Rationale: Deep brain stimulation (DBS) of the hippocampus is proposed for enhancement of memory impaired by injury or disease. Many pre-clinical DBS paradigms can be addressed in epilepsy patients undergoing intracranial monitoring for seizure localization, since they already have electrodes implanted in brain areas of interest. Even though epilepsy is usually not a memory disorder targeted by DBS, the studies can nevertheless model other memory-impacting disorders, such as Traumatic Brain Injury (TBI). Methods: Human patients undergoing Phase II invasive monitoring for (...) intractable epilepsy were implanted with depth electrodes capable of recording neurophysiological signals. Subjects performed a delayed-match-to-sample (DMS) memory task while hippocampal ensembles from CA1 and CA3 cell layers were recorded to estimate a multi-input, multi-output (MIMO) model of CA3-to-CA1 neural encoding and a memory decoding model (MDM) to decode memory information from CA3 and CA1 neuronal signals. After model estimation, subjects again performed the DMS task while either MIMO-based or MDM-based patterned stimulation was delivered to CA1 electrode sites during the encoding phase of the DMS trials. Each subject was sorted (post hoc) by prior experience of repeated and/or mild-to-moderate brain injury (RMBI), TBI, or no history (control) and scored for percentage successful delayed recognition (DR) recall on stimulated vs. non-stimulated DMS trials. The subject’s medical history was unknown to the experimenters until after individual subject memory retention results were scored. Results: When examined compared to control subjects, both TBI and RMBI subjects showed increased memory retention in response to both MIMO and MDM-based hippocampal stimulation. Furthermore, effects of stimulation were also greater in subjects who were evaluated as having pre-existing mild-to-moderate memory impairment. Conclusion: These results show that hippocampal stimulation for memory facilitation was more beneficial for subjects who had previously suffered a brain injury (other than epilepsy), compared to control (epilepsy) subjects who had not suffered a brain injury. This study demonstrates that the epilepsy/intracranial recording model can be extended to test the ability of DBS to restore memory function in subjects who previously suffered a brain injury other than epilepsy, and support further investigation into the beneficial effect of DBS in TBI patients. A number of bioethicists have been critical of the power of the family to “veto” a patient’s decision to posthumously donate her organs within opt-in systems of organ procurement. One major objection directed at the family veto is that when families veto the decision of their deceased family member, they do something wrong by violating or failing to respect the autonomy of that deceased family member. The goal of this paper is to make progress on answering this objection. I do (...) this in two stages. First, I argue that the most plausible interpretation of what happens when a person registers as an organ donor in an opt-in system is that she gives her consent to the state to posthumously remove her organs for transplantation purposes. Call this the Authorization Account. Second, given the Authorization Account, I argue by analogy that when families veto an individual’s decision to donate and the individual’s organs are not in the end removed, neither the doctors nor the family violate the individual’s autonomy in any morally objectionable sense. Call this the Nonremoval Thesis. I argue that since the Nonremoval Thesis is true, we do not violate or fail to respect the autonomy of registered donors when we fail to remove their organs because their family has objected. The General Data Protection Regulation (GDPR) of the EU confirms the protection of personal data as a fundamental human right and affords data subjects more control over the way their personal information is processed, shared, and analyzed. However, where data are processed by artificial intelligence (AI) algorithms, asserting control and providing adequate explanations is a challenge. Due to massive increases in computing power and big data processing, modern AI algorithms are too complex and opaque to be understood by most data (...) subjects. Articles 15 and 22 of the GDPR provide a modest regulatory framework for automated data processing by, among other things, mandating that data controllers inform data subjects about when it is being used, and its logic and ramifications. Nevertheless, due to the phrasing of the articles and the numerous exceptions they allow, doubts have arisen about their effectiveness. In this paper, we empirically evaluate the quality and effectiveness of AI disclosures as mandated by the GDPR. By means of an online survey (N = 835), we investigated how data subjects expect to be informed about the automated processing of their data. We then conducted a content analysis of the AI disclosures of N = 100 companies and organizations. The combined findings reveal that current GDPR-mandated disclosures do not meet the expectations and needs of data subjects. Explanations drawn up following the guidelines of the generic formulations of the GDPR differ widely and are often vague, incomplete and lack transparency. In our conclusions we identify a path towards standardizing and optimizing AI information notices. (shrink)

