This book offers a conceptual history of compromise that demonstrates the connection between different understandings of compromise and corresponding differences in understandings of political representation.

Christopher Boorse’s bio-statistical theory of health and disease argues that the central discipline on which theoretical medicine relies is physiology. His theory has been much discussed but little has been said about its focus on physiology or, conversely, about the role that other biomedical disciplines may play in establishing a theoretical concept of health. Since at least the 1950s, epidemiology has gained in strength and legitimacy as an independent medical science that contributes to our knowledge of health and disease. Indeed, (...) it not only provides important information about disease distribution and aetiology, but the risk-factor approach it employs seems to challenge BST’s binary conception of health and disease. The objective of the article is to show, firstly, how important information deriving from descriptive and analytical epidemiology forms part of our contemporary medical concepts of health and disease, and secondly, that these elements are not taken into account by BST in a satisfactory way. The article’s central contention, therefore, is that if the project of defining the theoretical concept of health is to be maintained, more importance should be accorded to the contribution made by epidemiology—alongside physiology—in defining health. Two types of truth table task are used to examine people's mental representation of conditionals. In two within-participants experiments, participants either receive the same task-type twice (Experiment 1) or are presented successively with both a possibilities task and a truth task (Experiment 2). Experiment 3 examines how people interpret the three-option possibilities task and whether they have a clear understanding of it. The present study aims to examine, for both task-types, how participants' cognitive ability relates to the classification of the (...) truth table cases as irrelevant, and their consistency in doing so. Looking at the answer patterns, participants' cognitive ability influences their classification of the truth table cases: A positive correlation exists between cognitive ability and the number of false-antecedent cases classified as ?irrelevant?, both in the possibilities task and the truth task. Interest in proportionalism as an important trend in Catholic moral theology seems to have faded in the recent decade. This has led some to view it as a movement that was somehow defeated. I suggest that proportionalism's influence can still be seen in contemporary Catholic ethics, most noticeably in the current interest in virtue ethics, casuistry, and feminist ethics. I argue that proportionalism encouraged a reappraisal of the methodology for evaluating moral action in a direction that was more hospitable to (...) concerns about the particularity and context of the agent. There is ample evidence that in classical truth table task experiments false antecedents are judged as ?irrelevant?. Instead of interpreting this in support of a suppositional representation of conditionals, Schroyens (2010a, 2010b) attributes it to the induction problem: the impossibility of establishing the truth of a universal claim on the basis of a single case. In the first experiment a truth table task with four options is administered and the correlation with intelligence is inspected. It is observed that ?undetermined? is (...) chosen in one third of the judgements and ?irrelevant? in another third. A positive correlation is revealed between intelligence and the number of ?irrelevant? and ?undetermined? judgements. The data do not exclude that a part of the ?irrelevant? judgements in classical truth table task experiments might be caused by the induction problem. In the second experiment participants are presented with a simplified four-option truth table task and asked for a justification of their judgements. These justifications show the induction problem is not the reason for choosing the ?irrelevant? or ?undetermined? option, which is supportive for a suppositional representation of conditionals. Background:Little is known about case managers’ ethical issues and professional values.Objectives:This article presents an overview of ethical issues in case managers’ current practice. Findings are examined in the light of nursing ethics, social work ethics and principle-based biomedical ethics.Research design:A systematic literature review was performed to identify and analyse empirical studies concerning ethical issues in case management programmes. It was completed by systematic content analysis of case managers’ national codes of ethics.Findings:Only nine empirical studies were identified, eight of them from (...) North America. The main dilemmas were how to balance system goals against the client’s interest and client protection against autonomy. Professional codes of ethics shared important similarities, but offered different responses to these two dilemmas.Discussion:We discuss the respective roles of professional and organizational ethics. In order to understand how Deleuze's method of dramatization is ‘not privileging mankind in any way’, this article turns to the figure of the marionette as it is discreetly, but consistently, developed thorough Deleuze's books. Inspired by Kleist's On the Marionette Theatre, this marionette figure claims for a rhizomatic approach to the subject, defined by the lines it draws into space and exercising its freedom in the present of Aion through spatio-temporal dynamisms similar to those of Leibniz's monads. The strange (...) freedom developed by marionettes also leads to an examination of Nietzsche's ‘eternal return’, which is at the core of Deleuze's elaboration of the method of dramatization. Combining Nietzsche's eternal return with the characteristics of Deleuzian marionettes then requires us to revisit the famous concept of ‘becoming’: becomings are selective, both methodologically and ontologically. La possibilité d’une définition naturaliste de la santé et d’une distinction entre le normal et le pathologique qui ne repose pas sur des normes culturelles, sociales ou subjectives est au cœur des débats en philosophie de la médecine. Or le concept statistique de la normalité, fondamental pour une définition objective de la santé, soulève d’importantes difficultés. Christopher Boorse défend une « théorie bio-statistique » qui, en articulant ce concept à une notion non normative de fonction biologique, résoudrait ces difficultés. Après avoir précisé le rôle que joue la normalité statistique dans la BST, nous dégageons, à partir de l’épidémiologie contemporaine, un certain nombre de problèmes et questions que cette définition naturaliste soulève.The liability for a naturalist definition of health and for a value-free distinction between the normal and the pathological is at the core of discussions on health and disease in philosophy of medicine. But the statistical concept of normality, a central one for any objective definition of health, raises numerous problems. Christopher Boorse argues for a « biostatistical theory » which aims at solving these difficulties by articulating a statistical concept of normality and a non-normative concept of biological function. However the BST is still based on identifying normality and health with the most frequent. After analyzing in details the true role of statistical normality in BST, I will show how results and data from modern epidemiology can be mobilized to reveal several limits and difficulties with respect to this naturalist definition of health and disease. According to Alasdair Cochrane, liberty can have value for most animals only because it allows them to obtain other desirable things, such as well-being. With this he concludes that humans can continue to use other animals as long as they treat them well. In this article, I reject this conclusion by arguing against the positive conception of liberty in favor of its negative or republican conception. I suggest that it is sufficient for a being to be capable of agency in (...) order to have an interest in liberty, which deserves to be protected by the right to be free. (shrink)

