Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. L’émergence de l’exégèse moderne et contemporaine s’est faite par singularisation et autonomisation par rapport à la globalité d'un horizon théologique, ce qui n’alla pas sans sérieux conflits avec les théologiens. Un espace s’aménagea progressivement pour une lettre étudiée selon les règles de la critique, valorisant ainsi le grammairien ou le philologue aux dépens du théologien. Ainsi Richard Simon, en 1678, reconnaissait-il deux sens à la Bible : le littéral et le théologique, qu’il appelle encore spirituel ou mystique. Le critique laisse (...) aux théologiens et aux pasteurs d'âmes le soin d’enseigner le sens spirituel. Il admet que le sens littéral n’a pas toujours vocation à nourrir la foi des fidèles ; sa seule demande est qu’on veuille bien lui laisser le soin de le fixer selon les lois de la critique historique et philologique, et donc de l’enlever à l’emprise que la théologie a sur lui. Over the last few decades, multiple studies have examined the understanding of participants in clinical research. They show variable and often poor understanding of key elements of disclosure, such as expected risks and the experimental nature of treatments. Did the participants in these studies give valid consent? According to the standard view of informed consent they did not. The standard view holds that the recipient of consent has a duty to disclose certain information to the profferer of consent because valid (...) consent requires that information to be understood. The contents of the understanding and disclosure requirements are therefore conceptually linked. In this paper, we argue that the standard view is mistaken. The disclosure and understanding requirements have distinct grounds tied to two different ways in which a token of consent can be rendered invalid. Analysis of these grounds allows us to derive the contents of the two requirements. It also implies that it is sometimes permissible to enroll willing participants who have not understood everything that they ought to be told about their clinical trials. (shrink)

D’abord utilisé dans le domaine financier, le pourcentage est incorporé, en 1662, par Graunt dans le champ des études de mortalité; au début du xix e siècle, il migre vers les études de croissance de la population, puis il gagne d’autres territoires pour devenir un outil d’application générale. Chaque migration s’inscrit dans le cadre de l’émergence d’une nouvelle problématique: « naissance de la mortalité » (...) dans un cas; « naissance de la population » dans l’autre. We argue that there is a conflict among classical theism's commitments to divine simplicity, divine creative freedom, and omniscience. We start by defining key terms for the debate related to classical theism. Then we articulate a new argument, the Aloneness Argument, aiming to establish a conflict among these attributes. In broad outline, the argument proceeds as follows. Under classical theism, it's possible that God exists without anything apart from Him. Any knowledge God has in such a world would be wholly (...) intrinsic. But there are contingent truths in every world, including the world in which God exists alone. So, it's possible that God contingently has wholly intrinsic knowledge. But whatever is contingent and wholly intrinsic is an accident. So, God possibly has an accident. This is incompatible with classical theism. Finally, we consider and rebut several objections. (shrink)

