A dilemma exists when a doctor is faced with a child or young person who refuses medically indicated treatment. The Gillick case has been interpreted by many to mean that a child of sufficient age and intelligence could validly consent or refuse consent to treatment. Recent decisions of the Court of Appeal on a child's refusal of medical treatment have clouded the issue and undermined the spirit of the Gillick decision and the Children Act 1989. It is now the case (...) that a child patient whose competence is in doubt will be found rational if he or she accepts the proposal to treat but may be found incompetent if he or she disagrees. Practitioners are alerted to the anomalies now exhibited by the law on the issue of children's consent and refusal. The impact of the decisions from the perspectives of medicine, ethics, and the law are examined. Practitioners should review each case of child care carefully and in cases of doubt seek legal advice. In our reply to Rowe, we explain why most of what he criticizes is actually the product of his misunderstanding our argument. We begin by showing that nearly all of his Part 1 misconceives our project by defending a position we never attacked. We then question why Rowe thinks the distinction we make between motivational and virtue intellectualism is unimportant before developing a defense of the consistency of our views about different desires. Next we turn to Rowe’s criticisms of our (...) account of the prudential paradox and show these criticisms to rest on a misunderstanding. We close with some remarks about the implausibility and textual problems Rowe faces in denying that Socrates recognized a role for painful punishments. (shrink)

Plato's "laches" is an investigation into the nature of courage with the intention of demonstrating the difficulty of singling out one virtue, namely courage, and defining it separately from the other cardinal virtues such as bravery, wisdom, justice, temperance, and piety. As the dialogue proceeds it becomes evident that socrates not only relates courage with the battlefield, but also with other spheres of life. Of special interest is his reference of being courageous regarding desires and pleasures where an overlap of (...) virtues is anticipated. This extension of the range of manifestations of courage indicates that his conception of courage transcends the traditional one in which he hints at a new sort of unity of courage and temperance, and on the other of courage and justice. One of plato's main aims in writing this dialogue was to mark out the intellectual limits of the two generals' positions, especially that of nicias, whose philosophical position could appear to be deceptively similar to the socratic one which he did not fully understand. Aristotle on the Perfect Life may be viewed as part of such a detailed study. In this book, Kenny discusses a series of topics relating to the central Aristotelian concept of the supreme good, and compares the treatment of these topics in the two treatises. He devotes separate discussions to the notions of finality, perfection, and self-sufficiency as attributes of the supreme good. He also considers the way in which friendship and good fortune relate to happiness. A theme which recurs (...) throughout the book is the divergent ways in which the EE and the NE conceive the relationship between moral excellence, contemplation and happiness. In some cases Kenny suggests that the EE offers a subtler treatment than the NE; in other cases he argues that the EE presents a more coherent, more plausible, position. Are we in a position, then, to conclude with confidence that the EE is the later, more authoritative, treatise? Kenny does not draw such a conclusion. One comes away with the impression that although he leans towards this conclusion, he also believes that still more work, especially on the EE, is needed. (shrink)

We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

ABSTRACTResistance to austerity in Ireland has until recently been largely muted. In 2013 domestic water charges were introduced and throughout 2014 a series of protests against the charges emerged, culminating in over 90 separate marches on November 1. In this paper we examine the discourses which are produced and circulated by politicians and the mainstream media about this protest movement, and offer a brief insight into the contemporary Irish context of austerity and crisis. We analyse the role of the phrase (...) ‘sinister fringe’ as a discursive device, and unpick the ways in which it has been used to explain the water charges protests to the Irish public. Our conclusions speak to the currency of the protest paradigm as a means of understanding news media reporting of protest. Ultimately we raise concerns regarding the effects of this dominant frame on deliberative democracy. (shrink)