The principle of energy conservation is widely taken to be a se- rious difficulty for interactionist dualism (whether property or sub- stance). Interactionists often have therefore tried to make it satisfy energy conservation. This paper examines several such attempts, especially including E. J. Lowe’s varying constants proposal, show- ing how they all miss their goal due to lack of engagement with the physico-mathematical roots of energy conservation physics: the first Noether theorem (that symmetries imply conservation laws), its converse (that conservation (...) laws imply symmetries), and the locality of continuum/field physics. Thus the “conditionality re- sponse”, which sees conservation as (bi)conditional upon symme- tries and simply accepts energy non-conservation as an aspect of interactionist dualism, is seen to be, perhaps surprisingly, the one most in accord with contemporary physics (apart from quantum mechanics) by not conflicting with mathematical theorems basic to physics. A decent objection to interactionism should be a posteri- ori, based on empirically studying the brain. (shrink)

Fraud, speculative bubbles and collapse, plus the resulting bankruptcies and hard times are a continuing part of the corporate environment. The 21st century is no exception, and its first decade has seen more than its share of abuse. This is somewhat surprising, given the level of regulation and oversight required. The focus here is primarily on Enron as a microcosm of all that can go wrong in a sophisticated, high-tech environment. Enron represents the long-term use of greed based primarily on (...) executive compensation incentives; poor corporate governance; executives willing to break the law or overlook others who did; the use of political lobbying; plus accommodating auditors, attorneys, analysts and regulators. Other fraud and abuse cases considered include WorldCom, Tyco, and Adelphi. In addition, the widespread corruption associated with the stock options scandals and the current housing collapse/banking crisis are reviewed, suggesting that the massive regulatory effort of Sarbanes-Oxley and other reforms have not solved the underlying problems. This article examines Gilles Deleuze’s 1986 letter to French film critic Serge Daney about cinema, television, and images in control societies through a Benjaminian lens. While neither Deleuze nor Daney deeply engage with Walter Benjamin’s thought, I argue that the ideas or dialectical images constructed by the German thinker are crucial to better understand Deleuze’s and Daney’s thoughts regarding the threatened death of modern cinema in the 1980s because of the predominance of television as a control apparatus. In the first (...) part of the article, I analyze the aesthetical and political meaning of the concept of history as/of perception. I also show affinities between Benjamin’s and Deleuze’s works through their connection to art historian Aloïs Riegl. In the sec- ond part, I demonstrate how Deleuze’s and Daney’s reflections about mannerism as a weapon against the rise of clichés and the ideology of the visible in control societies must be supplemented by Benjamin’s concept of “construction”. In conclusion, I draw on Benjamin’s discussion of politics as a body space to advocate for desiring mannerisms to fight control apparatuses and the reign of clichés. (shrink)

