Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. Every year, the Vietnamese people reportedly burned about 50,000 tons of joss papers, which took the form of not only bank notes, but iPhones, cars, clothes, even housekeepers, in hope of pleasing the dead. The practice was mistakenly attributed to traditional Buddhist teachings but originated in fact from China, which most Vietnamese were not aware of. In other aspects of life, there were many similar examples of Vietnamese so ready and comfortable with adding new norms, values, and beliefs, even contradictory (...) ones, to their culture. This phenomenon, dubbed “cultural additivity”, prompted us to study the co-existence, interaction, and influences among core values and norms of the Three Teachings –Confucianism, Buddhism, and Taoism–as shown through Vietnamese folktales. By applying Bayesian logistic regression, we evaluated the possibility of whether the key message of a story was dominated by a religion (dependent variables), as affected by the appearance of values and anti-values pertaining to the Three Teachings in the story (independent variables). Our main findings included the existence of the cultural additivity of Confucian and Taoist values. More specifically, empirical results showed that the interaction or addition of the values of Taoism and Confucianism in folktales together helped predict whether the key message of a story was about Confucianism, β{VT ⋅ VC} = 0.86. Meanwhile, there was no such statistical tendency for Buddhism. The results lead to a number of important implications. First, this showed the dominance of Confucianism because the fact that Confucian and Taoist values appeared together in a story led to the story’s key message dominated by Confucianism. Thus, it presented the evidence of Confucian dominance and against liberal interpretations of the concept of the Common Roots of Three Religions (“tam giáo đồng nguyên”) as religious unification or unicity. Second, the concept of “cultural additivity” could help explain many interesting socio-cultural phenomena, namely the absence of religious intolerance and extremism in the Vietnamese society, outrageous cases of sophistry in education, the low productivity in creative endeavors like science and technology, the misleading branding strategy in business. We are aware that our results are only preliminary and more studies, both theoretical and empirical, must be carried out to give a full account of the explanatory reach of “cultural additivity”. The study of cultural evolution has taken on an increasingly interdisciplinary and diverse approach in explicating phenomena of cultural transmission and adoptions. Inspired by this computational movement, this study uses Bayesian networks analysis, combining both the frequentist and the Hamiltonian Markov chain Monte Carlo (MCMC) approach, to investigate the highly representative elements in the cultural evolution of a Vietnamese city’s architecture in the early 20th century. With a focus on the façade design of 68 old houses in Hanoi’s Old Quarter (...) (based on 78 data lines extracted from 248 photos), the study argues that it is plausible to look at the aesthetics, architecture, and designs of the house façade to find traces of cultural evolution in Vietnam, which went through more than six decades of French colonization and centuries of sociocultural influence from China. The in-depth technical analysis, though refuting the presumed model on the probabilistic dependency among the variables, yields several results, the most notable of which is the strong influence of Buddhism over the decorations of the house façade. Particularly, in the top 5 networks with the best Bayesian Information Criterion (BIC) scores and p<0.05, the variable for decorations (DC) always has a direct probabilistic dependency on the variable B for Buddhism. The paper then checks the robustness of these models using Hamiltonian MCMC method and find the posterior distributions of the models’ coefficients all satisfy the technical requirement. Finally, this study suggests integrating Bayesian statistics in the social sciences in general and for the study of cultural evolution and architectural transformation in particular. (shrink)

This article synthesizes the current theoretical attempts to understand human-machine interactions and introduces seven premises to understand our emerging dynamics with increasingly competent, pervasive, and instantly accessible algorithms. The hope that these seven premises can build toward a social theory of human-AI cocreation. The focus on human-AI cocreation is intended to emphasize two factors. First, is the fact that our machine learning systems are socialized. Second, is the coevolving nature of human mind and AI systems as smart devices form an (...) indispensable part of our cognitive scaffolds, thus, shaping how we perceive the world and ourselves. The seven premises include: primacy of social structures; human’s desire for freedom and autonomy; AI systems will form inseparable parts of our cognitive/affective scaffolds and can change our self-understanding; philosophy and humanistic foundations on human flourishing as a guide to human-AI interaction; mindsponge information-filtering process; acculturative process of how values change and emerge from human-AI interaction; overlapping Venn diagram of the human-human, human-nature, and human-machine interactions. This article concludes with a discussion on human agency in our entanglements with socialized machines and the illusoriness of the Cartesian agent view of the mind. (shrink)