Hans KELSEN, le plus célèbre philosophe du droit issu du rang des juristes, est surtout connu pour avoir fondé une école juridique (l'Ecole de Vienne) qui radicalise la doctrine du positivisme juridique. Il a défendu, sa vie durant, une conception normativiste du droit et la thèse d'une stricte séparation entre le droit et la science du droit. Si l'on connaît bien en France son ouvrage programmatique sur la Théorie pure du droit, dans sa deuxième édition traduite par Charles Eisenmann, on (...) sait au moins que cette seconde édition, publiée en 1960, n'est pas l'expression définitive de sa pensée. La traduction de la Théorie générale des normes, qui est un ouvrage posthume et inachevé, donne au lecteur français l'occasion de découvrir cette pensée dans ses derniers développements qui rompent en partie avec ceux de l'œuvre précédente. Le Maître viennois y poursuit l'analyse de la norme juridique, entamée dans la Théorie pure du droit, mais il l'approfondit sur certains points et l'infléchit sur d'autres. Il introduit ainsi de nouvelles réflexions sur la signification de la norme et sur ses fonctions, sur l'application et l'interprétation de la norme et également sur le rapport entre la norme et le langage, insistant notamment sur la distinction entre la norme et l'énoncé sur la norme. Par ailleurs, il considère la religion et le droit comme deux ordres normatifs similaires, ce qui le conduit à proposer une théorie vraiment " générale " des normes et non pas seulement une théorie juridique des normes. Il avance une nouvelle interprétation de la norme fondamentale en recourant à l'idée de fiction juridique. Enfin, dans la dernière partie du livre, Kelsen donne le dernier état de sa pensée sur le problème majeur de l'application de la logique au droit. Rompant avec son logicisme antérieur, il nie l'existence d'une logique spécifique au droit et conteste l'application de la logique syllogistique au processus d'application du droit, renouant ainsi avec un volontarisme juridique qu'il avait rejeté au début de son œuvre. Dans cet ouvrage, sous couvert de bâtir une théorie générale des normes, Kelsen construit une théorie de l'interprétation des normes. Il propose donc une herméneutique juridique originale qui intéressera tous ceux qui étudient les sciences normatives (juristes, mais aussi théologiens et spécialistes de l'éthique). Il engage un dialogue avec les représentants anglo-américains de la philosophie du droit, de l'éthique ou de la logique, et il renoue le dialogue avec les auteurs influents à Vienne au début du siècle. Le présent article porte sur les débats relatifs à la Forme que doit prendre l'appareil de collecte de données statistiques pour faire face aux transformations que connaissent les sociétés occidentales depuis le début du XIXe siècle. C'est au moment de la mise sur pied, en 1832, du Bureau statistique du Board of Trade britannique que sont avancés pour la première fois les arguments en faveur de la coordination, de la centralisation ou de la décentralisation en matière statistique. Jusqu'en 1945, ce (...) débat sera un des mieux alimentés, le décollage des économies, les guerres mondiales, la crise des années trente offrant aux protagonistes l'occasion de s'interroger sur la forme que doit prendre le système de collecte et d'analyse des données statistiques. La perspective que nous adopterons ici se distingue par sa double amplitude: ainsi, ne nous limitant pas aux grands systèmes statistiques, ceux de GrandeBretagne, de France et des États-Unis, nous croiserons les fils des histoires nationales de la plupart des pays occidentaux; de plus, ne nous en tenant pas à la période où naissent la plupart des bureaux statistiques, soit le XIXe siècle, nous embrasserons l'ensemble de la période s'étendant de 1800 à 1945. Grand relecteur des mythes, Michel Tournier revient régulièrement, dans son oeuvre, sur la Genèse. Ses grands héros pervers, particulièrement Abel Tiffauges du Roi des Aulnes, soumettent le texte à une herméneutique du détournement et de l’inversion. Ils font ainsi apparaître dans le texte biblique la figure de l’androgyne primitif dont ils tirent des considérations éthiques et esthétiques sur la relation de l’homme et de la femme. Quant à Caïn et Abel, ils deviennent les supports d’un système binaire qui est une (...) des grandes caractéristiques de l’herméneutique tournérienne. Négligeant la dimension instauratrice et fondatrice du mythe biblique, Tournier rappelle plutôt, dans ses interprétations, le monde de la mystique juive occupée à scruter ce qui était avant la création. Mais chez le romancier, elles sont toutes affectées par le grand détournement pervers. As a great re-reader of myths, Michel Tournier regularly returns to Genesis in his work. His great, depraved heroes, especially Abel Tiffauges from Rois des Aulnes, subject the text to a hermeneutic of corruption and inversion. In this way, they bring forth from the biblical text the figure of primitive androgyny, from which they draw ethical and aesthetic considerations on the male-female relationship. As for Cain and Abel, they become the basis of a binary system that is one of the great characteristics of Tournier’s hermeneutic. By neglecting the founding dimension of the biblical myth, Tournier evokes, in his interpretations, the world of Jewish mysticism, which seeks to peer into that which existed before creation. This paper provides a sketch of a fresh conception of the “metaphysics” of culture and a sense of its conceptual power and advantages, based on a post-Darwinian account of the artifactual, hybrid nature of a person, chiefly in terms of (what I treat as terms of art) Bildung (“external” and “internal”), Sittlichkeit (both descriptive and normative), and interpretation (diversely manifested in different sectors of inquiry). I consider the (“metaphysical”) relationship between membership in the species Homo sapiens sapiens and functioning as (...) a person the generic distinction of human cultures (enlanguaged cultures), which I call Intentionality (that is, whatever is culturally significant or significative); and the bearing of the thesis on familiar philosophical quarrels and theory of the sciences. There is a growing body of empirical evidence which shows that infants and non-human primates have the ability to represent the mental states of other agents, i.e. that they possess a Theory of Mind. We will argue that this evidence also suggests that infants and non-human primates possess the concept of truth, which, as we will explain, is good news for primitivists about truth. First, we will offer a brief overview of alethic primitivism, focusing on Jamin Asay’s conceptual version of (...) the view. Next, we will survey relevant work on Theory of Mind which indicates that children younger than two and non-human primates are able to attribute false beliefs. Then, we will bring these false-belief data to bear on Asay’s form of primitivism, arguing that the data support two of the four distinctive theses of this view and offering some remarks about the empirical evaluability of the two remaining theses. We hope that our discussion will help to bridge the gap between psychological and philosophical inquiry and that it will encourage further empirical research on the cognitive significance of the concept of truth for humans and other thinking creatures. The target articles by Dixon (2012), Scarantino (2012), and Mulligan and Scherer (2012) explore the nature of emotion from philosophical and psychological perspectives. I discuss how neuroscience can also contribute to debates about the nature of emotion. I focus on the aspects of emotion that usually fall within the topic of basic emotions, but conclude that we may need to revise how we conceive and study these kinds of emotional states in relation to the brain.

Belief storage is often modeled as having the structure of a single, unified web. This model of belief storage is attractive and widely assumed because it appears to provide an explanation of the flexibility of cognition and the complicated dynamics of belief revision. However, when one scrutinizes human cognition, one finds strong evidence against a unified web of belief and for a fragmented model of belief storage. Using the best available evidence from cognitive science, we develop this fragmented model into (...) a nascent theory of the cognitive architecture of belief storage. (shrink)
