Desde que Nozick publicou, em 1974, o clássico Anarquia, Estado e Utopia, muita tinta tem sido gasta na tarefa de discutir o que ficou conhecido como Teoria da Titularidade. Em linhas gerais, essa teoria busca estabelecer as condições de apropriação inicial, transferência e retificação de propriedade. Os filósofos ficaram especialmente interessados nas implicações anti-redistributivistas da argumentação de Nozick. Menos atenção, contudo, é dada à estrutura prévia de direitos individuais que Nozick ofereceu na primeira parte do livro. Será que ela pode (...) ser plausivelmente defendida? Neste artigo, defendo que ela sofre de tensões internas que a tornam uma base frágil para o projeto nozickiano. (shrink)

In this paper, I criticize two recent and influential arguments for no-platforming advanced by Robert Simpson and Amia Srinivasan and by Neil Levy, respectively. What both arguments have in common is their attempt to reconcile no-platforming with liberal values. For Simpson and Srinivasan, no-platforming does not contradict liberalism if grounded on the distinction between norms of free speech and norms of academic freedom; for Levy, those who defend the practice need not be accused of promoting paternalism. I argue that neither (...) view succeeds: these authors’ views are in strong tension with core tenets of liberalism. I proceed as follows: after introducing some basic liberal principles, I explain Simpson and Srinivasan’s argument in more detail and argue that it is too strong for some their stated purposes; then I proceed to show that both Simpson and Srinivasan and Levy’s arguments would justify extremely closed universities; finally, after arguing that Levy’s stance does not circumvent paternalism, I present some evidence that no-platforming would be captured by censors and probably threaten the very academic freedom that the authors want to protect. I argue that there are liberal reasons to reject what I call “Global Individualism”, which is the conjunction of two views strongly associated with liberalism: moral individualism and social individualism. According to the first view, all moral properties are reducible to individual moral properties. The second holds that the social world is composed only of individual agents. My argument has the following structure: after suggesting that Global Individualism does not misrepresent liberalism, I draw on some recent insights in social ontology (...) to show that it is inconsistent with the satisfaction of an important liberal principle related to the protection of individual rights over time. As I hold, to solve this problem we need to accept group agents acting as moral agents, which in turn commits us to the weaker notion of normative individualism (a view that is consistent with the existence of some group moral properties). I conclude with the suggestion that even this solution is costly for liberalism, for the conjunction of group moral agency and normative individualism makes the latter unstable and compels liberals to a much less individualistic stance than expected. My aim in this paper is to show a tension in the nozickian entitlement theory. The tension is between the enforcement of the rectification principle in ideal epistemic conditions and the first two clauses of the theory. In order to do that, I argue that the principle of rectification in the above conditions entails a weird theoretical result: it is better applied under relative ignorance than under ideal conditions, which suggests that Nozick’s theory is too rigid. The underlying point is (...) that Nozick neglects some important aspects concerning the effects of time in property claims. I finish the paper suggesting that we can face this problem in two ways and that both imply costs. The first one is to keep the theory as it was conceived, accepting the objection that it is, in a way, implausible. Or we can change the theory and weaken its purely historical character. And it is not clear how this can be done without raising difficulties. (shrink)

Minha intenção neste artigo é mostrar uma tensão na teoria da titularidade nozickiana. A tensão é entre a aplicação do princípio de retificação em condições epistêmicas ideais e as duas primeiras cláusulas da teoria. Para tanto, mostro que a aplicação do princípio nas condições acima descritas acarreta um resultado teoricamente estranho: ele é mais bem aplicado sob relativa ignorância do que em condições ideais, o que provavelmente indica que a teoria de Nozick é exageradamente rígida. A sugestão de fundo é (...) a de que Nozick ignora certos aspectos importantes a respeito do modo como encaramos os efeitos do tempo nas reivindicações de propriedade. Finalizo com a sugestão de que há dois modos de encarar o problema e que ambos implicam custos. O primeiro é manter a teoria tal como foi concebida e arcar com a objeção de que ela é, de certa maneira, implausível. Ou podemos alterar a teoria de modo a enfraquecer seu caráter puramente histórico. E não é claro como isso pode ser feito sem suscitar dificuldades. (shrink)

