Much has been written over the years regarding the norms, values, and ideals of modern science—in a word, what is expected of science and scientists. Most frequently, however, attention has focused on the conduct expected of scientists (e.g., Merton’s norms) rather than on the specific content expected of their scientific contributions, and attention has also tended to focus on the current scene rather than on the events that produced it. So. a kind of two-fold gap exists in our understanding of (...) our scientific heritage. Why is this important? Because it turns out that the two general ideals that have shaped the content of modern science right from the start seem to contradict each other. Nonetheless, they both have enjoyed weighty reasons offered in their defense and they both have exerted strong holds through the centuries on scientists and nonscientists alike, and still exert these holds. And the tradition has not offered any satisfying resolution. So, it is high time we deal with this situation. At least, that is what I attempt to do in this paper. (shrink)

The increasing application of artificial intelligence (AI) to healthcare raises both hope and ethical concerns. Some advanced machine learning methods provide accurate clinical predictions at the expense of a significant lack of explainability. Alex John London has defended that accuracy is a more important value than explainability in AI medicine. In this article, we locate the trade-off between accurate performance and explainable algorithms in the context of distributive justice. We acknowledge that accuracy is cardinal from outcome-oriented justice because it helps (...) to maximize patients’ benefits and optimizes limited resources. However, we claim that the opaqueness of the algorithmic black box and its absence of explainability threatens core commitments of procedural fairness such as accountability, avoidance of bias, and transparency. To illustrate this, we discuss liver transplantation as a case of critical medical resources in which the lack of explainability in AI-based allocation algorithms is procedurally unfair. Finally, we provide a number of ethical recommendations for when considering the use of unexplainable algorithms in the distribution of health-related resources. (shrink)

Understanding science requires appreciating the values it presupposes and its social context. Both the values that scientists hold and their social context can affect scientific communication. Philosophers of science have recently begun studying scientific communication, especially as it relates to public policy. Some have proposed “guiding principles for communicating scientific findings” to promote trust and objectivity. This paper contributes to this line of research in a novel way using behavioural experimentation. We report results from three experiments testing judgments about the (...) trustworthiness, competence and objectivity of scientists. More specifically, we tested whether such judgments are affected by three factors: consulting or not consulting nonscientists, conducting research under a restrictive or non-restrictive governmental communication policy, and the source of a lab’s funding (i.e., government funding, private funding, or a combination of the two). We found that each of these factors affects ordinary judgments of trustworthiness, competence and objectivity. These findings support several recommendations that could help improve scientific communication and communication policies. (shrink)

The critical realist conception of open and closed systems is not about systems: it is about regularities in the flux of events and states of affairs. It has recently been criticised on the grounds that critical realists should take on board ideas about the general nature of systems; recognise that genuinely open social systems would be impossible; avoid polarities or dualisms where either there are event regularities and open systems, or there are no event regularities and closed systems and accept (...) partial regularities and partially open systems; and understand that orthodox economics is not based upon event regularities, laws or Humean empiricism. Is it time to take a break from feminism? In this pathbreaking book, Janet Halley reassesses the place of feminism in the law and politics of sexuality. She argues that sexuality involves deeply contested and clashing realities and interests, and that feminism helps us understand only some of them. To see crucial dimensions of sexuality that feminism does not reveal--the interests of gays and lesbians to be sure, but also those of men, and of constituencies and values beyond the (...) realm of sex and gender--we might need to take a break from feminism. Halley also invites feminism to abandon its uncritical relationship to its own power. Feminists are, in many areas of social and political life, partners in governance. To govern responsibly, even on behalf of women, Halley urges, feminists should try taking a break from their own presuppositions. Halley offers a genealogy of various feminisms and of gay, queer, and trans theories as they split from each other in the United States during the 1980s and 1990s. All these incommensurate theories, she argues, enrich thinking on the left not despite their break from each other but because of it. She concludes by examining legal cases to show how taking a break from feminism can change your very perceptions of what's at stake in a decision and liberate you to decide it anew. (shrink)

This collection of contributions from both linguists and lawyers brings a pragmatic perspective to the linguistic basis for legal meaning and for finding a norm by which to decide a case. That is, it turns from notions of linguistic meaning as residing in the text, as literal meaning waiting to be dug out, to focus instead on how readers infer pragmatic meaning, and on the kinds of inferencing that characterise legal discourse.