“Opt-out” organ procurement policies based on presumed consent are typically advertised as being superior to “opt-in” policies based on explicit consent at securing organs for transplantation. However, Michael Gill has argued that presumed consent policies are also better than opt-in policies at respecting patient autonomy. According to Gill’s Fewer Mistakes Argument, we ought to implement the procurement policy that results in the fewest frustrated wishes regarding organ donation. Given that the majority of Americans wish to donate their organs, it is (...) plausible that a presumed consent policy would result in fewer frustrated wishes compared to the current opt-in policy. It follows that we ought to implement a policy of presumed consent. In this paper, I first consider and find wanting an objection to the Fewer Mistakes Argument developed recently by Douglas MacKay. I also consider an objection put forth by James Taylor but argue that there is a methodological reason to prefer my own argument to Taylor’s. Finally, I argue for two theses: first, that Gill’s major argument in favor of the crucial premise of the Fewer Mistakes Argument is flawed, and second, that the major premise of the Fewer Mistakes Argument is false. The aim of Dimitris Vardoulakis’s paper, ‘Toward a Critique of the Ineffectual: Heidegger’s Reading of Aristotle and the Construction of an Action without Ends’, is to provide the foundation for a critique of aimless action by tracing its genesis to Heidegger’s putative misinterpretation of Aristotelian phronēsis (practical wisdom) in the 1920s. Inasmuch as ‘the ineffectual’—the name Vardoulakis gives to action devoid of ends—plays a crucial role in post-Heideggerian continental philosophy, he thereby seeks to diagnose and to provide an aetiology of (...) an illness afflicting contemporary thought. In my response, I will first argue that, while Vardoulakis is right to identify an emphasis on the ineffectual in Heidegger, he is mistaken about its origin. Heidegger does not strip phronēsis of instrumentality, nor does he mistranslate Nichomachean Ethics 1139a31–32. Second, I trace an alternative source for the ineffectual, which is not simply a negative alternative to technological machination but stems from a positive experience of what Meister Eckhart, and Heidegger in his wake, called life without why. Finally, I look at a couple of texts, including one discussed by Vardoulakis, in which even the later Heidegger is not entirely dismissive of calculative instrumentality but instead assigns the latter to a secondary, restricted site of competence. Alexander R. Pruss examines a large family of paradoxes to do with infinity - ranging from deterministic supertasks to infinite lotteries and decision theory. Having identified their common structure, Pruss considers at length how these paradoxes can be resolved by embracing causal finitism.

Two sources of possible disagreement in bioethics may be associated with pessimism about what bioethics can achieve. First, pluralism implies that bioethics engages with interlocutors who hold divergent moral beliefs. Pessimists might believe that these disagreements significantly limit the extent to which bioethics can provide normatively robust guidance in relevant areas. Second, the interdisciplinary nature of bioethics suggests that interlocutors may hold divergent views on the nature of bioethics itself—particularly its practicality. Pessimists may suppose that interdisciplinary disagreements could frustrate the (...) goals of bioethics. In this article, I explore how wonder may alleviate the concerns of the first group of pessimists regarding problems associated with pluralism, provided that we are willing to accept some interdisciplinary frustrations. Then, I invite readers of this issue of The Journal of Medicine & Philosophy to test these intuitions by considering the role of wonder in these articles. (shrink)

У статті розглянуто результати археологічного дослідження трипільського храмового комплексу – Небелівського храму. Автор виокремлює особливу знахідку, а саме – залишки керамічного диска з групою фішок до нього. Ця знахідка в науковому світі дістала назву Небелівський Диск. Відзначено, що засадничим явищем інтер’єрного простору Небелівського Храму стала умовна яма (заглиблення) у самому центрі ритуального залу. Вона є центральною храмовою точкою, яка надає ключ до інтерпретації головного храмового символу, котрий ймовірно був рослинного походження. У статті проводяться паралелі між головним ритуальним залом Трипільського Храму (...) та особливою ритуальною спорудою ведичної релігії «prâcînavamsa» («прачинаванса»), в якій проводився найголовніший ритуал ведичної релігії «ашвамедха». Це засвідчує значну подібність двох сакральних споруд, а найголовніше – це подібність заглиблень у центрі священного простору, яке позначалося «Світовим Деревом» (за В. Топоровим). Автор доводить, що особливості інтер’єрного наповнення Небелівського Храму висвітлюють уявлення давніх людей про структуру священного Космосу, про місце людей у ньому та символи, які пов’язують сакральне суспільство з космологічними уявленнями. Особливість даного дослідження полягає в тому, що внутрішнє храмове наповнення є, по суті, матеріалізованим духовним світом давніх землеробів, який транслює їхню релігійну космологію. (shrink)