I will discuss the relationship between two different accounts of remedial duty ascriptions. According to one account, the beneficiary account, individuals who benefit innocently from injustices ought to bear remedial responsibilities towards the victims of these injustices. According to another account, the causal account, individuals who caused injustices ought to bear remedial duties towards the victim. In this paper, I examine the relation between the principles central to these accounts: the Beneficiary Pays Principle and the well-established principle of Strict Liability (...) in law. I argue that both principles display a strong yet unexplored similarity as they make certain kinds of causal connection sufficient for incurring liability. Because of this similarity, I suggest that insights into the Beneficiary Pays Principle can be gained from exploring its relation with Strict Liability. In particular, I examine two new positive arguments that could be adapted to support of the Beneficiary Pays Principle: the Minimising Injustice Argument and the Normative Connection Argument. However, I’ll show that only one of those arguments, namely the Normative Connection Argument, can truly support the Beneficiary Pays Principle. I conclude that, if you endorse the Normative Connection Argument for Strict Liability, you have at least a strong prima facie reason to endorse the parallel argument for the Beneficiary Pays Principle. According to the dominant account of forgiveness, to forgive is to overcome the reactive attitudes warranted by a wrongdoing. On one version of this ‘reactive attitudes’ account, forgiveness involves cognitive dissociation, while on another it involves affective dissociation. In this paper, I will argue that reflection on cases of repeated offences—where a wrongdoer is forgiven but then keeps repeating an offence—raises two challenges to this account of forgiveness. First, I will argue that, on either way of developing the account, it (...) has the implausible implication that those who forgive must avoid considering the forgiven wrongdoing in their deliberations. Second, I will argue that the reactive attitude account of forgiveness is vulnerable to the objection that it is epistemically vicious. But the reactive attitudes account of forgiveness needn’t be abandoned: I will propose several ways in which the account can be revised or clarified in order to address the problem of repeated offences. De acordo com a interpretação mais comum na literatura filosófica, Donald Davidson – que celebremente afirmou que “uma criatura não pode ter pensamentos a menos que tenha uma linguagem” – nega que criaturas não linguísticas são criaturas pensantes. No entanto, neste artigo argumento que esta interpretação é errada. Analisando atentamente os argumentos de Davidson, procuro mostrar que ele não está a argumentar que criaturas não linguísticas não podem possuir pensamentos; em vez disso, defendo que ele está simplesmente a afirmar que (...) na ausência de linguagem as atribuições de pensamento não podem ser vistas como mais do que meras ficções úteis que permitem explicar com êxito o comportamento daquelas criaturas. Faced with a national tragedy, citizens respond in different ways. Some will initiate debate about the possible connections between this tragedy and broader moral and political issues. But others often complain that this is too early, that it is inappropriate to debate such larger issues while ‘the bodies are still warm’. This paper critically examines the grounds for such a complaint. We consider different interpretations of the complaint—cynical, epistemic and ethical—and argue that it can be resisted on all of these (...) readings. Debate shortly after a national disaster is therefore permissible. We then set out a political argument in favour of early debate based on the value of broad political participation in liberal democracies and sketch a stronger argument, based on the duty to support just institutions, that would support a political duty to engage in debate shortly after tragedies have occurred. In a couple of short papers, Donald Davidson holds that a creature cannot think unless it is the interpreter of the speech of another. At first blush, speaking a language is, therefore, a necessary condition for thought. His controversial claims has led many to regard him as a follower of the Cartesian tradition wherein languageless creatures are nothing but mindless machines. Against this widely shared interpretation, in this paper we put forward a more charitable interpretation of Davidson’s claims. According to (...) our reading, Davidson never meant to argue that languageless creatures do not think. Instead, the only thing his arguments purport to show is that one will never be in a position to confirm that they do. This paper consists of a defense of the idea that Davidson is better seen as endorsing radical skepticism as to whether languageless creatures think. (shrink)

