Resumo: A concepção moderna de literatura idealizou a linguagem literária como um jogo de linguagem à parte dos demais, uma dimensão do sentido que seria "poética", não parafraseável nos seus sentidos figurados, incomensurável relativamente à linguagem ordinária. O romantismo instituiu como o valor literário central uma idéia de autenticidade, fundada no mentalismo introspectivo. Contrapondo-se à concepção de linguagem como expressão mentalista, corrente no romantismo, muitos formalistas situam o significado como intrínseco à estrutura da linguagem, e atribuem ao uso literário da (...) linguagem um peculiar caráter polissêmico. É como se, para rejeitar a mimese clássica da duplicação da natureza e a mimese interior expressivista, houvesse que esvaziar de sentido o problema da relação entre linguagem e mundo. Um dos pontos chave da defesa da autonomia da linguagem literária através da afirmação de sua polissemia peculiar tem sido a refutação da aplicabilidade da noção de intencionalidade. No entanto, trata-se de questões diversas. Oferece-se um contra-argumento à tese central de "A falácia Intencional" , de Wimsatt e Beardsley. O Gedankenexperiment do poema encontrado nas areias da praia não é adequado para ilustrar um argumento antiintencionalista porque pressupõe o que pretende negar, velando os critérios de aplicação dos verbos de comunicação . Estes critérios apontam para a intencionalidade, e para o espaço extratextual.: the modern conception of literature idealized literary language as language game different from others, a "poetic" dimension of sense, non-paraphrasable in its figurative senses, incommensurable as regards the ordinary language. Romanticism sets as its central value an idea of authenticity, founded on an introspective mentalism. As a counterpoint to the concept of language as a mentalist expression, present in romanticism, many formalists thought meaning as intrinsic to the structure of language, ascribing a peculiar polissemic character to the literary use of language. It is as if, in order to reject the classic mimesis of the duplication of nature as well as the inner mimesis of expressivism, one should void of sense the problem of the relation between language and world. One of the key points of the defense of literary language's autonomy through the avowal of its peculiar polissemy has been the refutation of the applicability of the notion of intentionality. However, these are diverse questions. A counter argument is offered to the central thesis of Wimsatt and Beardsley's "the Intentional Fallacy" . The Gedankenexperiment of the poem found on the beach sand is not adequate as an illustration of an anti-intentionalist argument because it presupposes what it sets itself to deny, veiling the criteria of application of communication verbs . Contudo, foi levada longe demais, ao sugerir uma imagem da linguagem composta apenas de inferências à maneira dos sistemas de regras fechados. Isto embargaria certa expansão pragmática do contexto criterial da análise conceitual. Mas a aplicabilidade do símile do cálculo não é invalidada. A metáfora será reativada em manuscritos posteriores, sempre e quando puder servir aos mesmos propósitos do período intermediário, à medida que o ambiente dialógico convoque novas vozes dogmaticamente referencialistas. Ainda assim, é nos manuscritos intermediários que melhor se esclarece o seu funcionamento. Tal movimento exemplifica, por fim, um método filosófico que não procede por meio da superação de problemas à maneira científica. (shrink)

