The European Union bas recently started negotiations on its enlargement with a first group of six countries. This will probably be followed by a second wave of enlargements that would include five or six more countries. A question that can be raised in whether the institutional structure of the EU is ready to cope with an expanded membership. This article aims at analyzing this question as far as the Council of Ministers is concerned. It points at the rising tension between (...) the capacity of the Council to act and the extent of control that each member states can exert on Council decision-making. The IGC that resulted in the Amsterdam Treaty basically failed to resolve this problem. The article looks at the reasons why it failed since these reasons expound the problems the EU will have to face in the near future when preparing its institutions for an expanded membership. In view of the pessimism on the two EU presidencies before 1994 and ofa number ofpolitica[ breakthroughs that has been reached during that year, one can say that the last year of the Tweve has been relatively succesful. It was a year in which the economic recession came to an end, in which the enlargement negotiations have been concluded, and in which the Europe Agreements entered into force. At the same time, however, 1994 showed the first signs of future problems (...) with which the enlarged EU wilt have to cope. The expected eastern and southern enlargements wilt necessitate institutional adaptations and wilt intensify the already bitter discussions on the EU's budget. At the same time, the EU wilt have to find ways to cape with rising unemployment. This will have to happen in a period during which the member states are having difficulties to fullfil the budgetary conditions of Maastricht. In 1995 the newly enlarged European Union has proved to be capable to handle its problems and to take decisions in a large array of issues. The EU tried to cope with unemployment, continued the preparation of the third stage of the Economic and Monetary Union, adopted its 1996 budget decisions relatively smoothly, and intensified its relations with different parts of the world. On the other hand however, enlargement itself is increasingly affecting the Union as it preparing itself for the (...) upcoming accession of some of its Central European and Mediterranean neighbors. The northern member states look with some suspicion at the budgetary consequences and already show a lot of restraint in paying more to the EU-budget, for the sake of their southern counterparts. Some member states are looking for a balanced enlargement in which the eastern enlargement would be counterbalanced by a Mediterranean one, and for a balance in the financial support that is provided by the EU to third countries. The biggest issue is however, the institutional adaptation of the European Union to a new enlargement. The preparations of the 1996 Intergovernmental Conferencethat took place in 1995, have shown however, that this process will be a difficult one. With the 1995 enlargement, the European Union has increased the number ofmember states that perceive the process of European integration primarily as an economic one. This will make institutional adaptations more difficult and risks to paralyze the Common Foreign and Security Policy of the Union even more than it already did in the past few years. During the past year, the European integration process steadily continued along familiar as well as less familiar paths. This contribution gives an overview of the core decisions made within the three pillars of the European construction in the year 2000. Although the vast majority of these decisions were closely linked to the approaching Eastern enlargement of the European Union, new avenues have been followed during the past year as well. The existence of a Flemish identity is a much debated issue in the Flanders. Some deny its existence on the basis of a rejection of national identities all together. Others perceive it as just one variant of a Western European identity. Still others consider it, not as a identity on its own but as part of the Belgian identity. Whatever the outcome, the discussion itself seems to be restricted to a small elite. The general public in the Flanders is not (...) interested in the issue and doesn't seem to identify itself with a Flemish identity. A small empirical research indicates however, that part of the Flemish politicians and journalists use this identity as a perspective on politics and society. For that reason, the Flemish identity seems to be a condition which is quite similar to the one attributed by Gellner to national identities in the nineteenth century. Isn't it better therefore, to talk about a nascent instead of an existent Flemish identity? (shrink)