This paper examines Fichte's conception of the freedom of choice in Das System der Sittenlehre of 1798 as a solution to the dilemma posed by determinism and indeterminism. It show that Fichte does not simply affirm an indifferent power of voluntary choice, but demonstrates how such a power might co-exist with the measure of regularity and lawfulness we normally admit of human choices. Particular choices do not occur at random, but are based on general reasons. These reasons are in turn (...) based on the extent to which we have freely reflected on our original drive. Thus our choices can be comprehended and predicted from the point of reflection from which we choose. This does not lead to the denial of the freedom of choice, but only to rethinking it in terms of the freedom of reflection: Though we cannot choose other than what we choose from the point of reflection we occupy, we can choose other than what we choose by raising or lowering ourselves through reflection to a higher or lower point of reflection. This paper argues that the sublime feeling can only announce itself as a paradoxical mixture of pain and pleasure in an experience of a lost or irrevocable past. Presenting the typical evanescence and inevitable deferral of the past in musical terms, this paper rewrites the sublime feeling as a musical feeling: a suspended feeling wavering in-between apparently opposite intensities of tension and respite. This suspended feeling is analyzed through a juxtaposition of the sublime with Sehnsucht, or the potentially endless longing (...) for an irretrievable past, and trauma, or the potentially endless rehearsal of an unforgettable past. We have examined the attitude and moral perception of 228 college students towards artificial intelligence in an international university in Japan. The students were asked to select a single most significant ethical issue associated with AI in the future from a list of nine ethical issues suggested by the World Economic Forum, and to explain why they believed that their chosen issues were most important. The majority of students chose unemployment as the major ethical issue related to AI. The second (...) largest group of students were concerned with ethical issues related to emotional AI, including the impact of AI on human behavior and emotion. The paper discusses the results in detail and concludes that, while policymakers must consider how to ameliorate the impact of AI on employment, AI engineers need to consider the emotional aspects of AI in research and development, as well. It is found that a coherent state of the cavity field can be generated in a micromaser with injected atoms in a coherent superposition of the upper and lower states. The dependence of the density matrix elements of the field on the number of injected atoms indicates that due to the same initial atomic coherence the emission of separately injected single atoms in the cavity is a cooperative process.

Recent work on Hume's Theory of Perception has shown that Hume takes the appearance of impressions to vary according to the ideas under which they are subsumed. In this paper, I argue that the vulgar position in the section where he discusses the Inference from Constancy is characterised by an ideal primordial state of mind where impressions are directly encountered without being subsumed under any idea. In particular, impressions which are not subsumed under the idea of a perception do not (...) appear to the mind as impressions. Read in this light, Hume's Inference from Constancy is immune to the difficulties which have commonly been raised against it. (shrink)

Biometric technologies are becoming more pervasive in the workplace, augmenting managerial processes such as hiring, monitoring and terminating employees. Until recently, these devices consisted mainly of GPS tools that track location, software that scrutinizes browser activity and keyboard strokes, and heat/motion sensors that monitor workstation presence. Today, however, a new generation of biometric devices has emerged that can sense, read, monitor and evaluate the affective state of a worker. More popularly known by its commercial moniker, Emotional AI, the technology stems (...) from advancements in affective computing. But whereas previous generations of biometric monitoring targeted the exterior physical body of the worker, concurrent with the writings of Foucault and Hardt, we argue that emotion-recognition tools signal a far more invasive disciplinary gaze that exposes and makes vulnerable the inner regions of the worker-self. Our paper explores attitudes towards empathic surveillance by analyzing a survey of 1015 responses of future job-seekers from 48 countries with Bayesian statistics. Our findings reveal affect tools, left unregulated in the workplace, may lead to heightened stress and anxiety among disadvantaged ethnicities, gender and income class. We also discuss a stark cross-cultural discrepancy whereby East Asians, compared to Western subjects, are more likely to profess a trusting attitude toward EAI-enabled automated management. While this emerging technology is driven by neoliberal incentives to optimize the worksite and increase productivity, ultimately, empathic surveillance may create more problems in terms of algorithmic bias, opaque decisionism, and the erosion of employment relations. Thus, this paper nuances and extends emerging literature on emotion-sensing technologies in the workplace, particularly through its highly original cross-cultural study. (shrink)