ARISTOTLE thought his predecessors in general, and Plato in particular, made a serious mistake in failing to mark the boundaries separating the different sciences and branches of philosophical inquiry. All of them failed to grasp the fundamental distinction between practical and theoretical knowledge. Ethics and politics, the prime examples of practical knowledge, differ from such theoretical sciences as metaphysics and physics not only in their aims but in their methods and subject matter as well. Traditional methods for deriving property-based representations of concepts from text have focused on either extracting only a subset of possible relation types, such as hyponymy/hypernymy (e.g., car is-a vehicle) or meronymy/metonymy (e.g., car has wheels), or unspecified relations (e.g., car—petrol). We propose a system for the challenging task of automatic, large-scale acquisition of unconstrained, human-like property norms from large text corpora, and discuss the theoretical implications of such a system. We employ syntactic, semantic, and encyclopedic information to guide our extraction, (...) yielding concept-relation-feature triples (e.g., car be fast, car require petrol, car cause pollution), which approximate property-based conceptual representations. Our novel method extracts candidate triples from parsed corpora (Wikipedia and the British National Corpus) using syntactically and grammatically motivated rules, then reweights triples with a linear combination of their frequency and four statistical metrics. We assess our system output in three ways: lexical comparison with norms derived from human-generated property norm data, direct evaluation by four human judges, and a semantic distance comparison with both WordNet similarity data and human-judged concept similarity ratings. Our system offers a viable and performant method of plausible triple extraction: Our lexical comparison shows comparable performance to the current state-of-the-art, while subsequent evaluations exhibit the human-like character of our generated properties. Plato's dialogues form the basis of Socratic Ethics and Moral Psychology. Among Plato's thirty-five dialogues there is a group of eleven or twelve that share certain features setting them apart from the rest. In these dialogues, which are considerably shorter than the others, Socrates always has the role of questioner. The questions he discusses are mostly about specific virtues and how they are related to each other: for example, piety is discussed in the Euthyphro, courage in the Laches, temperance in (...) the Charmides, and justice and temperance in the Gorgias. A major theme of Socratic dialogues is Socrates' opposition to the “sophists,” a varied lot with different interests and claims to fame who shared certain characteristics that justified their common designation. Socrates debates the issue, if virtue is an art or skill that involves knowing what is truly good and evil, the virtuous person should be able to “size up” a situation and determine, as to what sort of action is called for to resolve a particular situation. We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

Reflection Principles are commonly thought to produce only strong axioms of infinity consistent with V = L. It would be desirable to have some notion of strong reflection to remedy this, and we have proposed Global Reflection Principles based on a somewhat Cantorian view of the universe. Such principles justify the kind of cardinals needed for, inter alia , Woodin’s Ω-Logic.

When it originated in the late 19th century, psychometrics was a field with both a scientific and a social mission: psychometrics provided new methods for research into individual differences, and at the same time, these psychometric instruments were considered a means to create a new social order. In contrast, contemporary psychometrics - due to its highly technical nature and its limited involvement in substantive psychological research - has created the impression of being a value-free discipline. In this article, we develop (...) a contrasting characterization of contemporary psychometrics as a value-laden discipline. We expose four such values: that individual differences are quantitative (rather than qualitative), that measurement should be objective in a specific sense, that test items should be fair, and that utility of a model is more important than its truth. Our goal is not to criticize psychometrics for employing these values, but rather to bring them into the open and to show that these values are not inevitable and are in need of systematic evaluation. When it comes to using patient data from the National Health Service for research, we are often told that it is a matter of trust: we need to trust, we need to build trust, we need to restore trust. Various policy papers and reports articulate and develop these ideas and make very important contributions to public dialogue on the trustworthiness of our research institutions. But these documents and policies are apparently constructed with little sustained reflection on the nature of trust (...) and trustworthiness, and therefore are missing important features that matter for how we manage concerns related to trust. We suggest that what we mean by ‘trust’ and ‘trustworthiness’ matters and should affect the policies and guidance that govern data sharing in the NHS. We offer a number of initial, general reflections on the way in which some of these features might affect our approach to principles, policies and strategies that are related to sharing patient data for research. This paper is the outcome of a ‘public ethics’ coproduction activity which involved members of the public and two academic ethicists. Our task was to consider collectively the accounts of trust developed by philosophers as they applied in the context of the NHS and to coproduce an argumentative position relevant to this context. I propose to demonstrate the clinical plausibility of the ‘psychotherapy scene’ of the Bacchae, which is subjected here to a purely psychiatric analysis: all my interpretations and conjectures are based on clinical data and psychiatric theory only. Euripides' objective and rational treatment of the irrational, the accuracy of his descriptions of abnormal behaviour, which are compatible, down to the last detail, with descriptions found in modern psychiatric texts, and his capacity to present not simply a partial list of symptoms, but (...) a coherent clinical picture are taken for granted and will not be discussed further in the present context. The focus of my enquiry is exclusively the psychiatric plausibility of Euripides' description of the psychotherapeutic process.It goes without saying that, since ‘instant cures’ are impossible, Euripides condensed a normally fairly long procedure into a single scene, selectively high-lighting only what would be the crucial moments of a real psychotherapy. His summary of the psychotherapy is as satisfactory as that of a modern psychiatrist. In fact, Euripides' masterly selectivity actually facilitates the understanding of the psychodynamics of Agave's recovery. This enables me to comment on the Euripidean text in exactly the same way as I commented on the verbatim transcript of the psychotherapy of one of my Plains Indian patients. (shrink)

Benson’s study is remarkable for unusual care and thoroughness in the development of its arguments, and the fairness of its treatment of rival interpretations. One can safely predict that future work on the topic will have to come to grips with his arguments and original interpretations.Benson begins with a careful analysis of the brief descriptions of the method in (...)
