The ability to find relevant materials in large document collections is a fundamental component of legal research. The emergence of large machine-readable collections of legal materials has stimulated research aimed at improving the quality of the tools used to access these collections. Important research has been conducted within the traditional information retrieval, the artificial intelligence, and the legal communities with varying degrees of interaction between these groups. Legal text retrieval traditionally relies upon external knowledge sources such as thesauri and classification schemes, and an accurate indexing of the documents is often manually done. As a result not all legal documents can be effectively retrieved. However a number of current artificial intelligence techniques are promising for legal text retrieval. They sustain the acquisition of knowledge and the knowledge-rich processing of the content of document texts and information need, and of their matching. Currently, techniques for (...) learning information needs, learning concept attributes of texts, information extraction, text classification and clustering, and text summarization need to be studied in legal text retrieval because of their potential for improving retrieval and decreasing the cost of manual indexing. The resulting query and text representations are semantically much richer than a set of key terms. Their use allows for more refined retrieval models in which some reasoning can be applied. A variety of legal documents are increasingly being made available in electronic format. Automatic Information Search and Retrieval algorithms play a key role in enabling efficient access to such digitized documents. Although keyword-based search is the traditional method used for text retrieval, they perform poorly when literal term matching is done for query processing, due to synonymy and ambivalence of words. To overcome these drawbacks, an ontological framework to enhance the user’s query for retrieval of truly (...) relevant legal judgments has been proposed in this paper. Ontologies ensure efficient retrieval by enabling inferences based on domain knowledge, which is gathered during the construction of the knowledge base. Empirical results demonstrate that ontology-based searches generate significantly better results than traditional search methods. (shrink)

In this work we study, design, and evaluate computational methods to support interpretation of statutory terms. We propose a novel task of discovering sentences for argumentation about the meaning of statutory terms. The task models the analysis of past treatment of statutory terms, an exercise lawyers routinely perform using a combination of manual and computational approaches. We treat the discovery of sentences as a special case of ad hoc document retrieval. The specifics include retrieval of short texts, specialized (...) document types, and, above all, the unique definition of document relevance provided in detailed annotation guidelines. To support our experiments we assembled a data set comprising 42 queries which we plan to release to the public in the near future in order to support further research. Most importantly, we investigate the feasibility of developing a system that responds to a query with a list of sentences that mention the term in a way that is useful for understanding and elaborating its meaning. This is accomplished by a systematic assessment of different features that model the sentences’ usefulness for interpretation. We combine features into a compound measure that accounts for multiple aspects. The definition of the task, the assembly of the data set, and the detailed task analysis provide a solid foundation for employing a learning-to-rank approach. (shrink)