Philosophers discussing forgiveness have usually been split between those who think that forgiveness is typically virtuous, even when the wrongdoer doesn’t repent, and those who think that, for forgiveness to be virtuous, certain pre-conditions must be satisfied. I argue that Darwall’s second-personal account of morality offers significant theoretical support for the latter view. I argue that if, as Darwall claims, reactive attitudes issue a demand, this demand needs to be adequately answered for forgiveness to be warranted. In this paper, I aim to demonstrate the importance of liberal engagement in public debate, in the face of Nagel’s claim that respect for privacy requires liberals to withdraw from their ‘control of the culture’. The paper starts by outlining a pluralist conception of privacy. I then proceed to examine whether there really is liberal cultural control, as Nagel affirms it, and whether such control truly involves a violation of privacy. Moreover, I argue that Nagel’s desire to leave the social (...) and cultural space radically neutral is incompatible with Rawls’ conception of public reason and clashes with the need to justify liberal institutions. O artigo apresenta parte da monografia “ Estudo sobre o ensino remoto em macaé 2020-2021: estudo de caso com ênfase na exclusão social” (Dez.2022). Investigou-se o ensino ofertado, atentando para as políticas de acesso, desigualdades sociais e econômicas no período remoto. Como metodologia definiu-se a Qualitativa, Descritiva e a Quantitativa na análise dos dados. Parte deles capturou-se em páginas virtuais e em documentos oficiais. Além de Estudo de Caso amostral em 3 escolas municipais. Aplicou-se questionário aos professores e entrevista com (...) gestores, objetivando averiguar o contexto social dos alunos na elaboração das medidas emergenciais, estudo da evasão escolar, acesso ao ensino online e/ou disponibilização de ensino não presencial, sem uso de tecnologias. Concluiu-se que os métodos foram transpostos para o meio digital, os profissionais não dispunham de recursos para uma metologia específica, havendo aumento do abandono e evasão escolar e que o CFCG foi suporte para os profissionais da rede. Este artigo parte da compreensão do campo da política pública, considerando-o como espaço de disputas. Ao pensar a formação continuada como uma política pública apresenta-se o Ciclo de Políticas (SECCHI, 2012; 2016), como referencial de análise, para discussão de possibilidades. Utiliza-se como instrumento de pesquisa a observação em quatro escolas públicas, em turmas de quinto anos, no município de Macaé/RJ e aplicação de questionários semiestruturados junto aos professores. A elaboração de uma questão discursiva serviu como objeto de análise para o (...) estudo aqui apresentado. A partir da identificação dos problemas relativos à formação continuada realizou-se reflexão acerca de soluções e alternativas, apresentadas em uma matriz de avaliação. O modelo de formação tido como recomendação de solução ao problema diagnosticado passa por algumas etapas. Acredita-se que a aplicação dessa metodologia de análise pode vir a ser um gerador de política de formação continuada, possibilitando maior interação dos professores em sua formação. (shrink)

A proposta desta coletânea de ensaios, em sua décima edição, é reunir pesquisas que refletem sobre as fronteiras entre educação e leitura. Elas, também, de alguma forma, pelos seus recortes, revelam a errância do pensamento e da práxis, mostram caminhos pelos quais a leitura e a pesquisa transitam e dialogam atualmente. Seus dez ensaios versam sobre os mais variados aspectos: há aqui desde de leituras críticas pontuais, a leituras que enfocam aspectos propriamente teóricos com relação à tópicos de leitura comparatista.