Folklore has a critical role as a cultural transmitter, all the while being a socially accepted medium for the expressions of culturally contradicting wishes and conducts. In this study of Vietnamese folktales, through the use of Bayesian multilevel modeling and the Markov chain Monte Carlo technique, we offer empirical evidence for how the interplay between religious teachings (Confucianism, Buddhism, and Taoism) and deviant behaviors (lying and violence) could affect a folktale’s outcome. The findings indicate that characters who lie and/or commit (...) violent acts tend to have bad endings, as intuition would dictate, but when they are associated with any of the above Three Teachings, the final endings may vary. Positive outcomes are seen in cases where characters associated with Confucianism lie and characters associated with Buddhism act violently. The results supplement the worldwide literature on discrepancies between folklore and real-life conduct, as well as on the contradictory human behaviors vis-à-vis religious teachings. Overall, the study highlights the complexity of human decision-making, especially beyond the folklore realm. (shrink)

A decrease in cortical excitability tends to be easily followed by an increase induced by external stimuli via a mechanism aimed at restoring it; this phenomenon is called “homeostatic plasticity.” In recent years, although intervention methods aimed at promoting motor learning using this phenomenon have been studied, an optimal intervention method has not been established. In the present study, we examined whether subsequent motor learning can be promoted further by a repetitive passive movement, which reduces the excitability of the primary (...) motor cortex before motor learning tasks. We also examined the relationship between motor learning and the brain-derived neurotrophic factor. Forty healthy subjects participated. Subjects were divided into two groups of 20 individuals each. The first group was assigned to perform the motor learning task after an intervention consisting in the passive adduction–abduction movement of the right index finger at 5 Hz for 10 min, while the second group was assigned to perform the task without the passive movement. The motor learning task consisted in the visual tracking of the right index finger. The results showed that the corticospinal excitability was transiently reduced after the passive movement in the RPM condition, whereas it was increased to the level detected in the control condition after the motor learning task. Furthermore, the motor learning ability was decreased immediately after the passive movement; however, the motor performance finally improved to the level observed in the control condition. In individuals carrying the Val/Val genotype, higher motor learning was also found to be related to the more remarkable changes in corticospinal excitability caused by the RPM condition. This study revealed that the implementation of a passive movement before a motor learning tasks did not affect M1 excitatory changes and motor learning efficiency; in contrast, in subjects carrying the Val/Val polymorphism, the more significant excitatory changes in the M1 induced by the passive movement and motor learning task led to the improvement of motor learning efficiency. Our results also suggest that homeostatic plasticity occurring in the M1 is involved in this improvement. (shrink)

The article also uses analytical and synthesis methods to highlight the content of benevolence and righteousness in the cultural tradition of the Vietnamese nation today. The Covid-19 pandemic had affected the world in general and Vietnam in particular. So Nguyen Trai’s thought culture is powerfully and effectively prompt in responding to the Covid-19 pandemic in Vietnam and other countries today. In this article, Nguyen Trai’s benevolence and righteousness fairness clearly define the responsibility of the state and the obligation of citizens to promote the traditional cultural values of the nation. Resumo: Nguyen Trai foi um grande filósofo patriótico vietnamita, uma das maiores personalidades de todos os tempos. Ele viveu no século XV; seus pensamentos se tornaram um grande exemplo de ética, cultura, alma e sabedoria vietnamitas. O artigo estudou os pensamentos filosóficos de Nguyen Trai, para ajudar a desenvolver um país próspero e feliz, usando os valores culturais tradicionais da nação. O texto utiliza a metodologia do materialismo dialético como princípio geral e como princípio histórico específico, a fim de avaliar a benevolência e a retidão de Nguyen Trai, em termos de compaixão, justiça e gestão, associadas aos interesses do povo, da comunidade e da sociedade. O artigo também usa métodos analíticos e de síntese, para destacar o conteúdo de benevolência e retidão, na tradição cultural da nação vietnamita hoje. The experiential self in interaction with an object is not, as Richard Rorty emphasizes, an inherent attribute that exists before real interactions, nor is it an entity with fixed characteristics. What Rorty constantly highlights is that the interaction in forming the self must achieve self-awareness as an entity impacted, acknowledged, and evaluated by others. This line of interpretation leads to two important concepts regarding the self’s formation that need to be clarified: First, when an individual expands his/her ability to manage (...) space outside the reach of his/her physical person and visual perception, it is imperative that the individual is aware that he/she is controlling his/her own body. Second, the reciprocal effect from others cannot make the individual self-aware of his/her own existence as an independent entity if there is a lack of the other’s skepticism and questioning of the subject himself/herself. In this step of the self-experience process, the self’s attributes and its existence in relation to its surroundings are questioned. This article will focus on the explanation of the feasibility of perceiving the self as a form made up of biological premises and the awareness of the self as a living entity with contingent and flexible characteristics. This essay analyzes the rise of Large Language Models (LLMs) such as GPT-4 or Gemini, which are now incorporated in a wide range of products and services in everyday life. Importantly, it considers some of their hidden human costs. First, is the question of who is left behind by the further infusion of LLMs in society. Second, is the issue of social inequalities between lingua franca and those which are not. Third, LLMs will help disseminate scientific concepts, but their meanings' (...) dissemination is at risk. Fourth, is the issue of information security and how nations and individuals might adapt. Fifth, is the issue of the environmental cost of LLMs for future generations. A work of Vietnamese art crossed a million-dollar mark in the international art market in early 2017. The event was reluctantly seen as a sign of maturity from the Vietnamese art amidst the many existing problems. Even though the Vietnamese media has discussed the issues enthusiastically, there is a lack of literature from the Vietnamese academics examining the subject, and even rarer in from the market perspective. This paper aims to contribute an insightful perspective on the Vietnamese art market, and (...) hesitantly the Vietnamese art as well, through the lens of fake, forgery and copy artworks. 35 cases of fake, forgery and copy paintings were found on the news and from the experts' wisdom. Through the examples, we argue that the Vietnamese art market is a temporary reaction to the immaturely rising of the Vietnamese art and the economy. Therefore, the art market is unable to function healthily unless the Vietnamese art and the economy developed. (shrink)