Literatura e arte, por um lado, e discurso argumentativo, por outro, soem situar-se em campos opostos, de tal maneira que maximizar um é minimizar o outro. Mais ainda se restringimos os conceitos a poesia e lógica. Quando ensaiamos contrastar esses campos do discurso, listas de atributos distintivos necessários e suficientes, ou mesmo a noção de função, parecem recursos pobres para dar conta do papel que esses conceitos desempenham. Pensamos, com isso, no que Wittgenstein gostava de chamar de rituais de uma (...) forma de vida – os quais haveria que descrever com mais perspicuidade para fazer justiça ao contraste sugerido, se quisermos ser mais prudentes com tal oposição. O texto é um chamado a essa prudência.: Literature and art, on the one hand, and argumentative discourse on the other are usually placed opposite to each other, in such a way that to maximize the one is to minimize the other. Even more so if we restrict the relevant concepts to those of poetry and logic. When we try to contrast these fields of discourse, lists of distinctive, necessary and sufficient attributes – or even the notion of function – seem to be poor instruments to describe the role played by those concepts. We think here of what Wittgenstein liked to call rituals of a form of life – which one should describe more perspicuously in order to do justice to the suggested contrast, if prudence shoud preside over such opposition. Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Este artículo se propone analizar las representaciones narrativas de las migraciones centroamericanas hacia los Estados Unidos, en su paso por México, tal como son elaboradas en las novelas Amarás a Dios sobre todas las cosas (2013), del escritor mexicano Alejandro Hernández y La mara (2004), del también mexicano Rafael Ramírez Heredia. Nos enfocaremos en dos temas que consideramos de mayor importancia en ambas obras para comprender la Centroamérica de hoy: el papel que juega el concepto de camino para el (...) migrante de Amarás a Dios sobre todas las cosas (2013) y el de entre-lugar en La mara (2004). La reflexión que planteamos en este artículo forma parte de una discusión más amplia desarrollada en nuestra tesis doctoral, que tuvo como eje central las migraciones centroamericanas hacia los Estados Unidos y las representaciones que de estas se hacen en la narrativa contemporánea de la región centroamericana. Interesan de manera particular esos dos textos porque trabajan de manera diferente ambos aspectos –el cronotopo del camino y la noción de entre-lugar–, al mismo tiempo que forman parte de un creciente corpus de novelas que tienen como tema central los movimientos migratorios en la región. In recent years, online “involuntary celibate” or “incel” communities have been linked to various deadly attacks targeting women. Why do these men react to romantic rejection with not just disappointment, but murderous rage? Feminists have claimed this is because incels desire women as objects or, alternatively, because they feel entitled to women’s attention. I argue that both of these explanatory models are insufficient. They fail to account for incels’ distinctive ambivalence toward women—for their oscillation between obsessive desire and violent hatred. (...) I propose instead that what incels want is a Beauvoirian “Other.” For Beauvoir, when men conceive of women as Others, they represent them as simultaneously human subjects and embodiments of the natural world. Women function then as sui generis entities through which men can experience themselves as praiseworthy heroes, regardless of the quality of their actions. I go on to give an illustrative analysis of Elliot Rodger’s autobiographical manifesto, “My Twisted World.” I show how this Beauvoirian model sheds light on Rodger’s racist and classist attitudes and gives us a better understanding of his ambivalence toward women. It therefore constitutes a powerful and overlooked theoretical alternative to accounts centered on objectification and entitlement. (shrink)

One of the key insights of Simone de Beauvoir’s The Second Sex is the idea that gender-based subordination is not just something done to women, but also something women do to themselves. This raises a question about ethical responsibility: if women are complicit, or actively implicated in their own oppression, are they at fault? Recent Beauvoir scholarship remains divided on this point. Here, I argue that Beauvoir did, in fact, ethically criticize many women for their complicity, as a sign of (...) what she called “bad faith”. I challenge recent accounts by Nancy Bauer and Manon Garcia, who both read Beauvoir as exonerating complicit women. According to this reading, women emerge as human “freedoms” within a social world where a “destiny” of inferiority is already prepared for them. Their self-subordination is then an inevitable product of acting in a patriarchal world. I argue, however, that this interpretation generates a crucial tension, leading Bauer and Garcia to call on women to stop being complicit, while also claiming they cannot avoid complicity. I propose instead a different interpretation, on which feminine complicity is often fueled by criticizable ethical attitudes that are far from inevitable. By revisiting Beauvoir’s notion of “bad faith”, I show that this account is compatible with recognizing the limitations imposed on women’s agency and I show that this feminist ethical criticism is itself an important part of a collective project of social transformation. At the end of 2017, Kristen Roupenian’s short story, Cat Person, went viral. Published at the height of the #MeToo movement, it depicted a ‘toxic date’ and a disturbing sexual encounter between Margot, a college student, and Robert, an older man she meets at work. The story was widely viewed as a relatable denunciation of women’s powerlessness and routine victimization. In this paper, I push against this common reading. I propose an alternative feminist interpretation through the lens of Simone de (...) Beauvoir’s notion of narcissism: a form of alienation that consists in making oneself both the subject and the ultimate project of one’s life. Framing Margot as a narcissist casts her as engaging, not in subtly coerced, undesired sex, but rather in sex that is desired in a tragically alienated way. I argue that Beauvoir’s notion of narcissism is an important tool for feminists today – well beyond the interpretation of Cat Person. It presses us to see systematic subordination not just as something done to women, but also as something women do to themselves. This in turn highlights the neglected role of self-transformation as a key aspect of feminist political resistance. (shrink)

Aesthetic hedonism is the view that to be aesthetically good is to please. For most aesthetic hedonists, aesthetic normativity is hedonic normativity. This paper argues that Kant's third critique contains resources for a non-hedonic account of aesthetic normativity as sourced in autonomy as self-legislation. A case is made that the account is also Kant's because it ties his aesthetics into a key theme of his larger philosophy.

