In Section 1, I outline the history of natural law theory, covering Plato, Aristotle, the Stoics and Aquinas. In Section 2, I explore two alternative traditions of natural law, and explain why these constitute rivals to the Aristotelian tradition. In Section 3, I go on to elaborate a via negativa along which natural law norms can be discovered. On this basis, I unpack what I call three 'experiments in being', each of which illustrates the cogency of this method. In Section (...) 4, I investigate and rebut two seminal challenges to natural law methodology, namely, the fact/value distinction in metaethics and Darwinian evolutionary biology. In Section 5, I then outline and criticise the 'new' natural law theory, which is an attempt to revise natural law thought in light of the two challenges above. In this chapter, I argue that Plato and Aristotle provide analyses of virtue and practical reason that are strongly shaped by the structure of the technai. Socrates assimilates virtue to skill, while Aristotle assimilates practical reason to a means-end technique. While both philosophers are sensitive to the problems these technē models generate, and try either to escape or to remedy them, they nonetheless remain under the impress of those models. I argue that the theory of happiness now dominant among philosophers embraces a flawed, technicizing model that represents happiness as a set of mental states produced by actions and events. This view contrasts with Aristotle’s conception, according to which happiness is not produced by (but is tantamount to) long-term activity and incorporates (but is not reducible to) a set of mental states. I then go on to criticize the skill model of happiness on three main grounds. First, unlike the Aristotelian (...) model, it necessarily instrumentalizes activity while setting no principled limit to the manipulation of human action and experience. Second, and again contra Aristotle, it privileges an efficient (rather than formal) conception of causation while obscuring the way in which happiness is inextricably grounded in its conditions, which in turn has various deleterious upshots. In this paper, I tackle Aquinas’s notion of ‘natural inclinations’, specifically as it occurs in his seminal elaboration of the natural law in Summa Theologiae I-II. Question 94. Article 2. Maintaining that it constitutes a departure from Aristotle’s terminology, and is hence puzzling, I go on to investigate a raft of modern, mainly Anglophone, interpretations of the concept. Beginning with Jacques Maritain, I move through the broadly chronological sequence of John Finnis, Jean Porter, Steven Jensen, Justin Matchulat and Stephen Brock. (...) In each case, I argue that – despite these scholars’ philosophical ingenuity and textual facility – there are crucial problems with their respective approaches and construals. I end the paper by outlining my own construal of ‘natural inclinations’, which, even if not bolstered by heavy textual scholarship, is at least coherent and, moreover, avoids the philosophical pitfalls of the above interpretations. I begin by detailing the semantic range of the English terms ‘work’ and ‘labour’, in comparison with that of their closest Greek equivalents. Narrowing matters down to work in the sense of ‘occupation’, what is striking about Aristotle, I maintain, is his willingness to sort occupations into a hierarchy. This hierarchy is fourfold. At the bottom we have servile work, which is directed at life’s ‘necessities’, and is founded on mere habit. Then we have technē or skilled work, which typically (...) produces material objects, and requires expertise. Further up the hierarchy we have praxis or morally-informed activity, which reaches its apogee in the life of the politikos or ruler. At the summit of Aristotle’s hierarchy is theōria or intellectual contemplation, which supposedly approximates divine activity. After documenting the resilience of this hierarchy in the Western tradition, I outline three grounds for it – social, metaphysical and psychological – which are manifestly weak. I then elaborate other grounds for it – found both within and outside Aristotle’s texts – which, I argue, are manifestly strong, and thus deserve our endorsement even today. (shrink)