The effectiveness of information retrieval technology in electronic discovery (E-discovery) has become the subject of judicial rulings and practitioner controversy. The scale and nature of E-discovery tasks, however, has pushed traditional information retrieval evaluation approaches to their limits. This paper reviews the legal and operational context of E-discovery and the approaches to evaluating search technology that have evolved in the research community. It then describes a multi-year effort carried out as part of the Text Retrieval Conference (...) to develop evaluation methods for responsive review tasks in E-discovery. This work has led to new approaches to measuring effectiveness in both batch and interactive frameworks, large data sets, and some surprising results for the recall and precision of Boolean and statistical information retrieval methods. The paper concludes by offering some thoughts about future research in both the legal and technical communities toward the goal of reliable, effective use of information retrieval in E-discovery. Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often (...) contain long articles and only some parts are relevant to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. In this work, we provide a broad overview of the distinct stages of E-Discovery. We portray them as an interconnected, often complex workflow process, while relating them to the general Electronic Discovery Reference Model (EDRM). We start with the definition of E-Discovery. We then describe the very positive role that NIST’s Text REtrieval Conference (TREC) has added to the science of E-Discovery, in terms of the tasks involved and the evaluation of the legal discovery work performed. Given the (...) critical nature that data analysis plays at various stages of the process, we present a pyramid model, which complements the EDRM model: for gathering and hosting; indexing; searching and navigating; and finally consolidating and summarizing E-Discovery findings. Next we discuss where the current areas of need and areas of growth appear to be, using one of the field’s most authoritative surveys of providers and consumers of E-Discovery products and services. We subsequently address some areas of Artificial Intelligence, both Information Retrieval-related and not, which promise to make future contributions to the E-Discovery discipline. Some of these areas include data mining applied to e-mail and social networks, classification and machine learning, and the technologies that will enable next generation E-Discovery. The lesson we convey is that the more IR researchers and others understand the broader context of E-Discovery, including the stages that occur before and after primary search, the greater will be the prospects for broader solutions, creative optimizations and synergies yet to be tapped. Retrieval database artwork, unlike other artwork, does not present fixed, preset and stable contents; it is formed as external data are retrieved from different sociocultural contexts and combined into the artworks’ content. This article aims to address the intertextual relationships between retrieval database artworks and the mass-produced texts from which the database artworks retrieve their data. After briefly discussing the difference between retrieval database artwork and participatory database artwork, and exploring the main concept of intertextuality, we address (...) why intertextuality is essential and beneficial in understanding retrieval database artworks. Two selected works are used to demonstrate that, as the artwork is executed, the meanings and relationships of retrieval database artwork are ever-changing, and the authorship is constantly shifting due to the viewer’s participation. Shifting authorship in retrieval database artwork is caused by the daily mass cultural production of original text, which might or might not be retrieved by the database to be incorporated into the artwork. We conclude that retrieval database artworks cannot separate themselves from mass data. The dynamic intertextual relationships between the work and its ongoing retrieval of content from other cultural productions, as well as the viewers’ contributions to the work, simultaneously shape and reshape the work and its authorship. One of the peculiar characteristics of the vast body of Jain commentarial literature is the primacy given to artha , meaning, over sūtra , the root text itself. It is the task of the commentator—or, in a pedagogical context, the teacher—to retrieve and explain a text’s true, hidden meaning, which often appears to stretch and even contradict its apparent meaning. This article examines the interpretive processes in one of the most important Jain commentaries on monastic discipline, the Bṛhatkalpabhāṣya (...) attributed to the sixth-century CE Śvetāmbara Jain exegete Saṅghadāsa. An examination of passages where the commentator claims to uncover the real—but sometimes less-than-apparent—meaning of monastic rules enables us to detect the interpretive moves involved and the underlying assumptions about the nature of text and the work of commentary. I argue that this commentarial tradition presupposes particular practices of memory, and a degree of internalizing the traditional hermeneutical methods, on the part of a monastic practitioner who wants to understand the text correctly and live according to its true meaning. The idea is not to reinstate the older vision of Aristotle and Thomas Aquinas, with its final causes and animated spheres, or even the early modern culmination of natural philosophy in Newton’s universe of mathematically fixed natural laws; rather, the author hopes to engender a newer and deeper understanding of nature that is at once scientific, ethical, and poetic, which he explains in terms of the conceptual framework of Popper’s “Three Worlds”: objective, subjective, and theoretical. What is recovered thereby is said to be a “lost conceptual space” wherein human beings learn both about and from nature, modes of knowing rendered obsolete by disciplinary specialization in the sciences as well as our commitment to objective methods that leave no room for ethical or spiritual approaches to understanding the natural world and our place in it.The author covers quite a bit of ground on the historical side, from the ancient Greeks through the Middle Ages, moving on to the idea of natural philosophy as it was gradually transformed during the early modern period by Copernicus, Kepler, Galileo, Bacon, Boyle, and Newton—a picture finally eclipsed by the objective, empirical concept of natural science familiar to us today. Curiously, the book says very little about the Platonic tradition of natural philosophy that grew up around the Timaeus. Because it was available in Latin (or the first half of it, anyway, in a Latin translation by the Roman Neoplatonist Calcidius, who also wrote an influential commentary on the work), the Timaeus was, for almost a millennium, the authoritative text in natural philosophy in the West, at least until Aristotle’s nonlogical and scientific writings were recovered in the twelfth century. The Timaeus was the subject of many commentaries and philosophical discussions, from Calcidius in the fourth century to Bernardus Silvestris, William of Conches, and Alan of Lille in the twelfth. It fell out of favor among philosophers with the rise of Aristotle’s Physics and Aristotelian natural philosophy, though it continued to shape the popular imagination of nature in other genres, such as art and literature—recall, for example, the well-known image of “God the Geometer” (c. 1230), measuring the cosmos with a compass. If the author’s project is about “retrieving” natural philosophy “as a lost disciplinary imaginary” (the book’s subtitle), then surely the Platonic vision of the universe deserves equal billing with the Aristotelian. Early-and pre-modern authors were more adept at bringing together science and poetry, but that might be because their epistemic position was radically different from our own. Calcidius, for example, finds it easy to draw moral and aesthetic conclusions from the motions of the cosmos because he really believed heavenly bodies are, like us, animated by souls. Even a materialist like Lucretius accepts that the gods exist; his (still) very radical thesis is that they don’t care about us. (And why should they? Case law retrieval is the task of locating truly relevant legal cases given an input query case. Unlike information retrieval for general texts, this task is more complex with two phases (legal case retrieval and legal case entailment) and much harder due to a number of reasons. First, both the query and candidate cases are long documents consisting of several paragraphs. This makes it difficult to model with representation learning that usually has restriction on input length. Second, (...) the concept of relevancy in this domain is defined based on the legal relation that goes beyond the lexical or topical relevance. This is a real challenge because normal text matching will not work. Third, building a large and accurate legal case dataset requires a lot of effort and expertise. This is obviously an obstacle to creating enough data for training deep retrieval models. In this paper, we propose a novel approach called supporting model that can deal with both phases. The underlying idea is the case–case supporting relation and the paragraph–paragraph as well as the decision-paragraph matching strategy. In addition, we propose a method to automatically create a large weak-labeling dataset to overcome the lack of data. The experiments showed that our solution has achieved the state-of-the-art results for both case retrieval and case entailment phases. (shrink)

