This paper presents methods and challenges attendant on the use of protocol analysis to develop a model of heuristic processing applied to research ethics. Participants are exposed to ethically complex scenarios and asked to verbalize their thoughts as they formulate a requested decision. The model identifies functional parts of the decision-making task: interpretation, retrieval, judgment and editing and seeks to reliably code participant verbalizations to those tasks as well as to a set of cognitive tools generally useful in such work. (...) Important difficulties in the reliability and external validity of measurement are evaluated and a small set of illustrative data is used in support of that discussion. Results indicate that both intuitive emotional but also more deliberative cognition is present which is consistent with work in related literatures in expertise and in neuropsychology. Finally, the theoretical and practical potential of the approach is elaborated, particularly through links to a framing in Aristotelian ethics. (shrink)

In a recent paper, David Albert has suggested that no quantum theory can yield a description of the world unfolding in Minkowski spacetime. This conclusion is premature; a natural extension of Stein's notion of becoming in Minkowski spacetime to accommodate the demands of quantum nonseparability yields such an account, an account that is in accord with a proposal which was made by Aharonov and Albert but which is dismissed by Albert as a ‘mere trick’. A proof is given, at a greater level of generality than previous 'no-go' theorems, of the impossibility of formulating a modal interpretation that exhibits 'serious' Lorentz invariance at the fundamental level. Particular attention is given to modal interpretations of the type proposed by Bub.

This book argues that Kant's transcendental idealism has been misinterpreted: it denies not simply the super-sensory reality of space, time, and appearances, but their reality outside imagination as well. After adducing extensive and explicit textual evidence in its favor, Waxman shows this interpretation to be essential to the Transcendental Deduction, the affirmation of things in themselves, and the attempt to surmount Hume's scepticism. He further argues that Kant's much-neglected claim that, besides himself, "no psychologist has so much as even thought (...) that the imagination might be a necessary constituent of perception," should be construed so that even our consciousness of sensation itself (visual, tactile, etc.) is impossible without imagination. A compelling and original contribution to Kantian scholarship, Kant's Model of the Mind will also bear close examination by students and scholars of Hume, the philosophy of mind, and the philosophy of science. A common methodological adage holds that diverse evidence better confirms a hypothesis than does the same amount of similar evidence. Proponents of Bayesian approaches to scientific reasoning such as Horwich, Howson and Urbach, and Earman claim to offer both a precise rendering of this maxim in probabilistic terms and an explanation of why the maxim should be part of the methodological canon of good science. This paper contends that these claims are mistaken and that, at best, Bayesian accounts of diverse (...) evidence are crucially incomplete. This failure should lend renewed force to a long-neglected global worry about Bayesian approaches. (shrink)

The Akaike Information Criterion can be a valuable tool of scientific inference. This statistic, or any other statistical method for that matter, cannot, however, be the whole of scientific methodology. In this paper some of the limitations of Akaikean statistical methods are discussed. It is argued that the full import of empirical evidence is realized only by adopting a richer ideal of empirical success than predictive accuracy, and that the ability of a theory to turn phenomena into accurate, agreeing measurements (...) of causally relevant parameters contributes to the evidential support of the theory. This is illustrated by Newton's argument from orbital phenomena to the inverse-square law of gravitation. (shrink)

This article draws on Foucault's concept of governmentality to explore how recent political moves to legalise ‘flexibility’ mobilises education authorities to make ‘community’ a technical means of achieving the political objective of schooling the child. I argue that ‘flexibility’ in this sense is a neo‐liberal strategy that shifts relations between the governed and the State. In this way, it transforms the idea of schooling from a State run institution for the purpose of ‘community building’ to a community run institution for (...) the purpose of making parents governable by both instrumentalising and institutionalising individualism through the force of community membership. Rather than a form of liberation from bureaucratic rule, the paper exposes how ‘flexibility’ acts as a normalising strategy that works with difference to entangle parents as community members in the process of schooling the child through the moral obligation of the contract. Biblical theology ought to find relevant to its task the whole story, if it can be learned, of the formation and reformation of the people for whom and by whom the biblical writings were made.