1996 was a y ear of both gridlock and reform for the European Union. The EU experienced one of its major institutional crises with the Mad Cow Disease. ltwas equally confronted with only minor progress in the ongoing Intergovernmental Conference for institutional reform as no major breakthroughs could be expected before the UK elections of May 1997. However, some major achievements occured as well. The adoption of the Stability Pact at the Dublin Summit in December increased the credibility of the (...) EMU-project seriously. At the same time, the EU intensified its efforts to improve its trade relations with different parts of the world, especially South and South-East-Asia. At the same time however, the Commission bas been confronted with increasing disputes on the way in which it uses its prerogatives in competition policy and the enforcement of implementation. Without doubt, the year 2001 will remain identified with the terrorist attacks of september 11. To some extent, this goes for the European Union as well. The events of september 11 left an important mark on the European integration process, of which the development of the European arrest warrant is an important illustration. Nevertheless, as for the European Union, the year 2001 was more than a year of anti-terrorism measures. In the second semester of2001, the Belgian government assumed the presidency (...) ofthe European Union. 2001 was also the year in which, only weeks after street violence disruputed the European Council ofGöteborg, a protester was killed in the margin ofthe G7-G8 Summit in Genova. In 2001, the gap between the European Union and the United States got larger for a number of policy fields, including National Missile Defence and the Kyoto Protocol. Yet, in the autumn of2001, both power blocks reconciliated at the WTO Ministerial Conference in Doha, Qatar. In Doha, a new global round of trade negotiations was launched. As in previous years, in 2001, the enlargement process was high on the European agenda. As for the latter, for the first time, ten candidate countries were mentioned by name, making their accession in 2004 a more realistic scenario. The eastern enlargement will radically change the face of the European Union. The Belgian presidency anticipated this impeding metamorphosis and stimulated the adoption of the Laeken Declaration in december 2001. The Declaration laid the foundation for the Convention on the Future of Europe which started on February 28, 2002. The Declaration of Laeken was one of the European highlights of 2001. The low point was the Irish referendum of June 7, 2001, in which a majority of the Irish population rejected the Treaty of Nice. Both events reflect the situation the European Union is faced with today, as they demonstrate the growing tension between the desires of «widening» and «deepening» the European construction. After the disappointments of 1992, however a year that engendered a lot of expectations, it was not difficult for the European Union to perform better in 1993. But even then, the European Union has not been spared from serious difficulties. The economic recession raged through the old continent as never before and the stability and the survival of the ERM came under severe pressure. Only the last three months seemed to provide the first indications of a slow recovery. The Maastricht (...) Treaty came finally into force, monetary stability came back and the first signs of the end of the recession showed-up. In the light of the serious political and institutional burdens of the enlargement of1995, one can only hope that this recovery will continue further. (shrink)

The European Union stepped into the year 2002 with mixedfeelings. On the one hand, the anthraxcrisis and the war in Afghanistan remembered of the terrorist attacks of 11 September 2001. On the other hand, the introduction of the euro notes and coins created a EU-wide feeling of euphoria. In the following twelve months, EU activity was mainly dominated by the impeding eastern enlargement. Moreover, in 2002, the institutional foundations were laid ofwhat will turn out to be one of the mostfundamental (...) transformations ofthe European construction in EU history. In 2003, the completion of the eastern enlargement process dominated European Union activities. Without doubt, for the ten countries that joined the European Union on 1 May 2004, the signing of the Treaty of Accession on 16 May 2003 at the foot of the Akropolis was the high point. A few weeks later, Valéry Giscard D'Estaing presented the draft constitution at the European Council of Thessaloniki. Yet, in the spring of 2003, the European Union was mainly in the news as (...) a divided European Union. In the weeks before the military intervention in lraq, on the European continent, a split became visible between the 'old' and 'new' Europe. However, when looking back, the lraq debacle seems to have given a new impulse to the development of the Common Foreign and Security Policy, witness the security strategies approved in December 2003. The compliance with the rules of the Stability and Crowth Pact, the increasing exchange rate of the euro, and the evaluation of the internal market programme were on the European economic agenda in 2003. The Belgian Presidency is generally seen as being a success. On many difficult questions, the Belgians succeeded in forging compromises between the member states. There is a risk however, that the apparent successes of this Presidency will lead to an over-estimation of the role which a EU-president can play. Therefore, it is important to pay attention to its limits and possibilities. It can help to relativize the Belgian presidency and to improve insights into the potential role of EU-presidents within the (...) decision-making of the European Union. (shrink)

