thought but its language and procedure.’ Few would be found to-day to subscribe to so sweeping a pronouncement; but the existence of an important oriental element in Plotinus' thought is still affirmed by many French and German writers.
