Munsch 595 pull back the curtain on men’s lives and masculine institutions in order to demystify socially constructed masculinities, particularly in their most powerful forms. As early feminist scholars note, male privilege renders women’s lives invisible.4 But male privilege renders aspects of men’s lives invisible, too. In this article we highlight how institutional review boards (IRBs) in universities and hospitals erect barriers to research that render particular aspects of men’s lives invisible. We draw on our experiences of submitting ten applications for a series of methodologically diverse studies of masculinity to eight IRBs. First, we argue that, despite their original function of protecting subordinated groups, IRBs are gendered institutions in which members base their decisions on culturally dominant, normative images of women and men. We show how this results in the stringent protection of male research participants, the safeguarding of participants’ personal masculinity, and the shielding of men’s lives from social inquiry. Second, we argue that IRBs are gendering institutions. Our experiences reveal how the privileging and protection of masculinity results in mandatory protocol modifications that idealize hegemonic masculinity. These modifications require researcher-participant interactions that socialize men to engage in gender “appropriate” behavior and reify gendered expectations. Third, our experiences reveal the ways in which IRBs protect the institution itself and privilege the universities, hospitals, and (predominantly male) medical doctors they represent. Consequently, the ways they reproduce social inequality remain impervious to academic inquiry. The object of this research is gentleness, a construct maybe not treated enough in the literature, but just in the area of the so called Positive Psychology. And precisely from his representative Martin Seligman, the inspiration for the construction of a questionnaire and of a specific hypothesis has been born, including the use of a precise terminology. In general terms, maybe the most interesting result lies in the fact of having found a correlation between the various items, therefore between the (...) various constructs, in accordance with the idea of gentleness proposed as a synergy of “quality”. This idea has also been supported from recent research in which has emerged a very tight bond between optimism and a particular character trait that is extroversion. Being placed at a higher, transcendental level, the “gift of oneself” could become the “jump of quality” to fulfil ourselves in the relation with the other. (shrink)

The visibility of environmental problems and the increasing awareness of associated consequences have made environmental issues salient in Zambia. The purpose of this study was to investigate correlations between the social and psychological influences affecting college students in Zambia, and the behaviours perceived by them to be appropriately environmentally friendly. The underlying social and psychological factors that would determine individuals' attitudinal responses toward appropriate environmental behaviour were assessed. The study attempted to measure behavioural tendencies towards environmental conservation. Behaviour (...) involving energy and water conservation (EW) was consistently rated as the most important, and appropriate category of environmental behaviour, whereas social and political action (SP) was viewed as the least favourable behaviour according to the respondents in Zambia. The respondents who were older in the graduate level of the study and had frequently contact with environmental education activities and courses were more likely to hold positive behavioural tendencies toward environmental conservation in general. ABSTRACT Liberal political philosophy has little of interest to say about the social liberty of the physically disabled. It accepts that the physically disabled and the able‐bodied are equally at liberty, even though the former can do far less than the latter; and it concludes that there are no interesting political statements we can make about their situation. In this essay, I assume that the physically disabled are unfree, not merely unable, to use public facilities which do (...) not take their disability into account, thereby excluding them. I criticise liberal theories of liberty by exposing and questioning the assumptions which entail the liberal theorist's rejecting this claim. I conclude that there is a form of negative liberty which does enable the liberal theorist to make political statements about the freedom of the disabled [1]. (shrink)

But, subject to this constraint, government is urged to do all the utilitarian good it can and some nasty worries for democratic socialists surface instructively. They centre on the social aspects of individuality and give rise to problems in what my title calls the Social Liberty Game. British socialism, with its Lib-Lab origins and tolerant respect for individual liberty, embodies a tension between the rights of each and the good of all, which makes the Principles a living part of its intellectual history. An attempt to answer in some detail the questions and criticism brought up in a colloquium on my book on ‘Socialism’.

This paper examines the link between political liberties and social equality, and contends that the former are constitutive of, i.e. necessary to secure, the latter. Although this constitutive link is often assumed in the literature on political liberties, the reasons why it holds true remain largely unexplored. Three such reasons are examined here. First, political liberties are constitutive of social equality because they bestow political power on their holders, leaving disenfranchised individuals excluded from decisions that are particularly pervasive, (...) coercively enforced, hard to avoid, monopolistic, and final. Second, they are constitutive of social equality due to their positional value, such that those who are denied such liberties are socially downgraded because and to the extent that others enjoy them. Third, they are constitutive of social equality due to their expressive value, in the sense that, by disenfranchising some individuals, the state publicly fails to recognize their equal moral agency. While unpacking these reasons, we address some criticisms of this constitutive link recently raised by Steven Wall and Jason Brennan. (shrink)