The church mission and objectives are more and more difficult to accomplish because of the secularization of the today’s society. Church’s use of marketing is a sensitive issue that has both supporters and critics. This article subscribes to the positive point of view that suggests that religious organizations can apply marketing in order to fulfill their mission and to obtain better results. It also claims that the use of marketing by the church and clergy does not contradict the religious core (...) values and that church marketing should develop a theoretical framework of its own and a specific set of methods, techniques and instruments. The present paper reveals the complexity of religious marketing. It presents a holistic view of the church marketing and proposes a specific conceptual framework for it. The article demonstrates that religious organizations’ marketing should be regarded as a form of social marketing and it briefly describes the church marketing process. (shrink)

This commentary addresses the concept of learning stemming from Eva Jablonka and Simona Ginsburg’s theory of the emergence of consciousness. Jablonka and Ginsburg find strong support in biosemiotics for their argument that learning offers an evolutionary transition marker for the emergence of consciousness. Indeed, biosemiotics embraces a view on evolution that integrates both phylogeny and ontogeny. It does not polarize learning and evolving. At the same time, Jablonka and Ginsburg’s argument gives both biosemiotics and learning theory a shake, forcing scholarship (...) in these fields to tackle difficult questions on agency, selfhood, consciousness and anthropological difference. I explore some of the main questions that arise from this theoretical development, particularly in reference to Andrew Stables’ semiotic learning theory, which has been easily nested in a biosemiotic framework. Faut-il voir dans l’esthétique, comme le suggèrent certains passages et exemples chers à Souriau, le paradigme de l’activité créatrice et le ressort-même de l’instauration, concept central de la philosophie sourialienne? Ou, au contraire, l’esthétique et les créations artistiques ne fourniraient-elles que des exemples, certes particulièrement nets, de processus appelés « cosmiques » par Souriau que seule la philosophie serait à même d’explorer pleinement? L’article cherche à apporter une (...) réponse nuancée à cette question en se penchant à la fois sur des ouvrages philosophiques majeurs de Souriau et sur des articles plus méconnus. Une autre question se pose en conclusion : et si les interactions de l’esthétique et de la philosophie générale de Souriau nous incitaient à repenser la fonction de l’esthétique en lui conférant un rôle expérimental, directement connecté à la construction dramatique de la philosophie sourialienne? In this response to Christian Smith's What Is a Person?, I raise questions about his conception of the human life as a narrative quest and his account of change in social structures and institutions. The metaphor of life as a quest suggests a solid, isolated, and integrated moral agent. I wonder whether the experiences of most moral agents render a different picture—one where life is fragmented and characterized by complex webs of relationships. Smith provides a detailed account of how social (...) institutions change. I pose examples of more subtle and complex types of change as a way to press him to think about whether his account of change is too linear. (shrink)

This article presents a comparative analysis between Georges Canguilhem’sEssay on Some Problems Concerning the Normal and the Pathological, published in 1943 and the English language debate that started in the 1970s between the naturalists and the normativists. Seemingly, this comparison illustrates the opposition between the French historical epistemology and the Anglo-American philosophy of sciences. However, I put into perspective what is generally considered an opposition between the two traditions by analyzing certain conceptual similarities.