This paper presents the NeoCrawler – a tailor-made webcrawler, which identifies and retrieves neologisms from the Internet and systematically monitors the use of detected neologisms on the web by means of weekly searches. It enables researchers to use the web as a corpus in order to investigate the dynamics of lexical innovation on a large-scale and systematic basis. The NeoCrawler represents an innovative web-mining tool which opens up new opportunities for linguists to tackle a number of unresolved and under-researched issues (...) in the field of lexical innovation. Unbelievable Errors defends an error theory about all normative judgements: not just moral judgements, but also judgements about reasons for action, judgements about reasons for belief, and instrumental normative judgements. This theory states that normative judgements are beliefs that ascribe normative properties, but that normative properties do not exist. It therefore entails that all normative judgements are false. -/- Bart Streumer also argues, however, that we cannot believe this error theory. This may seem to be a problem for the (...) theory. But he argues that it makes this error theory more likely to be true, since it undermines objections to the theory and it makes it harder to reject the arguments for the theory. -/- He then sketches how certain other philosophical theories can be defended in a similar way. ABSTRACTThe massive influx of refugees into Europe in the past few years has given rise to different kinds of challenges among which is the challenge to successfully communicate with newly arrived immigrants. In this article, we will focus on the public service provision sector where quality of service is to a large extent determined by the capability of a service provider and his or her “client” to understand one another. The article centres on a study involving public organisations providing asylum (...) services or healthcare services in the multilingual and multicultural city of Brussels. Several interviews were conducted to gain insight into the communication problems such organisations face, as well as their communication requirements and solutions when providing services to people of different linguistic and cultural backgrounds. In this volume, Geurts takes discourse representation theory (DRT), and turns it into a unified account of anaphora and presupposition, which he applies not only to the standard problem cases but also to the interpretation of modal expressions, attitude reports, and proper names. The resulting theory, for all its simplicity, is without doubt the most comprehensive of its kind to date. The central idea underlying Geurts' 'binding theory' of presupposition is that anaphora is just a special case of presupposition projection. (...) But this is only one of the ways in which the concept of presupposition is taken beyond its traditional limits. Geurts shows, furthermore, that presupposition projection is crucially involved in several phenomena that are not usually viewed in presuppositional terms, such as modal subordination, de re readings of attitude reports, and rigid designation. While making his case for DRT and the binding theory, Geurts also presents an incisive analysis of what is probably still the most influential account of presupposition, viz. the satisfaction theory, demonstrating that there are fundamental problems not only with this theory but with the very framework in which it is couched. The concept of resistance has always been central to the reception of Hegel's philosophy. The prevalent image of Hegel's system, which continues to influence the scholarship to this day, is that of an absolutist, monist metaphysics which overcomes all resistance, sublating or assimilating all differences into a single organic 'Whole'. For that reason, the reception of Hegel has always been marked by the question of how to resist Hegel: how to think that which remains outside of or other to the (...) totalizing system of dialectics. In recent years the work of scholars such as Catherine Malabou, Slavoj Žižek, Rebecca Comay and Frank Ruda has brought considerable nuance to this debate. A new reading of Hegel has emerged which challenges the idea that there is no place for difference, otherness or resistance in Hegel, both by refusing to reduce Hegel's complex philosophy to a straightforward systematic narrative and by highlighting particular moments within Hegel's philosophy which seem to counteract the traditional understanding of dialectics. This book brings together established and new voices in this field in order to show that the notion of resistance is central to this revaluation of Hegel. (shrink)

In this paper, a reaction is presented to Siegel’s claim that the pragma-dialectical theory of argumentation ignores or neglects epistemological viewpoints that he finds vital to any normative theory of argumentation. The focus is on the most important problems in Siegel’s argument: 1) the ambiguity of the term ‘argument’ and the alleged negligence of this ambiguity in pragma-dialectics; 2) the critical rational perspective of the pragma-dialectical account; and 3) the alleged negligence of the “abstract propositional sense” of argument in pragma-dialectics.

According to the error theory, normative judgements are beliefs that ascribe normative properties, even though such properties do not exist. In this paper, I argue that we cannot believe the error theory, and that this means that there is no reason for us to believe this theory. It may be thought that this is a problem for the error theory, but I argue that it is not. Instead, I argue, our inability to believe the error theory undermines many objections that (...) have been made to this theory. (shrink)

The legal basis for processing personal data and some other types of Big Data is often the informed consent of the data subject involved. Many data controllers, such as social network sites, offer terms and conditions, privacy policies or similar documents to which a user can consent when registering as a user. There are many issues with such informed consent: people get too many consent requests to read everything, policy documents are often very long and difficult to understand and users (...) feel they do not have a real choice anyway. Furthermore, in the context of Big Data refusing consent may not prevent predicting missing data. Finally, consent is usually asked for when registering, but rarely is consent renewed. As a result, consenting once often implies consent forever. At the same time, given the rapid changes in Big Data and data analysis, consent may easily get outdated. This paper suggests expiry dates for consent, not to settle questions, but to put them on the table as a start for further discussion on this topic. Although such expiry dates may not solve all the issues of informed consent, they may be a useful tool in some situations. (shrink)