John Rawls’s thesis that a certain package of basic liberties should be given lexical priority is of great interest for legal and political philosophy, but it has received relatively little defense from Rawls or his supporters. In this paper, I examine three arguments for the thesis: the first is based on the two ‘moral powers’; the second, on the social bases of self-respect; and the third, on a Kantian notion of autonomy. I argue none of these accounts successfully establishes (...) 1) the distinct claim of lexical priority, 2) for the complete package of basic liberties, on the basis of reasons that are appropriately public. In turn, I propose an alternative argument, in support of those two claims, based on the social or ‘relational’ conception of equality. (shrink)

Tomasi’s view of social democracy is shown to mischaracterize it as hostile to private economic liberties, which all real-world social democracies guarantee. The supposed Manichean choice between social and market democracy, seen as requiring contrasting accounts of fairness, results from combining Rawls-style idealization of regime types, the Hayekian presumption that social democracies are advancing along the road to serfdom, and tendentious appeal to scant and unconvincing historical evidence. The proposed constitutional protection of ‘thick,’ market-based economic liberties, (...) as favoring both individual self-authorship and fair equality of opportunity, is defended by Tomasi against high-liberal and social democratic views as compatible with what Rawls’s social justice demands, but as their scope expands in the course of the book this fails to convince. Finally it is argued that the ever-expanding reach of the market across all social life, with feedback effects on the formation of preferences, renders questionable Tomasi’s claims that his account of market fairness is neutral with respect to ways of life and that it specifies conditions under which individuals can live lives that are truly their own. This paper is concerned to bring out the philosophical contribution that Thomas Reid makes in his discussions of promising. Reid discusses promising in two contexts: he argues that the practice of promising presupposes the belief that the promisor is endowed with what he calls 'active power' , and he argues against Hume's claim that the very act of promising—and the obligation to do as one promised—are "artificial," or the products of human convention . In addition to explaining what Reid says (...) in each of these two contexts, the paper demonstrates that the two discussions are linked. It is, in part, because he thinks that promises are a special kind of act —performable solely through the exercise of our native, natural capacities—that he thinks that the practice of promising presupposes active power. Towards this end, the paper explains how Reid conceives of active power and explains his concept of a social act. The paper argues that, when considered as part of a single, unitary conception of the nature of promises, Reid's two discussions provide important insights into the nature of promising, particularly with regard to the sense in which promisory obligations are conditional: they are conditional upon a rather short list of circumstances that are not within our power—a shorter list than those on which other obligations are conditional. In this article Hobbes's view of the commonwealth, and of law and liberty within it, is discussed from the point of view of social ontology. The artificial character of the commonwealth and the constitutive function of the covenant is put in terms of the institutional world being constructed through collective intentionality, which is performative, self-referential, and collective, and which serves as truth-maker. Hobbes is used here to make the point that it is a mistake to argue, as for (...) example Tuomela has done, that the construction of institutions require a joint commitment: we-attitudes held in the we-mode. Instead, institutions on a `Hobbesian' model are constructed by we- attitudes held in the I-mode. This analysis is used in a discussion of law as an institution and law serving as a constraint on freedom. The constructive character of law means that the idea of law can serve as a constraint even in an area of life where in actual fact is unregulated. In order to assess whether liberty can be said to be infringed when that happens we need to go back to the notion of an external constraint, appreciating that what agents there are, what they can do and the powers they possess are functions of collective attitudes conveying meaning and status. Although modern Republicanism, which highly values the right of freedom of speech, finds its inspiration in the historical reality of the Roman Republic, it seems that in the course of the Republican period citizens shared a recognised ability to speak freely in public, but did not enjoy equal status with one another in the domain of speech as protected by law. Of course, Republican Rome knew laws regulating free speech and perhaps even later provisions had been passed concerning iniuria. However, (...) in these cases, as later on under Augustus, these measures acted as means of restraint and inhibition and did not directly address the right of the individual to speak freely. The fundamental question this paper addresses is why, in the course of the Republic, the right to speak freely was not protected by law and never came to be recognised as a formalised subjective right in Republican Rome. The answer, I argue, lies in the fact that in Rome speaking freely was conceived as the positive moral quality that characterised a natural ability of human beings, and thereby it could not have provided a field of legislation. It follows that the Roman Republic would not have passed the ‘straight talk test’ that modern Republicanism requires for the establishment of a free and just society. However, Republican Rome invites us to think about liberty of speech as belonging to the realm of ethics: as a moral quality sustained by contemporary social norms, not subject to legislation, which inevitably ends up protecting the interests of a group or groups and their specific speech regimes. May social unity - the unity of a society or social group - be a matter of sharing values? Political philosophers disagree on this topic. Kymlicka answers: No. Devlin and Rawls answer: Yes. It is argued that given one common 'summative' account of sharing values a negative answer is correct. A positive answer is correct, however, given the plural subject account of sharing values. Given this account, those who share values are unified in a substantial way by their (...) participation in a joint commitment. Some consequences of such sharing of values for the liberty of the people involved are noted. (shrink)