At workplaces where nanomaterials are produced or used, risk assessment and risk management are extremely difficult tasks since there is still limited evidence about the risks of nanomaterials. Measurement methods for nanoparticles are contested and safety standards have not yet been developed properly. To support compliance with the legal obligation of the employer to care for safe workplaces a large number of ‘soft’ regulatory tools have been proposed (e.g. codes of conduct, benchmarks, standards). However, it is not clear whether and (...) under which conditions soft regulation is complied with. This article discusses the potential advantages and drawbacks of soft regulation. It explores compliance issues when exposure measurement devices and other technology-related factors are involved. The exploration of three examples of soft regulation on occupational health and safety (a ministerial recommendation on preliminary exposure benchmarks, a nano-specific guidance of a chemical company and a public–private OHS guideline) shows that the capacity of the regulated parties to comply depends on the availability of appropriate technological devices and methods, technical expertise and other resources. When technological prerequisites are met, compliance is likely to increase. (shrink)

Inspired by Ursula Le Guin's ‘The Carrier Bag Theory of Fiction’, contemporary feminist writing in the social sciences and the humanities has been characterised by a strong renewal of interest in storytelling, as is evidenced by the works of Anna Tsing and Donna Haraway among others. How can storytelling grow with and beyond its literary origin to become a political and heuristic tool? And how does the Anthropocene – our specific geologic epoch – require the renewal of the means of (...) expression of such an old tool as storytelling, so that it becomes a human and nonhuman process? To answer those questions, Deleuze's and Haraway's takes on ‘fabulation’ are intermingled along three lines: the part played by storytelling in the construction of earthly knowledges, the imbrication of speculation and politics, and the nonhuman dimension of fabulation that allows for the liberation of forces of life repressed by an anthropocentric approach. Desde o início da teorização freudiana, inibição, defesa e censura são processos que devem incidir sobre as pulsões. O primitivo pulsional precisa ser reprimido ou transformado. Este artigo problematiza a relação entre as pulsões sexuais e a defesa psíquica, ao longo do período pré-psicanalítico e da primeira tópica freudiana. Situamos o conflito entre sexualidade e repressão, apontado por Freud como característico das psiconeuroses, enquanto que nas neuroses atuais a angústia está relacionada a um registro quantitativo e não exatamente a um (...) conflito psíquico. Nesse caso, revela-se desencontros entre um sexual corpóreo e sua representação psíquica. Pretende-se, neste trabalho, evidenciar o caráter negativo das pulsões e pôr em relevo a natureza do antagonismo que se opõe às pulsões sexuais. A formulação das pulsões de autoconservação como aquilo que deve se contrapor às pulsões sexuais não esclarece completamente porque é imperativo que algo aconteça face às vivências pulsionais fundantes do aparelho. A satisfação em estado bruto acarreta prejuízos, tanto do ponto de vista psíquico quanto social; logo, a repressão das pulsões sexuais é condição necessária para a existência individual e coletiva. Evidencia-se assim algo específico do humano, afinal, se toda a natureza funciona afirmando o instinto, a espécie humana somente se desenvolve a partir de sua negação. A partir de tais construções teóricas, questiona-se se a psicanálise ainda permanece demasiadamente tributária de uma concepção de natureza revestida de pressupostos morais, sustentando a noção de que tenha que ser continuamente negada, afastada, coagida e domesticada, em prol de construções sociais bastante questionáveis, porém acatadas como necessárias. As narrativas fabulísticas foram transmitidas, no início, oralmente, pelos antigos. Assim que o homem começou a falar e a observar o que acontecia à sua volta, sentiu a necessidade em expor, através das fábulas, o comportamento humano. A presente pesquisa tem como objeto a exposição de alguns instrumentos, na fábula de Fedro “O boieiro e a Lebre”, que possibilitam em maior ou menor grau aproximar-se da oralidade. Julgamos que o texto, apesar de todas as limitações, não deixa de sugerir alguns (...) conceitos da análise da conversação através do diálogo, ou seja, há vestígios da oralidade no texto selecionado, embora o latim não seja mais falado. Convém enfatizar que a língua falada não deixa de estar refletida na fábula. (shrink)