As a generation of ‘digital natives,’ secondary students who were born from 2002 to 2010 have various approaches to acquiring digital knowledge. Digital literacy and resilience are crucial for them to navigate the digital world as much as the real world; however, these remain under-researched subjects, especially in developing countries. In Vietnam, the education system has put considerable effort into teaching students these skills to promote quality education as part of the United Nations-defined Sustainable Development Goal 4 (SDG4). This issue (...) has proven especially salient amid the COVID−19 pandemic lockdowns, which had obliged most schools to switch to online forms of teaching. This study, which utilizes a dataset of 1061 Vietnamese students taken from the United Nations Educational, Scientific, and Cultural Organization (UNESCO)’s “Digital Kids Asia Pacific (DKAP)” project, employs Bayesian statistics to explore the relationship between the students’ background and their digital abilities. Results show that economic status and parents’ level of education are positively correlated with digital literacy. Students from urban schools have only a slightly higher level of digital literacy than their rural counterparts, suggesting that school location may not be a defining explanatory element in the variation of digital literacy and resilience among Vietnamese students. Students’ digital literacy and, especially resilience, also have associations with their gender. Moreover, as students are digitally literate, they are more likely to be digitally resilient. Following SDG4, i.e., Quality Education, it is advisable for schools, and especially parents, to seriously invest in creating a safe, educational environment to enhance digital literacy among students. According to their founders, the DVjs, established in 1923, was supposed to develop a specific focus also for medieval literature and culture. This article analyzes how this program was realized and how the relationship between literary studies and intellectual history (›Geistesgeschichte‹) was shaped in different periods from the early articles of Günther Müller, Wolfgang Stammler or Walther Rehm to the reestablishment by Hugo Kuhn around 1950. The authors reconstruct a particular branch of German medieval studies still relevant today.

To evaluate the moral awareness of college students regarding artificial intelligence (AI) systems, we have examined 467 surveys collected from 152 Japanese and 315 non-Japanese students in an international university in Japan. The students were asked to choose a most significant moral problem of AI applications in the future from a list of ten ethical issues and to write an essay about it. The results show that most of the students (n = 269, 58%) considered unemployment to be the major (...) ethical issue related to AI. The second largest group of students (n = 54, 12%) was concerned with ethical issues related to emotional AI, including the impact of AI on human behavior and emotion and robots’ rights and emotions. A relatively small number of students referred to the risk of social control by AI (6%), AI discrimination (6%), increasing inequality (5%), loss of privacy (4%), AI mistakes (3%), malicious AI (3%), and AI security breaches (3%). Calculation of the z score for two population proportions shows that Japanese students were much less concerned about AI control of society (− 3.1276, p < 0.01) than non-Japanese students, but more concerned about discrimination (2.2757, p < 0.05). Female students were less concerned about unemployment (− 2.6108, p < 0.01) than males, but more concerned about discrimination (2.4333, p < 0.05). The study concludes that the moral awareness of college students regarding AI technologies is quite limited and recommends including the ethics of AI in the curriculum. (shrink)

This paper sketches first the notion of Christ′s mediality up to early Scholasticism and then highlights the new conceptual patterns developed by Bonaventure (Collationes in Hexaemeron) and Nicolas of Cusa (De visione dei).