Gricean pragmatics has often been criticised for being implausible from a psychological point of view. This line of criticism is never backed up by empirical evidence, but more importantly, it ignores the fact that Grice never meant to advance a processing theory, in the first place. Taking our lead from Marr, we distinguish between two levels of explanation: at the W-level, we are concerned with what agents do and why; at the H-level, we ask how agents do whatever it is (...) they do. Whereas pragmatics is pitched at the W-level, processing theories are at the H-level. This is not to say that pragmatics has no implications for psychology at all, but it is to say that its implications are less direct than is often supposed. (shrink)

Many philosophers claim that it cannot be the case that a person ought to perform an action if this person cannot perform this action. However, most of these philosophers do not give arguments for the truth of this claim. In this paper, I argue that it is plausible to interpret this claim in such a way that it is entailed by the claim that there cannot be a reason for a person to perform an action if it is impossible that (...) this person will perform this action. I then give three arguments for the truth of the latter claim, which are also arguments for the truth of the former claim as I interpret it. (shrink)

Health-promoting nudges have been put into practice by different agents, in different contexts and with different aims. This article formulates a set of criteria that enables a thorough ethical evaluation of such nudges. As such, it bridges the gap between the abstract, theoretical debates among academics and the actual behavioral interventions being implemented in practice. The criteria are derived from arguments against nudges, which allegedly disrespect nudgees, as these would impose values on nudgees and/or violate their rationality and autonomy. Instead (...) of interpreting these objections as knock-down arguments, I take them as expressing legitimate worries that can often be addressed. I analyze six prototypical nudge cases, such as Google’s rearrangement of fridges and the use of defaults in organ donation registration. I show how the ethical criteria listed are satisfied by most—but not all—nudges in most—but not all—circumstances. (shrink)

Conventions are regularities in social behaviour of the past that enable us to coordinate our actions. Some conventions are lawlike: they are expected to be observed always or nearly always. However, in order to coordinate our actions, it may suffice that a precedent has occurred often enough, and sometimes even a single precedent will do. So, in general, conventions merely enable us to solve our coordination problems; lawlike conventions are a special case. Grammatical conventions are often lawlike; sense conventions are (...) typically enabling. In order to resolve the indeterminacies that sense conventions give rise to, interlocutors must rely on the common ground. One of the most pervasive criticisms of nudges has been the claim that they violate, undermine or decrease people’s autonomy. This claim, however, is seldom backed up by an explicit and detailed conception of autonomy. In this paper, we aim to do three things. First, we want to clear up some conceptual confusion by distinguishing the different conceptions used by Cass Sunstein and his critics in order to get clear on how they conceive of autonomy. Second, we want to add (...) to the existing discussion by distinguishing between ‘autonomy’ as the ability to set your own ends and ‘autocracy’ as the ability to actually realize those ends. This will allow for a more careful ethical evaluation of specific nudge interventions. Third, we will introduce the idea of ‘perimeters of autonomy’ in an attempt to provide a realistic account of personal autonomy and we will argue that it can alleviate most of the worries about nudging being autonomy-undermining. In Magnolia, a 1999 movie written and directed by then 29-year-old Paul Thomas Anderson, we follow a range of characters who all try to come to terms with the things happening to them in both the present and past. This chapter interprets the movie as making a philosophical point about meaning: how and why do people find meaning in and attribute meaning to things, even if they seem to happen for no apparent reason at all? We will analyze how both (...) the movie’s characters and all of us watching the movie, living our own lives, try to make sense of the often absurd coincidences in life. More importantly, we will ask why we feel the need to “make sense” of the things that happen to and around us and what happens when our attempts fail. How should we respond to things that simply don’t make sense, even after we have tried hard? The chapter explains how (key scenes of) the movie can be interpreted as visualizing the philosophical notion of “the absurd” and inviting us to respond to absurdities in ways already articulated by the French existentialist Albert Camus. What is property, and why does our species happen to have it? In The Property Species, the economist Bart Wilson explores how we acquire, perceive, and know the custom of property, and why this might be relevant to social scientists, philosophers, and legal scholars for understanding how property works in the twenty-first century.

Many philosophers argue that the error theory should be rejected because it is incompatible with standard deontic logic and semantics. We argue that such formal objections to the theory fail. Our discussion has two upshots. First, it increases the dialectical weight that must be borne by objections to the error theory that target its content rather than its form. Second, it shows that standard deontic logic and semantics should be revised.

