This article examines the implications for contract law of Rawls' theory of justice as fairness. It argues that contract law as an institution is part of the basic structure of society and as such subject to the principles of justice. Discussing the basic structure in relation to contract law is particularly interesting because it is instructive for both contract law and Rawlsian theory. On the one hand, justice as fairness has clear normative implications for the institution of contract law. Randomized controlled trials are often considered the gold standard for estimating causal effect, but they may lack external validity when the population eligible to the RCT is substantially different from the target population. Having at hand a sample of the target population of interest allows us to generalize the causal effect. Identifying the treatment effect in the target population requires covariates to capture all treatment effect modifiers that are shifted between the two sets. Standard estimators then use either weighting, outcome (...) modeling, or combine the two in doubly robust approaches. However, such covariates are often not available in both sets. In this article, after proving L 1 {L}^{1} -consistency of these three estimators, we compute the expected bias induced by a missing covariate, assuming a Gaussian distribution, a continuous outcome, and a semi-parametric model. Under this setting, we perform a sensitivity analysis for each missing covariate pattern and compute the sign of the expected bias. We also show that there is no gain in linearly imputing a partially unobserved covariate. Finally, we study the substitution of a missing covariate by a proxy. We illustrate all these results on simulations, as well as semi-synthetic benchmarks using data from the Tennessee student/teacher achievement ratio, and a real-world example from critical care medicine. Anatomo-functional studies in humans point out that handedness and language-related functional laterality are not correlated – except during language production; and that the convergence of language and hand control is located in the precentral gyrus, whereas executive functions required by movement imitation and phonological and semantic processing converge onto Broca's area. Scholars have revealed how moral evaluation is woven into formal administrative processes. While research examining these dynamics tends to assume that a person’s naturalized identity (such as race and gender) precedes administrative processing, we argue that social categorization by administrators is the tacit precondition upon which further processing takes place. We make this argument by looking at a set of unusual cases: parole hearings where prisoners fall outside of, conflict with, or move between categories of gender, sexuality, race, and ability. (...) We find that categorization acts as a prerequisite to moral evaluation. When administrators cannot easily categorize a prisoner, they resolve this uncertainty by denying parole. Yet, social categorization can also serve as a pathway to moral approval and administrative allocation. In certain situations, administrators encourage prisoners’ identification with a new social category as proof that they are deserving of parole. In both cases, successful administrative categorization occurs through a combination of what we call narrativization, or crafting a narrative around one’s identity that aligns with administrators’ presumptions, and authorization, or marshalling official evidence from prior classification moments to support identity claims. These insights extend our understanding of classification, moral evaluation, and the administrative reproduction of inequality. (shrink)

With the development and increasing use of diverse public involvement methods over the past decade, formal technology assessment has shifted from a largely closed, intrainstitutional tool of policy analysis and advice to a tool for the social assessment of scientific-technological issues at the interface between politics and public discourse. Through citizens’ conferences, scenario workshops, and consensus conferences, technology assessment has effectively been opened up to the public sphere: Citizens and interest group representatives are drawn into the process of assessing scientific (...) and technological issues alongside experts, the process often takes place in public, and its outcomes are made widely available for information and debate. This article analyzes the public involvement agenda in technology assessment from the conceptual perspective of the “public sphere.” It discusses key features of public sphere–oriented technology assessment, including public access, actor involvement, and deliberation. And it considers the implications of the public sphere dimension for future developments in participatory technology assessment. (shrink)