Indeed, On Liberty is one of the most influential books ever written, and remains a foundational document for the understanding of vital political, philosophical and (...) social issues. In addition to its many useful appendices, this new edition includes a chronology, bibliography, and a substantial introduction which outlines Mill’s life and works, and sets this central work of 1859 in the context of both his own intellectual development and of the play of ideas and political forces in Victorian society. British philosopher and economist John Stuart Mill is the author of several essays, including Utilitarianism - a defence of Jeremy Bentham's principle applied to the field of ethics - and The Subjection of Women, which advocates legal equality between the sexes. This work, arguably his most famous contribution to political philosophy and theory, was first published in 1859, and remains a major influence upon contemporary liberal political thought. In it, Mill argues for a limitation of the power of government and (...) society over the individual, and defines liberty as an absolute individual right. According to the still much debated 'harm principle', power against the individual can only be exercised to prevent harm to others. Full of contemporary relevance, this essay also defends freedom of speech as a necessary condition of social and intellectual progress. (shrink)

This article reconsiders contemporary conservatism’s “libertarian” claim to economic and political liberty and related claims. It re‐examines the relation of conservatism and its supposed “libertarianism” to the principle or ideal of liberty in society and economy, respectively. The paper argues and demonstrates that since its inception out of medieval traditionalism, conservatism has continued to consistently oppose the ideal and practice of liberty defining liberalism, and to that extent modern liberal‐democratic society as a reality or project premised on (...) that ideal. The argument and inference is that conservative “libertarianism” is effectively the antithesis to the ideal of liberty, couched in and rationalized as antagonism toward liberalism identified as its original and continual antagonist. One of the still unsolved problems in liberal anarchism is a definition of social constituency in positive terms. Partially, this had been solved by the advancements of liberal discourse ethics. These approaches, built on praxeology as a universal framework for social formation, are detached from the need of any previous or external authority or rule for the discursive partners. However, the relationship between action, personal identity, and liberty within the process of a community becoming solely generated from (...) the praxeological a priori remains largely disputed. In order to develop a testable constitutional model, this study revises how the “ontological turn” was introduced into liberal theories and redefines the concept of liberty. Liberty is usually understood as a moral goal or measurement for just actions, as the generative principle of all social existence - individual and interpersonal. For this purpose, the function of performative contradiction within the mechanism of interpersonal “encounter”, as part of the co-generative process of the individual becoming and social formation was explored through the production of a game-based narrative historiography grounded on 19th century life writings. This narrative historiography was developed in the context of Swiss history, with a “design-based” research approach, and resulted in a prototype for networked storytelling through which the transformative learning process could be visible and the negotiation of competing individual visions of the future could be re-enacted. Mill's On Liberty is centrally concerned with avoiding social tyranny. But Mill's Principle of Liberty defines interfering, in the context of social pressure, as intentionally punishing and it seems to allow speech and actions that critics have thought would conflict with liberty in self-regarding matters. To critics, Mill draws distinctions among social influences where no genuine difference is to be found and he permits more social pressure than can be accepted by someone who (...) values liberty highly. In this article, I explain where and why Mill draws the line he does between permitted and forbidden influences and show the line is coherent and tracks a genuine difference. I also show that although the Principle leaves residual social pressure, Mill has resources besides the Principle that can prevent social influences that threaten individuality while retaining beneficial social influences. This book features new approaches to social contract theory. Whereas traditional social contract theories and their adaptations in the twentieth century were developed for fairly homogeneous societies, societies in the twenty-first century often are characterized by conflicting first-order directives that stem from deep moral, political, religious, and cultural diversity. To address such diversity and the complexities of contemporary societies, new approaches (including formal approaches) to social contract theory have emerged that re-envision the social contract for a (...) fragmented and sometimes polarized, yet interdependent social world. New social contract theory explores how, in a world of continuous disagreement on questions of justice, in particular the ideals of liberty and equality, society can not only progress, but also flourish and become more robust and open in its social fabric. This book brings together, for the first time, defenders and discussants of new social contract theory. It includes contributions by eminent and emerging scholars in this field. I examine Rousseau’s claim that any given will can be either itself or another, and cannot be commuted , through an investigation of liberty and legitimacy in The Social Contract, with respect to which Rousseau elaborates his notion that we prescribe laws to ourselves. Through an examination of the logic of the general will, I attempt to show that, while the theory of legitimacy is radical, it is faced with serious problems that concern the identification of the we (...) that is supposed to be prescribing laws to itself, and that when we are supposedly doing so, the identity of the will is far from clear.