It appears that in mixed quotations like the following, the quoted expression is used and mentioned at the same time: (1) George says Tony is his ``bestest friend''. Most theories seek to account for this observation by assuming that mixed quotations operate at two levels of content at once. In contradistinction to such two-dimensional theories, we propose that quotation involves just a single level of content. Quotation always produces a change in meaning of the quoted expression, and if the quotation (...) is mixed the shift is, to a first approximation at least, from '...' to ``what x calls '...''', where x is a variable whose value is determined by the context. We argue that quotation is generally context dependent in various ways, and that some of these ways are presuppositional in nature; we present a detailed analysis of the presuppositions in question. People talk not only to others but also to themselves. The self talk we engage in may be overt or covert, and is associated with a variety of higher mental functions, including reasoning, problem solving, planning and plan execution, attention, and motivation. When talking to herself, a speaker takes devices from her mother tongue, originally designed for interpersonal communication, and employs them to communicate with herself. But what could it even mean to communicate with oneself? To answer that question, we (...) need a theory of communication that explains how the same linguistic devices may be used to communicate with others and oneself. On the received view, which defines communication as information exchange, self talk appears to be an anomaly, for it is hard to see the point of exchanging information with oneself. However, if communication is analysed as a way of negotiating commitments between speaker and hearer, then communication may be useful even when speaker and hearer coincide. Thus a commitment-based approach allows us to make sense of self talk as well as social talk. (shrink)

The term ‘inertia’ is often used to describe a kind of irrational resistance to change in individuals or institutions. Institutions, ideas and power structures appear to become entrenched over time, and may become ineffective or obsolete, even if they once played a legitimate or useful role. In this paper I argue that there is a common set of problems underlying the occurrence of resistance to change in individuals, social structures and the development of knowledge. Resistance to change is not always (...) irrational or problematic; it is also necessary to allow stable personal identities and social structures to survive in a constantly changing world. I offer a historical and theoretical framework for the question of inertia. Finally, I argue that philosophy has often seen its task to be the critique of ossified, inert or obsolete ideas and social structures, but that it has neglected the positive dimension of resistance to change. Despite clear legislative and judicial support, a well established ethical consensus, and increased efforts at information dissemination and education, proxy decision making for incapacitated patients continues to produce moral muddle and poor resolutions in end-of-life care.In her analysis of the proxy-doctor relationship, Nancy Dubler spells out the institutionalized patterns that keep the promise of proxy directives so often unrealized. Facing medically complex care of an incapacitated patient, health care teams are apt to view the proxy as a potentially indecisive or (...) unrealistically demanding decision-maker, less a stand-in for the patient than an interloper whose improper, misguided, or self-interested decisions will work against the patient's best interests. So perceived, proxies are routinely relegated to the edges of care planning discussions, left relatively uninformed and unconsulted, and then suddenly thrust center stage to face decisions they find overwhelming. Confronting such decisions, proxies need support and compassion. What they often find is isolation and distrust, a web of professional and institutional practices that trammel their efforts to understand and execute their role. (shrink)

Abstract: The Gricean theory of conversational implicature has always been plagued by data suggesting that what would seem to be conversational inferences may occur within the scope of operators like believe , for example; which for bona fide implicatures should be an impossibility. Concentrating my attention on scalar implicatures, I argue that, for the most part, such observations can be accounted for within a Gricean framework, and without resorting to local pragmatic inferences of any kin d. However, there remains a (...) small class of marked cases that cannot be treated as conversational implicatures, and they do require a local mode of pragmatic interpretation. (shrink)

The epistemologists Biro and Siegel have raised two objections against the pragma-dialectical approach to argumentation. According to the first objection the pragma-dialectical theory is not genuinely normative. According to the second objection the rejection of justificationism by pragma-dialecticians is unwarranted: they reject justificationism prematurely and they are not consistent in accepting some arguments (‘justifications’) as sound. The first objection is based on what we regard as the misconception that the goal of resolving differences of opinion cannot provide a normative approach. (...) Frank Jackson has argued that, given plausible claims about supervenience, descriptive predicates and property identity, there are no irreducibly normative properties. Philosophers who think that there are such properties have made several objections to this argument. In this paper, I argue that all of these objections fail. I conclude that Jackson's argument shows that there are no irreducibly normative properties.

We argued that formal objections to the error theory overgeneralize and therefore fail. Christine Tiefensee and Gregory Wheeler deny this. We argue that they are wrong, for two reasons. The first concerns how we should adjudicate conflicts between formal and substantive commitments. The second concerns an overlooked tension between formal objections and non-error-theoretic views. Our discussion shows that the commitments behind formal objections to the error theory, such as the dual schema, should be regarded as much more contentious than is (...) often assumed. (shrink)