How do words mean? What is the nature of meaning? How can we grasp a word's meaning? The frame-semantic approach developed in this book offers some well-founded answers to such long-standing, but still controversial issues. Following Charles Fillmore's definition of frames as both organizers of experience and tools for understanding, the monograph attempts to examine one of the most important concepts of Cognitive Linguistics in more detail. The point of departure is Fillmore's conception of "frames of understanding" - an approach (...) to (cognitive) semantics that Fillmore developed from 1975 to 1985. The envisaged Understanding Semantics ("U-Semantics") is a semantic theory sui generis whose significance for linguistic research cannot be overestimated. In addition to its crucial role in the development of the theoretical foundations of U-semantics, corpus-based frame semantics can be applied fruitfully in the investigation of knowledge-building processes in text and discourse. In transplant medicine, the use of normothermic regional perfusion (NRP) in donation after circulatory determination of death raises ethical difficulties. NRP is objectionable because it restores the donor's circulation, thus invalidating a death declaration based on the permanent cessation of circulation. NRP's defenders respond with arguments that are tortuous and factually inaccurate and depend on introducing extraneous concepts into the law. However, results comparable to NRP's—more and higher‐quality organs and more efficient allocation—can be achieved by removing organs from deceased donors (...) and using normothermic machine perfusion (NMP) to support the organs outside the body, without jeopardizing confidence in transplantation's legal and ethical foundations. Given the controversy that NRP generates and the convoluted justifications made for it, we recommend a prudential approach we call “ethical parsimony,” which holds that, in the choice between competing means of achieving a result, the ethically simpler one is to be preferred. This approach makes clear that policy‐makers should favor NMP over NRP. (shrink)

Esta investigación se emprende motivada por la necesidad de desentrañar la progresión delos modelos de aprendizaje, los cuales se han ido adaptando para responder a las demandas de lasociedad en su dinámica constante de fluctuación y transformaciones. El objetivo de este trabajo es examinar de forma sistemática la evolución de los modelos de aprendizaje, destacando los cambios paradigmáticos que han favorecido la transición de enfoques de aprendizaje tradicionales hacia propuestas más innovadoras y transdisciplinarias. Para lograrlo, se lleva a cabo un (...) análisis bibliográfico apoyado en el método hermenéutico para la interpretación contextual de la literatura y los discursos, a fin de desentrañar las complejidades inherentes en la evolución de los modelos de aprendizaje. Los resultados resaltan la influencia limitante del paradigma de la simplicidad en laformación educativa tradicional y la necesidad de un giro hacia la dialogicidad y la colaboración eintegración disciplinaria para avanzar hacia la complejidad. Se concluye argumentando a favor de la adopción del paradigma de la complejidad, abogando por una epistemología transdisciplinariay un enfoque de aprendizaje interestructurante, que permitan el desarrollo humano integral.El reconocimiento de la complejidad humana en la enseñanza y el aprendizaje exige una transformación radical de la educación hacia prácticas más holísticas y transformadoras, esenciales para construir una sociedad equitativa y justa. A dispositional theory of skill, such as that defended by Stanley and Williamson, might seem promising. Such a theory looks to provide a unified intellectualist account of skill reflecting insights from cognitive science and philosophy. I argue that any theory of the kind fails given that skill is broadly answerable to the will. A person may be characteristically disposed both against the exercise of her skill and against any associated intentional forming of knowledge. Clearly she does not cease thereby to (...) be skilled. Almaatouq et al. propose a novel integrative approach to experiments. We provide three examples of how unaddressed measurement issues threaten the feasibility of the approach and its promise of promoting commensurability and knowledge integration.