This paper clarifies the terms “institutions” and “social structures” and related terms “rules”, “conventions”, “norms”, “values” and “customs”. Part one explores the similarities between institutions and social structures whilst the second and third parts explore differences. Part two considers institutions, rules, habits or habitus and habituation, whilst part three critically reflects on three common conceptions of social structures. In 1978, as the protests against the Shah of Iran reached their zenith, philosopher Michel Foucault was working as a special correspondent for _Corriere della Sera_ and _le Nouvel Observateur_. During his little-known stint as a journalist, Foucault traveled to Iran, met with leaders like Ayatollah Khomeini, and wrote a series of articles on the revolution. _Foucault and the Iranian Revolution _is the first book-length analysis of these essays on Iran, the majority of which have never before appeared in English. Institutional ethics committees (IECs) are part of a growing phenomenon in the American health care system. Although a major force driving hospitals to establish IECs is the desire to resolve difficult clinical dilemmas in a quick and systematic way, in this paper we argue that such a goal is naive and, to some extent, misguided. We assess the growing trend of these committees, analyse the theoretical assumptions underlying their establishment, and evaluate their strengths and shortcomings. We show how the 'medical (...) consultation' model is often inappropriately applied to IECs and suggest that IECs must operate under a different framework. Finally, we argue that IECs should be valued for the process they facilitate, and not for the product that they are, often unreasonably, expected to deliver. (shrink)

While powers and tendencies are among the most fundamen- tal concepts of critical realism, there are several problems with these concepts that have been ignored, avoided or glossed. The purpose of this paper, therefore, is to tease out these problems and provide clarification and consistency where possible. In the first section of the paper I sketch the existing critical realist conceptualization of tendencies by identifying eight distinct moments in a causal chain, denoted tendency1 to tendency8. In section two I ask: (...) Is there a difference between powers and tendencies? The answer, controversially perhaps, is: ‘No’. In section three I ask: What is the difference between tendency1 and tendency2? The answer considers two possible arguments accounting for the difference, and initiates a re-think of some of the terminology used to discuss tendencies as distinct moments in a causal chain. I conclude by raising the possibility that tendencies or powers are not of an either/or, discrete, dichotomous or discontinuous nature, but are continuous. This raises the further possibility that powers or tendencies can come in stronger and weaker forms. (shrink)

This article is a collective writing experiment undertaken by philosophers of education affiliated with the PESGB (Philosophy of Education Society of Great Britain). When asked to reflect on questions concerning the Philosophy of Education in a New Key in May 2020, it was unsurprising that the effects of the coronavirus pandemic on society and on education were foremost in our minds. We wanted to consider important philosophical and educational questions raised by the pandemic, while acknowledging that, first and foremost, it (...) is a human tragedy. With nearly a million deaths reported worldwide to date, and with everyone effected in one way or another by Covid-19, there is a degree of discomfort, and a responsibility to be sensitive, in reflecting and writing about it academically. Members of this ‘Covid Collective’ come from various countries, with perspectives from Great Britain and Ireland well represented, and we see academic practice as a globally connected enterprise, especially since the digital revolution in academic publishing. The concerns raised in this article relate to but move beyond Covid-19, reflecting the impact of neoliberalism [and other political developments] on geopolitics with educational concerns as central to our focus. Whilst the concept of causal powers is central to much post-positivist social science in general, and to critical realism in particular, it has not been significantly developed by critical realists since the initial work of Harré and Madden and Bhaskar in the mid-1970s. To deepen our understanding of powers we need to start with a ‘package’ of related terms. In §1 of the paper I introduce this package, clear up some terminological ambiguity and inconsistency, and focus the discussion upon things, (...) properties and powers. The real problems begin when we try to figure out how things, properties and powers relate to one another. In §2 I introduce and evaluate three possible ontologies: an ontology where powers are primary; an ontology where properties are primary; and an ontology where neither properties, powers are primary, but all emerge to form a unity. The last ontology is defended. §3 deals with ambiguities surrounding three other terms that often crop up when discussing powers, namely, dispositional properties, transfactuals and processes. The net result is a far less ambiguous concept of powers, firmly anchored in an ontology of things, properties and powers as a unity. (shrink)

Understanding contemporary environments in the laboratory and elsewhere requires grappling conceptually with multiple, coexisting, nonconforming infrastructures which actors engage at the same time. In this article, I develop the analytical vocabulary of “seams” for studying heterogeneous, multi-infrastructural environments. Drawing upon six years of ethnographic fieldwork with two distributed science teams, as well as studies in Ubiquitous Computing, I examine overlaps among infrastructures and how actors work creatively with and across their seams. Rather than suggesting that actors are hemmed in or (...) incapacitated by multiple infrastructural commitments, inclusions, and exclusions, I show instead how they work artfully to align them in ways concordant with membership and how this produces both consequences for their work and opportunities for analysis. This paper proposes communities of practice (CoP) as a process to build moral resilience in healthcare settings. We introduce the starting point of moral distress that arises from ethical challenges when actions of the healthcare professional are constrained. We examine how situations such as the current COVID-19 pandemic can exponentially increase moral distress in healthcare professionals. Then, we explore how moral resilience can help cope with moral distress. We propose the term collective moral resilience to capture the shared capacity arising (...) from mutual engagement and dialogue in group settings, towards responding to individual moral distress and towards building an ethical practice environment. Finally, we look at CoPs in healthcare and explore how these group experiences can be used to build collective moral resilience. (shrink)

Contrary to Vaesen's argument that humans are unique with respect to nine cognitive capacities essential for tool use, we suggest that although such cognitive processes contribute to variation in tool use, it does not follow that these capacities arenecessaryfor tool use, nor that tool use shaped cognition per se, given the available data in cognitive neuroscience and behavioral biology.