ObjectivesQuality of Life depends on the discrepancy between desired and current experiences, thus in chronic illness, adjustment of expectations and interpretation of the current situation are crucial. Depression is known to influence this gap, and the present study aims to further assess the role of resilience and health locus of control.MethodsA total of 94 patients with neurological disorders were screened via telephone regarding depression, resilience and HLC. Current and desired state of several life domains were assessed, such as Fitness, General (...) Health, Pain, Daily Activities, Finances, Leisure, and Family. Elastic net regularization and analyses of variance were used to disentangle the impact of depression, resilience, HLC, and sociodemographic factors on the perception of current and desired state, and the gap between both.ResultsA gap was present for all domains but largest for pain. Interpretation of the current state was linked to desired state, HLC, and age. All gaps were related to depression; certain domains were in addition influenced by resilience, HLC and sociodemographic factors. Of note, for most domains, patients did not select the highest possible desired state.ConclusionOlder patients with neurological disorders report a gap between current and desired state for many aspects of life. Adjusting expectations is beneficial in the face of declining health, but a reasonably increased desired state may positively influence the perception of the current situation. Depression negatively influences the interpretation of the Calman gap. (shrink)

This article examines the particular way Souriau’s concepts of instauration and modes of existence have been inherited by Bruno Latour in his Inquiry into Modes of Existence. It suggests that Bruno Latour has hacked some key-aspects of Souriau’s general ontology in order to regionalize it and, by doing so, to give the Moderns an accurate depiction of the plurality of beings they hold dear. It then shows how Souriau’s concept of instauration is crucial to Latour’s project of rethinking and repopulating (...) modern institutions, in a gesture aimed at making metaphysics a vital practice that has the power to make the world worth of worrying and caring for. This paper explores a semiotic notion of body as starting point for bridging biosemiotic with social semiotic theory. The cornerstone of the argument is that the social semiotic criticism of the classic view of meaning as double articulation can support the criticism of language-centrism that lies at the foundation of biosemiotics. Besides the pragmatic epistemological advantages implicit in a theoretical synthesis, I argue that this brings a semiotic contribution to philosophy of mind broadly. Also, it contributes to overcoming the polemic (...) in linguistics between, loosely put, cognitive universalism and cultural relativism. This possibility is revealed by the recent convergence of various semiotic theories towards a criticism of the classic notion of meaning as double articulation. In biosemiotics, the interest to explicate meaning as multiply articulated stems from the construal of Umwelt as relying on the variety of sense perception channels and semiotic systems that a species has at its disposal. Recently, social semiotics developed an unexplored interest for embodiment by starting from the other end, namely the consideration of the modal heterogeneity of meaning. To bridge these notions, I employ the cognitive semantic notion of embodiment and Mittelberg’s cognitive semiotic notion of exbodiment. In light of these, I explore the possible intricacies between the biosemiotic notion of primary modeling system and concepts referring to preconceptual structures for knowledge organization stemming from cognitive linguistics. Further, Mittelberg’s concept of exbodiment allows for a construal of meaning articulation as mediation between the exbodying and embodying directions of mind. (shrink)

Le problème se présente ainsi : s’il existe des vérités politiques, c’est-à-dire des positions politiques qui soient véritablement bonnes, ne devrait-on pas faire de l’atteinte de ces vérités politiques l’objectif central de notre système politique, ce qui pourrait nous conduire à limiter le pouvoir populaire afin de laisser les individus « éclairés » prendre toutes les décisions politiques ? J’explore différentes stratégies (...) possibles afin de défendre la démocratie contre l’attrait d’une telle épistocratie, et je conclus que la meilleure stratégie consiste à souligner qu’une démocratie délibérative bien organisée démontre un potentiel épistémique supérieur à tout autre système politique. Je termine en montrant comment une telle conclusion parvient à nous informer sur le phénomène de la contestation politique. | : In this paper, I consider a problem that I call the “epistocratic specter”. The problem goes as follows : if there are political truths, by which I mean political positions that are truly good, shouldn’t we make the attainment of such truths the central goal of our political system, which could lead us to restrict popular power and let only truly “enlightened” individuals make every political decision ? I explore various possible strategies in order to defend democracy against the appeal of such an epistrocratic system, and I conclude that the best available strategy is one that emphasizes that a well-organized deliberative democracy possesses an epistemic potential that is superior to that of any other political system. I conclude by showing how this fact can inform our understanding of the phenomenon of political dissent. (shrink)