Financial risks are among the most important risks in the construction industry projects, which significantly impact project objectives, including project cost. Besides, financial risks have many interactions with each other and project parameters, which must be taken into account to analyze risks correctly. In addition, a source of financial risks in a project is the contract, which is the most important project document. Identifying terms related to financial risks in a contract and considering their effects on the risk management process (...) is an essential issue that has been neglected. Hence, an integrated model for evaluating financial risks and their related contractual clauses were presented. To this end, the effect of financial risks on the project cost was simulated using a system dynamics model. Moreover, terms related to financial risks in a contract text were identified and extracted using text mining, and their effect was included in the system dynamics model. The model was implemented in a hospital construction project in Tehran as a case study, and its results were analyzed. The innovation of the research is integrating text mining and the system dynamics model to investigate the effect of financial risks and related contractual clauses on the project cost. (shrink)

This paper adopts Hadoop to build and test the storage and retrieval platform for painting resources. This paper adopts Hadoop as the platform and MapReduce as the computing framework and uses Hadoop Distributed Filesystem distributed file system to store massive log data, which solves the storage problem of massive data. According to the business requirements of the system, this paper designs the system according to the process of web text mining, mainly divided into log data preprocessing module, log (...) data storage module, log data analysis module, and log data visualization module. The core part of the system is the log data analysis module. The analysis of search keywords ranking, Uniform Resource Locator, and user click relationship, URL ranking, and other dimensions are realized through data statistical analysis, and Canopy coarse clustering is performed first according to search keywords, and then K-means clustering is used for the results after Canopy clustering, and the calculation of cosine similarity is adopted to realize the grouping of users and build user portrait. The Hadoop development environment is installed and deployed, and functional and performance tests are conducted on the contents implemented in this system. The constructed private cloud platform for remote sensing image data can realize online retrieval of remote sensing image metadata and fast download of remote sensing image data and solve the problems in storage, data sharing, and management of remote sensing image data to a certain extent. In this essay I examine the concept of reason bequeathed to us by Kant. I draw upon the work of a number of feminist philosophers who have broken new ground in Kantian scholarship. I seek to build upon their work by forging connections with material that although disparate I believe to be ultimately complementary. I track the development of Kant's thought through two texts: Observations on the Feeling of the Beautiful and Sublime 1764 and Critique of Pure Reason 1781. My (...) purpose is twofold. Firstly, I examine Kant's strategy and possible allegiance to the maintenance of the patriarchal order in the context of enlightenment thought. Secondly I consider the implications of his strategy for the emergent concept of reason and the need for and possibility of retrieval. I conclude that reason is essentially egalitarian and provides us with the potential for the dismantling of the perpetuation of misogyny. (shrink)