Children must be taught morality. They must be taught to recognise the authority of moral standards and to understand what makes them authoritative. But there’s a problem: the content and justification of morality are matters of reasonable disagreement among reasonable people. This makes it hard to see how educators can secure children’s commitment to moral standards without indoctrinating them. -/- In A Theory of Moral Education, Michael Hand tackles this problem head on. He sets out to show that moral education (...) can and should be fully rational. It is true that many moral standards and justificatory theories are controversial, and educators have an obligation to teach these nondirectively, with the aim of enabling children to form their own considered views. But reasonable moral disagreement does not go all the way down: some basic moral standards are robustly justified, and these should be taught directively, with the aim of bringing children to recognise and understand their authority. -/- This is an original and important contribution to the philosophy of moral education, which lays a new theoretical foundation for the urgent practical task of teaching right from wrong. Emmanuel Levinas has been Professor of Philosophy at the Sorbonne and the director of the Ecole Normale Israelite Orientale. Through such works as "Totality and Infinity" and "Otherwise than Being", he has exerted a profound influence on twentieth-century continental philosophy, providing inspiration for Derrida, Lyotard, Blanchot and Irigaray. "The Levinas Reader" collects, often for the first time in English, essays by Levinas encompassing every aspect of his thought: the early phenomenological studies written under the guidance and inspiration of Husserl and (...) Heidegger; the fully developed ethical critique of such totalizing philosophies; the pioneering texts on the moral dimension to aesthetics; the rich and subtle readings of the Talmud which are an exemplary model of an ethical, transcendental philosophy at work; the admirable meditations on current political issues. Sean Hand's introduction gives a complete overview of Levinas's work and situates each chapter within his general contribution to phenomenology, aesthetics, religion, politics and, above all, ethics. In this inaugural lecture, delivered at the University of Birmingham in January 2014, I sketch the outline of a theory of moral education. The theory is an attempt to resolve the tension between two thoughts widely entertained by teachers, policy-makers and the general public. The first thought is that morality must be learned: children must come to see what morality requires of them and acquire the motivation to submit to its authority. The second thought is that morality is controversial: there (...) is deep uncertainty about both the requirements of morality and the reasons to comply with them. I draw distinctions between two kinds of moral education and between two kinds of moral inquiry . I argue that some basic moral standards are robustly justified and that schools should promote subscription to these standards by means of both moral formation and directive moral inquiry. (shrink)

Curiously, this logical difficulty was largely overlooked in the debate on religious upbringing and parental rights between Terence McLaughlin, Eamonn Callan and Peter Gardner in the 1980s. Truth’s universal knowability entails its discovery. This threatens antirealism, which is thought to require it. Fortunately, antirealism is not committed to it. Avoiding it requires adoption (and extension) of Dag Prawitz’s position in his long-term disagreement with Michael Dummett on the notion of provability involved in intuitionism’s identification of it with truth. Antirealism (intuitionism generalized) must accommodate a notion of lost-opportunity truth (a kind of recognition-transcendent truth), and even truth consisting in the presence of unperformable verifications. Dummett’s position cannot abide (...) this, while Prawitz’s can. Antirealism’s epistemic notion of truth derives from general features of its meaning theory, not from a universal knowability principle. (shrink)

Discussions of Karl Popper's falsificationist philosophy of science appear regularly in the recent literature on economic methodology. In this literature, there seem to be two fundamental points of agreement about Popper. First, most economists take Popper's falsificationist method of bold conjecture and severe test to be the correct characterization of scientific conduct in the physical sciences. Second, most economists admit that economic theory fails miserably when judged by these same falsificationist standards. As Latsis states, “the development of economic analysis would (...) look a dismal affair through falsificationist spectacles.”. (shrink)

The so-called knowability paradox results from Fitch's argument that if there are any unknown truths, then there are unknowable truths. This threatens recent versions of semantical antirealism, the central thesis of which is that truth is epistemic. When this is taken to mean that all truths are knowable, antirealism is thus committed to the conclusion that no truths are unknown. The correct antirealistic response to the paradox should be to deny that the fundamental thesis of the epistemic nature of truth (...) entails the knowability of all truths. Correctly understood, the antirealistic conditions on a proposition's truth do not require that the proposition possess a verification-procedure which, when executed under the given conditions, issues in an agent's recognition of truth, but merely that there be a verification-procedure which, under these conditions, takes the value true . The knowability paradox and the related idealism problem (that antirealism seems, but is not, committed to the necessary existence of an epistemic agent) draw attention to the fact that certain propositions, those that are about verification-procedures themselves, may under certain conditions take the value true despite their unperformability under these circumstances. Thus these propositions' procedures can only be performed when the propositions are false, and they gain the appearance of antirealistic impossibility (e.g., that there is an unknown truth). This differs from the unperformability that antirealists object to, pertaining merely to matters of execution rather than to the logical structure of the procedures themselves. The force of antirealism's notion of epistemic truth is piecemeal, rather than consisting in a blanket characterization of truth as knowable. (shrink)

The purpose of this paper is to examine the normative interpretation of the fast-and-frugal research program and in particular to contrast it with the normative reading of rational choice theory and behavioral economics. The ecological rationality of fast-and-frugal heuristics is admittedly a form of normative naturalism – it derives what agents “ought” to do from that which “is” ecologically rational – and the paper will examine how this differs from the normative rationality associated with rational choice theory. In this brief comment on Educational Goods, I raise two worries about the authors' proposed normative framework for educational decision-makers. The first concerns the omission of rationality, or responsiveness to reasons, from the list of educational goods; the second concerns the inclusion of parental interests in the list of independent values.