Informed consent is thought to exist as a well-defined entity. Altered concepts of patient autonomy, differential cultural understanding of the entity, and the failure of clients to distinguish between research and clinical ethics, and various hierarchical cultural views of informed consent all suggest that alterations may be needed in the traditional concept. By using the methodology outlined by Gasking in which he defines the idea of “cluster concepts,” one may be able to enlarge the definition and augment the understanding of (...) the informed consent and include the time and culture-specific variants which exist. This paper attempts to provide a descriptive theoretical overview of the medical futility debate. I will first argue that quantitative data cannot alone resolve the medical futility debate. I will then examine two aspects of medical futility, which I call the prospective and immediate, respectively. The first involves making prospective factual and value judgments about the efficacy of proposed medical interventions, while the latter involves making value judgments about ongoing medical conditions where the clinical data are clear. At stake is (...) the nature and scope of individual rights. Thus, I maintain there is an undeveloped aspect to the medical futility debate and, briefly, analyze two political perspectives which give rise to different understandings of medical futility. The view that I will defend is that only a system with defined collective goals can accommodate a normative concept of medical futility. These larger questions are the value options which, if unaddressed, may be settled by default of economic grounds. (shrink)

Earman and Ruetsche ([2005]) have cast their gaze upon existing no-go theorems for relativistic modal interpretations, and have found them inconclusive. They suggest that it would be more fruitful to investigate modal interpretations proposed for "really relativistic theories," that is, algebraic relativistic quantum field theories. They investigate the proposal of Clifton ([2000]), and extend Clifton's result that, for a host of states, his proposal yields no definite observables other than multiples of the identity. This leads Earman and Ruetsche to a (...) suspicion that troubles for modal interpretations of such relativistic theories "are due less to the Poincaré invariance of relativistic QFT vs. the Galilean invariance of ordinary nonrelativistic QM than to the infinite number of degrees of freedom of former vs. the finite number of degrees of freedom of the latter" (577-78). I am skeptical of this suggestion. Though there are troubles for modal interpretations of a relativistic quantum field theory that are due to its being a field theory—that is, due to infinitude of the degrees of freedom—they are not the only troubles faced by modal interpretations of quantum theories set in relativistic spacetime; there are also troubles traceable to relativistic causal structure. In particular, it is argued that the 'sense of understanding' that plays a critical role in the form of explanation implicated in the hard problem provides neither a necessary nor a sufficient condition on satisfactory scientific explanation. Considerations of the actual tools and methods available to scientists are used to make the case against it being a (...) necessary condition, and work by J.D. Trout that exploits psychological research on the hindsight and overconfidence biases is used to show that it is not a sufficient condition. It is argued, however, that certain intellectual and moral concerns give us good reason to still try to meet the hard problem's explanatory challenge, despite its extrascientific nature. (shrink)

This review essay emphasizes the distinction between academic art history, based ultimately on the model of scientific research, and the sort that Roberto Calasso practices in his 2009 study Tiepolo in Pink. It is difficult to locate the book's genre, and the reviewer rejects identifying it as a biography (of the sort practiced by Irving Stone, Somerset Maugham, and Dimitri Merejkovski), since Calasso, like most other writers on Tiepolo, stresses how little we know about his personality, which was elusive, and (...) about his private life, which was undramatic. What chiefly interests both Calasso and the reviewer is whether Tiepolo, whose ceiling frescoes are without gravity—their “antigravity” draws the painted figures upward—is an artist without gravitas. The reviewer supports Calasso's argument that the thirty-two etchings comprising the Capricci and Scherzi make it absurd to consider Tiepolo artistically, intellectually, or morally frivolous. “Scientific” art historians have applied the category of “decoration” to these somber etchings, with their incomprehensible allegories, but Calasso, himself an artist (a novelist), approaches these pictures without scientific prejudice. The reviewer traces the dour attitude of mainstream art historians toward Tiepolo to his rivalry for commissions in the 1760s with Anton Raphael Mengs, a representative of the rising Enlightenment cult of virtue and the austere aesthetics of a rising neoclassicism. From that time on, art historians have treated Tiepolo's work as unhealthy, lightweight, and bizarre, but this review supports Calasso's claim that his work is actually sober and moving. The review concludes that there are artists whom the narrow sensibility of standard art historians will never be able to accommodate, Tiepolo being only one among several. (shrink)

Husserl's explication of "self" and "others" occurs within his founding science of pure possibilities or "bracketed" consciousness and experience. His analysis of self and others seeks, in part, to demonstrate that "personal" or "self-experience" is not the only possibility of immanent consciousness but that "other persons" are also given as possibilities. The possibility of others, though in a form of givenness different from that of self, provides a basis for inter-subjectivity. Thus, Husserl's phenomenological analysis can, if it does avoid solipsism (...) and subjective idealism in general, establish inter-subjectivity as coextensive with subjectivity within the deepest possibilities of experience. Husserl's discussion of how the other as an external person or alien ego occurs as a given after all beliefs in an independently existing world are suspended (bracketed) shares some interesting parallels with psychological concepts and also suggests foundational possibilities for research on how the other is constituted as a separate "person" within our consciousness.