In this article I propose a theory of musical meaning and experience which takes into consideration the dialectical relationship between musical text and context, and which is flexible enough to apply to a range of musical styles. Through this theory I examine the roles played by the school music classroom which, despite the multiplicity of musical styles now incorporated into schooling, continues to contribute to the reproduction of existing social relations in the wider society. I consider how music itself (...) can be understood to construct and communicate apparent ‘truths’ about ourselves and society and what role the classroom plays in perpetuating those ‘truths’. Finally I argue for a partial but necessary reinstatement of the much‐maligned notion of musical autonomy as a critical moment in any attempt to change things. (shrink)

Reading is a complex cognitive task with the ultimate goal of comprehending the written input. For longer, connected text, readers generate a mental representation that serves as its basis. Due to limited cognitive resources, common models of discourse representation assume distinct processing levels, each relying on different processing mechanisms. However, only little research addresses distinct representational levels when text comprehension is assessed, analyzed or modelled. Moreover, current studies that tried to relate process measures of reading to comprehension did (...) not consider comprehension as a multi-faceted, but rather a uni-dimensional construct, usually assessed with one-shot items. Thus, the first aim of this paper is to use confirmatory factor analysis to test whether comprehension can be modelled as a uni-or multi-dimensional concept. The second aim is to investigate how well widely used one-shot items can be used to capture comprehension. 400 participants read one of three short stories of comparable length, linguistic characteristics, and complexity. Based on the evaluation of three independent raters per story, 16 wh-questions and 60 yes/no-statements were compiled in order to retrieve information at micro and inference level, and 16 main contents were extracted to capture information at the macro level in participants’ summaries. Still, only a fraction of these items showed satisfactory psychometric properties and factor loadings – a blatant result considering the common practice for item selection. For CFA, two models were set up that address text comprehension as either a one-dimensional construct, or a three-dimensional construct reflecting the three distinct representational levels. Across stories and item types, model fit was consistently better for the three-factor model providing evidence for a multi-dimensional construct of text comprehension. Our results provide concrete guidance for the preparation of comprehension measurements in studies investigating the reading process. (shrink)

This article proposes a method for the semi-automatic extraction of resemblance metaphor terms from a manually annotated corpus of marine biology texts in English and Spanish. The corpus was first searched for target domain terms as well as for lexical markers indicative of metaphors. The combination of these search strategies for metaphor extraction resulted in a set of English-Spanish term pairs. After analysing and comparing these metaphor candidates, a quantitative analysis provided comparative statistical data regarding marine biology metaphor. Finally, the (...) metaphorical nature of marine biology terms was verified in three ways. The first verification strategy entailed an adapted version of the Metaphor Identification Procedure (CitationPragglejaz Group, 2007). The second involved the analysis of contextual data extracted from the corpus, and the third involved the analysis of visual images from an online marine biology database and from the Google search engine. This volume represents the first sustained effort to relate Derrida's work to the Western philosophical tradition from Plato to Heidegger. Bringing together twelve essays by twelve leading Derridean philosophers and an important paper by Derrida previously unpublished in English, the collection retrieves the significance of deconstruction for philosophy.

Socialist courts are supposed to apply the law, not make it, and socialist legality denies judicial decisions any precedential status. In 2011, the Chinese Supreme People’s Court designated selected decisions as Guiding Cases to be referred to by all judges when adjudicating similar disputes. One decade on, the paucity of citations to Guiding Cases has been taken as demonstrating the incongruity of case-based adjudication and the socialist legal tradition. Citations are, however, an imperfect measure of influence. Reproduction of language uniquely (...) traceable to Guiding Cases can also be evidence of their impact on judicial decision-making. We employ a local alignment tool to detect unattributed text reuse of Guiding Cases in local court decisions. Our findings suggest that Guiding Cases are more consequential than commonly assumed, thereby complicating prevailing narratives about the antagonism of socialist legality to case law. (shrink)