Reflecting current debates on ‘organizational virtues’ as going beyond the capitalocentrist bias of contemporary economies and to see diversity as ‘ethical responsibility,’ this article explores ‘ethical organizing’ at the intersection of alternative organizations and diversity. Our interest in a diversity-oriented analysis of alternative organizations stems from the assumption that those which question taken-for-granted notions of existing economies and follow alternative values of autonomy, solidarity, and responsibility might also be likely to challenge existing diversity relations and, thus, potentially open up new (...) avenues for ethical organizing. Discussing our findings in terms of Lewis and Simpson’s (in)visibility vortex, our study shows that even though organizations position themselves discursively as ‘alternative,’ this positioning is not related to diversity issues. We conclude that a shift is needed to fully constitute ethical organizing, namely the establishment of a strong connection between alternative organizations’ virtues with, e.g., the feminist, anti-racist, queer, and disability rights movements. This article analyses the parallels between the pre-Qin Daoist notion of heng 恒 as a constancy that is nevertheless ceaselessly in motion, and Karl Barth’s concept of Beständigkeit as God’s constancy throughout infinite transformation. Underlying both concepts is an understanding of the ultimate origin (whether dao 道 or the Christian God) as irreducibly temporal in nature. Stemming from this conviction, both systems of thought ultimately identify the continuous change of the ultimate origin with the flow of time in the universe. (...) The commonalities found between these two traditions provide fresh resources to advance the study of both. On the one hand, Barth’s deliberate juxtaposition of contrary statements to illustrate the union of permanence and transience in Beständigkeit challenges the frequent assumption that similar juxtapositions in the pre-Qin texts comprise careless inconsistency or outright incoherence. By extension, Barth’s metaphysical underpinning of this juxtaposition offers a compelling framework to explicate the Daoist notion of heng. On the other hand, the pre-Qin texts’ confluence of permanence and freedom in the principle of ziran 自然 offers a new lens through which to read and hence redeem Barth’s oft-critiqued attempt to combine the irrevocability and ongoing freedom of God’s decision of election. In his recently published Donner le temps II, Derrida raises, but does not develop, the possibility that Heidegger's notion of Gelassenheit (‘releasement’, ‘letting-be’) might escape the economic confines of exchange, debt, and repayment and therefore qualify as a pure gift. In this paper, I explore this possibility, explaining that Gelassenheit would have to be understood, first, not primarily as a human comportment but at the level of being itself, second, beyond appropriation, and third, as ‘without why’. If Heidegger's focus on (...) appropriation in ‘Time and Being’ remains entangled in the economy of exchange (as Derrida insinuates in the final session of Donner le temps II), Heidegger's anarchic treatment of ‘letting’ ( laisser, Lassen) in the final session of his 1969 seminar in Le Thor opens instead onto a ‘pure giving’ ( pur donner, reines Geben). Piers Norris Turner’s recent interpretation of John Stuart Mill’s philosophy transforms Mill into an illiberal utilitarian, against the textual evidence. Mill rejects Turner’s standard utilitarian, or “expansive,” conception of harm, according to which mere displeasure or distress counts as nonconsensual harm. Moreover, Mill is not a radical antipaternalist. He says that society may legitimately consider the individual’s own good as a reason for interference with other-regarding actions that inflict nonconsensual harm on others. But there are no reasons, paternalistic or otherwise, (...) for interference with self-regarding actions that may be displeasing to others without causing them any nonconsensual harm. (shrink)

Human rights law has been called upon to help with the problem of persistently high greenhouse gas emissions. An obligation on states and other legal entities to lower their emissions (mitigation) is said to be deducible from that body of law. I refute this thesis. First, I consider two practical difficulties—causality and non-triviality—that face a plaintiff who, with emission mitigation as the objective, attempts to prove a human rights violation using the regular pattern of proof for a violation. Proponents of (...) the “human rights approach” to mitigation have held that proof of an emission “contribution” by the defendant together with proof of an “impact” by climate change on the plaintiff’s human rights are sufficient to discharge the evidentiary burden for the proof of causation. The rest of the causation chain is simply presumed. Thus, the original proof pattern for a human rights violation is abandoned. The proponents’ answer to the triviality difficulty has been to aggregate emitters into very large entities and sue _them_. However, aggregation can be shown to lead to a _reductio ad absurdum_. In my argument’s second part, I identify a more fundamental difficulty with the human rights approach to mitigation: The defendant’s emissions do not amount to a norm violation. Everyone contributes emissions without legislative or other prohibition. Treaty law on climate change itself recognizes emitting behaviour as lawful and permits the continuation of state emissions through to at least 2050. A rise in global warming from preindustrial levels to 1.5° Celsius with room for an even greater rise to close to 2° Celsius has been _budgeted for_ by the Paris Agreement on Climate Change. The setting up of a budget affirms the normalized status of within-budget emissions. This universal license to emit denies the human rights approach to mitigation the very conditions of application of human rights law. (shrink)