In this paper, a proposed modified stochastic fractal search algorithm is applied to find the most appropriate site and size of capacitor banks for distribution systems with 33, 69, and 85 buses. Two single-objective functions are considered to be reduction of power loss and reduction of total cost of energy loss and capacitor investment while satisfying limit of capacitors, limit of conductor, and power balance of the systems. MSFS was developed by performing three new mechanisms including new diffusion mechanism and (...) two new update mechanisms on the conventional stochastic fractal search algorithm. As a result, MSFS can reduce 0.002%, 0.003%, and 0.18% of the total power loss from SFS for the three study systems. As compared to other methods, MSFS can reduce power loss from 0.07% to 3.98% for the first system, from 3.7% to 7.3% for the second system, and from 0.92% to 6.98% for the third system. For the reduction of total cost, the improvement level of the proposed method over SFS and two other methods is more significant. It is 0.03%, 1.22%, and 5.76% for the second system and 2.31%, 0.87%, and 3.77% for the third system. It is emphasized that the proposed method can find the global optimal solutions for all study cases while SFS was still implementing search process nearby or far away from the solutions. Furthermore, MSFS can converge to the best solutions much faster than these compared methods. Consequently, it can be concluded that the proposed method is very effective for finding the best location and size of added capacitors in distribution power systems. (shrink)

Entrepreneurship plays an indispensable role in the economic development and poverty reduction of emerging economies like Vietnam. The rapid development of technologies during the Fourth Industrial Revolution (Industry 4.0) has a significant impact on business in every field, especially in the innovation-focused area of entrepreneurship. However, the topic of entrepreneurial activities with technology applications in Vietnam is under-researched. In addition, the body of literature regarding entrepreneurial finance tends to focus on advanced economies, while mostly neglecting the contextual differences in developing (...) nations. Therefore, this research contributes to these topics by investigating the main characteristics of a high potential market for entrepreneurs in Vietnam, which is the English language training market (ELTM). It also aims at indicating the impacts of technology on the entrepreneurial firms within this market, with an emphasis on financing sources. To answer the research questions, this study employs a qualitative analysis and conducts 12 in-depth, semi-structured interviews with entrepreneurs and researchers in the field. The key findings in our study highlight the main contributing factors to the growth of the market, both universally and context-specific for a developing nation like Vietnam. It also lists the leaders in each market segment and the industry’s potential profit margin. The results also show that most entrepreneurs in the ELTM utilized private sources of finance rather than external ones, such as bank loans. It again confirms the idea from previous works that even with the rapid development of the economic and technological landscape, entrepreneurial activities in general barely benefit from additional sources of funding. However, it also points out the distinct characteristics of the ELTM that may influence these financing issues; for example, English training services usually collect revenues from customers before delivering their classes. This is of advantage for entrepreneurs in this area and helps significantly reduce the financial barriers. These findings, which are among the first attempts to contribute to a better understanding of entrepreneurial opportunities in the Industry 4.0 in Vietnam, provide valuable insights for policymakers and entrepreneurs, as well as investors. Educational philosophy helps to orient the educational development process of each country and develop the capacity of each individual in society. In the educational history of each country, there is always a process of preserving and transferring social heritages. The educational system prepares the next generation to enter society and imparts ideas, values, and beliefs that will shape young people’s thinking and behavior for the rest of their lives. Therefore, this article wishes to clearly and vividly clarify the importance of (...) studying Pragmatism’s educational philosophy to realize its present influence. At the same time, it is crucial to deeply understand the educational process of Pragmatism to derive meaning and clarify the primary function of educating Vietnamese people in the context of current global integration. The article uses the materialist dialectic method with broad and specific historical principles to evaluate Vietnamese education with opportunities and challenges in the current integration process by studying Pragmatism’s philosophical education. The article found that the theory of education by Pragmatism clarifies the role of social educational institutions – schools in the educational process. In parallel, it is a teacher with educational methods and programs that are the basis for educating learners to become comprehensive citizens in the future. And students are the goal and the product that the educational philosophy needs to implement. Research results, the article clarifies the need to develop an educational philosophy for Vietnamese people to build comprehensively in the socialist orientation in the current globalization context. In our ever technologically driven and mediatized society, we face the existential risk of falling into an info-calypse as much as an eco-calypse. To complement the list of values of a progressive culture put forth by Harrison (Natl Interest 60:55–65, 2000) and Vuong (Econ Bus Lett 10(3):284–290, 2021), this short essay proposes cultivating a new cultural value of protecting the infosphere.