As with many other countries, Malaysia is also developing and promoting biomedical research to increase the understanding of human diseases and possible interventions. To facilitate this development, there is a significant growth of biobanks in the country to ensure continuous collection of biological samples for future research, which contain extremely important personal information and health data of the participants involved. Given the vast amount of samples and data accumulated by biobanks, they can be considered as reservoirs of precious biomedical big (...) data. It is therefore imperative for biobanks to have in place regulatory measures to ensure ethical use of the biomedical big data. Malaysia has yet to introduce specific legislation for the field of biobanking. However, it can be argued that its existing Personal Data Protection Act 2010 has laid down legal principles that can be enforced to protect biomedical big data generated by the biobanks. Consent is a mechanism to enable data subjects to exercise their autonomy by determining how their data can be used and ensure compliance with legal principles. However, there are two main concerns surrounding the current practice of consent in biomedical big data in Malaysia. First, it is uncertain that the current practice would be able to respect the underlying notion of autonomy, and second, it is not in accordance with the legal principles of the PDPA. Scholars have deliberated on different strategies of informed consent, and a more interactive approach has recently been introduced: dynamic consent. It is argued that a dynamic consent approach would be able to address these concerns. (shrink)

The Farm to Fork (F2F) Strategy at the heart of the European Union’s Green Deal set out to create a “just transition” towards a sustainable food system, with benefits for all actors. We conducted a critical discourse analysis (CDA) to explore discourses around power in the food system and farmers’ position in the communication and implementation of the Farm to Fork Strategy. Discourse analysis encapsulates various scientific methodologies for deciphering the meaning behind the creation and communication of different forms of (...) language and identify power dynamics, amongst other aspects. We identified two prior discourses in one of the objectives of the European Union’s new Common Agricultural Policy (2023-27). Our analysis found that the discourses, namely “rebalance power in food system” and “strengthening farmers’ position in value chains,” are marginalized in favour of an innovation-investment discourse, indicative of greater financialization and technologization based on techno-finances fixes in transforming the European Union agri-food system. We argue that entities representing agri-business interests have been influential in the policymaking process and voices representing smallholder and medium-sized farmers’ transformational discourses have been excluded. The past decade has seen major movements and mobilizations against the new crop of bilateral free trade and investment agreements being pursued by governments in the wake of the failure of global (World Trade Organization) and regional (e.g. Free Trade Area of the Americas) negotiations, and the defeat of an attempted Multilateral Agreement on Investment in the 1990s. However, in spite of much scholarly, non-governmental organization (NGO) and activist focus on transnational global justice activism, many of these movements, such as (...) the major multi-sectoral popular struggle over the recently-concluded US-Korea Free Trade Agreement, are hardly acknowledged in North America and Europe. With a shift in emphasis pushing liberalization and deregulation of trade and investment increasingly favouring lower-profile bilateral agreements, this article maps the resistance movements to these latest shifts in global free market capitalist relations and discusses the disconnect between these (mainly Southern) struggles and dominant scholarly and NGO conceptions of global justice and the global justice movement as well as questions of knowledge production arising from these movements. Aesthetic values give agents reasons to perform not only acts of contemplation, but also acts like editing, collecting, and conserving. Moreover, aesthetic agents rarely operate solo: they conduct their business as integral members of networks of other aesthetic agents. The consensus theory of aesthetic value, namely that an item’s aesthetic value is its power to evoke a finally valuable experience in a suitable spectator, can explain neither the range of acts performed by aesthetic agents nor the social contexts in which (...) they operate. This paper proposes a new theory of aesthetic value specifically to explain facts about the sociality of aesthetic agents. (shrink)

The representation of color by pictures raises worthwhile questions for philosophers and psychologists. Moreover, philosophers and psychologists interested in answering these questions will benefit by paying attention to each other's work. Failure to recognize the potential for interdisciplinary cooperation can be attributed to tacit acceptance of the resemblance theory of pictorial color. I argue that this theory is inadequate, so philosophers of art have work to do devising an alternative. At the same time, if the resemblance theory is false, then (...) color depiction has interesting implications for color science. Empirical researchers must rethink the widespread assumption that color recognition requires color constancy. I suggest that a neuropsychological account of color recognition will be instrumental to completing the philosophical task, but by the same token scientists might do well not to proceed without casting an eye to the work of philosophers of art. This paper presents an experience in developing professional ethics by an approach that integrates knowledge, teaching methodologies and assessment coherently. It has been implemented for students in both the Software Engineering and Computer Engineering degree programs of the Technical University of Madrid, in which professional ethics is studied as a part of a required course. Our contribution of this paper is a model for formative assessment that clarifies the learning goals, enhances the results, simplifies the scoring and can be replicated (...) in other contexts. A quasi-experimental study that involves many of the students of the required course has been developed. To test the effectiveness of the teaching process, the analysis of ethical dilemmas and the use of deontological codes have been integrated, and a scoring rubric has been designed. Currently, this model is also being used to develop skills related to social responsibility and sustainability for undergraduate and postgraduate students of diverse academic context. (shrink)