In Grundgesetze der Arithmetik, Frege tried to show that arithmetic is logical by giving gap-free proofs from what he took to be purely logical basic laws. But how do we come to judge these laws as true, and to recognize them as logical? The answer must involve giving an account of the apparent arguments Frege provides for his axioms. Following Sanford Shieh, I take these apparent arguments to instead be exhibitions: the exercise of a logical capacity in order to bring (...) us into a state of judgement. I provide an account of what sort of inferential capacities are at play in such exhibitions, and explain how they lead us to judge that Frege’s primitive laws are general and undeniable. I will also situate my account with respect to other rival interpretations, particularly the elucidatory interpretations of Joan Weiner and Thomas Ricketts. (shrink)

This dissertation examines the theory of perceptual cognition laid out by the 7th century Buddhist scholar, Dharmakīrti, in his magnum opus, the Pramāṇavārttika. Like most theories of perception, both ancient and modern, the sensory cognition of ordinary objects is a topic of primary concern. Unlike other theorists, however, Dharmakīrti advances a technical definition of “perception” as a cognition which is both nonconceptual and non-erroneous. Dharmakīrti’s definition of perception is thereby deliberately inclusive of three additional types of “perceptual” cognition, in addition (...) to veridical sensory awareness: the nonconceptual mental apprehension of an immediately-preceding cognition (“mental perception”), the vivid appearance of soteriologically efficacious objects of contemplative practice (“yogic perception”), and the sheer unmediated presence of the contents of cognition—whatever these might be—to the cognizing mind (“reflexive awareness”). Through the logical examination of what it means to be aware of an object, Dharmakīrti demonstrates that the awareness of an object is just the awareness of a phenomenal form or cognitive image produced by that object. Pursuing this analysis further, however, Dharmakīrti argues that the very notion of an object of cognition that exists “externally” or outside the mind is incoherent. Additionally, Dharmakīrti maintains that the phenomenological structure of subject and object—that is, the “first-personal” sense of one’s own cognitions as pertaining to oneself (“for-me-ness”), together with the inseparably concomitant sense that the objects of cognition exist “out there” in an extramental world—is strictly a form of cognitive error. Therefore, because ordinary sensory cognition is inherently structured by this subject-object duality, ordinary sensory cognition must in the final analysis be understood as erroneous. According to Dharmakīrti, in other words, ultimately only the nondual “luminosity” of reflexive awareness is genuinely perceptual, because only reflexive awareness is undistorted by nature. In this way, Dharmakīrti’s epistemology provides a theoretical foundation for the advanced nondual contemplative practices of Indian and Tibetan Buddhism, particularly Mahāmudrā and rDzogs chen. In this paper I explore a new approach to the ethics of animal experimentation by conceiving of it as a form of rescue. The notion of rescue, I suggest, involves some moral agent performing an action or series of actions, whose end is to prevent or alleviate serious harm to another party, harm that otherwise would have occurred or would have continued to occur, had that moral agent not intervened. Animal experiments that are utilized as a means to alleviate human (...) illnesses mirror the structure of rescue cases and this means that we can and should apply principles of rescue to illuminate the moral status of animal experimentation. To do this I consider various principles of rescue that might justify animal experimentation. I’ll argue that all of these rescue principles are either not independently plausible, or else they fail to imply that animal experimentation is morally justified. This suggests that it is quite difficult to morally justify animal experimentation when conceived as a form of rescue. (shrink)

Since its inception, the institution of postmortem organ transplantation has faced the problem of organ shortage: Every year, the demand for donor organs vastly exceeds supply, resulting in the deaths of approximately 8,000 individuals in the United States alone.1 This is in large part due to the fact that the United States, for the most part, operates under an “opt-in” policy in which people are given the opportunity to voluntarily opt-in to organ donation by registering as organ donors.2 In the (...) United States, a person’s organs will not be removed for transplantation purposes unless she has registered as a donor or her family gives their consent for organ removal.3 Jointly, these policies generate a situation where we do not retrieve as many organs as we could.