O presente estudo tem como objetivo conhecer os sentidos produzidos por ouvidores de vozes sobre suas experiências com as vozes. Trata-se de uma pesquisa qualitativa de caráter exploratório. Se deu através de entrevistas semi-estruturadas realizadas com dezesseis ouvidores de vozes usuários de um Centro de Atenção Psicossocial da cidade de Pelotas/RS. Evidenciou-se que o sentido que o ouvidor atribui às vozes é subjetivo, individual, e dependente de fatores externos, como os discursos a que esse ouvidor é exposto no seu meio (...) histórico e social ao longo do tempo. Fica nítida a importância de não se minimizar as características e os conteúdos das vozes, a fim de auxiliar os ouvidores a estabelecerem sentidos e possíveis relações com suas histórias de vida. A proposta central deste trabalho é refletir como a relação entre os grandes dados (big data) e o sujeito contemporâneo, explorando o conceito de Colonialismo de Dados. O estudo busca analisar as semelhanças entre as relações de dados na sociedade atual e o colonialismo histórico, examinando as implicações sociais, políticas e econômicas dessa dinâmica. Os autores argumentam que o colonialismo de dados envolve a extração e o gerenciamento universal de dados das pessoas, resultando em uma nova ordem social baseada no (...) rastreamento constante. Tem como objetivo analisar como o colonialismo de dados envolve a extração de recursos, representados pelos dados pessoais das pessoas, que são coletados, armazenados e utilizados por empresas para diversos fins econômicos. Esse fenômeno é sustentado por uma ideologia que promove a coleta e o uso de dados como algo benéfico e necessário, criando um ambiente onde os indivíduos são incentivados a compartilhar seus dados sem compreender completamente as implicações. Além disso, o artigo discute o papel do capitalismo nas relações de dados, destacando como o capitalismo afirma a identidade do "eu" como um ponto de referência único, mas também elementos essenciais da continuidade e transformação do self ao instalar vigilância automatizada no espaço do self. O estudo também aborda a importância da identidade pessoal como um elemento essencial, enfatizando a necessidade de abandonar a reivindicação de uma universalidade absoluta que caracteriza o colonialismo de dados. O objectivo deste artigo é a exploração de duas perspectivas contrastantes das teses de Leibniz sobre a Vida Feliz: numa, a felicidade depende da razão iluminada e da compreensão. A razão e a sabedoria são os verdadeiros fundamentos da felicidade, e se alcançarmos essa “Ciência da felicidade”, encontrá-la-emos, sem qualquer dúvida. A outra perspectiva apresenta-nos a finitude humana, a confusão que rege muitas vezes a própria vida, a fraqueza da vontade e os limites da razão, como obstáculos para a felicidade (...) e a tranquilidade. Efectivamente, a verdadeira felicidade só se pode encontrar na “delectatio in felicitate alterius”, em suma, no amor a Deus. Estas diferentes perspectivas podem entender-se como o contraste entre uma felicidade ideal que todo o homem deseja e a realidade da condição humana e da sua indigência. (shrink)

A pesquisa acadêmica exige uma gama de procedimentos. Cada área desenvolve seus métodos, que são avaliados pelos resultados da qualidade das pesquisas. Para quem se inicia nesse processo, conhecer esses passos e procedimentos é muito significativo e definidor da formação do pesquisador. O presente texto, nascido na área de Ciências da Religião e Teologia, tem por objetivo a apresentação do método que foi desenvolvido pelo autor, professor convidado do Programa de Pós-graduação em Ciência da Religião da UFJF – PPCIR-UFJF, em (...) mais de três décadas de orientação, pesquisa e aprendizado. O artigo foi produzido a partir da experiência adquirida das orientações e mostra as condições fundamentais para o trabalho acadêmico, especialmente indicadas por João Batista Libanio, mas também por outros pesquisadores. A parte central do texto é a sistematização do método de orientação acadêmica denominado “método eletrônico”, termo criado por Libanio, e assumido pelo autor em suas mais de cinquenta orientações. Além de indicar os passos desse método, com observações importantes e práticas, há um exemplo de aplicação sobre como elaborar um artigo. (shrink)

In this study, we investigated endorsement of two types of prescriptive views of aging, namely active aging and altruistic disengagement. The study comprised a large international sample of middle-aged and older adults, covering the age range from 40 to 90 years. Participants rated their personal endorsement of prescriptive views of active aging and altruistic disengagement targeting older adults in general. Findings showed that endorsement was higher for prescriptions for active aging than for prescriptions for altruistic disengagement. Age groups in the (...) sample differed regarding their endorsement of both prescriptive views of active aging and altruistic disengagement with older adults showing higher endorsement than middle-aged adults did. Prescriptive views of active aging and altruistic disengagement related positively to each other and to the superordinate social belief that older adults should not become a burden, which attests to their functional similarity. In contrast, prescriptive views of active aging and altruistic disengagement were associated with psychological adjustment in opposite ways, with endorsement of active aging being related to better adjustment outcomes such as life satisfaction and subjective health. Our findings highlight the internalization of prescriptive views of aging in older people and their implications for their development and well-being. (shrink)

I will argue here a) that we have a right to have opportunities to meaningful relationships, b) that such a right is distinct from a right focusing only on protecting access to more basic social interactions, and c) that to the extent that we have rights to both kinds of social interactions, the one focused on more meaningful relationships should have priority because it secures an interest of greater importance for us.