Two systems of belief change based on paraconsistent logics are introduced in this article by means of AGM-like postulates. The first one, AGMp, is defined over any paraconsistent logic which extends classical logic such that the law of excluded middle holds w.r.t. the paraconsistent negation. The second one, AGMo , is specifically designed for paraconsistent logics known as Logics of Formal Inconsistency (LFIs), which have a formal consistency operator that allows to recover all the classical inferences. Besides the three usual (...) operations over belief sets, namely expansion, contraction and revision (which is obtained from contraction by the Levi identity), the underlying paraconsistent logic allows us to define additional operations involving (non-explosive) contradictions. Thus, it is defined external revision (which is obtained from contraction by the reverse Levi identity), consolidation and semi-revision, all of them over belief sets. It is worth noting that the latter operations, introduced by S. Hansson, involve the temporary acceptance of contradictory beliefs, and so they were originally defined only for belief bases. Unlike to previous proposals in the literature, only defined for specific paraconsistent logics, the present approach can be applied to a general class of paraconsistent logics which are supraclassical, thus preserving the spirit of AGM. This article offers a new reading of Heidegger's thesis of the animal in The Fundamental Concepts of Metaphysics. Framing Heidegger's text through a brief analysis of Protagoras' genetic story of nature and of man's nature in Plato's eponymous dialogue, our reading brings out three key elements common to both texts: living nature as a normative rather than a physical order, the poverty of man's world in relation to the animal, and the attempted redemption of the latter through the acquisition of (...) Weltbildung. Staying with the way Heidegger brings out man's poverty in world in the text allows us (i) to undo once for all the oft-repeated charge of Heidegger's anthropocentric interpretation of the animal, (ii) to stage the hypothesis that philosophy and the life sciences of his day draw upon a common basic experience of the autonomy of life in relation to everything human, all-too-human, and (iii) to demonstrate the normativity and poverty of life. A strange dialectical reversal characterizes the oppositions which psychoanalysis posits against philosophy and neuroscience: what psychoanalysis intervenes with as a unique and missing quality of these subjects, reveals itself upon enquiry as already having been a feature of said subjects. This article first discusses the failed intervention of psychoanalysis within the perceived totalities and absolutes of German idealism. Psychoanalysis, founded on an ontological division and internal inconsistency with a retroactive logic, finds this internal contradiction already reflected within the supposed totalities (...) of Schelling and Hegel. Schelling’s “blind act,” a decision with no prior foundation that grounds an abstract identity-in-itself, appears as the counterpart to what Badiou calls the strictly “analytic act.” Hegel’s Science of Logic, in which the inconclusive interpenetration of being and nothing presupposes its own conclusion in the transitions to essence, and in which an internal incompleteness and contradiction are retroactively constitutive of the concept, similarly nullifies the intervention of psychoanalysis. Finally, precisely such a reversal is presented in neuroscience, where the constitutive contradiction of contingently functional neuronal formations in the adaptive “multiple demand” model of executive functioning repeats the contingent and self-contradicting psychoanalytic subject as being its own deference within linguistic, discursive formations. I argue that the hospitality of the foreigner for Heidegger is the condition of possibility of dwelling understood as the happening of history.In the first section I analyze the notions of hospitality in Levinas and Derrida. The second section unpacks some of the senses of the earth in (...) Heidegger as the site of man’s historical dwelling, whereas in the third section I focus on holy mourning as the disposition that reveals the earth as the uncanny ground of history. In the final section, I spell out Heidegger’s conception of hospitality, the greeting, and the foreign guest. (shrink)

O objetivo deste artigo consiste em analisar como Nietzsche, baseado na filosofia schopenhauriana, resolveu o problema do surgimento da tragédia grega através da elevação dos elementos Apolo e Dionísio a um estatuto ontológico, e como os gregos fizeram isso em seu tempo através da Música, além de revelar como, em Nietzsche, o pensamento de Sócrates surge como o “perverso algoz da arte”.O estudo foi realizado através de uma pesquisa bibliográfica com base nas seguintes obras do filósofo: A visão Dionisíaca de (...) Mundo e O nascimento da tragédia no espírito da Música. Na segunda parte, sugere-se como Nietzsche faz esse resgate do trágico em sua época e qual a recepção no século XIX de seu trabalho. (shrink)