Freedom of information laws promote transparency by permitting individuals and organizations to obtain government documents. However, exemptions from disclosure are necessary to protect privacy and to permit government officials to deliberate freely. Deliberative language is often the most challenging and burdensome exemption to detect, leading to high processing costs and delays in responding to open-records requests. This paper describes a novel deliberative-language detection model trained on a new annotated training set. The deliberative-language detection model is a component of a decision-support (...) system for open-records requests under the US Freedom of Information Act, the FOIA Assistant, that ingests documents responsive to an open-records requests, suggests passages likely to be subject to deliberative language, privacy, or other exemptions, and assists analysts in rapidly redacting suggested passages. The tool’s interface is based on extensive human-factors and usability studies with analysts and is currently in operational testing by multiple US federal agencies. (shrink)

How to reduce pupils’ burden and improve learning efficiency? Research shows that non-intelligence factors and learning strategies are the key factors in the effective learning process, and external intervention can play a greater role in these two aspects. The purpose of this study is to explore the effects of different learning strategies on learning motivation under the presentation of augmented reality multimedia or traditional text learning. Sixty third-grade pupils in Hebei Province were selected, and 2 × 3 between-subjects design (...) was adopted. The dependent variable is learning motivation, which includes three dimensions: surface motivation, deep motivation and achievement motivation. The results showed that Learning strategies had a significant impact on deep motivation. The deep motivation aroused by retrieval practicing strategies was significantly higher than that aroused by restudying strategies and self-generated drawing strategies. The interaction between learning materials and learning strategies was marginally significant. When learning with AR materials, the achievement motivation of pupils in the restudying strategy group was higher than that in the retrieval practicing strategy group. Retrieval practicing strategies have positive significance in cultivating deep motivation. The combination of different learning modes and learning strategies will impact achievement motivation. With the rapid development of artificial intelligence technology, multitasking textual translation has attracted more and more attention. Especially after the application of deep learning technology, the performance of multitask translation text detection and recognition has been greatly improved. However, because multitasking contains the interference problem faced by the translated text, there is a big gap between recognition performance and actual application requirements. This paper selects the appropriate color channel and scale to extract the maximum stable extreme value area as the character candidate area and designs a cascaded filter from coarse to fine to remove false detections. The coarse filter is based on some simple morphological features and stroke width features, and the fine filter is trained by a two-recognition convolutional neural network. The remaining character candidate regions are merged into horizontal or multidirectional character strings through the graph model. The experimental results on the text data set prove the effectiveness of the improved deep learning network character model and the feasibility of the textual implication translation analysis method based on this model. Among them, the text contains translation character recognition results prove that the model has good description ability. The characteristics of the model determine that this method is not sensitive to the scale of the sliding window, so it performs better than the existing typical methods in retrieval tasks. (shrink)

I consider the potential of eight text-scaling methods for the analysis of jurisprudential change. I use a small corpus of well-documented German Federal Constitutional Court opinions on European integration to compare the machine-generated scores to scholarly accounts of the case law and legal expert ratings. Naive Bayes, Word2Vec, Correspondence Analysis and Latent Semantic Analysis appear to perform well. Less convincing are the performance of Wordscores, ML Affinity and lexicon-based sentiment analysis. While both the high-dimensionality of judicial texts and the (...) validation of computer-based jurisprudential estimates pose major methodological challenges, I conclude that automated text-scaling methods hold out great promise for legal research. Legal professionals in Malawi rely on a limited number of textbooks, outdated law reports and inadequate library services. Most documents available are in image form, are un-structured, i.e. contain no useful legal meta-data, summaries, keynotes, and do not support a system of citation that is essential to legal research. While advances in document processing and machine learning have benefited many fields, legal research is still only marginally affected. In this interdisciplinary research, the authors build semi-automatic tools for creating a corpus (...) of Malawi criminal law decisions annotated with legal meta-data, case and law citations. We used this corpus to extract legal meta-data, including law and case citations as used in Malawi by employing machine learning tools, spaCy and Gensim LDA. We set the foundation for a new methodology for classifying Malawi criminal case law according to the recently introduced International Classification of Crime for Statistical Purposes (ICCS).