In this paper I systematically criticise Feldman’s and Haybron’s theories of happiness as subjective well-being [SWB]. Having elaborated their trichotomy between SWB, welfare and virtue, I then outline Aristotle’s rival ethical schema, which construes these as aspects within an inextricable, organic whole, viz. eudaimonia. In order to vindicate this rival schema, I begin with four thought-experiments: Feldman’s Bertha, the indoctrinated housewife, Haybron’s ‘happy slave’, and two of my own. I argue that these demonstrate – contra Feldman and Haybron, but in (...) line with Aristotle – that happiness is essentially conditioned by objective welfare-goods. I then move on to how such goods are essentially conditioned, in turn, by the virtues. It follows that happiness itself is both logically and ontologically conditioned by the practice of the virtues. Although this Aristotelian conclusion faces charges of being moralistic and counter-evidential, it can overcome these, thereby securing – pace Feldman and Haybron – an authentic, sustainable conception of happiness. I argue that, in analysing the structure and development of moral traditions, MacIntyre relies primarily on Kuhn's model of scientific tradition, rather than on Lakatos' model. I unpack three foci of Kuhn's conception of the sciences, namely: the ‘crisis’ conception of scientific development, what I call the ‘systematic conception’ of scientific paradigms, and the view that successive paradigms are incommensurable. I then show that these three foci are integrated into MacIntyre's account of the development of moral traditions with a surprising (...) degree of faithfulness to Kuhn. And crucially, I argue against the overall cogency of his account, given the disparities I pinpoint between scientific and moral traditions. My overall critique is, however, fundamentally friendly, since nothing I have to say invalidates the very notion of a moral tradition, and all I am calling for are less problematic construals of that notion. Many individuals have miserable work lives, in which they must toil away at mind-numbing yet exhausting tasks for hours on end, being ordered about by their superiors, perhaps with few guarantees that this source of income will persist for very long. However, this is only half of the story: what is centrally important is that many of those who endure these conditions are denied a fair wage in return for the burdens that they bear. In this article, I reflect on (...) the significance of this fact in order to argue for the evaporation thesis. This thesis holds that individuals’ claims to particular employment-related protections from their government disappear as their earnings increase. In the course of defending this position, I explore the moral difference an employee's wage offer makes to the work conditions that we can expect her to accept, including why there are limits to the role that cash can play here. Around the world, the population is ageing in ways that pose new challenges for healthcare providers. To date these have mostly been formulated in terms of challenges created by increasing costs, and the focus has been squarely on life-prolonging treatments. However, this focus ignores the ways in which many older people require life-enhancing treatments to counteract the effects of physical and mental decline. The idea to utilise cognitive neuroscientific research for educational purposes is known as Mind-Brain Education or Educational Neuroscience. Despite some calls for an uncritical endorsement of such an agenda, a growing number of educational scholars argue that it must remain impossible to translate neurological descriptions into mental or educationally relevant descriptions. This paper takes these well-established arguments further by not only focusing upon these different levels of description but going beyond this issue to assess the theoretical foundations of cognitive science (...) as a functional theory of the mind. With relevance to education it is argued that because of its functional character a cognitive-psychological approach to education suffers from an inherent blind spot regarding the actor’s feelings and motivations. The paper concludes with the claim that, because of this experiential poverty, any cognitive neuroscientific approach must face severe limitations when utilised for educational purposes. (shrink)

Credentialism refers to the practice of hiring or promoting applicants on the basis of their educational qualifications. In this paper, we argue that this can amount to wrongful discrimination against the less qualified. A standard way to defend credentialism appeals to the fact that it minimizes the costs of production. We argue that this argument has unacceptable implications in some cases involving disability- and gender-based discrimination. We claim that, once we appropriately revise this argument, credentialism is revealed to be similarly (...) wrongfully discriminatory. We then consider two objections and draw some preliminary lessons for policymaking. (shrink)

Since 1989, widely circulating statistics on gay teen suicide in the United States have acted as catalysts for institutional reforms, scientific research, and the creation of an identity category “gay youth.” While one figure has been replicated scientifically, these numbers originated not from a scientific research study but as risk estimates developed by a social worker and published in a government document. Many people within the public took up these original numbers, attributing their author the status of scientific researcher. In (...) effect, the numbers became “black boxed,” often traveling without citation. Drawing on Ian Hacking’s “dynamic nominalist” perspective, this article utilizes interviews with the author of these statistics and other key claimants, along with textual analysis, to trace the origins, uptake, and effects of these figures. While making vital policy contributions, the numbers have led to some ironic consequences including the fostering of gay youth identification with suicide as a potential correlate of their identity and the potential antigay redeployment of decontextualized numbers. They have also led to a reaction in the form of “resilience” narratives. (shrink)
